ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING A 1 .03 ACRE TRACT OUT OF THE FREDRICK BIGNER SURVEY, BEAUMONT, JEFFERSON COUNTY, TEXAS, AS HEREINAFTER DESCRIBED, PRESENTLY ZONED R-2 TO LR-1; PROVIDING FOR SEVERABILITY ; AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT Section 1. That Chapter 30 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts as indicated upon the Zoning Map of the City of Beaumont, referred to in Section 30-4 thereof, is hereby amended by changing the zoning classification of a 1.03 acre tract of land described in Exhibit "A" attached hereto and made a part hereof, presently zoned R-2 (Two Family and Multiple Dwelling) to LR-1 (Local Retail District) , and the official zoning map of the City of Beaumont is hereby amended to reflect such changes. Section 2 . That in all other respects the use of the property hereinabove described shall be subject to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended. Section 3 . That in any section, subsection, sentence, clause, or phrase of this ordinance, or the application of same to a particular set of persons or circumstances , should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 4 . Any person who violates any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas. A. Collier Estate Subdivision, as it is recorded in Vol. 3 Page 119 of the Map Records of Jefferson County, Texas and being also a part of Lot 7, all of Lot 8 and a part of Lot 9 of the Robert L. Collier Subdivision of said Lot 7 of the Mrs. V. A. Collier Estate Subdivision as said Robert L. Collier Subdivision is recorded in Vol. 294 Page 40 of the Deed Records of Jefferson County, Texas and said 1.03 acre tract of land being more particularly described by metes and bounds as follows: FOR locative corner begin at an iron rod found in the West right-of-way line of U. S. Highway No. 69, 96 & 287 and in the South right-of-way line of Odom Road (a 40 foot wide right-of-way) ; THENCE North 88 degrees 40 minutes West with the South line of said Odom Road a distance of 553.67 feet to a 1 inch galvanized iron pipe placed for the Northwest corner of that certain tract of land described in deed from E. H. Rhodes, et ux to the North End Baptist Church of Beaumont as recorded in Vol. 1931 Page 417 of the Deed Records of Jefferson County, Texas and locating the Northeast and the beginning corner of the tract of land herein described; THENCE South 0 degrees 33 minutes 33 seconds East with the West line of said North End Baptist Church tract a distance 6f' 186.99 feet to a 5/8 inch iron rod placed in the South line of Lot 7 of said Mrs. V. A. Collier Estate Sub- division and in the North line of that certain 4.525 acre tract of land conveyed by R. P. Rhodes to the North End Baptist Church of Beaumont by deed recorded in Vol. 1931 Page 404 of the Deed Records of Jefferson County, Texas; THENCE South 0 degrees 51 minutes 22 seconds East a distance of 29.33 feet to a 1 inch galvanized iron pipe placed for corner; said pipe also locates the Northeast corner of a previously described 75,240 square foot tract of land; THENCE North 88 degrees 35 minutes 37 seconds West with the North line of said 75,240 square foot tract a distance of 207.70 feet to a 1 inch galvanized iron pipe placed for corner in the East line of the First Church of God tract ; THENCE North 0 degrees 51 minutes 22 seconds West with said line a distance of 28.82 feet to a C. A. Kohler concrete monument found in the South line of Lot 7 of the Mrs. V. A.
