ENTITLED AN ORDINANCE VACATING AND
ABANDONING A 20 FOOT ALLEY AND A
15 FOOT UTILITY EASEMENT LOCATED IN
JARR= ADDITION IN BEAUMONT, JEF-
FERSON COUNTY, TEXAS, AS DESCRIBED
HEREIN, PROVIDING THAT A 5 X 15 FOOT
PORTION BE RETAINED IN THE ALLEY FOR
A UTILITY EASEMENT.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
THAT that certain twenty (20) foot alley easement described as follows:
BEING a 20 foot wide alley that lies between
Blocks 23 and 24 of Jarrette Addition, a sub-
division recorded in Vol. 3 Page 175 of the
Map Records of Jefferson County, Texas and
said 20 foot wide alley being mere particu-
larly described by metes and bounds as follows:
BEGINNING at an iron stake in the South line
of a 12 foot wide alley locating the Northwest
corner of Lot 22 of Block 23 of said Jarrette
Addition and in the East line of a 20 foot wide
alley locating the Northeast and the beginning
corner of the tract of land herein described;
THENCE South 1 degree 03 minutes East with the
East line of said alley and with the West line of
Lot 22, 21, 20, 19 and 18 of said Block 23 a
distance of 125.0 feet to a point for corner in
the North line of the now abandoned Missouri
Pacific Railroad 100 foot wide right-of-way;
said point also locates the Southwest corner of
said Lot 18;
THENCE South 89 degrees 04 minutes 33 seconds
West with the North line of the now abandoned
Missouri Pacific Railroad right-of-way a dis-
tance of 20.0 feet to a point locating the
Southeast corner of Lot 17 Block 24 of Jarrette
Addition;
THENCE North 1 degree 03 minutes West with the
East line of Lots 17, 16, 15, 14 and 13 of
said Block 24 a distance of 125.0 feet to a
point for corner locating the Northeast corner of
Lot 13 of said Block 24 and lying in the South
line of a 12 foot wide alley;
THENCE North 89 degrees 04 minutes 33 seconds
East with the South line of said alley a distance
of 20.0 feet to the place of beginning. Save
and except a 5 foot wide and 15 foot long portion
of said alley as described as follows:
FOR locative corner begin at an iron stake
locating the Northwest corner of Lot 22 of Block
23 of said Jarrette Addition and lying in the
South line of a 12 foot wide alley;
THENCE South 89 degrees 04 minutes 33 seconds
West with the South line of said alley a dis-
tance of 7.5 feet to a point locating the
Northeast and beginning corner of the 5 foot
wide and 15 foot long tract of land herein
described;
THENCE South 1 degree 03 minutes East a distance
of 15.0 feet to a point for corner;
THENCE South 89 degrees 04 minutes 33 seconds
West a distance of 5.0 feet to a point for corner;
TRICE North 1 degree 03 minutes West a distance
of 15.O feet to a point for corner;
THENCE North 89 degrees 04 minutes 33 seconds
East a distance of 5.0 feet to the place of begin-
ning,
be, and the same is hereby, vacated and abandoned, and that title
to such property shall revert to and become the property of the
persons entitled thereto, as provided by law, providing, however,
that a 5 X 15 foot portion of the alley be retained by the City
of Beaumont for utility purposes only; title to such property,
other than the rights retained by the City of Beaumont herein,
shall revert to and become the property of the persons entitled
thereto, as provided by law.
Seation 2.
THAT that certain 15 foot utility easement described as follows:
BEING a 15 foot wide utility easement and
being a part of the abandoned 17th Street
right-of-way that lies adjacent to and East
of Lots 20, 21 and 22 of Block 23 of Jarrette
Addition and being that same 15 foot wide
utility easement conveyed by V. J. O'Shell to
the City of Beaumont by instrument dated
December 6, 1966 and recorded in Vol. 1487
Page 630 of the Deed Records of Jefferson
County, Texas and said 15 foot wide utility
easement being more particularly described by
metes and bounds as follows:
BEGINNING at an iron stake locating the North-
east corner of Lot 22 of Block 23 of said
Jarrette Addition and lying in the South line
of a 12 foot wide alley and in the West line
of the now abandoned 17th Street right-of-way
locating the Northwest and the beginning corner
of the tract of land herein described;
THENCE South 1 degree 03 minutes East with the
West line of the now abandoned 17th Street and
with the East line of Lot 22, 21 and 20 of said
Block 23, a distance of 75.0 feet to a point
for corner in the North line of a 5 foot wide
easement conveyed to Gulf States Utilities Com-
pany and Southwestern Bell Telephone Company
by instrument recorded in Vol. 1492 page 462
of the Deed Records of Jefferson County, Texas;
said iron stake locates the Southeast corner
of Lot 20 and the Northeast corner of Lot 19
of said Block 23;

THENCE North 89 degrees 04 minutes 33 seconds East
with the North line of said 5 foot wide utility
easement a distance of 15.0 feet to a point
for corner;
THENCE North 1 degree 03 minutes West a distance
of 75.0 feet to a point for corner in the South
line of a 12 foot wide alley;
THENCE South 89 degrees Q4 minutes 33 seconds West
with the South line of said alley a distance of
15.0 feet to the place of beginning,
be, and the same is hereby, vacated and abandoned, and that title
to such property shall revert to and become the property of the
persons entitled thereto, as provided by law.
Section 3.
That if any section, subsection, sentence, clause or phrase
of this ordinance, or the application of same to a particular set of
persons or circumstances, should for any reason be held to be invalid,
such invalidity shall not affect the remaining portions of this
ordinance, and to such end the various portions and provisions of
this ordinance are declared to be severable.
PASSED BY THE CITY COUNCIL of the City of Beaumont this
