HomeMy WebLinkAboutORD 88-79 ORDINANCE NO. K7 ENTITLED AN ORDINANCE ISSUING A SPECIFIC USE PERMIT TO ALLOW A CHURCH ON PROPERTY LOCATED AT 3690 YOUNGSTOWN AND HALE, BEAUMONT, JEFFERSON COUNTY, TEXAS. WHEREAS, the Planning and Zoning Commission of the City of Beaumont considered the issuance of a specific use permit to allow a church on property located at 3690 Youngstown and Hale, Beaumont, Jefferson County, Texas, to Joe H. Cheatham, property owner, his legal representatives, successors, and assigns for that certain property hereinafter described; and, WHEREAS, the City Council is of the opinion that the issuance of such specific use permit is in the best interest of the City of Beaumont and its citizens, subject to the hereinafter described conditions; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1 . That all conditions necessary for issuance of a specific use permit have been met and a specific use permit to allow a church on property located at 3690 Youngstown and Hale, Beaumont, Jefferson County, Texas, in accordance with Section 30-26 and Section 30-40 of the Code of Ordinances of the City of Beaumont, as amended, is hereby granted to Joe H. Cheatham, property owner, his legal representatives, successors and assigns for that certain tract described on Exhibit "A" attached hereto and made a part hereof for all purposes. Section 2. That the specific use permit herein granted is expressly issued for and in accordance with each particular and detail of the site plan attached hereto as Exhibit "B" and made a part hereof for all purposes. Section 3. Notwithstanding the site plan attached hereto, the use of the property hereinabove described shall be in all other respects subject to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended. C O M M E N T Attached is a copy of the signed memo and revised site plan showing approval by the Planning Director, Kirt Anderson, of the amended Specific Use Permit originally granted to Reverend J.H. Cheatham on September 6, 1988. This amended site plan dated June 7, 1989 is authorized under Sec. 30-26I. of the Zoning Ordinance. Please attach to the original ordinance. Joe Cheatham - applicant (Sec. 30-26I. City Code). C O M M E N T The Reverend Joe H. Cheatham, pastor of the Greater True Vine COGIC has submitted to the Planning Division a revised site plan for construction of new church at 3690 Youngstown as part of a formal request to amend the Specific Use Permit granted by the City Council on September 6, 1988. The revised site plan differs from the original site plan in that it includes the construction of concrete sidewalks on the north, south and west sides of the church. The west side entrance front canopy will be eliminated to provide for an additional parking space, increasing the number of spaces from 13 to 14. The Planning Director may approve minor variations from the original permit which do not increase density, change traffic patterns or result in any increase in external impact on adjacent properties or neighborhoods. Even though the 0.257 acre tract fronts on Youngstown, a minor residential street, and is also located on property zoned RM-H, the above proposed changes on the new site plan will in no way cause an adverse effect to neighboring properties nor increase in external impact on adjacent land nor change traffic patterns.
