ENTITLED AN ORDINANCE AMENDING CHAPTER 30
OF THE CODE OF ORDINANCES OF THE CITY OF
BEAUMONT BY AMENDING SECTION 30-33B( 1 ) (b)
BY CHANGING THE DENSITY REQUIREMENT FOR
CLUSTER HOUSING DEVELOPMENTS; AMENDING
SECTION 30-24B BY REQUIRING A SPECIFIC
USE PERMIT FOR MULTIPLE DWELLINGS IN THE
PLANNED UNIT DEVELOPMENT DISTRICT;
AMENDING SECTION 30-37E(2 ) (b) BY
AUTHORIZING THE BOARD OF ADJUSTMENT TO
GRANT A SPECIAL EXCEPTION REDUCING THE
MINIMUM SETBACK FOR SIGNS; PROVIDING FOR
SEVERABILITY; PROVIDING FOR REPEAL AND
PROVIDING A PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1 .
THAT Chapter 30 of the Code of Ordinances be and the
same is hereby amended by changing Section 30-33B(l ) (b) of said
Chapter to read as follows:
b) Density. The minimum average net land area
per dwelling unit shall be governed by
Section 30-25B but shall not include public
and private streets in the development.
Section 2 .
THAT Chapter 30, Section 30-24B of the Code of Ordinances
be and the same is hereby amended by changing "multi-family
dwellings" from a permitted use in the PUD Planned Unit Development
District to a use requiring a specific use permit.
Section 3 .
THAT Chapter 30 of the Code of Ordinances be and the
same is hereby amended by adding to Section 30-37E (2 ) (b) " of said
Chapter subsections 11 ( 4 ) " and " ( 5 ) " to read as follows:
4 ) An Exception from the minimum front yard
requirements for owner identification signs
where a structure existing at the effective
date of this Chapter precludes locating a
sign in compliance with the setback
regulation.
5) An exception from a minimum interior side
yard setback requirement for owner
identification signs for existing
businesses which were developed prior to
April 1 , 1981, where there is no safe place
to erect a sign in compliance with the

minimum setback requirements. A condition
for granting of the exception is that the
applicant must demonstrate that the sign
shall not screen or obstruct the view of an
existing sign, building, or outdoor display
area.
Section 4 .
That if any section, subsection, sentence, clause or
phrase of this ordinance, or the application of same to a
particular set of persons or circumstances, should for any reason
be held to be invalid, such invalidity shall not affect the
remaining portions of this ordinance, and to such end the various
portions and provisions of this ordinance are declared to be
severable.
Section 5 .
All ordinances or parts of ordinances in conflict
herewith are repealed to the extent of the conflict only.
Section 6 .
Any person who violates any provision of this ordinance
shall, upon conviction, be punished as provided in Section 1-8 of
the Code of Ordinances of Beaumont, Texas.
