ENTITLED AN ORDINANCE AMENDING ORDINANCE NO. 89-
30 WHICH GRANTED A SPECIFIC USE PERMIT TO ALLOW
A HELIPORT AT FIFTEENTH STREET AND LIBERTY
AVENUE FOR ST. ELIZABETH HOSPITAL, LOCATED AT
BEAUMONT, JEFFERSON COUNTY, TEXAS.
WHEREAS, on May 23, 1989, City Council approved Ordinance
89-30 issuing a Specific Use Permit to St. Elizabeth Hospital for
a ground level heliport at the northeast corner of Fifteenth Street
and Liberty Avenue in Beaumont, Jefferson County, Texas; and,
WHEREAS, the applicant, St. Elizabeth Hospital, wishes
to extend the time period for the existence of the heliport at
Fifteenth Street and Liberty Avenue in Beaumont, Texas for a period
of two years; and,
WHEREAS, the Planning and Zoning Commission of the City
of Beaumont considered the issuance of an amended specific use
permit to extend for two years the existing specific use permit for
a heliport at Fifteenth Street and Liberty Avenue, in Beaumont,
Jefferson County, Texas, to St. Elizabeth Hospital, its legal
representatives, successors, and assigns for that certain property
hereinafter described; and,
WHEREAS, the City Council is of the opinion that the
amendment of such specific use permit is in the best interest of
the City of Beaumont and its citizens, subject to the hereinafter
described conditions; and
WHEREAS, all conditions necessary for amendment of a
specific use permit have been met and a specific use permit to
allow a two year extension of a heliport at Fifteenth Street and
Liberty Avenue, in Beaumont, Jefferson County, Texas, should be
granted:
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
Section 1.
That Ordinance 89-30 be amended by amending the Specific
Use Permit to extend for a two year period the existing Specific
Use Permit to St. Elizabeth Hospital, its legal representatives,
its successors, and assigns for a heliport for that certain tract
described in Exhibit "A" attached hereto and made a part hereof for
all purposes.
Section 2.
That the amended specific use permit herein granted is
expressly issued for and in accordance with each particular and
detail of the site plan attached hereto as Exhibit "B" and made a
part hereof for all purposes.
Section 3 .
Notwithstanding the site plan attached hereto, the use
of the property hereinabove described shall be in all respects
subject to all of the applicable regulations contained in Ordinance
89-30 and the regulations contained in Chapter 30 of the Code of
Ordinances of the City of Beaumont, Texas, as amended.

Dear Mr. Godeaux:
The Federal Aviation Administration (FAA) has completed its
airspace utilization study (Study No. 90-ASW-0338-NRA) of
the reconsideration of paragraph a. in our August 2 , 1989
letter to Mr. Daniel B. McGowan regarding the Study
No. 89-ASW-0088-NRA. The reconsideration was requested by
Mr. William F. Nelson with the White Budd Van Ness Partnership
in his April 3, 1990 letter. Based upon the information
provided, our reevaluation removes the necessity for
paragraph a. therein. However, paragraphs b. and c. remain in
effect.
Furthermore, in the May 21, 1990 letter from Mr. Nelson, he
refers to the August 1, 1990, expiration date mentioned in our
August 2 , 1989 letter regarding the Study No. 89-ASW-0090-NRA.
Please be advised that date is the deadline for activating that
heliport by sending the completed FAA Form 5010-5 to
Washington. It is not considered to be the date the heliport
use will be discontinued.

of Logo's Heliport in 1984. After the new heliport (89-ASW-0089-NRA) is DATE

VAN NESS In a telephone conversation with Mr. Gerald Musick of your office
PARTNERSHIP on Tuesday April 3, 1990, we discussed the topic of the addition
Architecture of a fueling system for the existing helipad on the North Parking
Garage at St. Elizabeth Hospital in Beaumount, Texas.
This system will be installed per NFPA 507, Chapter 6, "Fueling
at Roof-Top Heliports", with the fuel storage tank buried in the
ground adjacent to the parking structure, the pumps at ground
level and the hose reel dispensing apparatus installed in an
enclosed steel cabinet mounted over the edge of the helipad with
the top of the cabinet flush with the helipad surface. Enclosed
you will find sketches showing the plan arrangement and a partial
North elevation of the parking garage and helipad. None of the
proposed work will extend above the surface of the helipad.
We are presently preparing the necessary documentation to apply
for a "Specific Use Permit" change with the Planning Department
of the City of Beaumont. Their code requirements indicate that
with the addition of a fueling system, the specific use descrip-
tion changes a helipad to a heliport. Additionally the City has
requested that the FAA be contacted and a letter from you,
addressed to St. Elizabeth Hospital c/o The White Budd Van Ness
Partnership, indicating your approval of this modification be
included in the "Specific Use Permit" change package. Our sche-
dule is to have the package in the City's hands by April 30th and
would v ry much appreciate your response prior to that date.

are sending you herewith a copy of the submittal data pro-
vided the City of Beaumont Planning Commission requesting a
time extension of the use of the existing ground Helipad by
St. Elizabeth Hospital .
The present permit expires on August 1, 1990 according to
your study No. 89-ASW-0090 NRA and the Hospital requests
that this be extended two additional years as described in
the attached data.
A letter from FAA is needed by the City of Beaumont in order
that the r permit extension can be approved. Please address

Additionally, we wish to advise that the FAA cannot prevent the construc-
tion of any structure near an airport or heliport. Protection of the
airport environs can be accomplished only through such means as local
airport zoning ordinances and acquisition of property rights.
In order to avoid placing any unfair restrictions on users of the navigable
airspace, this determination is valid until August 1, 1990. Should the
construction not be accomplished by this date, an extension of our
determination may be requested. Please complete the enclosed FAA
Form 5010-5 (yellow card) and return it when the facility is operational.
If we have not received this form by the above date, we will assume that
the plans to establish the facility have been abandoned and will remove it
from our active files. If more time is needed, please request an
extension prior to the established date.
