ENTITLED AN ORDINANCE AUTHORIZING
THE CITY MANAGER TO EXECUTE A CON-
TRACT IN THE AMOUNT OF $101,318 TO
E. R. DUPUIS; AND AUTHORIZING THE
ACCEPTANCE OF THE FINAL PAVING
ASSESSMENT ROLL; PROVIDING FOR
SEVERABILITY AND PROVIDING FOR
REPEAL.
WHEREAS, the City of Beaumont has heretofore ordered
the improvement of Collier Road from Berry Road to Drainage
Ditch No. 5 under the City' s Assessment Paving Program; and,
WHEREAS, bids were received for the improvement of
said street; and,
WHEREAS, E. R. Dupuis Concrete Company, Inc. submitted
a bid in the amount of $101, 318 ; and,
WHEREAS, the City Council is of the opinion that the
bid submitted by E. R. Dupuis Concrete Company, Inc. is the lowest
and best bid and should be accepted;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
Section 1.
THAT the bid of E. R. Dupuis Concrete Company, Inc.
in the amount of $101, 318 be, and the same is hereby, accepted
by the City of Beaumont, and the City Manager is hereby authorized
to execute a contract for said improvements.
Section 2.
THAT the City Council hereby approves and adopts the
Final Assessment Paving Roll on Collier Road from Berry Road to
Drainage Ditch No. 5, as follows: (See Exhibit A)
Section 3.
That if any section, subsection, sentence, clause or
phrase of this ordinance, or the application of same to a par-
ticular set of persons or circumstances, should for any reason
be held to be invalid, such invalidity shall not affect the
remaining portions of this ordinance, and to such end the various
portions and provisions of this ordinance are declared to be
severable.
Section 4.
All ordinances or parts of ordinances in conflict
herewith are repealed to the extent of the conflict only.
