ENTITLED AN ORDINANCE DESIGNATING A PORTION OF BLOCK 2 OF THE FRENCH SUBDIVISION AS A PLACE OF CULTURAL IMPORTANCE; PROVIDING REGULATIONS APPLICABLE THERETO; AMENDING THE ZONING MAP OF THE CITY OF BEAUMONT TO PERMIT THE OPERATION OF AN ART MUSEUM UPON SAID TRACT OF LAND; PROVIDING FOR SEVERABILITY; AND PROVIDING A PENALTY. WHEREAS, the tract of land described in Exhibit "A" is the Jefferson County TB Hospital property which is being acquired by the City of Beaumont for lease to the Beaumont Art Museum for establishment of a new art museum for the City of Beaumont; and, 4HEREAS, the operation of an art museum on the property is a variance in the use of such premises presently zoned R-1 under the zoning ordinance of the City of Beaumont; and, WHEREAS, the tract of land and the art museum to be operated thereon will be of significant cultural importance and significance to the City of Beaumont; and, WHEREAS, it is deemed desirable to amend the zoning of such premises in such a manner as to permit the operation of an art museum on the premises; but in all other respect to maintain the underlying zoning of said y� g g premises as R-1; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That that portion of Block 2 of the French Subdivision, described in Exhibit "A" attached hereto, is hereby designated as a place of cultural importance and significance, and the regulations contained in this ordinance shall apply within the boundary of said tract of land. ,a Section 2 . The tract shall be used only for the purposes of an art museum, and if such tract is not used as a art museum, the zoning of said tract of land shall continue as R-1, and no use shall be permitted except in conformance with the regulations applicable in R-1 zones. Section 3 . The zoning map of the City of Beaumont referred to in the Code of Ordinances of Beaumont, Texas, is hereby amended to reflect the zoning change above set forth. In all other respects, the use of the tract of land described in Exhibit "A" hereto shall continue as currently zoned, R-1, and shall be subject to all of the regulation applicable in such zone as contained in the zoning ordiance of the City of Beaumont, as amended. Section 4 . That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 5 . Any person who violates any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.
