ENTITLED AN ORDINANCE FOR THE ISSUANCE
OF A SPECIFIC USE PERMIT FOR CLUSTER
HOUSING DEVELOPMENT ON A 12.3 ACRE
TRACT HEREIN DESCRIBED IN ACCORDANCE
WITH A "PRELIMINARY PLAT"; PROVIDING
FOR THE FILING OF A DECLARATION OF
COVENANTS AND CONDITIONS CONVERING THE
12.3 ACRE TRACT.
WHEREAS, on October 27, 1980, the Planning and Zoning
Commission of the City of Beaumont recommended the issuance of a
specific use permit for a cluster housing development to Neches
Development Company, its heirs, representatives, successors,
and assigns, for that certain 12. 3 acre tract of land hereinafter
described; and,
WHEREAS, the City Council believes that the issuance of
such specific use permit is in the best interest of the City of
Beaumont and its citizens, subject to the hereinafter described
conditions;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
Section 1.
That a specific use permit for a cluster housing
development in accordance with Section 30-20 and Section 30-23, as
amended, be granted to Neches Development Company , its heirs,
legal representatives, successors and assigns for that certain
12.3 acre tract of land, more particularly described in Exhibit
"A" and made a part hereof.
Section 2.
That this specific use permit herein granted is
expressly issued for and in accordance with that certain
"Preliminary Plat" for Village Six, Beaumont, Texas, dated
November 4 , 1980, which "Preliminary Plat" is attached hereto as
Exhibit "B" and made a part hereof for all purposes.
PASSED BY THE CITY COUNCIL of the City of Beaumont this
