HomeMy WebLinkAboutORD 87-33 ORDINANCE NO. r ENTITLED AN ORDINANCE AMENDING CHAPTER 30, THE ZONING ORDINANCE, OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1 . That Chapter 30, Section 30-24(B) , SIC Group 074 for Veterinary Services in the Permitted Use Tables of the Code of Ordinances of the City of Beaumont be amended by adding the number 17 in the Special Conditions column as a -reference to Special Condition 17. Section 2. That Chapter 30, Section 30-33(B) of the Code of Ordinances of the City of Beaumont be amended to add the following: Section 30-33 (b) ( 17) : Veterinary Services and clinics in RCR, NC, NSC, CSC, GC-MD and CBD districts shall be limited to the care of household pets and shall not provide overnight kennel services, except on a medical emergency basis. Overnight kennels and veterinary services not limited to household pets may be allowed in CSC, GC-MD and C,BD districts with a Specific Use Permit. Section 3. That Chapter 30 , Section 30-24 (B) , SIC Group 07 for Agricultural Services in the Permitted Use Tables of the Code of Ordinances of the City of Beaumont be amended by adding the SIC Group 075 for kennels. Section 4. That Chapter 30-27/ (A) ( 412 ) of the Code of Ordinances of the City of Beaumont be amended to read as follows: Section 30-27(A) ( 12 ) : Bonus for Landscaping of Off-Street Parking Facilities. The minimum off-street parking requirements shall be reduced up to a maximum of ten percent ( 100 ) of the requirement for 'those parking facilities designed to accommodate twenty (20 ) or more vehicles where a percent of the total parking area has been retained and developed as landscaped open space area. The percent of the landscaped open space area in excess of the landscaped open space required in Section 30-31 (C) shall determine the maximum percent reduction which will be permitted in the total number of off-street parking spaces. Section 5. That Chapter 30, Section 30-25(B) (2 ) , Area and Height Regulations/Commercial Districts, of the Code of Ordinances of the City of Beaumont be amended to add the number "10" as a reference under the column titled "Zoning Districts" . Section 6. That Chapter 30, Section 30-206 (G) of the Code of Ordinances of the City of Beaumont be amended to add the following: Section 30-26(G) : Time Limit: A Specific Use Permit issued under this section shall be valid for a period of two (2) years from the date of issuance and shall become null and void unless construction or use is substantially underway during said two-year period, or unless and extension of time is approved by the City Council. A Specific Use Permit that was issued, whether by City Council or exempted by Section 30-30 (D) (2 ) of this Chapter shall become null and void, if the land use it was issued for has been closed, vacated, or changed to a different use for a period of two (2 ) or more years. - 2 - Section 7. That Chapter 30, Section 30-28(C) (2 ) of the Code of Ordinances of the City of Beaumont be amended to read as follows: Section 30---28( (C) ( 2 ) : One (1 ) attached owner-identification wall sign, and plus one ( 1 ) additional attached sign for each thoroughfare r;iore than one (1 ) that abuts the property, shall be permitted in the NC, Neighborhood Commercial District, and OP, Office ParK, District, subject to the following restrictions. Section 8. That Chapter 30, Section 30-26(1) of the Code of Ordinances of the City of Beaumont be amended to read as follows: Section 30-26 (1) : Processing Fee: A processing fee, as set in Section 30-40 (e) of this ordinance, shall be required for the processing of each Specific Use Permit request. Section 9. TI-rat Chapter 30 , Section 30-31 (B) of the Code of Ordinances of the City of Beaumont be amended as follows: Section 30-31 (B) (1 ) : When a commercial or industrial use is established an a lot or premise 'Located adjacent to any residential zoning district, or when any multiple family dwelling use is established on a lot or premise adjacent to any property located in a single-family residential zoning district, a ten foot (10 ' ) width of 'Landscaping open space buffer strip shall be installed and maintained by the owner, developer or operator of the commercial or industrial property between it and the adjacent residentially zoned property. In addition, an eight foot (8 ' ) high opaque fence or wall shall be erected and maintained along the property line to provide visual screening- The fence or wall shall be a wood or masonry diagonal, horizontal or vertical stockade-type privacy fence, although the framing may be metal. In lieu of the fence, a 30 foot (30 ' ) wide landscaped buffer may be provided along ti-le property line. The provisions of this paragraph shall not apply where - 3 - districts are separated by a public street, railroad right-of-way, drainage ditch, or canal with a minimum easement of thirty feet ( 30 ' ) . In addition, the provisions of this paragraph shall not apply when a commercial use abuts a developed non-residential use in an R-3 district. Section 30-331 (B) (2 ) a in an open space buffer strip required under the terms of this section, not less than one (1 ) tree shall be planted and maintained for earl-A twenty-five (25) lineal feet or portion thereof of said open space buffer strip. For a 30 foot (30 ' ) wide 'Landscaped buffer, one ( 1 ) tree shall be planted and maintained for each 250 square feet of landscaped buffer. Each tree shall be not less than six feet (0" ) in height immediately upon planting and shall have a caliper of not less than two (2 ) inches at ground level. Section 30-31 (B} (3 ) Q. When a Specific Use Permit is required, the landscape buffering and fencing required by Section 30-31 (B) may be modified or eliminated as a condition of a Specific Use Permit. Section 10 . That Chapter 30, Section 30-33 (B) (13 ) of the Code of Ordinances of the City of Beaumont be amended to read as follows: Section 30-33 (B) ( 13 ) : Specific Use Permits are not required for the rental of equipment in a zoning district that permits the sale of the equipment as a right. That Chapter 30, Section 30-24(B) , SIC Group Numbers 52, 53, 51-4, 55, 56, 57, 59 and 7394 in the Permitted Use Tables be amended to add the number 13 as a reference number. Section 11 . That Chapter 30 , Section 30-27 (A) (6 ) (a) , Parking Group Table) , of the Code of Ordinances of the City of Beaumont be amended as follows: 4 9--------One (1 ) space for each employee plus three ( 3 ) customer spaces 11 --------One (1 ) space for each employee plus one (1 ) space for each barber chair 12--------One (1 ) space for each 200 square feet of gross floor area and 2 spaces per pump island with a minimum of 0' Spaces 23--------One One ( 1 ) space for each 2,000 square feet of lot area for customer parking 24--------One ( 1 ) space for each 5,000 square feet of lot area for customer parking Section 12. That Chapter 30, Section 30-24(B) of the Code of Ordinances of the City of Beaumont be amended in the form attached hereto as Exhibit "A". Section 13 . That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should, for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are delcared to be severable. Section 14. That all ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only. Section 15. That any person who violated any provision of this ordinance shall, upon conviction, be punished as provided in Section 1 -8 of the Code of Ordinances of Beaumont, Texas. - 5 - PASSED BY THE CITY COUNCIL of the City of Beaumont this the day or 1 987.
