ENTITLED AN ORDINANCE AMENDING CHAPTER 26
SEC'T'ION 26-11 OF THE CODE OF ORDINANCES OF
THE CITY OF BEAUMONT TO PROVIDE FOR THE
USE OF THE PORTION OF MULTIMAX VILLAGE
PRESENTLY DESIGNATED FOR MINI-BIKE AND
SMALL MDTORCYCLE USES FOR OTHER DESIGNATED
CITY USES; AUTHORIZING AN AGREEMENT WITH
THE SPINDLETOP YOUTH SOCCER ASSOCIATION;
PROVIDING FOR SEVERABILITY; PROVIDING FOR
REPEAL AND PROVIDING A PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
That Chapter 26, Section 26-11 of the Code of Ordinances be
and the same is hereby amended to read as follows:
Sec. 26-11. Mini-bike and small motorcycle area.
A portion of the property known as Multimax Village, bounded
by the service road of Interstate 10, St. Helena Street, Caldwell Street,
and a line parallel to and six hundred forty-four (644) feet east of
St. Helena Street may be used by two wheel mini-bikes and motorcycles of
less than one hundred (100) c.c. displacement during daylight hours under
the following limitations:
(1) Only persons under the age of fifteen (15) years may
ride mini-bikes and motorcycles on said property.
(2) All mini-bikes and motorcycles shall be equipped with
an adequate muffler.
(3) All riders must be accompanied and continuously
supervised by a person eighteen (18) years of age
or older.
(4) All mini-bikes and motorcycles shall be transported
to the premises in a licensed and registered vehicle.
(5) No mini-bike or motorcycle operated on the premises
shall be registered by the state for operation on
public roads and highways.
(6) The property described in this section may not be used
for mini-bike and motorcycle operation when such use
will interfere with other city-permitted uses.
(7) The property described in this section shall not be
available for the uses herein described during the
month of April each year.
The designation of this property temporary only, and such
designation shall never be construed as establishing said property as
a park.
Section 2.
The City Manager be, and he is hereby, authorized to execute
an agreement with the Spindletop Youth Soccer Association for the use
of the portion of Multimax property bounded by the west side of the
Bribe Didrikson Foundation property, Interstate 10, St. Helena and
Caldwell Streets as a soccer field.
Section 3.
That if any section, subsection, sentence, clause or phrase
of this ordinance, or the application of same to a particular set of
persons or circumstances, should for any reason be held to be invalid,
such invalidity shall not affect the remaining portions of this
ordinance, and to such end the various portions and provisions of this
ordinance are declared to be severable.
Section 4.
All ordinances or parts of ordinances in conflict herewith
are repealed to the extent of the conflict only.
Section 5.
Any person who violates any provision of this ordinance shall,
upon conviction, be punished as provided in Section 1-8 of the Code of
Ordinances of Beaumont, Texas.
