ENTITLED AN ORDINANCE APPROVING AN
EXPERIMENTAL TIME-OF-DAY RATE SCHEDULE
TO BE CHARGED BY GULF STATES UTILITIES
COMPANY IN THE CITY OF BEAUMONT, TEXAS,
PROVIDING FOR AN EFFECTIVE DATE FOR SUCH
RATE SCHEDULE, AND PROVIDING CONDITIONS
UNDER WHICH SUCH RATE SCHEDULE MAY BE
CHANGED, MODIFIED, AMENDED OR WITHDRAWN.
WHEREAS, on April 11, 1980, Gulf States Utilities
Company filed with the City of Beaumont a request for authority
to institute an experimental Time-of-Day rate within the City,
applicable to certain volunteer residential customers approved
by Gulf States Utilities Company; and,
WHEREAS, the City having considered the same as
required by law, is of the opinion and finds that the experi-
mental Time-of-Day rate should be approved.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
That the request by Gulf States Utilities Company
for authority to institute an experimental Time-of-Day rate
applicable to certain volunteer residential customers approved
by Gulf States Utilities Company be and it is hereby approved.
Said rate schedule shall be effective from May 1, 1980 until
January 1, 1982.
Section 2.
That the action of the City Council of the City of
Beaumont enacting this Ordinance constitutes, on the date of
its final passage, a final determination of approval of Rate
Schedule TOD (Experimental) , a copy of which is attached hereto,
by the City of Beaumont in accordance with Section 43 (e) of the
Public Utility Regulatory Act. Such Schedule, as same may be
modified or amended, shall be effective from and after final
passage of this ordinance in accordance with its terms, and

shall apply to all power and energy used by each affected
customer under such rate Schedule TOD (Experimental) after
May 1, 1980, until January 1, . 1982 , unless such customers
elect not to continue to receive service under such rate
schedule in accordance with its terms.
Section 3.
Nothing in this Ordinance shall be construed now
or hereafter as limiting or modifying, in any manner, the
right and power of the City under the law to regulate the
rates and charges of Gulf States Utilities Company.
Section 4.
The thirty-five (35) day waiting period for
implementation of rates is waived in accordance with Section
43 (b) of the Public Utility Regulatory Act.

SCHEDULE TOD (EXPERIMENTAL)
I. Applicability
This rate is applicable under the regular terms and conditions of the Company
for all domestic purposes in single family residences or individual apartments.
Service will be single-phase 120/240 volt, three-wire only, where such service
is available. Customer must agree to the installation of special metering
equipment. Resale, breakdown, or auxiliary service is not applicable hereunder.
Availability is limited at any time to 150 volunteer customers approved by the
Company. Customers on this rate schedule may not transfer to another schedule
during the months of June through October and are not eligible for billing under
any equal payment plan such as the Company;s Rider EP.
II. Monthly Bill
The monthly bill shall be the sum of A and B as determined below.
A. Monthly Rate
A-1 For the billing months of November through May:
First 50 KWH or less used: $5.00
All additional KWH used in billing period: 2.32 /KWH
A-2 For the billing months of June through October:
$5.50 plus:
For all KWH used between 2 p.m. and 6 p.m. CDT weekdays: 10.7 /KWH
For all KWH used between 10 a.m. and 2 p.m. CDT and
6 p.m. and 10 p.m. CDT weekdays: 3.7�/KWH
For all additional KWH used: O.1C/KWH
In the event time-based meter readings are not available, all KWH
shall be billed at 2.85 /KWH.
A-3 The customer will be allowed a prompt payment discount from the amount
calculated in A-1 or A-2 above if payment is received by Company prior
to prompt payment date set forth on Customer's bill,- such date being
not less than 20 days after the meter reading date. The discount will
be 5% of the first $50 plus 20 of any charges above $50 under A-1 or
A-2 above.
A-4 The minimum monthly charge shall be $5.00 for A-1 and $5.50 for A-2.
B. Fuel Adjustment
The fuel adjustment will be calculated based upon the total KWH included
in the monthly bill times the adjustment per KWH for the current month, calculated
in accordance with Rate Schedule FA.
