HomeMy WebLinkAboutORD 85-111 ORDINANCE NO. ENTITLED AN ORDINANCE CANVASSING THE RETURNS OF THE ELECTION HELD IN THE CITY OF BEAUMONT ON THE 5TH DAY OF NOVEMBER, 1985. WHEREAS, the City Council of the City of Beaumont duly called a special election to be held on the 5th day of November, 1985 for the purpose of voting to repeal Ordinances 85-81 and 85-90; approving or rejecting an ordinance changing the name of Martin Luther King, Jr . Parkway and other streets referred to in Ordinance 85-66 back to the original names; approving or rejecting an ordinance changing the name of College Street to Martin Luther King, Jr . Boulevard; concerning the recall of the Mayor; concerning the recall of Councilman -G. Wayne Turner; concerning the repeal of the ordinances establishing rates for garbage, trash, water service, sewer service and, sanitation fees and regulations; an ordinance providing that no city employee shall receive a rate of pay in excess of $40,000 per year for th next five (5 ) years; and ordinance establishing the Beaumont Minimum Wage Law of 1985 to bring the minimum wage of the city to $4.10; and, WHEREAS, the election was duly conducted on the 5th day of November, 1985, at which time the qualified voters of the City of Beaumont cast ballots on the following issues: 1 . "AN ORDINANCE CHANGING THE NAME OF MARTIN LUTHER KING, JR. PARKWAY AND OTHER STREETS BACK TO THE ORIGINAL NAMES. " 2 . "AN ORDINANCE CHANGING THE NAME OF COLLEGE STREET TO MARTIN LUTHER KING, JR. BOULEVARD. 3 . "SHALL WILLIAM B . NEILD BE REMOVED FROM THE OFFICE OF MAYOR BY RECALL?" 4. "SHALL G. WAYNE TURNER BE REMOVED FROM THE OFFICE OF COUNCILMAN BY RECALL?" 5 . "AN ORDINANCE REPEALING AN ORDINANCE 83-122 ESTABLISHING RATES FOR GARBAGE AND TRASH COLLECTION; ORDINANCE 84-127 AMENDING WATER AND SEWER RATES; AND ORDINANCE 84-129 PROVIDING SANITATION FEES AND REGULATIONS. 6 . "AN ORDINANCE PROVIDING THAT NO CITY EMPLOYEE SHALL RECEIVE A RATE OF PAY IN EXCESS OF $40, 000 PER YEAR FOR THE NEXT FIVE (5) YEARS. 7 . "AN ORDINANCE ESTABLISHING THE BEAUMONT MINIMUM WAGE LAW OF 1985 WHICH WILL BRING THE MINUMUM WAGE IN THE CITY TO $4. 10 PER HOUR. and, WHEREAS, after duly canvassing said returns, the City Council found that the votes cast at said election for the issues were as follows : 1 . FOR THE ORDINANCE------------- 5 ,294 (23 .5°%) AGAINST THE ORDINANCE---------17, 227 (76 .5%) 2 . FOR THE ORDINANCE------------- 3 ,308 (14.9%) AGAINST THE ORDINANCE---------18,953 (85 .1% ) 3 . FOR THE ORDINANCE------------- 8,052 (35.5%) AGAINST THE ORDINANCE---------14,649 (64.5%) 4 . FOR THE ORDINANCE------------- 8,380 (37 .3%) AGAINST THE ORDINANCE---------14,077 (62.7°%) 5 . FOR THE ORDINANCE------------- 8,755 (41.2%) AGAINST THE ORDINANCE---------12,495 (58.8%) 6 . FOR THE ORDINANCE------------- 6,880 (31 . 2%) AGAINST THE ORDINANCE---------15, 176 (68.8%) 7 . FOR THE ORDINANCE------------- 5,858 (26 .2%) AGAINST THE ORDINANCE---------16,540 (73 .8%) NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: 2 - d mss--111 Section 1 . That the City Council finds that the election held in and throughout the City of Beaumont, Texas on the 5th day of November, 1985, which election is more particularly described in the preamble of this ordinance, was duly called and notice thereof was given and said election was held under and in strict conformity with law; that only duly qualified resident electors of said City voted at said election; that due returns of said election have been made by the proper officers; and, that said election has resulted in the following outcome: 1 . "AN ORDINANCE CHANGING THE NAME OF MARTIN LUTHER KING, JR. PARKWAY AND OTHER STREETS BACK TO THE ORIGINAL NAMES----------------DEFEATED 2 . "AN ORDINANCE CHANGING THE NAME OF COLLEGE STREET TO MARTIN LUTHER KING, JR. BOULEVARD. ------AGAINST THE RECALL 3 . "SHALL WILLIAM B . NEILD BE REMOVED FROM THE OFFICE OF MAYOR BY RECALL?"-----AGAINST THE RECALL 4. "SHALL G. WAYNE TURNER BE REMOVED FROM THE OFFICE OF COUNCILMAN BY RECALL?"----------DEFEATED 5 . "AN ORDINANCE REPEALING AN ORDINANCE 83-122 ESTABLISHING RATES FOR GARBAGE AND TRASH COLLECTION, ORDINANCE 84-127 AMENDING WATER AND SEWER RATES; AND ORDINANCE 84-129 PROVIDING SANITATION FEES AND REGULATIONS. ----------------DEFEATED 6 . That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable.
