ENTITLED AN ORDINANCE AMENDING CHAPTER
30 OF THE CODE OF ORDINANCES OF BEAUMONT,
TEXAS, AND IN PARTICULAR THE BOUNDARIES OF
THE ZONING DISTRICTS AS INDICATED UPON THE
ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING
A 1 .253 ACRE TRACT OUT OF THE LAUREL HEIGHTS
ADDITION, BEAUMONT, JEFFERSON COUNTY,
TEXAS, AS HEREINAFTER DESCRIBED, PRESENTLY
ZONED R-3 AND C-2 TO LR-1 ; BY CHANGING A 2 .384
ACRE TRACT OF LAND IN THE LAUREL HEIGHTS
ADDITION, BEAUMONT, JEFFERSON COUNTY,
TEXAS, AS HEREINAFTER DESCRIBED, PRESENTLY
ZONED R-3 AND C-2 TO LR-1 ; AND BY CHANGING A
2 .586 ACRE TRACT OUT OF THE LAUREL HEIGHTS
ADDITION, BEAUMONT, JEFFERSON COUNTY,
TEXAS, AS HEREINAFTER DESCRIBED, PRESENTLY
ZONED R-3 AND R-2 TO LR-1 ; PROVIDING FOR
SEVERABILITY ; AND PROVIDING A PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1 .
That Chapter 30 of the Code of Ordinances of Beaumont,
Texas, and in particular the boundaries of the zoning districts as
indicated upon the Zoning Map of the City of Beaumont, referred to
in Section 30-4 thereof, is hereby amended by changing the zoning
classification of a 1.253 acre tract of land described in Exhibit
"A" attached hereto and made a part hereof, presently zoned R-3
(Modified Two Family and Multiple Dwellings) and C-2 (Central
Commercial) to LR-1 (Local Retail District) ; by changing the
zoning classification of a 2 .384 acre tract of land described in
Exhibit "B" attached hereto and made a part hereof, presently
zoned R-3 (Modified Two Family and Multiple Dwelling) and C-2
( Central Commercial) to LR-1 (Local Retail District) ; by changing
the zoning classification of a 2.586 acre tract of land described
in Exhibit "C" attached hereto and made a part hereof, presently
zoned R-3 (Modified Two Family and Multiple Dwelling) and R-2 (Two
Family and Multiple Dwelling District) to LR-1 (Local Retail
District) , and the official Zoning Map of the City of Beaumont is
hereby amended to reflect such changes.

Section 2.
That in all other respects the use of the property
hereinabove described shall be subject to all of the applicable
regulations contained in Chapter 30 of the Code of Ordinances of
Beaumont, Texas, as amended.
Section 3 .
That in any section, subsection, sentence, clause or
phrase of this ordinance, or the application of same to a
particular set of persons or circumstances, should for any reason
be held to be invalid, such invalidity shall not affect the
remaining portions of this ordinance, and to such end the various
portions and provisions of this ordinance are declared to be
severable.
Section 4 .
Any person who violates any provision of this ordinance
shall, upon conviction, be punished as provided in Section 1-8 of
the Code of Ordinances of Beaumont, Texas.

FIELD NOTE DESCRIPTION OF TRACT NO. 1 OF THE PERLSTEIN PROPERTY
TRACT 1: BEING a 1.253 acre tract of land out of Block 3 of Laurel Heights Addition,
a subdivision recorded in Vol. 7 Page 19 of the Map Records of Jefferson
County, Texas and being out of a portion of the abandoned B S L & W Railroad
right-of-way and said 1.253 acre tract of land being more particularly des-
cribed by metes and bounds as follows:
FOR locative corner begin at a concrete monument in the North right-of-way
line of Laurel Avenue and in the East right-of-way line of 23rd Street locating
the Southeast corner of Block 4 of said Laurel Heights Addition;
THENCE North 1 degree -20 minutes West with the East line of 23rd Street a
distance of 354.59 feet to a concrete monument found for corner in the North
right-of-way line of Liberty Street locating the Southwest corner of Lot 3
Block 3 of said Laurel Heights and the Southwest and the beginning corner of
the tract of land herein described;
THENCE North 1 degree 20 minutes West with the East line of 23rd Street a
distance of 209.93 feet to a mark in concrete placed for corner in the
Southmost right-of-way line of Phelan Boulevard (a 100 foot wide right-of-
way) ;
THENCE North 88 degrees 21 minutes 30 seconds East with the Southmost line of
Phelan Boulevard a distance of 260.0 feet to a 1 inch galvanized iron pipe
placed for corner; said pipe also locates the Northwest corner of a previously
described 2.384 acre tract;
THENCE South 1 degree 20 minutes East with the upper West line of said 2.384
acre tract a distance of 209.94 feet to a 1 inch galvanized iron pipe placed
for corner in the North right-of-way line of Liberty Street; said pipe also
locates the Southeast corner of Lot 5 and the Southwest corner of Lot 6 in
said Block 3;
THENCE South 88 degrees 21 minutes 38 seconds West with the North line of
Liberty Street and with the North line of a previously described 2.586 acre
tract a distance of 260.0 feet to the place of beginning containing 1.253
acres of land.

Heights Addition, a subdivision recorded in Vol. 7 Page 19 of the Map Records
of Jefferson County, Texas and being out of a portion of the Liberty Street
right-of-way and out of a portion of the abandoned B S L & W Railroad right-
of-way and said 2.384 acre tract of land being more particularly described
by metes and bounds as follows:
FOR locative corner begin at a concrete monument in the North right-of-way
line of Laurel Avenue and in the East right-of-way line of 23rd Street; said
monument also locates the Southwest corner of Block 4 of said Laurel Heights;
THENCE North 89 degrees 26 minutes 05 seconds East with the North right-of-
way line of Laurel Avenue a distance of 320.0 feet to a 1 inch galvanized
iron pipe placed locating the Southeast corner of a 2.586 acre tract and the
Southwest and the beginning corner of the tract of land herein described;
THENCE North 1 degree 20 minutes West with the East line of said 2.586 acre
tract and with the common line of Lots 9 & 10 and 34 & 35 of said Block 4
and at 300.59 feet pass an iron stake in the South right-of-way line of Liberty
Street and continue a total distance of 330.59 feet to a 1 inch galvanized
iron pipe placed for corner in the centerline of' Liberty Street (a 60 foot
wide right-of-way) ;
THENCE South 88 degrees 21 minutes 38 seconds West with the centerline of
Liberty Street a distance of 59.98 feet to 'a. 1 inch galvanized iron pipe
placed for corner; -
THENCE North 1 degree 20 minutes West and at 30.0 feet pass a 1 inch galvanized
iron pipe locating the Southeast corner of a 1.253 acre tract and the upper
Northeast corner of said 2.586 acre tract and the common corner of Lots 5 & 6
of said Block 3 and continue a total distance of 239.94 feet with the common
line of said Lots 5 & 6 and its extension, to a 1 inch galvanized iron pipe
_placed for corner in the South right-of-way line of Phelan Boulevard (a 100
foot wide right-of-way) ; said pipe also locates the Northeast corner of a
1.253 acre tract;
THENCE North 88 degrees 21 minutes 30 seconds East with the South right-of-way
line of Phelan Boulevard a distance of 183.59 feet to a 1 inch galvanized
iron pipe placed for corner; said pipe also locates the Northwest corner of
a tract of land known as Perlstein Park;
THENCE South 1 degree 18 minutes 22 seconds East with the West line of Perlstein
Park and at 209.94 feet pass a concrete monument found in the North right-of-
way line of Liberty Street locating the Southwest corner of Perlstein Park
and continue a total distance of 239.94 feet to a 1 inch galvanized iron pipe
placed for corner in the centerline of Liberty Street;

Liberty Street a distance of 56.60 feet to a 1 inch galvanized iron pipe
placed for corner;
THENCE South 1 degree 18 minutes 06 seconds East and at 30.0 feet pass a
concrete monument found in the South right-of-way line of Liberty Street
locating the Northwest corner of that certain 2.30 acre tract of land con-
veyed by T. E. Moore and Peter W. Maida to Robert Q. Keith, Trustee by deed
dated October 4, 1972 and recorded in Vol. 1752 Page 265 of the Deed Records
of Jefferson County, Texas, and continue with the West line of said tract
a total distance of 333.97 feet to a concrete monument found for corner in
the North right-of-way line of Laurel Avenue locating the Southwest corner
of said Keith tract ;
THENCE South 89 degrees 26 minutes 05 seconds West with the North right-of-
way line of Laurel Avenue a distance of 179.93 feet to the place of beginning
containing 2.384 acres of land.

TRACT 3: BEING a 2.586 acre tract of land out of Black 4 of Laurel Heights Addition,
a subdivision recorded in Vol. 7 Page 19 of the Map Records of Jefferson
County, Texas and being out of a portion of the Liberty Street right-of-way
and said 2.586 acre tract of land being more particularly described by metes
and bounds as follows:
BEGINNING at a concrete monument found in the North right-of-way line of Laurel
Avenue and in the East right-of-way line of 23rd Street locating the Southwest
corner of said Block 4 and the Southwest and the beginning corner of the tract
of land herein described;
THENCE North 1 degree 20 minutes West with the East right-of-way line of 23rd
Street and at 294.59 feet pass a concrete monument found in the South right-
of-way line of Liberty Street and continue a total distance of 354.59 feet to
a concrete monument found for corner in the North right-of-way line of Liberty
Street; said monument also locates the Southwest corner of a 1.253 acre tract
and the Southwest corner of Block 3 of said Laurel Heights;
THENCE North 88 degrees 21 minutes 38 seconds East with the North line of
Liberty Street and the South line of said 1.253 acre tract a distance of 260.0
feet to a 1 inch glavanized iron pipe placed for corner; said pipe also locates
the Southeast corner of said 1.253 acre tract and the Southeast corner of Lot 5
and the Southwest corner of Lot 6 of said Block 3;
THENCE South 1 degree 20 minutes East with the upper- West line of a previously
described 2.384 acre tract and with the extension of the common line of said
Lots 5 & 6 a distance of 30.0 feet to a 1 inch. galvanized iron pipe placed
for corner in the centerline of Liberty Street;
THENCE North 88 degrees 21 minutes 38 seconds East with the centerline of Liberty
Street a distance of 59. 98 feet to a 1 inch galvanized iron pipe placed for
corner;
THENCE South 1 degree 20 minutes East and at 30.0 feet pass an iron stake in the
South right-of-way line of Liberty Street locating the common corner of Lots
34 & 35 of said Block 4 and continue with the common line of Lots 34 & 35 and
9 & 10 of said Block 4 and with the West line of a 2.384 acre tract a total
distance of 330.59 feet to a 1 inch galvanized iron pipe placed for corner in
the North right-of-way line of Laurel Avenue locating the Southwest corner of
said 2. 384 acre tract and the common corner of said Lots 9 & 10;
