ENTITLED AN ORDINANCE AMENDING CHAPTER
30 OF THE CODE OF ORDINANCES OF BEAUMONT,
TEXAS, AND IN PARTICULAR THE BOUNDARIES
OF THE ZONING DISTRICT'S AS INDICATED
UPON THE ZONING MAP OF BEAUMONT, TEXAS,
BY CHANGING A 8.9 ACRE TRACT OUT OF THE
H. WILLIAMS SURVEY, BEAUMONT, JEFFERSON
COUNTY, TEXAS, AS HEREINAFTER DESCRIBED,
PRESENTLY ZONED R-2 TO LR-1; PROVIDING
FOR SEVERABII,ITY; AND PROVIDING A PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
That Chapter 30 of the Code of Ordinances of Beaumont,
Texas, and in particular the boundaries of the zoning districts
as indicated upon the Zoning Map of the City of Beaumont,
referred to in Section 30-4 thereof, is hereby amended by changing
the zoning classification of the following described tract of land,
presently zoned R-2 (TWo Family and Multiple Dwelling) to LR-1 (Local
Retail District) to wit:
BEING an 8.936 acre tract of land out of a 17.414
acre tract located in the H. Williams Survey,
Abstract 56, Beaumont, Jefferson County, Texas;
BEGINNING at an iron rod in the East right-of-way
line of Major Drive, said point being the Northwest
corner of the 8.936 acre tract herein described,
said corner being located. South 00 02' 58" East,
300.0 feet from the point of intersection of the
South right-of-way line of Gladys Avenue and the
East right-of-way line of Major Drive, being the
Northwest corner of the 17.414 acre tract and also
being the Northwest corner of a 20.4 acre tract
formerly known as the Viola V. Stagg tract as
recorded in Volume 903, Page 477 of the Deed Records
of Jefferson County, Texas;
THENCE North 890 57' 05" East along the North line
of the 8.936 acre tract, a distance of 582.68 feet
to a point for corner located in the centerline of
a 60.0 foot wide drainage right-of-way;
THENCE South 38° 26' 17" East long the North-
easterly line of the said 17.414 acre tract and
being the Northeasterly line of the 8.936 acre
tract herein described, being along the centerline
of a 60.0 foot wide drainage right-of-way as
recorded in Volume 1650, Page 88, of the Deed
Records of Jefferson County, Texas, for a distance
of 285.81 feet to a point;
THENCE South 18° 12' 29" East continuing along the
centerline of said drainage right-of-way, a distance
of 310.94 feet to a point for the Southeast corner
of the herein described 8.936 acre tract;
THENCE South 89° 57' 39" West along the South line of
the herein described 8.936 acre tract, a distance of
857.08 feet to an iron rod for the Southwest corner
of said 8.936 acre tract, said corner being located
in the West line of the 17.414 acre tract;
THENCE North 001 02' 58" West along the West line of
the 17.414 acre tract and along the East right-of-way
line of Major Drive, a distance of 519.33 feet to the
PLACE OF BEGINNING, containing in area 8.936 acres
of land, more or less.
and the official Zoning Map of the Cite of Beaumont is hereby amended
to reflect such changes.
Section 2.
That in all other respects the use of the property here-
inabove described shall be subject to all of the applicable regulations
contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas,
as amended.
Section 3.
That if any section, subsection, sentence, clause or phrase
of this ordinance, or the application of same to a particular set of
persons or circumstances, should for any reason be held to be invalid,
such invalidity shall not affect the remaining portions of this ordinance,
and to such end the various portions and provisions of this ordinance
are declared to be severable.
Section 4.
Any person who violates any provision of this ordinance shall,
upon conviction, be punished as provided in Section 1-8 of the Code of
Ordinances of Beaumont, Texas.
