ENTITLED AN ORDINANCE AMENDING CHAPTER 6 ,
OF THE CODE OF ORDINANCES OF THE CITY OF
BEAUMONT CONCERNING THE FLOOD HAZARD AREA;
PROVIDING FOR SEVERABILITY AND PROVIDING FOR
REPEAL.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1 .
That Chapter 6, Article III, of the Code of Ordinances of
the City of Beaumont be amended to reflect changes in Sections
6.30.3, 6 .40, 6.41 , and 6.45.1 in the Flood Hazard Areas ordinance,
by changing all references to the term "mobile" to "manufactured" .
Section 2.
That Chapter 6, Section 30.3 of the Code of Ordinances of
the City of Beaumont be amended by repealing the following
definitions:
Repeal
- Existing Mobile Home Parks or Mobile Home Subdivisions
- Expansion to an Existing Mobile Home Park or Mobile
Home Subdivision
- Habitable Floor
- New Mobile Home Park or Mobile Home Subdivisions
- Start of Construction
- Mobile Home
and adding new definitions as follows:
Functionally Dependent Use means a use which cannot
perform its intended purpose unless it is located or
carried out in close proximity to water. The term
includes only docking facilities, port facilities that
are necessary for the loading and unloading of cargo or
passengers, and ship building and ship repair facilities,
but does not include long-term storage or related
manufacturing facilities.
Lowest Floor means the lowest floor of the lowest
enclosed area (including basement) . An unfinished or

flood resistant enclosure, useable solely for parking of
vehicle, building access or storage, in an area other
than a basement area, is not considered a building' s
lowest floor, provided that such enclosure is not built
so as to render the structure in violation of the
applicable non-elevation design requirements of this
ordinance.
Manufactured Home means a structure, transportable in one
or more sections, which is built on a permanent chassis
and is designed for use with or without a permanent
foundation when connected to the required utilities. For
flood plain management purposes, the term "manufactured
home" also includes park trailers, travel trailers, and
other similar vehicles placed on a site for greater than
one hundred eighty ( 180 ) consecutive days. For insurance
purposes, the term "manufactured home" does not include
park trailers, travel trailers, and other similar
vehicles.
Manufactured Home Park or Subdivision means a parcel (or
contituous parcels) of land divided into two or more
manufactured home lots for rent or sale.
Start of Construction ( for other than new construction or
substantial improvements under the Coastal Barrier
Resources Act [Pub. L. 97-348] ) , includes substantial
improvements, and means the date the building permit was
issued, provided the actual start of construction,
repair, reconstruction, placement, or other improvement
was within one hundred eighty (180) days of the permit
date.
The actual start means either the first placement of
permanent construction of a structure on a site, such as
the pouring of slab or footings, the installation of
piles, the construction of columns, or any work beyond
the stage of excavation; or the placement of a
manufactured home on a foundation. Permanent
construction does not include the installation of streets
and/or walkways, nor does it include excavation for a
basement, footings, piers or foundations or the erection
of temporary forms; nor does it include the installation
on the property of accessory buildings, such as garages
or sheds not occupied as dwelling units or not part of
the main structure.
Section 3 .
That Chapter 6, Section 6-35(e) of the Code of Ordinances
of the City of Beaumont be amended to add the following:

Section 6-35(f) : Granting of Variances
Variances may be issued for new construction
and substantial improvements and for other
development necessary for the conduct of a
functionally dependent use provided that ( 1 )
the criteria outlined in Section 6-35(a)-(f)
are met, and (2 ) the structure or other
development is protect ed by methods that
minimize flood damages during the base flood
and create no additional threats to public
safety.
Section 4.
That Chapter 6, Section 6-41 of the Code of Ordinances of
the City of Beaumont be amended to add the following:
Section 6-41 : Construction Techniques, Materials, and Utility
Equipment
(d) Electrical, heating, ventilation, plumbing, and
air-conditioning equipment and other service facilities
shall be placed one foot (1 ' ) above the base flood
elevation and designed and/or located so as to prevent
water from entering or accumulating within the components
during conditions of flooding.
Section 5.
That Chapter 6, Section 6-44 of the Code of Ordinances of
the City of Beaumont be amended to add the following:
Section 6-44: Specific Standards-Base Flood Elevations Determined
(3) Enclosures - new construction and substantial
improvements, with fully enclosed areas below the lowest
floor that are subject to flooding shall be designed to
automatically equalize hydrostatic flood forces on
exterior walls by allowing for the entry and exit of
floodwaters. Designs for meeting this requirement must
either be certified by a registered professional engineer
or architect or meet or exceed the following minimum
criteria:
a. A minimum of two openings having a total net
area of not less than one square inch for every square
foot of enclosed area subject to flooding shall be
provided.
b. The bottom of all openings shall be no higher
than one foot (1 ' ) above grade.

C. Openings may be equipped with screens, louvers,
valves, or other coverings or devices provided that they
permit the automatic entry and exit of floodwaters.
Section 6.
That Chapter 6, Section 6-45.1 of the Code of Ordinances
of the City of Beaumont be amended by repealing subsection (1 ) and
adding a new subsection ( 1 ) to read as follows: this section and to
Section 6-45.1 : Specific Standards-Mobile Homes
(1 ) All manufactured homes to be placed or substantially
improved within Zones Al -30, and AE shall be elevated on
a permanent foundation, as defined in FEMA' s manual (FEMA
#85) , "Manufactured Home Installation in Flood Hazard
Areas" , September 1985, such that the lowest floor of the
manufactured home is elevated one foot (1 ' ) above the
base flood elevation and is securely anchored to an
adequately anchored foundation system in accordance with
the provisions of this section. A registered
professional engineer, architect, or land surveyor shall
submit a certification to the chief building inspector
that the standards of this paragraph and Section 6-38.2
of this article are complied with;
Section 7 .
That if any section, subsection, sentence, clause or
phrase of this ordinance, or the application of same to a
particular set of persons or circumstances, should for any reason
be held to be invalid, such invalidity shall not affect the
remaining portions of this ordinance, and to such end the various
portions and provisions of this ordinance are declared to be
severable.
Section 8.
All ordinances or parts of ordinances in conflict
herewith are repealed to the extent of the conflict only.
