ENTITLED AN ORDINANCE REPEALING SECTION 24-2
OF CHAPTER 24 OF TBE CODE OF ORDINANCES OF
THE CIT'Y OF BEAUMONT, TEXAS AND ENACTING
A NEW SECTION 24-2 RELATIVE TO GENERAL
SUBDIVISION REQUIREMM4TS; AMENDING SECTIONS
24-3 and 24-4 OF THE CODE OF ORDINANCES BY
ADDING SUBSECTIONS 24-3(8) AND 24-4(4) ,
RESPECTIVELY, RELATIVE TO PRELIMINARY AND
FINAL PLAT REQUIREMENTS; AND ADDING NEW
SECTION 24-8 TO CHAPTER 24 OF THE CODE OF
ORDINANCES RELATIVE TO ISSUANCE OF CERTAIN
BUILDING PERMITS AND UTILITY CONNECTIONS;
PROVIDING FOR SEVERABILITY; PROVIDING FOR
REPEAL; PROVIDING A PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
THAT Section 24-2 of Chapter 24 of the Code of Ordinances of
the City of Beaumont, Texas be repealed and a new Section 24-2 be added
thereto as follows:
Seca 24-2. GENERAL REQUIREMENTS
a) Except as otherwise provided herein, every owner of land
situated within the City of Beaumont or within the extraterritorial
jurisdiction thereof, who divides such tract into two or more lots,
building sites, parcels, units, interests, or other fractional
parts thereof, or who negotiates the sale of any such lots, building
sites, parcels, units, or interests, or other fractional parts
thereof, shall first cause a plat to be prepared in accordance with
the provisions of this ordinance. The description of such lots, build-
ing sites, units or interests by metes and bounds or by other reference
in an instrument of transfer shall not exempt the transaction from the
provisions of this ordinance.
b) No improvements shall be started until a preliminary plat of
said subdivision has been approved by the Planning Commission after
which, improvements may be started in accordance with such preliminary
plat.
c) Preliminary and final plats required to be submitted herein
shall be submitted to the Department of Planning not less than twenty-
one (21) days prior to the Planning Commission meeting at which
consideration of said plat is requested.

Section 2.
THAT Section 24-3 of Chapter 24 of the Code of Ordinances
be amended by adding subsection (8) thereto as follows:
(8) A preliminary plat shall not be required for the
subdivision or resubdivision of a tract of land provided
the following conditions exist or have been met:
a) Each block and subdivided lot fronts upon a
dedicated street.
b) All utilities, easements and improvements required
to serve each block and lot are in place in accordance with
this Chapter.
c) The resulting lots meet the minimum lot area, width,
depth, and yard regulations for the zoning district in which
the property is located; and
d) Existing buildings and structures located on the lots
are in compliance with the fire wall regulations of the building
code.
Section 3.
THAT Section 24-4 of Chapter 24 of the Code of Ordinances be
amended by adding subsection (4) thereto as follows:
(4) Mandatory Approval. The Planning Commission shall approve
the final plat of a subdivision or resubdivision of land when the
final plat and supporting instruments comply with the final plat
specifications and requirements as herein provided and the
exemptions for filing a preliminary plat under Section 24-3 have
been met.
Section 4.
THAT Chapter 24 of the Code of Ordinances be amended by adding
a new section 24-8 thereto as follows:
Sec. 24-8. BUILDING PERMITS - UTILITIES
a) No building permit shall be issued for any new structure
or improvement or for any alteration of any existing structure or
any tract of land which has not been subdivided in accordance with
the requirements of this Chapter.

b) No water or sewer utilities shall be furnished to any
structure upon any tract of land which has not been subdivided in
accordance with the requirements of this Chapter.
Section 5.
That if any section, subsection, sentence, clause or phrase
of this ordinance, or the application of same to a particular set of
persons or circumstances, should for any reason be held to be invalid,
such invalidity shall not affect the remaining portions of this ordinance,
and to such end the various portions and provisions of this ordinance
are declared to be severable.
Section 6.
All ordinances or parts of ordinances in conflict herewith are
hereby repealed to the extent of the conflict only.
Section 7.
Any person who violates any provision of this ordinance shall,
upon conviction, be punished as provided in Section 1-8 of the Code of
Ordinances of Beaumont, Texas.
