ENTITLED AN ORDINANCE FOR THE ISSUANCE
OF A SPECIFIC USE PERMIT FOR A TRACT
OF LAND OUT OF THE J. W. BULLOCK
SURVEY, AND APPROVAL OF A GENERAL LAND
USE AND DENSITY PLAN FOR THE
PROPERTY.
WHEREAS, the Planning and Zoning Commission of the City of
Beaumont considered the issuance of a specific use permit and
approval of a general land use and density plan for new apartment
construction on property presently zoned PUD (Planned Unit
Development) District and described as Tract 1 , City Tax Plat B-1 ,
J. W. Bullock Survey, located in the 3500 Block of Port Arthur Road,
Beaumont, Jefferson County, Texas, to Josh Allen, owner, his heirs ,
representatives, successors, and assigns for that certain property
hereinafter described; and,
WHEREAS, the City Council is of the opinion that the
issuance of such specific use permit and approval of the general land
use and density plan is in the best interest of the City of Beaumont
and its citizens, subject to the hereinafter described conditions;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
Section 1.
That the eight (8 ) conditions necessary for issuance of a
specific use permit have been met and the specific use permit for new
apartment construction on property described as Tract 1 , City Tax
Plat B-1 , J. W. Bullock Survey, located in the 3500 Block of Port
Arthur Road, in accordance with Section 30-26 and Section 30-40 of
the Code of Ordinances of the City of Beaumont, as amended, be
granted to Josh Allen, his heirs, legal representatives, successors
and assigns for that certain tract described on Exhibit °A° attached
hereto and made a part hereof for all purposes.
Section 2 .
That the specific use permit and the general land use and
density plan herein granted is expressly issued for and in accordance
with each particular and detail of Section 30-26 (e) of the Code of
Ordinances and the site plan attached hereto as Exhibit "B" and made
a part hereof for all purposes.
PASSED BY THE CITY COUNCIL of the City of Beaumont this the
