ENTITLED AN ORDINANCE ISSUING A
SPECIFIC USE PERMIT FOR AN ALCOHOLIC
BEVERAGE ESTABLISHMENT ON PROPERTY
LOCATED AT 6352 PHELAN BOULEVARD.
WHEREAS, the Planning and Zoning Commission of the City of
Beaumont considered the issuance of a specific use permit for an
alcoholic beverage establishment on property located at 6352 Phelan
Boulevard, Beaumont, Jefferson County, Texas to Roy W. Maness, his
legal representatives, successors, and assigns for that certain
property hereinafter described; and,
WHEREAS, the City Council is of the opinion that the
issuance of such specific use permit is in the best interest of the
City of Beaumont and its citizens, subject to the hereinafter
described conditions;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
Section 1 .
That all conditions necessary for issuance of a specific
use permit have been met and the specific use permit for an alcoholic
beverage establishment on property located at 6352 Phelan Boulevard,
Beaumont, Jefferson County, Texas, in accordance with Section 30-26
and Section 30-40 of the Code of Ordinances of the City of Beaumont,
as amended, be granted to Roy W. Maness, his legal representatives,
successors and assigns for that certain tract described in Exhibit
"A" attached hereto and made a part hereof for all purposes.
Section 2 .
That the specific use permit herein granted is expressly
issued for and in accordance with each particular and detail of the
site plan attached hereto as Exhibit "B" and made a part hereof for
all purposes.

Dear Sirs :
This application is submitted for your approval by
KAD Corporation. The location will be in the new
Colonade Shopping Center. The name of the business
will be "Pacesetter" . The type of business will be
a lounge serving mixed drinks , beer , wine , sandwiches ,
and snacks .
We have signed a letter of intent with the property
owner for 2800 square feet . We will have 30 to 35
tables with chairs , two restrooms , offices , a storage
room, and a kitchen .
See attached artists ' drawing of "Pacesetter" location .
We will be compatible with other property in the
Colonade Shopping Center .
The drainage , access roads , utilities , parking, and
landscaping, have been provided for by the property
owners . All nuisance prevention measures will be taken .
Directional lighting will be provided . The outside sign
will be limited to the Colonade Shopping Center lease
agreement . The site plan and preliminary floor plan
are also attached for your information .
