ENTITLED AN ORDINANCE AMENDING CHAPTER 28 OF THE
CODE OF THE ORDINANCES OF THE CITY OF BEAUMONT TO
PROVIDE WATER AND SEWER RATES; PROVIDING AN
EFFECTIVE DATE; PROVIDING FOR SEVERABILITY;
PROVIDING FOR REPEAL AND PROVIDING A PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1 .
That Chapter 28, Section 28-50(a) of the Code of
Ordinances of the City of Beaumont be amended to read as follows:
Section 28-50(a) :
Minimum monthly charge. . . . . . . . . . .$ 1 .13;
A charge of $1 .23 per one thousand (1 ,000)
gallons of water usage shall be made
thereafter from zero gallons to maximum
monthly usage.
Section 2 .
That Chapter 28, Section 28-53 of the Code of Ordinances
of the City of Beaumont be amended to read as follows:
Section 28-53(a) :
(a) The following metered rates based upon water
measured through meters approved by the
Water Utilities Department shall be
effective inside the city: There shall be a
minimum monthly charge to all persons who
have a sewer connection of One Dollar and
Twenty-Three Cents ( $1 . 23) . A charge of One
Dollar and Twenty-Two Cents ($1 .22) per one
thousand (1 ,000) gallons of water usage
shall be made thereafter from zero gallons
to maximum monthly usage.
Section 28-53(c) :
(c) Where a building containing more than one
dwelling unit is served by a single meter or
where there is not a separate water meter

for each dwelling unit, each unit shall be
charged a minimum base charge of One Dollar
and Twenty-Three Cents ( $1 .23) and sewer
service shall be charged based on water
usage at the rate of One Dollar and
Twenty-Two Cents ($1 .22) per one thousand
(1 ,000) gallons of water usage from zero
gallons to maximum monthly usage.
Section 3 .
This ordinance shall be effective from and after
October 1 , 1985.
Section 4 .
That if any section, subsection, sentence, clause or
phrase of this ordinance, or the application of same to a
particular set of persons or circumstances, should for any reason
be held invalid, such invalidity shall not affect the remaining
portions of this ordinance, and to such end the various portions
and provisions of this ordinance are declared to be severable.
Section 5 .
That all ordinances or parts of ordinances in conflict
herewith are repealed to the extent of the conflict only.
Section 6 .
That any person who violates any provision of this
ordinance shall, upon conviction, be punished as provided in
Section 1-8 of the Code of Ordinances of Beaumont, Texas.
