ORDINANCE NO.
AN ORDINANCE AUTHORIZING THE SALE
OF A TRACT OF LAND OUT OF LOTS 3
AND 4 OF THE CALDER COURT ADDITION
TO THE CITY OF BEAUMONT, JEFFERSON
COUNTY, TEXAS, CONTAINING 10,249.50
SQUARE FEET OF LAND, MORE OR LESS.
WHEREAS, the City of Beaumont is the owner of a tract of
land containing 10,249.50 square feet of land, more or less, out
of Lots 3 and 4 of the Calder Court Addition to the City of
Beaumont, Jefferson County, Texas, herein called the "Property,"
having acquired said tract for street right of way purposes; and,
WHEREAS, Allied Union Bank is the owner of a portion of
Lots 5 through 12 of the Calder Court Addition to the City of
Beaumont, Jefferson County, Texas, said tract abutting the
Property; and,
WHEREAS, traffic conditions on Phelan Boulevard will
permit only limited access from Phelan Boulevard to Lots 3 through
12 of the Calder Court Addition, making the Property incapable of
being used independently as zoned; and,
WHEREAS, Article 5421c-12 of the Revised Civil Statutes
of Texas permits the sale by the City of Beaumont of the Property
to the abutting property owner for not less than fair market value
as determined by an appraisal; and,
WHEREAS, the City has obtained an appraisal of the
Property from Willard J. Hall, who appraised the fair market value
of the Property at $61,500; and,
WHEREAS, Allied Union Bank, the abutting owner, has
offered to purchase the Property from the City of Beaumont for
$72,000; and,
WHEREAS, the City council is of the opinion that said
sale is in the best interest of the City;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
Section 1 .
That the City Manager be, and he is hereby, authorized
to convey by general warranty deed to Allied Union Bank for the
Sum of $72,000 that 10,249.50 square foot tract of land out of
Lots 3 and 4, Calder Court Addition to the City of Beaumont,
described as follows:
Being a tract of land out of Lots 3 and 4 of
the Calder Court Addition to the City of
Beaumont, Jefferson County, Texas, and being
more particularly described by metes and
bounds as follows:
Beginning at a 5/811 rod at the intersection
of the South line of Calder Avenue and the
common line between Lots 4 and 5 of the
Calder Court Addition, said point being the
Place of Beginning of the herein described
tract of land;
Thence East 25.00 feet along the South line
of Calder Avenue to a point for corner;
Thence South 57 01611911 East, 29.41 feet to a
point in the common boundary of Lots 3 and 4 ;
Thence continuing South 57 116119!1 East, 58.82
feet to a point for corner in the East line
of Lot 3 ;
Thence South 00 0561 West, 36.14 feet along
said East line to a point for a corner in
North right-of-way line of Phelan Boulevard;
Thence South 53 05412211 West, 62.73 feet along
said right-of-way line to a point for corner
in the common line between Lot 3 and 4 ;
Thence South 54°58'3711 West, 61.75 feet along
same right-of-way line to a point for corner
in the West line of Lot 4 ;
Thence North 00 0561 East, 156.19 feet along
the West line of Lot 4 to a 5/811 rod for
corner being the Place of Beginning of the
herein described tract of land containing
10,249.50 square feet of land, more or less .
