ORDINANCE NO.
ENTITLED AN ORDINANCE DESIGNATING THE WILSON
ME7,70RTAL ART CENTER, BLOCK 38 OF THE AVERILL
ADDITION TO THE CITY OF BEAUMNT,A PLACE OF
ARCHITECTURAL AND CULTURAL IMPORTANCE; PRO-
VIDING REGULATIONS APPLICABLE THERETO; AMENDING
THE ZONING MAP OF THE CITY OF BEAUMONT TO PERM-IT
THE OPERATION OF AN ART MUSEUM! UPON SAID TRACT
OF LAND; PROVIDING SEVERABILITY; AND PROVIDING
A PENALTY.
W[MREAS, the hereinafter described tract of land, and structures
standing thereon, is the Wilson Memorial Art Center which was donated to
the City of Beaumont in 1969 in memory of J. Cooke Wilson and Mary Randolph
Wilson; and,
WHEREAS, the subject land and structures standing thereon were
donated to the City of Beaumont to be used as an art museum and are being
operated as such by the Beaumont Art Museum; and,
WHEREAS, the operation of the art museum in accordance with the
deed of gift is a variance in the use of such premises in violation of the
R-1 zoning regulations applicable to said tract of land; and,
WHEREAS, the structure located upon said tract of land is an
outstanding example of Regency-style architecture; and,
WFMREAS, the said tract of land and structures thereon are hereby
found to be of significant architectural and cultural importance and signi-
ficance; and,
WHEREAS, it is deemed desirable to amend the zoning of such pre-
mises in such a manner as to permit the continuation of the operation of
the Wilson Memorial Art Center and the maintenance and preservation of the
grounds as they currently exist, but in all other respects to maintain the
underlying zoning of said premises as R-1; and,
WHEREAS, it is the desire of the City Council to amend the zoning
map of the City of Beaumont to permit and validate the continued operation
of the Wilson Memorial Art Center and the continued maintenance of the
grounds all in accordance with the original deed of gift from the Wilson
family to the City of Beaumont;
NOW, THEREFORE, BE IT ORDAIISE D By THE
CITY OF BEAL]MONT:
That the following described tract of land, to wit:
Lot Number One (1) through Twenty-six (26)
in Block Number Thirty-eight (38) of the
Averill Addition to the City of Beaumont,
Jefferson County, Texas
is hereby designated as a place of architectural and cultural importance
and significance, and the regulations contained in this ordinance
shall apply within the above described tract of land.
Section 2.
A. The above described tract of land shall be used only for
the purposes of an art museum, and if such use as an art museum be
discontinued, the zoning of said tract of land shall continue as R-1,
and no use shall be permitted except in conformance with the regulations
applicable in R-1 zones.
B. There shall be no exterior alteration, enlargement modi-
fication, or razing of the structure currently located on the above-
described tract of land.
C. The interior of such structure may be modified at the
discretion of the owners or tenants in accordance with their agreements
and obligations to provide for the receiving, shipping, preparing
or storing of art exhibits.
D. There shall be no enlargement of any parking lot located
on the premises, no construction on any portion of the grounds of new
structures of any kind, and no significant or substantial modification
to the grounds as they now exist.
Section 3.
The zoning map of the City of Beaumont, referred to in the
Code of Ordinances of Beaumont, Texas, is hereby amended to reflect
the zoning change above set forth. In all other respects, the use of
the tract of land hereinabove described shall continue as currently
zoned, R-1, and shall be subject to all of the regulations applica-
ble in such zone as contained in the zoning ordinance of the City of
Beaumont as amended.
Section 4.
That if any section, subsection, sentence, clause or phrase
of this ordinance, or the application of same to a particular set of
persons or circumstances, should for any reason be held to be invalid,
such invalidity shall not affect the remaining portions of this
ordinance, and to such end the various portions and provisions of this
ordinance are declared to be severable.
Section 5.
Any person who violates any provision of this ordinance shall,
upon conviction, be punished as provided in Section 1-8 of the Code of
Ordinances of Beaumont, Texas.
