ORDINANCE NO.
ENTITLED AN ORDINANCE AMENDING CHAPTER
30 OF THE CODE OF ORDINANCES OF BEAUMONT,
TEXAS, AND IN PARTICULAR THE BOUNDARIES
OF THE ZONING DISTRICTS AS INDICATED
UPON THE ZONING MAP OF BEAUMONT, TEXAS,
BY CHANGING A 9.36 ACRE TRACT OUT OF THE
CHARLES WILLIAMS LEAGUE, BEAUMONT,
JEFFERSON COUNTY, TEXAS, AS HEREINAFTER
DESCRIBED, PRESENTLY ZONED R-1 TO R-2;
PROVIDING FOR SEVERABILITY; AND PROVIDING
A PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
That Chapter 30 of the Code of Ordinances of Beaumont, Texas,
and in particular the boundaries of the zoning districts as indicated
upon the Zoning Map of the City of Beaumont, referred to in Section 30-4
thereof, is hereby amended by changing the zoning classification of the
following described tract of land, presently zoned R-1 (Single Family
Dwelling) to R-2 (Two Family and Multiple Dwelling) to wit:
BEING a 9.36 acre tract of land out of the Charles
Williams League, Abstract No. 59 in Beaumont,
Jefferson County, Texas, being particularly
described by metes and bounds as follows:
FOR locative corner begin at a concrete
monument in the South right-of-way line of
College Street and lying in the West line of
the Langham 78.58 acre tract of land that was
previously conveyed to the City of Beaumont
and lying in the East line of that certain
tract of land conveyed by C. E. Davis, et al
to W. C. Beard, et ux by deed dated February 25,
1936, and recorded in Vol. 411 Page 253 of
the Deed Records of Jefferson County, Texas;
from said concrete monument the original
Northeast corner of said Davis tract bears
North 1 degree 15 minutes 15 seconds West a
distance of 36.0 feet;
THENCE South 1 degree 15 minutes 15 seconds
East with the East line of the Davis tract
and the West line of said Langham tract a
distance of 235.49 feet to a 1 inch galvanized
iron pipe placed locating the Southeast corner
of said Davis tract and the northeast and the
beginning corner of the tract of land herein
described;
THENCE South. 1 degree 15 minutes 15 seconds
East with the West line of said Langham tract
and with the East line of said 23.13 acre tract
of land a distance of 400.04 feet to a 1 inch
galvanized iron pipe placed for corner from
which a galvanized iron pipe in concrete for
the Southeast corner of said 23.13 acre tract
of land bears South 1 degree 15 minutes
15 seconds East a distance of 55.39 feet;
THENCE South 89 degrees 34 minutes West a
distance of 1023.22 feet to a 1 inch galvanized
iron pipe placed for corner in the East line
of the proposed extension of Pinchback Road;
THENCE North 0 degrees 26 minutes West with
said line a distance of 400.0 feet to a 1 inch
galvanized iron pipe placed for corner in the
South line of the R. T. Pinchback 6.27 acre
tract; from said pipe a 1 inch galvanized
iron pipe in the South right-of-way line of
College Street bears North 0 degrees 26
minutes West a distance of 235.40 feet;
THENCE North 89 degrees 34 minutes East with
the South line of said 6.27 acre tract and
with the South line of the following described
tracts of land:
J. E. Taylor to W. G. Conover, Vol. 349 Page 170,
dated August 18, 1930; J. E. Taylor to W. G.
Conover, Vol. 349, Page 171, dated August 18,
1930; Clarence Gabriel Hebert, Sr. , et ux to
James L. Massey, et ux, Vol. 886, Page 53,
dated February 18, 1953. Apart of that
tract conveyed. by H. M. Mitchell, et ux to
Mrs. James Stovall, Vol. 333 Page 2, dated
September 19,1929
The aforementioned C. E. Davis tract a distance
of 1017.49 feet to the place of beginning
containing 9.36 acres of land.
and the official Zoning Map of the City of Beaumont is hereby
amended to reflect such changes.
Section 2.
That in all other respects the use of the property here-
inabove described shall be subject to all of the applicable
regulations contained. in Chapter 30 of the Code of ordinances
of Beaumont, Texas, as amended.
Section 3.
That if any section, subsection, sentence, clause or phrase
of this ordinance, or the application of same to a particular set of
persons or circumstances, should for any reason be held to be invalid,
such invalidity shall not affect the remaining portions of this ordinance,
and to such end the various portions and provisions of this ordinance
are declared to be severable.
Section 4.
Any person who violates any provision of this ordinance shall,
upon conviction, be punished as provided in Section 1-8 of the Code of
Ordinances of Beaumont, Texas.
