HomeMy WebLinkAboutORD 83-104 ORDINANCE NO. Y3 -/a4 ENTITLED AN ORDINANCE ISSUING A SPECIFIC USE PERMIT TO SELL ALCOHOLIC BEVERAGES IN A GC-MD DISTRICT AT 5905-E PHELAN BOULEVARD. WHEREAS, the Planning and Zoning Commission of the City of Beaumont considered the issuance of a specific use permit to sell alcoholic beverages in a GC-MD (General Commercial - Multiple Dwelling) District on property located at 5905-E Phelan Boulevard, Beaumont, Jefferson County, Texas, to Damon Kellams, prospective lessee from owner, Ted Henchey , his legal representatives, successors, and assigns for that certain property hereinafter described; and, WHEREAS, the City Council is of the opinion that the issuance of such specific use permit is in the best interest of the City of Beaumont and its citizens, subject to the hereinafter described conditions; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That all conditions necessary for issuance of a specific use permit have been met and a specific use permit to sell alcoholic beverages in a GC-MD (General Commercial-Multiple Dwelling) District on property located at 5905-E Phelan Boulevard, Beaumont, Jefferson County, Texas, in accordance with Section 30-26 and Section 30-40 of the Code of Ordinances of the City of Beaumont, as amended, is hereby granted to Damon Kellams , prospective lessee from owner, Ted Henchey, D- 93 -43 e f his legal representatives, successors and assigns for that certain tract described on Exhibit "A" attached hereto and made a part hereof for all purposes. Section 2 . That the specific use permit herein granted is expressly issued for and in accordance with each particular and detail of the site plan attached hereto as Exhibit "B" and made a part hereof for all purposes. THE MAGIC LOMM concept is an intimate, neighborhood- style bar catering to upper middle class professional people. The bar is rendered 100% unique through the use of magicians as bartenders and an all-magic decor from the late 19th and 20th cen- turies. All customers of the Magic Lounge will have close-up magic performed either in front of them at the bar or at their table. Having Magic as the only form of entertainment offered provides several advantages; since there is no music or dancing, people going out to get drunk and loud will find no attraction in the Magic Lounge, also, the duration of stay is shortened consider- .tbly. It also eliminates w' potential noise problems The Magic Lounge, operated as proposed, will be attractive to both the other tenants of the shopping centre and to the surrounding community. Since the Magic Lounge will not be somewhere to gust go and drink, but somewhere to go see magic, the bar would not open until 5:00 PM, thusby giving the allotted parking of this portion of the centre over to the other tenants, while allowing the Magic Lounge an assurance that all parking would be in front of the building (Phelan side) and not in the back where residences face the centre. The opening of ataxy establishment that is 100% unique to the area will also attract a :'Large amount of media coverage, adding prestige to both the centre and the area. Also, since all the signs in the centre are uni."orm white neon block letters and are lighted at night, having something in the co+ntr*e open at night will offer ex- poeuars heretofore unavailable to every tenant. According to GEh= magazine and THE LINKING RING magazine, the people who enjoy magic the most are upper middle class, professional people with above average edu- cations. This fact, provides for two important factors. First, the placement of an establishment such as The Magic Loungein the Beaumont area almost has to be in the west end, second, the level of our clientele will be in accordance with the sur- rounding community. The Magic Lounge will have seating for 73 peopl+a, will open at 5;00 PM and close on Mon-toted at 12;C►0 PM az�d cyan Thum, Fri and Sat between 12:00 PM and 2:00 AM according to business. The Magic Lounge will employ 2 bartenders, 2 waitreases and 1 door person per night, identification will be checked at the door, no one under 19 will be allowed in the building at arq time. The magic Lounge is to be financed with an investment of the applicant and the investments of Mr. Ed Brooks and Mr. Lynn Spencer. Since the Magic Lounge is to open within an existing centre, the conditions concerning access roads, supporting facilities, driveways,, parking spaces, directional lighting, landscaping, vehicular and pedestrian traffic, walls and screening can be taken as read. This particular centre has design control as fax as signs, all businesses have white, neon, block letters of approx. 1911 in height, ao if the average width of a letter is 1611, if our sign is 2 words of 5 letters each, and if the words were stacked one on top of the other, our sign would be approx. 39" high and 83" wide. Any Specific Use Permit conditions in direct harmony with stipulations stated in the lease provided by the landlord of the centre w1.11 be considered complied with through applicants acceptance of lease.
