ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE
BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON
THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING THE
ZONING FROM R-3 (MODIFIED TWO-FAMILY AND MULTIPLE
DWELLING) AND RS (RESIDENTIAL SINGLE-FAMILY DWELLING
DISTRICT) TO RM-H (RESIDENTIAL MULTIPLE-FAMILY DWELLING
- HIGHEST DENSITY DISTRICT) , GC-MD (GENERAL COMMERCIAL
MULTIPLE-FAMILY DWELLING DISTRICT AND LI (LIGHT
INDUSTRIAL DISTRICT) ON VARIOUS PARCELS LOCATED IN
BEAUMONT, JEFFERSON COUNTY, TEXAS; PROVIDING FOR
SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A
PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1 .
That Chapter 30 of the Code of Ordinances of Beaumont,
Texas, and in particular the boundaries of the zoning districts
as indicated upon the Zoning Map of the ,City of Beaumont,
referred to in Section 30-5B thereof, is hereby amended by
changing the zoning classification as follows:
1 . Property to be rezoned from R-3 (Modified Two-Family
and Multiple Dwelling and RS (Residential Single-
Family Dwelling) to RM-H (Residential Multiple-Family
Dwelling - Highest Density) is described as Lots 8
through 13 Neches Terrace Addition, Beaumont, Jefferson
County, Texas as shown on Exhibit "A" attached hereto.
2. Property to be rezoned from R-3 (Modified Two-Family
and Multiple Dwelling to GC-MD (General Commercial
Multiple-Family Dwelling) is described by the Jefferson
County Tax Appraisal District as Tract 95-D out of
Tract 95, Plat RS-4, W. B. Dyches Survey, containing 3
acres, more or less, Beaumont, Jefferson County, Texas
as shown on Exhibit 11B" attached hereto.
3. Property to be rezoned from R-3 (Modified Two-Family
and Multiple Dwelling) to GC-MD (General Commercial
Multiple-Family Dwelling) is described as the southwest
corner of the Perlstein City Park, being an irregularly
shaped parcel of land out of the Laurel Heights
Subdivision in the Noah Tevis Survey, containing 0.344
acres, more or less; Beaumont, Jefferson County, Texas
as shown on Exhibit "C" attached hereto.
4. Property to be rezoned from R-3 (Modified Two-Family
and Multiple Dwelling) to GC-MD (General Commercial
Multiple-Family Dwelling) is the west 1 /2 of Block 11 ,
Cartwright and Roberts "A" Subdivision, Tract 3, D.
Brown Survey, containing 0.75 acres, more or less;
Beaumont, Jefferson County, Texas as shown on Exhibit
"D" attached hereto.
S. Property to be rezoned from R-3 (Modified Two-Family
and Multiple Dwelling) to GC-MD (General Commercial
Multiple-Family Dwelling) is Lots 11 and 12, Block 6,
Lamar Addition, Beaumont, Jefferson County, Texas as
shown on Exhibit "E" attached hereto.
6. Property to be rezoned from R-3 (Modified Two-Family
and Multiple Dwelling) to LI (Light Industrial
District) is an irregularly shaped tract of land
consisting of several abutting and adjacent parcels,
being so-called lots and tracts out of "Blocks 4, 5, 6
and 7" of Tax Roll Plat B-21 , J. A. Veatch Survey,
Beaumont, Jefferson County, Texas; containing 3.08
acres, more or less as shown on Exhibit "F" attached
hereto.
The official zoning map of the City of Beaumont is hereby amended
to reflect such changes.
Section 2.
That in all other respects the use of the property
hereinabove described shall be subject to all of the applicable
regulations contained in Chapter 30 of the Code of Ordinances of
Beaumont, Texas, as amended.
Section 3.
That if any section, subsection, sentence, clause or phrase
of this ordinance, or the application of same to a particular set
of persons or circumstances, should for any reason be held to be
invalid, such invalidity shall not affect the remaining portions
of this ordinance, and to such end the various portions and
provisions of this ordinance are declared to be severable.
Section 4.
That all ordinances or parts of ordinances in conflict
herewith are repealed to the extent of the conflict only.
Section 5.
That any person who violates any provision of this ordinance
shall, upon conviction, be punished as provided in Section 1-8 of
the Code of Ordinances of Beaumont, Texas.
