ENTITLED AN ORDINANCE SETTING
RESIDENTIAL AND SMALL CONMERCIAL
RATES FOR ENTEX, INC.; PROVIDING
FOR SEVERABILITY; AND PROVIDING
FOR REPEAL.
WHEREAS, on August 12, 1979, Entex, Inc. filed an application
with the City of Beaumont for an increase in rates for residential
and small commercial customers; and,
WHEREAS, the rate increase proposed by Entex, Inc. would
provide additional annual revenue of $1,302,086 from the Beaumont
Distribution System; and,
WHEREAS, the City Council has engaged the firm of Touche,
Ross and Company to study the proposed rate increase; and,
WHEREAS, a public hearing has been conducted; and,
WHEREAS, East Texas Legal Services, representing Jean
Holland and other low-income consumers, has filed a petition to
intervene, which has not been granted; and,
WHEREAS, East Texas Legal Services, in behalf of its clients,
has been allowed to participate and provide information in this matter;
and,
WHEREAS, the City Council of the City of Beaumont finds that
the revenue deficiency for Entex, Inc. in the Beaumont Distribution
System for the year ending December 31, 1978, was $730,346; and,
WHEREAS, the City Council finds that there are unamortized
rate case expenses from Gas Utilities Docket 710 in the amount of
$39,475.00 still to be recovered by Entex, Inc.; and,
WHEREAS, the rates established herein will produce additional
annual revenues for Entex, Inc. from its Beaumont Distribution System
in the amount of $698,400; and,
WHEREAS, the City Council is of the opinion that the unamortized
rate case expenses from Docket 710 should be recovered through an eight

(8 } cents per bill surcharge until all unamortized rate case expenses
have been collected;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT: SECTION I
That Entex, Inc. , is hereby authorized to place into effect within the
Beaumont Distribution System the rate schedules attached hereto labeled
Rate Schedule No. SC-511-2 and Rate Schedule No. R-511-2.
SECTION II
That if any section, subsection, sentence, clause or phrase
of this ordinance, or the application of same to a particular set of
persons or circumstances, should for any reason be held to be invalid,
such invalidity shall not affect the remaining portions of this
ordinance, and to such end the various portions and provisions of this
ordinance are declared to be severable.
SECTION III
All ordinances or parts of ordinances in conflict herewith
are repealed to the extent of the conflict only.

RATE SCHEDULE NO. -511-2
APPLICATION OF SCHEDULE
This schedule is arpZicable to consumers using gas 'or purposes other than residential
whose consumption it any ,month is Zess than 150,000 cubic Feet. When a customer uses
in excess of 150,000 cubic ,=eet in any month, the consumer shall be biZZed on the
applicable Zarge volume rate schedule. NaturaZ gas supplied hereunder is for the
individuaZ use of the customer at one point of delivery and shall not be resold or
shared with others.

Monthly bills are due and payable within ten (10) days from the date of the bill.
PURCHASED GAS ADJUSTMENT PROVISION
^"ne above net monthly rate per unit sold is predicated upon a price of gas purchased
for resale hereunder of 36.7 cents per ,Vcf. To the extent that Entex's price OF
gas to be purchased (adjusted to correct any prior variations from actuaL costs) for
resale hereunder increases or decreases, said net mcnthZy rate shaZZ be adjusted up
or down to ref�,ect (i) changes in such cost Of gas per unit sold and (ii) changes in
gross receipts taxes resulting from such increases or decreases in the net monthly rate.
For purposes Of caZcualting said adjustment, it shaZZ be rrcper fop Entex to determine
its cost of gas -From its several suppliers and the cross receipts taxes to be Maid on the
basis of a logical geographical area. V
if Entex receives any refunds of any increased cost of purchased gas that have
'Deen passed on under this rrovision, a refund shaZZ be made to consumers served by
this rate schedule.
REGULATORY EXPENSE RECOVERY PROVISION
The company shaZZ be entitled to recover the urmnortized portion of rate case expenses

539,_75 and cross receipts taxes thereon. Such
expense shaZZ be recovered by adding a surcharge of 5.08 to each bill rendered under this

APPLICATION OF SCHEDULE
This schedule is applicable to consumers receiving gas for uses usual in a home through a
single meter serving a single family dwelling and its related structures. Natural gas
supplied hereunder is for the individual use of the customer at one point of delivery and
shall not be resold or shared with others.
NET MONTHLY RATE
First 600 cubic feet or less $4.07
Next 2,400 a 1.4500 per 1000 cubic feet
