ENTITLED AN ORDINANCE REPEALING SECTIONS
7-30 THROUGH 7-45, INCLUSIVE , CHARITABLE
SOLICITATIONS; SECTIONS 26-3 AND 26-4 ,
TRAFFIC SAFETY SUPPORT COMMITTEE; PROVIDING
FOR THE CREATION OF A HEALTH ADVISORY BOARD;
PROVIDING FOR ATTENDANCE REQUIREMENTS FOR
ALL BOARDS AND COMMISSIONS; PROVIDING A CITY
COUNCIL LIAISON; CREATING A TRANSIT ADVISORY
COMMITTEE; AMENDING CHAPTER II, SECTIONS
2-5, 2-10, AND 2-87; AMENDING CHAPTER 30,
SECTIONS 30-39(A) (3 ) (B) AND 39-39( A) (3 ) (F) ;
CHAPTER 13, SECTION 13-66, AND CHAPTER 20,
SECTION 20-2 (A) ; OF THE CODE OF ORDINANCES
OF THE CITY OF BEAUMONT REGARDING THE SIZE
OF CERTAIN BOARDS AND COMMISSIONS; PROVIDING
FOR SEVERABILITY AND PROVIDING FOR REPEAL.
Section 1 .
That Sections 7-30 through 7-45, inclusive, and
Sections 26-3 and 26-4 , of the Code of Ordinances of the City of
Beaumont be, and the same are hereby , repealed.
Section 2 .
That Chapter II of the Code of Ordinances of the City
of Beaumont is hereby amended to add a new Section 2-11 to read
as follows:
Section 2-11:
There is hereby created a Health Advisory
Board composed of seven (7 ) members who are
resident citizens and voters of the City of
Beaumont. The members of the Health
Advisory Board shall be appointed by the
City Council. Of the seven (7 ) members,
three ( 3 ) shall be appointed for a term of
two (2 ) years and four (4 ) shall be
appointed for a term of one ( 1 ) year;
thereafter, the term of office of each
board member shall be for two (2 ) years or
until a successor is appointed. Two (2 ) of
the members of the board shall be appointed
from the health care provider community in
the City of Beaumont; one ( 1 ) member shall
be appointed from the business community in
the City of Beaumont; one ( 1 ) member shall
be appointed from the labor community in
the City of Beaumont; one ( 1 ) member shall
be appointed from the medically indigent
population in the City of Beaumont; two (2 )
members shall be appointed from the general
public at-large of the City of Beaumont.
The City Council shall name the chairman
and vice chairman. The City Council shall
appoint one ( 1 ) of its number to serve as
an ex-officio member of the board without
vote. Vacancies shall be filled by the
City Council for the unexpired term.
Members of the board shall serve without
compensation.
The duties of the Health Advisory Board
shall be advisory in nature to the City
Council and the City Manager. Its duties,
among others, shall be to recommend policy
relating to public health affecting the
community; assist in the development and
implementation of a master public health
services plan for the City of Beaumont;
recommend program and service improvements;
facilitate communications between the City
Council, the Beaumont Health Department,
the community at-large, the health care
community, targeted populations and
regulated groups.
Section 3 .
That Chapter II of the Code of Ordinances of the City
of Beaumont is hereby amended to add a new Section 2-12 to read as
follows:
Section 2-12:
The City Council shall appoint one ( 1 ) of its
number to serve as an ex-officio member
without vote to each board and commission
appointed by the City Council. Any appointed
member of any board or commission who fails
to attend three ( 3 ) regular meetings in
succession or does not attend at least seventy
percent (700) of the regularly scheduled
board meetings in a six (6 ) month period will
be considered to have automatically resigned
from the board or commission.

The City Manager or his designee shall
monitor attendance and maintain attendance
records for boards and commissions and notify
the City Council of resignations under this
section.
Section 4 .
That Chapter II, Section 2-5 of the Code of Ordinances
of the City of Beaumont be, and the same is hereby , amended to read
as follows:
There is hereby created an airport advisory
committee composed of ten ( 10) members who
are resident citizens and qualified voters
of the City of Beaumont. The members of the
airport advisory committee shall be
appointed by the city council. Of the ten
( 1 0) members first appointed, five (5 ) shall
be appointed for a term of one year and five
( 5 ) shall be appointed for a term of two ( 2 )
years. Thereafter, the term of office of
each member of the airport advisory
committee shall be two ( 2) years or until a
successor is appointed. The chairman and
vice chairman shall be appointed by the City
Council. Vacancies shall be filled by the
City Council for the unexpired term.
Members of the airport advisory committee
shall serve without compensation and all
members of said committee shall be subject
to removal at the will and pleasure of the
City Council. The duties of the airport
advisory committee shall be advisory in
nature and it shall advise the City Council,
the City Manager and Director of Traffic and
Transportation concerning the needs of the
Beaumont Municipal Airport and other airport
matters and policy. The airport advisory
committee shall meet as required by the
chairman or the Director of Urban
Transportation.
Section 5 .
That Chapter II, Section 2-10 of the Code of
Ordinances of the City of Beaumont be amended to read as follows:

Section 2-10:
There is hereby created a senior citizens
advisory commission composed of fourteen ( 14)
members who are resident citizens and
qualified voters of the City of Beaumont.
Members shall be senior citizens and others
knowledgable and interested in the concerns
of senior citizens. Members of the senior
citizens advisory commission shall be
appointed by the City Council. Of the
fourteen ( 14) members first appointed, five
( 5 ) shall be appointed for a term of one
year, five ( 5 ) shall be appointed for a term
of two ( 2) years, and four ( 4 ) shall be
appointed for a term of three ( 3 ) years;
thereafter, the term of office of each member
of the senior citizens advisory commission
shall be three ( 3 ) years or until a successor
is appointed. The chairman and vice chairman
shall be appointed by the City Council.
Vacancies shall be filled by the City Council
for the unexpired term. Members of the
senior citizens advisory commission shall
serve without compensation and all members of
said commission shall be subject to removal
at the will and pleasure of the City Council.
The duties of the senior citizens advisory
commission shall be advisory in nature, and
it shall advise the City Council and the City
Manager in matters affecting senior
citizens' interests and assist in planning
and policy making for related activities.
These duties will include, but not be
limited to assisting in the development of
plans and policies for the Best Years
Center and other programs and facilities
provided by the city for senior citizens.
The senior citizens advisory commission
shall meet monthly or as required by the
chairman or the City Manager.
Section 6 .
That Chapter II, Section 2-87 of the Code of
Ordinances of the City of Beaumont be amended to read as follows:

Section 2-87:
There is hereby established a community
development advisory committee to be
composed of twenty-one ( 21) members who are
resident citizens of the city. The members
of the community development advisory
committee shall be appointed by the City
Council for two-year terms. The City
Council shall name one ( 1 ) of the members
as chairman and one ( 1 ) as vice chairman.
Vacancies shall be filled by the City
Council for the unexpired term. Members of
the committee shall serve without
compensation.
Section 7 .
That Chapter 30, Sections 30-39(A) (3 ) (b) and
30-39(A) (3 ) (f) of the Code of Ordinances of the City of Beaumont be
amended to read as follows:
Section 30-39(A) (3 ) (b) :
The City Council of the City of Beaumont
shall name a chairman and vice-chairman
for the historical landmark commission.
Section 30-39(A) (3 ) (f) :
Any appointed member of the historical
land-mark commission who fails to attend
three (3 ) regular meetings in succession or
does not attend at least seventy percent
(700 ) of the regularly scheduled meetings
during any six-month period will be
considered to have automatically resigned
from the board or commission. Verification
of attendance shall be the responsibility
of the City Manager or his deisgnee.
Section 8 .
That Chapter 13, Section 13-66 of the Code of
Ordinances of the City of Beaumont be amended to read as follows:

Section 13-66:
There is hereby created a clean community
commission composed of twenty-one ( 21)
members who are residents, citizens and
qualified voters of the City of Beaumont.
Members of the clean community commission
shall be appointed by the City Council and
the chairman shall be selected by the City
Council. Vacancies shall be filled by the
City Council for the unexpired term.
Members of the clean community commission
shall serve without compensation and all
members of said commission shall be subject
to removal at the will and pleasure of the
City Council. Members shall be appointed
for two-year terms.
Section 9 .
That Chapter 20, Section 20-2 (a) of the Code of
Ordinances of the City of Beaumont be amended to read as follows:
Section 20-2 ( a) :
There is hereby created a parks and
recreation advisory committee to be composed
of fourteen ( 14) members who are resident
citizens and qualified voters of the city.
The members of the parks and recreation
advisory committee shall be appointed by the
City Council. Of the initial fourteen ( 14)
members appointed, seven (7 ) shall be
appointed for a term of two (2 ) years; and
seven ( 7 ) shall be appointed for a term of
one (1 ) year; thereafter, the term of office
of each member of the parks and recreation
advisory committee shall be for two ( 2 ) years
or until a successor is appointed. The City
Council shall name one of the members of the
parks and recreation advisory committee as
chairman for two ( 2) years. Vacancies shall
be filled by the Council for the unexpired
term. Members of the parks and recreation
advisory committee shall serve without
compensation. All members of the parks and
recreation advisory committee shall be
subject to removal at the will and pleasure
of the Council.

Section 10.
That Chapter 28 of the Code of Ordinances of the City
of Beaumont is hereby amended to add a new Section 28-7 to read as
follows:
Section 28-7:
There is hereby established a Transit Advisory
Committee composed of seven ( 7 ) members. The
Transit Advisory Committee shall be charged
with the duty and responsibility of acting in
an advisory capacity for the City Council, City
Manager, and City Staff concerning transit
system objectives and activities of the City of
Beaumont. The Transit Advisory Committee shall
include one or more members who represent
physically handicapped individuals.
Upon the expiration of the term of service of
each of the members, new members of the Transit
Advisory Committee will be appointed by the
City Council to serve for terms of three ( 3 )
years, and existing members may be
reappointed.
The Chairman and Vice-Chairman will be named by
the City Council to serve one ( 1 ) year terms.
Section 10.
That if any section, subsection, sentence, clause or
phrase of this ordinance, or the application of same to a
particular set of persons or circumstances, should for any reason
be held to be invalid, such invalidity shall not affect the
remaining portions of this ordinance, and to such end the various
portions and provisions of this ordinance are declared to be
severable.
Section 11.
That all ordinances or parts of ordinances in conflict
herewith are repealed to the extent of the conflict only.
