ENTITLED AN ORDINANCE AMENDING CHAPTER 30, THE ZONING ORDINANCE OF THE CITY OF BEAUMONT TO AMEND PERMITTED USES, REGULATIONS, AREA AND HEIGHT RESTRICTIONS, DEFINITIONS, EXEMPTIONS, LANDSCAPING AND SCREENING REQUIREMENTS, PARKING AND LOADING REGULATIONS AND OTHER REGULATIONS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. WHEREAS, a public hearing was held December 6 , 1982 before the Planning and Zoning Commission and the City Council of the City of Beaumont concerning proposed amendments to the Zoning Ordinance; and, WHEREAS, the Planning Commission of the City of Beaumont considered each item as presented and forwarded same to the City Council with the recommendation to either approve or disapprove each individual item; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1 . THAT Chapter 30, Section 30-33(b) is hereby amended by adding new special conditions ( 13) , ( 14) and ( 15) to read as follows: Section 30-33(b) (13) : Renting, Leasing or Storing of Heavy Equipment. The renting, leasing, or storing of heavy equipment such as constsruction equipment, oil field equipment and other heavy machinery shall be permitted in a GC-MD District only with a specific use permit. Section 30-33(b) ( 14) : Accessory Parking. Accessory parking of vehicles with more than two ( 2) axles or that have a rated carrying capacity in excess of two ( 2) tons, other than recreational vehicles, shall not be allowed in residential zoning districts. Section 30-33(b) (15) : Storage Limitations. In a GC-MD District a towing service shall only be permitted to store not more than ten ( 10) vehicles on the lot or premise on which it is located as a use of right. Storage of more than ten ( 10) vehicles shall be permitted only with a specific use permit. Section 2 . That Chapter 30, Section 30-30(b) (3 ) is hereby amended to read as follows: Section 30-30(b) (3) : A non-conforming use may be changed only to a use permitted in a more restricted zoning district or to a conforming use. Section 5 . That Chapter 30, Section 30-30(d) (1 ) is hereby amended to read as follows: Section 30-30(d) (1 ) : The limitations on non-conforming uses in this section shall not apply to any residential use existing at the time of the adoption of this ordinance. Section 6 . That Chapter 30, Section 30-31(b) (2 ) is hereby amended to read as follows: Section 30-31(b) (2 ) : In an open space buffer strip required under the terms of this section, not less than one tree shall be planted and maintained for each twenty-five ( 25) lineal feet or portion thereof of said open space buffer strip. Each tree shall be not less than six (6 ) feet in height immediately upon planting and shall have a caliper of not less than two (2) inches at ground level. Section 7 . That Chapter 30, Section 30-27(a) of the Code of Ordinances is amended to read as follows: Section 30-27(a) : A. Off-Street Parking.Regulations: It is the intent of t�iis section to assure i)at 'id- equate off- stree-t parking to accommodate personal vehicles of employees and/or customers is provided with the construction, alteration, remodeling or change in the use of land. 1) Any person establishing an off-street parking facility or applying for a building permit for construction, reconstruction, or alteration of the use of any building, other than a single family residence, shall submit to the building official three (3) copies of a plot plan designating the number, dimensions, and location of off- street parking spaces and driveways that exist or are proposed. 2) The building official shall not issue a building permit if it is determined that the plot plan does 'nact conform to the Off-Street Parking and Driveway Standards adopted by resolution by the City Council and on file in the Office of the Director of Transportation. Any variation to these standards must be approved by the Director of Transportation. 3) Required off-street parking spaces shall be located on, or within four-hundred (400) feet of the- same lot, tract, parcel, or premises as the use being served or other property of the same or less restrictive zoning classi- fication that the owner of the premises being served has a continuing right to use for parking. 4) Any existing building or use that is enlarged, structur- ally altered, or remoded to the extent, in the judgement of the Planning Director and building official, of increasing , or changing the use by more than fifty (50) percent as it + existed at the effective date of this Ordinance shall be accompanied by off-street parking for the entire building or use in accordance with the off-street parking regulations set forth in this section. When the enlargement, structural alteration, or remodeling is to the extent that the use } is not increased or changed by more than fifty (50) per- cent, additional off-street parking shall only be required. for the increased or changed .floor area or use. . • i S) Existing parking spaces may not be used to satisfy additional off-street parking requirements of this chapter unless the existing spaces proposed for use in meeting the requirements of this chapter exceed the number required for the building or use for which the existing spaces are associated. All parking associated with a building or use from which the spaces are drawn must meet all requirements of this Ordinance. 6) General Requirements: a) The number of off-street parking spaces ftr each use shall be determined by reference to the following "Parking Group Table." Specific parking groups are identified for each --primary use or accessory -residential use in Section 30-24.B. b) For shopping centers, or other tracts where different property uses will share a joint parking area, the parking requirements shall be computed based upon the overall development. Shopping centers containing not more than 200,000 square feet or gross leasable floor area shall have a minimum of six (6) spaces per 1,000 square feet of net floor arga.- Shop- ping centers containing more than 200,000 square feet of gross floor area shall have a minimum of five and one-half (S.S) spaces per 1,000 square feet of -liet floor area. c) For any use not listed, or where the listed regula- tions are not applicable, in the judgement of the Director of Transportation, the parking requirements shall be determined by the Director of Transportation. Computations of required parking spaces by the Direc- tor of Transportation shall be final, subject only to an appeal to the Board of Adjustment. PARKING GROUP TABLE REQUIRED NUMBER OF PARKING GROUP OFF-STREET PARKING SPACES 1........One (1) space for each dwelling unit. 2........0ne and one-half (1 1/2) spaces for each dwelling unit. 3........Two (2) spaces for each dwelling unit. 4........Two (2) spaces for each trailer unit. 5........One (1) space for each trailer space. 6. .......Four (4) spaces for each five (5) employees on the largest shift/or one (1) space per 600 square feet of gross floor area, which- ever is greater. In addition, the dimensions of up to twenty (20) percent of the total number of off-street parking spaces may be reduced to eight (8) feet in width and sixteen (16) feet in depth to accommodate compact automobiles. s ` 8) Off-street parking spaces shall be clearly marked according to -the Off-Sxreet Parking-- and Driveway Standards. � �Park- ing spaces abutting an adjoining property line or street right-of-way shall be provided with wheel guards or bum- per guards so located that no part of a normally parked vehicle will extend beyond the property line. When wheel guards are used, they shall be centered 2.5 feet from the property line for 90 degree parking, 2.3 feet for 60 degree parking, and 2.0 feet for 45 degree and 30 degree parking. 9) The Director of Transportation or his designee shall approve the layout, arrangement and design of off-street parking areas and the location of all ingress and egress points on any public street or alley upon an affirmative finding that: A. The parking spaces provided are useable for the intended purpose; B. The internal circulation pattern is safe and efficient for motorists and pedestrians; and, C. Ingress and egress will minimize interference with the orderly, safe and efficient movement of traffic on adjacent public streets. 10) Buildings and land uses within the Central Business Dis- trict shall be exempt from requirements to provide off- street parking; provided that when off-street parking is ' furnished, it shall conform to the Off-Street Parking and Driveway Standards. 11) Pedestrian access to buildings shall be provided from rights-of-way and parking areas by means of a pathway leading to at least one public entrance. Such pathway shall be cleared of all obstructions related to con- struction activity prior to the opening of the building to the general public. Where curbs exist along such pathway, as between a parking lot surface and sidewalk surface, included curb approaches or curbcuts having a gradient of not more than one (1) foot in twelve (12) feet and width of not less than four (4) feet shall be provided for access by wheelchairs. A parking lot servicing each entrance pathway should have a number of level parking spaces, as set forth in the following table, identified by above-grade signs as being reserved for physically handicapped persons; provided .that a maximum of two (2) handicapped spaces is necessary for any private use facility or for industrial uses in industrial districts. Each parking space so reserved shall conform to the design and dimensions provided in the Off-Street Parking and Driveway Standards. The minimum off-street park inFrequirements shall be reduced up to a maximum of ten (10) percent of the require- ment for those parking facilities designed to accommodate twenty (20) or more vehicles where a percent of the total parking area has been retained and developed as landscaped open space area. The percent of the landscaped open space area shall determine the maximum percent reduction which will be permitted in the total number of off-street park- ing spaces. Section 8 . That Chapter 30, Section 30-34(a) is amended to read as follows: Section 30-34( a) : Enforcement. The provisions of this chapter shall be administered and enforced by the Planning Director or his designee. Each application for a building permit shall be accompanied by a site plan in duplicate drawn to scale, showing the actual dimensions of the lot to be built upon, the size, shape, and location of the building and/or structure to be erected, and such other information as may be necessary to provide for the enforcement of this chapter. Section 9 . That Chapter 30, Section 30-40(c) is hereby amended to read as follows: Section 30-40(c) : Public Hearing and Notification Requirements. No regulation, restriction or zoning district boundary shall be amended, supplemented or changed and no specific use permit approved or revoked until after a public hearing in relation thereto is held by the Planning Commission and City Council at which parties in interest and citizens shall have an opportunity tr% he heard. At least fifteen ( 15) days' notice of the time and place of such hearing shall be published in an official paper, or a paper of general circulation in the City of Beaumont. The City Council may hold any public hearing jointly with any public hearing required to be held by the Planning Commission. Written notice of all public hearings before the Planning Commission and City Council on proposed changes in "'assification shall be sent to owners of real property lying within two hundred (200) feet of the property on which the change in classification is proposed, such notice to be given not less than ten ( 10) days before the date set for hearing, to all such owners who have rendered their said property for city taxes as the ownership appears on the last approved city tax roll. Protests must be received prior to the close of the public hearing in order to invoke the protest provisions of this section of the ordinance. Protests shall be accepted only if made in writing and the signature of one ( 1 ) owner shall be sufficient for property owned under joint tenancy. Chapter 10. That Chapter 30, Section 30-25(c) (11) is hereby amended to read as follows: Section 30-25(c) (11) : The zero-lot line concept which involves locating a residential dwelling with a doorless and windowless wall actually on one interior side yard lot line adjacent to a dwelling with a side yard that is the width of two ( 2) minimum side yards for the district in which located, shall be permitted when the appropriate building lines, necessary structural restrictions, five ( 5) foot maintenance access easement, and a maximum three (3 ) foot roof overhang easement are shown on a recorded plat which has been approved by the Planning Commission. Section 11. That Chapter 30, Section 30-38( a) of the Code of Ordinances is hereby amended to read as follows: Section 30-38( a) : Creation. The Planning Commission, created in accordance with Article XVII, Section 24, of the Charter of the City of Beaumont, shall have the duties and responsibilities of the Zoning Commission provided for in Article 1011f, Vernon' s Annotated Texas Statutes. The Planning Commission shall consist of nine (9) members who are resident citizens and qualified voters of the city. The members of the Planning Commission shall be appointed by the City Council for three ( 3) year terms or until a successor is appointed. Vacancies shall be filled for the unexpired term of any member whose position becomes vacant for any cause in the same manner as the original appointment was made. The members of the Planning Commission existing on the effective date of this chapter shall continue to serve as members of the commission until the terms for which they were originally appointed expire. Members of the commission shall serve without compensation. Failure of any regular or alternate member to attend a minimum of eighty ( 80) percent of all meetings and workshops of the Planning Commission during any calendar year shall result in automatic removal from membership on the Planning Commission. Excused absences which have been approved by the chairman of the Planning Commission shall not be counted as absences in calculating the percentage of attendance. Section 12. That Chapter 30, Section 30-31(b) (1 ) is hereby amended to read as follows: Section 30-319b) (1 ) : When a commercial or industrial use is established on a lot or premise located adjacent to any residential zoning district, or when any multiple-family dwelling use is established on a lot or premise adjacent to any property located in a single-family residential zoning district, a ten-foot width of landscaping open space buffer strip shall be installed and maintained by the owner, developer or operator of the commercial or industrial property between it and the adjacent residentially zoned property. In addition, an eight-foot high opaque fence or wall shall be erected and maintained along the property line to provide visual screening . The fence or wall shall be a wood or masonry diagonal, horizontal or vertical stockade type privacy fence although the framing may be metal. The provisions of this paragraph shall not apply where districts are separated by a public street, railroad right-of-way, drainage ditch, or canal with a minimum easement of thirty ( 30) feet. In addition, the provisions of this paragraph shall not apply when a commercial use abuts a developed non-residential use in an R-3 district. Section 13. That Chapter 30, Section 30-37 is hereby amended by adding a new sub-section (m) to read as follows: Section 30-37(m) : Validity. If an application is granted by the Board, all permits necessary for the prosecution of the work must be obtained within ninety ( 90) days and construction completed within the time established by the building code. All previous applications approved by the Board for which building permits have not been issued shall be valid only if a building permit is obtained within ninety ( 90) days after receipt of a written notice of the requirements of this section and construction must be completed within the time limits set forth in the building code. Written notice shall be considered received on the date such notice is mailed to the person, firm or corporation who received the variance addressed to the address of such person, firm or corporation as the same shall appear in the records of the Planning Department relating to the granting of such application. Section 14. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 15. That all ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only. Section 16 . That any person who violates any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.
