ORDINANCE NO. �-�/
ENTITLED AN ORDINANCE DESIGNATING
REINVESTMENT ZONE NO. 5; ESTABLISHING THE
BOUNDARIES THEREOF; MAKING NECESSARY
FINDINGS, PROVIDING FOR SEVERABILITY AND
PROVIDING FOR REPEAL.
WHEREAS, the City Council of the City of Beaumont
( "City" ) , desires to promote the development or redevelopment of
a certain contiguous geographic area within its extraterritorial
jurisdiction by the creation of a reinvestment zone for
commercial-industrial tax abatement as authorized by Article
1066f, Vernon' s Texas Civil Statutes (the "Act" ) ; and
WHEREAS, by resolution duly adopted, a hearing on the
designation of the reinvestment zone was set for 1 :15 p.m. on the
20th day of September, 1988, such date being at least seven (7)
days after the date of publication of the notice of such public
hearing; and
WHEREAS, the City held such public hearing after
publishing notice of such public hearing; and
WHEREAS, at such hearing, all interested persons were
provided an opportunity to speak and present evidence for or
against the designation of the zone;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
Section 1 .
THAT there is hereby established a reinvestment zone in the
extraterritorial jurisdiction of the City of Beaumont, said zone
to be known as Reinvestment Zone No. 5. The boundaries of said

zone shall be set out in Exhibit "A" attached hereto and made a
part hereof for all purposes.
Section 2.
With reference to such zone, the City finds as follows:
1 ) That a public hearing on the adoption of the
reinvestment zone has been properly called, held
and conducted, and that notices of such hearing
were published according to law;
2) That creation of the reinvestment zone for
commercial-industrial tax abatement will result in
benefits to the City and to the land included in
the zone and the improvements sought are feasible
and practical;
3 ) That the reinvestment zone meets the criteria for
the creation of a reinvestment zone as set forth in
Section 3 of the Act.
Section 3.
THAT the zone shall take effect on January 1 , 1989, and terminate
on December 31 , 1993 .
Section 4.
THAT if any section, subsection, sentence, clause or phrase of
this ordinance, or the application of same to a particular set of
persons or circumstances, should for any reason be held to be
invalid, such invalidity shall not affect the remaining portions
of this ordinance, and to such end the various portions and
provisions of this ordinance are declared to be severable.

Section 5.
THAT all ordinances or parts of ordinances in conflict here with
are repealed to the extent of the conflict only.

NOTICE OF PUBLIC HEARING FOR
DESIGNATION OF REINVESTMENT ZONE #5
CITY COUNCIL, BEAUMONT, TEXAS
The City Council of Beaumont, Texas will hold a PUBLIC HEARING on Tuesday, September
20, 1988 at 1:15 p.m. in the City Council Chambers, City Hall, 801 N. Main Street. The
purpose of the hearing is to allow interested persons to speak for or against approval of an
ordinance designating Reinvestment Zone #5 for Tax Abatement under the Texas Property
Redevelopment and Tax Abatement Act. Reinvestment Zone #5 was requested by the E.I. du
Pont de Nemours and Company, a corporation of Delaware, and concerns the property
locally known as the Beaumont DuPont plant.
The Reinvestment Zone is generally described as follows:
BEING a tract of land out of the J.S. Johnson Survey (Abstract No. 34) and the Pelham
Humphries Survey (Abstract No. 32) in Jefferson County, Texas, said property being
described as follows:
FOR POINT OF BEGINNING, begin at a point in the northerly Right-of-Way (R.O.W.) line of
State Highway 347 where it intersects with a common Extraterritorial Jurisdiction Area (ETJ)
line of the City of Beaumont and the City of Nederland, said ETJ line being established in
1965 on a map adopted as part of the Extraterritorial Jurisdiction Agreement between the
Cities of Port Arthur, Beaumont and Nederland, Texas, said point being located a distance of
approximately 1,400 feet northwest of the intersection of State Highway 347 with Viterbo
Road, said Viterbo Road being a corporate city limits line of the City of Nederland;
THENCE northwesterly along the northerly R.O.W. line of Highway 347 a distance of 150
feet, more or less, to a point; THENCE continuing along said highway R.O.W. line N. 470
59' W. a distance of 4,320.24' to a point; THENCE continuing along said highway R.O.W. line
a distance of 250', more or less, to a point; THENCE continuing an additional 300', more or
less, to a point;
THENCE N. 470 55' W. along said Highway 347 R.O.W. line 2,333.70' to a point for corner;
THENCE N. 470 56' 52" E. a distance of 996.10' to a point for corner in the southerly
R.O.W. line of the Kansas City Southern (KCS) Railway;
THENCE continuing along the same bearings an additional distance of 100' across the
railroad R.O.W. to a point for corner in the northerly R.O.W. line of the KCS RR;
THENCE N. 440 07' W. along the northerly R.O.W. line of the KCS RR a distance of
2,506.10' to a point for corner;
