ENTITLED AN ORDINANCE AMENDING THE
BUDGET OF THE CITY OF BEAUMONT BY
TRANSFERRING $88, 000 FROM UNOBLIGATED
FUNDS IN THE WATER UTILITIES ACCOUNT
TO THE STREET SYSTEM IMPROVEMENT FUND;
PROVIDING FOR SUPPLEMENTARY AGREEMENTS
TO THE 1979 AND 1980 STREET MAINTENANCE
CONTRACTS; PROVIDING FOR THE EMERGENCY
PURCHASE OF 1, 000 INCREASER RINGS;
AND PROVIDING FOR SEVERABILITY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
That the budget of the City of Beaumont for the
period commencing October 1, 1979 ending September 30, 1980
be and the same is hereby amended by transferring $88, 000
from unobligated resources in Account No. 211, the Water
Utilities Fund, to the Street System Improvement Fund.
Section 2.
That the City Manager be, and he is hereby,
authorized to execute supplementary agreements to the 1979
and 1980 street maintenance contracts with F. Gatlin Asphalt
Company, Trotti & Thomson Company, Bella Company, and A. F.
Jones & Sons=, Inc. The supplementary agreements will provide
a unit price for labor for the adjustment of the existing
manhole covers within the streets to be repaired under the
contracts these companies have with the City of Beaumont.
Section 3.
That the City Manager be, and he is hereby,
authorized to purchase, as an emergency item, 1, 000 increaser
rings from Municipal Casting Company of Texas and pay there-
fore the amount of $39, 900. These rings will be used to
raise manhole covers to the new level of streets under
construction.

Section 4.
That if any section, subsection, sentence, clause
or phrase of this ordinance, or the application of same to
a particular set of persons or circumstances, should for
any reason be held to be invalid, such invalidity shall not
affect the remaining portions of this ordinance, and to such
end the various portions and provisions of this ordinance
are declared to be severable.
