ENTITLED AN ORDINANCE CALLING A SPECIAL
ELECTION IN THE CITY OF BEAUMONT ON THE 10TH
DAY OF AUGUST, 1985, FOR THE PURPOSE OF
APPROVING OR REJECTING AN ORDINANCE DEDICATING
A TRACT OF LAND ON DELAWARE STREET TO BE A
PARK UPON TERMINATION OF CERTAIN 99 YEAR
LEASES.
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT, TEXAS:
WHEREAS, :a petition was submitted to the City under the
provisions of Article XI of the Charter of the City of Beaumont
proposing the ordinance set forth in Section 2 below; and
WHEREAS, the City Clerk has certified to the City
Council that the petition was signed by qualified electors equal
in number to at least twenty-five percent ( 250) of the total
number of votes cast at the last general municipal election; and,
WHEREAS, in accordance with Chapter XI of the Charter of
the City of Beaumont, the City Council has considered the petition
and desires to submit the proposed ordinance to a vote of the
people;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
Section 1 .
That it is hereby ordered that a special election be
held on the 10th day of August, 1985, between the hours of 7 :00
a.m. and 7 :00 p.m. , at which election an initiative petition shall
be submitted to the qualified voters of the City for their action
thereon as set out in the official ballot hereinafter prescribed.
Section 2 .
That the following ordinance be submitted to the
electors of the City of Beaumont at an election to be held within
the City of Beaumont on August 10, 1985:
"BE IT ORDAINED BY THE CITY OF BEAUMONT THAT
THAT CERTAIN TRACT OF LAND KNOWN AS THE OLD
JEFFERSON COUNTY HOSPITAL T. B . SITE ON
DELAWARE STREET AND DESCRIBED BY METES AND
BOUNDS IN THREE ( 3) SEVERAL DEEDS FROM THE
COUNTY OF JEFFERSON TO THE CITY OF BEAUMONT
RESPECTIVELY RECORDED IN VOL. 2306, PG. 447
ET SEQ, VOL. 2379, PG. 49 ET SEQ, AND FILM
CODE #100-12-0212 ET SEQ IN THE DEED RECORDS
AND OFFICE OF THE COUNTY CLERK OF JEFFERSON
COUNTY, TEXAS, BE DEDICATED TO PASSIVE
PUBLIC PARK PURPOSES AS DEFINED IN SAID
DEEDS, SUBJECT ONLY TO THE TERMS OF THOSE
THREE SEVERAL LEASES COVERING SAID PROPERTY
BETWEEN THE CITY OF BEAUMONT AND BEAUMONT
ART MUSEUM ."
Section 3 .
That notice of said election shall be given by
publishing said notice as set out herein in a newspaper of general
circulation in this city and county one time, not more than
twenty-five ( 25) days or not less than ten ( 10) days before said
election. Said notice shall be in the following form:
"NOTICE OF ELECTION IN THE CITY OF
BEAUMONT FOR THE PURPOSE OF DEDICATING A
TRACT OF LAND ON DELAWARE STREET TO BE A
PARK UPON TERMINATION OF CERTAIN 99 YEAR
LEASES.
NOTICE IS HEREBY GIVEN THAT AN ELECTION AS
PROVIDED BY ARTICLE XI OF THE CHARTER OF THE
CITY OF BEAUMONT WILL BE HELD IN THE CITY OF
BEAUMONT, TEXAS, ON THE 10TH DAY OF AUGUST,
1985, FROM 7 :00 A.M. TO 7 : 00 P. M. , FOR THE
PURPOSE OF APPROVING OR REJECTING AN ORDINANCE

Section 4 .
The form of ballot which shall be used in said election
shall be substantially as follows:
"AN ORDINANCE TO DEDICATE A TRACT OF LAND
ON DELAWARE STREET TO BE A PARK UPON
TERMINATION OF CERTAIN 99 YEAR LEASES."

AGAINST THE ORDINANCE
Section 5 .
The special election hereby ordered shall be held under
the provisions of the Charter of the City of Beaumont, Texas, and
the Constitution and Laws of the State of Texas and the ordinances
of the City of Beaumont, including this particular ordinance, and
only qualified voters of and in the City of Beaumont shall be
allowed to vote at said election, and each elector shall vote in
the election precinct of his residence.
Section 6 .
The places for voting and the judges and officials at
said election are set out in Exhibit "A" attached hereto and made
a part hereof for all purposes. The presiding judges shall be
authorized to select such clerks or other assistants provided by
law, as may be deemed necessary; and said election shall be held
in accordance with the provisions of law relating to elections for
the submission of amendments to municipal charters, and the

general laws of the State of Texas shall be observed insofar as
they are applicable.
Section 7 .
That an electronic voting system, as defined and
described by Article 7 .15, Texas Election Code, shall be used for
said election and the following are hereby appointed officers of
said election to serve at the Central Counting Station, which is
hereby established at the Jefferson County Mid-County office
Building:

Presiding Judge for the
Central Counting Station: Myrtle Corgey
The Manager and Presiding Judge of the Central Counting Station
shall appoint not more than four (4 ) clerks to serve at the
Central Counting Station. The official ballot cards and ballot
labels, respectively , for the election shall be prepared in
accordance with the Texas Election Code.
Absentee voting shall be conducted by a clerk for
absentee voting, namely, Myrtle Corgey, the City Clerk , and the
place at which the absentee voting shall be conducted is
designated at the City Hall, Beaumont, Texas, which address is in
the mailing address to which absentee ballot applications and
ballots voted by mail may be sent. Said clerk shall keep said
office open for at least eight (8 ) hours, between 8 :00 a.m. to
5:00 p.m. , on each day for absentee voting which is not a
Saturday, a Sunday, or an official State holiday; provided,

however, except as authorized by Article 5 .05, Subdivision 3 (d) ,
Texas Election Code, said clerk shall not permit anyone to vote
absentee by personal appearance on any day which is not a regular
working day for the clerk' s office, and under no circumstances
shall she permit anyone to vote absentee by personal appearance at
any time when her office is not open to the public.
Absentee votes by mail shall be counted by a special
canvassing board consisting of a Presiding Judge and two clerks.
E . A. Adams is hereby appointed Presiding Judge of the special
canvassing board and he shall appoint the two clerks.
Section 8 .
A copy of this ordinance, both in the English language
and in the Spanish language, signed by the Mayor of the City of
Beaumont, Texas, and attested by the City Clerk of said City,
shall constitute the notice ordering said election and the City
Clerk is directed to cause a copy of this ordinance, signed by the
Mayor and attested by her, to be posted at the City Hall in the
City of Beaumont, Jefferson County, Texas, and at each of the
polling places in each precinct of the City, said posting to be
not less than twenty ( 20) days prior to said election, and to
cause a copy of this ordinance to be published on the same day in
each of two (2) successive weeks in some newspaper of general
circulation in the City of Beaumont, said publication to be made
in accordance with the requirements of Article 1170, V.A.C.S . ,
Texas, the first such publication to be made not less than
fourteen (14) day before the date of said election.

Section 9 .
This ordinance shall be finally passed on the date of
its enactment and shall take effect immediately upon its passage
and signature by the Mayor. The City Clerk is hereby authorized
to attest to same and to affix the seal of the City of Beaumont
hereto.
