ENTITLED AN ORDINANCE SUSPENDING THE
OPERATION OF PROPOSED RATE SCHEDULES OF
ENTEX, INC.; CALLING A PUBLIC HEARING
THEREON; AUTHORIZING EWLOYMENT AND PAYMENT!'
OF CONSULTANTS; ASSESSING THE EXPENSES OF
THIS PROCEEDING AGAINST ENTEX, INC.; AND
PROVIDING FOR SEVERABILITY.
WHEREAS, on April 12, 1979, Entex, Inc. filed its Statement
of Intent to change rates for natural gas service to residential
and small commercial customers within the City of Beaumont effective
May 17, 1979; and,
WHEREAS, Entex, Inc. states that the proposed rate change
will increase its annual revenues in Beaumont approximately $1,300,706;
and,
WHEREAS, the City Council believes that such increase is
so substantial as to require a public hearing and a careful review
by the City Council before becoming effective; and,
WHEREAS, in order to study thoroughly the proposed change,
the City Council believes that additional time is required beyond the
proposed effective date of the change;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEALMONT:
Section 1.
That, pending hearing and decision by the City Council,
the effective date of the proposed change in the rates of Entex, Inc.
within the City of Beaumont, is hereby suspended from May 12, 1979
to September 9, 1979.
Section 2.
The the City Council shall hold a public hearing on the
proposed rate change at 2:00 p.m., Tuesday, May 1, 1979, in the City
Council Chambers, City Hall, Beaumont, Texas.
Section 3.
That the City Attorney is authorized and directed to employ
the firm of Touche, Ross & Company to review the proposed rate increase
and to pay said firm for its services an amount not to exceed $15,000.

Section 4.
That the costs of consultant services and other expenses
incurred by the City of Beaumont in connection with the review of the
proposed rate increase are assessed against Entex, Inc. pursuant to
Section 24 of the Public Utility Regulatory Act, TEX.CIV.STAT.ANN.
art. 1446c (1975) .
Section 5.
That the City Clerk is hereby directed to serve a certified
copy of this ordinance upon the local manager of Entex, Inc.
Section 6.
That if any section ,subsection, sentence, phrase or clause
of this ordinance, or the application of same to a particular set of
persons or circumstances, should for any reason be held to be invalid,
such invalidity shall not affect the remaining portions of this
ordinance, and to such end the various portions and provisions of
this ordinance are declared to be severable.
