The City Council of the City of Beaumont, Texas, met in a regular session on May 20, 2003, at
the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the
following:

Mayor Evelyn Lord called the meeting to order at 1:33 p.m. The invocation was said by Reverend
Jerry MaGrath,of St.Anthony Cathedral Catholic Church. Councilmember Samuel led the Pledge
of Allegiance. Roll call was made by Susan Henderson, City Clerk.
Present at the meeting was Mayor Lord,Mayor Pro Tern Ames,Councilmembers Smith, Beaulieu,
Cokinos, Samuel and Patterson.Also, present was Kyle Hayes, City Manager; Lane Nichols, City
Attorney; Susan Henderson, City Clerk and Betty Braxton, Deputy Clerk.
Proclamations, Presentations and Recognitions
• Mayor Lord read a Proclamation issued to recognize National Maritime Day on May
22, 2003. The Proclamation was received by Janet Floyd, President of the
Seafarers' Association and an employee of the Port of Beaumont.
• Mayor Pro Tem Ames read a Proclamation recognizing the month of May 2003 as
Foster Care Month. Rhonda O'Neil, from Buckner Children and Family Services,
Tracy Rideaux, Foster Care Director in Beaumont, Alice Wilson, Foster Care
Supervisor in Port Arthur, and Thad and Corley Smith, from Theraputic Family Life,
along with their baby, Haley, received the Proclamation.
• Councilmember Cokinos read a Proclamation recognizing the month of May 2003
as Mental Health Month. Jane Bordelon, Executive Director for the Mental Health
Association of Jefferson County, Betty Haston and John Davis, Board Members of
the Mental Health Association, along with Sherri Burris of MHMR and Scott Quintell
with United Way received the Proclamation.
• Sandra Womack with the Vietnam Veterans of America, Inc., Southeast Texas
Chapter#292 invited City Council and the public to attend the annual Memorial Day
Celebration Events on Sunday, May 25, 2003 at 1:00 p.m. for a picnic lunch and at
2:30 p.m. the annual candlelight service will take place.
• Councilmember Patterson read a Proclamation recognizing May 18through May24,
2003 as Hurricane Awareness Week. Fire Chief Mickey Bertrand, who is also the
Emergency Management Coordinator for the City of Beaumont, received the
Proclamation.

Administration recommended approval and at a Joint Public Hearing held May 12, 2003,
the Planning Commission voted 8:0 to approve a request for a zone change from RM-H

4. Consider approving a request for a zone change from RM-H (Residential Multiple Family
Dwelling-Highest Density)and GC-MD (General Commercial-Multiple Family Dwelling)to
LI (Light Industrial) District and a specific use permit to allow a farm equipment and
machinery manufacturing facility on property located between Irving and St. Anthony and
between McGovern and Schwarner.
Administration recommended Council deny these requests because the zone change
would constitute spot zoning and a zone change would be detrimental to the revitalization
efforts of the surrounding neighborhood. Administration also considered the uses allowed
in a LI District by approving the specific use permit would not be compatible with the
surrounding residential uses and the newly built Charlton Pollard Park site. At a Joint
Public Hearing held May 12, 2003, the Planning Commission voted 6:2 to approve a
request for a zone change from RM-H and GC-MD to LI (Light Industrial) District and a
specific use permit to allow a farm equipment and machinery manufacturing facility on
property located approximately between Irving and St. Anthony and between McGovern
and Schwarner.
Note: City Attorney Lane Nichols advised Council to vote on the zone change and the
request for the specific use permit separately.

Note: It was not necessary for Council to vote on the requested specific use permit
because the requested zone change was denied.
5. Consider approving a specific use permit to allow the expansion of an existing transitional
treatment center (halfway house)for offenders at 2495 Gulf Street.
Administration recommended approval of the specific use permit request made by the
applicant, Thomas J. Sibley, who is proposing to expand the Correctional Systems, Inc.
(CSI)facility(halfway house)currently located at 2495 Gulf Street, subject to providing 33
parking spaces as required by the Traffic Manager. At a Joint Public Hearing held May 12,
2003,the Planning Commission voted 6:2 to approve the request for a specific use permit
to allow the expansion of the existing transitional treatment center (halfway house) for
offenders at 2495 Gulf Street subject to providing 33 parking spaces as required by the
Traffic Manager.
COuncilmember Samuel moved to approve ORDINANCE No 03-040 ENTITLED AN ORDINANCE
GRANTING A SPECIFIC USE PERMIT TO ALLOW THE EXPANSION OF AN EXISTING TRANSITIONAL
TREATMENT CENTER (HALFWAY HOUSE) FOR OFFENDERS IN A GC-MD (GENERAL COMMERCIAL-
MULTIPLE FAMILY DWELLING) DISTRICT FOR PROPERTY LOCATED AT 2495 GULF STREET IN THE
CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, subject to the following conditions:
provisions are made to accommodate thirty-three (33) parking spaces as required by the
traffic manager and with the explicit directive that the capacity of the facility not exceed 180
resident offenders at a time, that no geographical expansion occur and that quarterly
inspections are conducted by City staff to ensure stipulated conditions are maintained.

6. Consider approving a specific use permit to allow an apartment complex in a GC-MD-2
(General Commercial-Multiple Family Dwelling-2)District for property located east of Major
Drive and north of Eagle's Landing Apartments.
Administration recommended approval and at a Joint Public Hearing held May 12, 2003,
the Planning Commission voted 8:0 to approve a specific use permit to allow an apartment
complex in a GC-MD-2 District for property located east of Major Drive and north of Eagle's
Landing Apartments.

7. Consider approving the revocation of a specific use permit to allow a residential care facility
(Youth Rescue Mission)in an RM-H(Residential Multiple Family Dwelling-Highest Density)
District at 1930 Franklin Street.
Administration recommended the approval of revoking a specific use permit that allowed
a residential care facility (Youth Rescue Mission) in an RM-H (Residential Multiple Family
Dwelling-Highest Density) District at 1930 Franklin Street. A specific use permit was
approved by City Council in March 2000 subject to eight (8) conditions. Section 30-26 of
the Zoning Ordinance allows the revocation or modification of a specific use permit, after
notice and hearing, for either of the following reasons:
1. The specific use permit was obtained or extended by fraud or deception; or
2. That one or more of the conditions imposed by the permit has not been met or
has been violated.
Administration provided information to Council showing numerous criminal activities noted
from numerous reports made by the Beaumont Police Department and health code
violations substantiated byvarious inspections made bythe Beaumont Health Department.
In September 2000, Deloris Davis, owner of the Mission, was notified by the City of
Beaumont's Planning Manager of an alleged violation of the specific use permit by having
three single men living at the mission as reported to him by the Police Department and
Beaumont Crime Stoppers. On August 4, 2002, an inspection made by the Planning
Manager discovered four single men living at the facility. On February 17, 2003, the
Planning Manager found three single men living at the facility. On April 10, 2003, the

Planning Manager,two police officers,the Fire Marshall's office and an Entergy employee
made an inspection of the Mission and found the following violations of City Ordinance 00-
26:
1. Eight single men not related by blood or marriage to the women and children
residing in the facility have been allowed to reside there during April 8-10, 2003. On
the night of the inspection, one of those men was arrested for a warrant violation.
2. Facility is not in compliance with all the codes of the City of Beaumont;
specifically, the Fire Code, Electrical Code and the Building Code (illegal electrical
connection, locked exit door).
At a Joint Public Hearing held May 12, 2003, the Planning Commission voted 7:0:1 to
approve the revocation of the specific use permit to allow a residential care facility(Youth
Rescue Mission)in an RM-H(Residential Multiple Family Dwelling-Highest Density)District
at 1930 Franklin Street,with the option of re-application within 12 months provided that all
standard requirements are met prior to re-application and with a waiver of the re-
application fee.
Councilmember Samuel moved thatASPECIFIC USE PERMIT FORTHE YOUTH RESCUE MISSION
BE ACTIVELY SUSPENDED FOR NINETY(90)DAYS,DURING WHICH TIME ALL CODE VIOLATIONS ARE
SATISFIED, ALL SUPERVISORS OF THE MISSION RECEIVE PROPER TRAINING AND A BOARD OF
DIRECTORS BE ESTABLISHED AND AFTER THE SUSPENSION PERIOD, A SPECIFIC USE PERMIT BE
GRANTED FORA NINE(9)MONTH PROBATIONARY PERIOD TO ALLOW A RESIDENTIAL CARE FACILITY
(YOUTH RESCUE MISSION) IN AN RM-H (RESIDENTIAL MULTIPLE FAMILY DWELLING-HIGHEST
DENSITY) DISTRICT AT 1930 FRANKLIN STREET,WITH THE EXPRESSED STIPULATION THAT IF ANY
CODE VIOLATION(S) OCCUR DURING THIS OVERALL TWELVE (12) MONTH PERIOD, SUCH
VIOLATION(S)COULD BE IMMEDIATE CAUSE FOR REVOCATION OF THE SPECIFIC USE PERMIT. The
motion failed for lack of a second.
Councilmember Beaulieu then moved to approve ORDINANCE NO. 03-042 ENTITLED AN
ORDINANCE REPEALING ORDINANCE NO. 00-26; REVOKING A SPECIFIC USE PERMIT TO ALLOW A
RESIDENTIAL CARE FACILITY (YOUTH RESCUE MISSION) IN AN RM-H (RESIDENTIAL MULTIPLE
FAMILY DWELLING-HIGHEST DENSITY) DISTRICT AT 1930 FRANKLIN STREET, WITHOUT THE
OPTION OF RE-APPLICATION WITHIN 12 MONTHS AND NO WAIVER OF RE-APPLICATION FEES.
Councilmember Smith seconded the motion.
Councilmember Patterson then asked Councilmember Beaulieu to amend her motion to:
INCLUDE THE OPTION OF RE-APPLICATION WITHIN 12 MONTHS WITH THE STIPULATION THAT ALL
CODE VIOLATIONS ARE IN COMPLIANCE AND THAT THE APPLICATION FEE BE PAID IN FULL.
Councilmember Beaulieu declined to amend the motion as did Councilmember Smith.
Mayor Pro Tern Ames received clarification from City Manager Kyle Hayes that an
applicant can reapply for a specific use permit after a twelve (12) month period. Mayor
Lord reaffirmed that Council would vote on the motion before Council as seconded with the
motion amended to include no stipulation as made by the Planning Commission or by City
Council.

THE FOLLOWING UNIT PRICES:$8.50/TON FOR 1 SACK;$10.25/TON FOR 1-1/2 SACK;$11.50/TON
FOR 2 SACK; $13.00/TON FOR 2-1/2 SACK; $14.00/TON FOR 3-1/2 SACK; AND$17.00/TON FOR

YEAR CONTRACT TO TOMAHAWK LAWN SERVICES IN THE AMOUNT OF$1,452.31 PER CUTTING FOR
NINE(9)CITY PARKS FOR AN ESTIMATED ANNUAL TOTAL OF$60,997.02. Mayor Pro Tem Ames
seconded the motion.

COUNCILMEMBER SAMUEL announced a Ward III Neighborhood Association meeting would
be held on Thursday, May 22, 2003 at 6:30 p.m. at the Elmo Willard Library.
Councilmember Samuel also requested to have the first Charter review workshop of
Articles I and I I on Tuesday, May 27, 2003. He asked that the next review workshop be
scheduled for Tuesday, June 2, 2003 to discuss Article III, which concerns the city's
election process of Councilmembers and their terms. Councilmember Samuel asked City
Manager Kyle Hayes to set a workshop for Tuesday, June 10, 2003 to discuss the MLK
Commission.

CouNCiLMEMBER PATrERSON reported that the Statewide 2003 Leadership Conference for
the Texas Association of Mayors and County Committee for People with Disabilities that
was held on Saturday, May 17, 2003 at the Holiday Inn Plaza was well organized as well
as a success. Councilmember Patterson also announced that a Ward IV Town Hall

Mayor Lord reminded the public they can participate in the City Charter Review with
their comments or suggestions. She also reminded City department heads to submit
concerns or suggestions to Council during the upcoming Charter review workshops.

Jerry Whittington 2164 Cable Beaumont, TX
Mr. Whittington asked Council to review the feasability of placing flashing lights with an
attached sign on busy streets warning drivers to watch for persons on motorized
wheelchairs. He stated his mother-in-law was almost hit while crossing over East Lucas
as she attempted to go to the grocery store. He also thanked Council and City staff for the
signs placed in his neighborhood preventing 18 wheeler trucks from traveling through the
community.

Mr. Marks thanked Mayor Lord and Council for their action against the requests of Modern
Manufacturing Inc.
Sandi Saulsbury 212 West Trout Kirbyville, TX
Mrs. Saulsbury told Council she was a missionary on the streets and woods of Beaumont
to help prostitutes, drug and alcohol addicts, as well as the homeless. She asked Council
to tell her where she would bring the homeless when she finds them on the street.
Roland Davis 535 McGovern Beaumont, TX
Mr. Davis wanted to know if Modern Manufacturing, Inc. had committed a crime. He lives
in the back of the company and did not understand the outcry against the company since
no crime had been committed.
John DeJean 585 Schwarner Beaumont, TX
Mr. DeJean thanked Council forthe action taken againstthe zoning and special use permit
requests made by Modern Manufacturing, Inc. He was concerned about the safety of the
neighborhood children.

permit of the Youth Rescue Mission.

Mr. Clark expressed his support for Modern Manufacturing, Inc., and its employees. He
expressed his concern that the company and other companies would move from
Beaumont.

Ms. Fulfer offered her support for the Youth Rescue Mission and for the director, Deloris
Davis.
William Procter 4340 Westridge Beaumont, TX
Mr. Procter asked Council to work on issues to keep our youth off the streets and out of
the justice system. He also asked Council to help Spindletop MHMR because of proposed
State cuts to their budget.
LeRoy Lewis, III 7866 Gladys Beaumont, TX
Mr. Lewis thanked the Rogers Brothers for the many donations made to various causes
over the years. He reported a dilapidated house to Councilmember Patterson at 2425
Hegele Street. Mr. Lewis thanked Hal Guillory for the work he does with the homeless of
Beaumont. He also thanked Kim Chretian, Director of the L. L. Melton YMCA for the work
currently in progress at the Melton YMCA.
Timothy Gill 1930 Franklin Beaumont, TX
Mr. Gill stated he was a resident of the Youth Rescue Mission. He thanked
Councilmember Samuel for his attempt to help the Mission stay open.

special use permit of the Youth Rescue Mission.

Mr. Bluiett told Council the company, as well as residents of the Charlton Pollard
Neighborhood Association, did not know comments would not be received before Council
voted on the requests made by Modern Manufacturing, Inc. He expressed the company's
desire to re-apply and work with the community to address their many concerns.
Roberto Flores 2425 Buchanan Beaumont, TX
Mr. Flores expressed his agreement with the decision made by Council to revoke the Youth
Rescue Mission's special use permit. Mr. Flores asked Council to consider installing a
traffic light at the corner of Avenue A and College. He was concerned about increased
traffic occurring at this intersection because of the opening of the new Family Dollar Store.

Mr. Tubbs expressed his disappointment with Council's decision to deny the requests
made by Modern Manufacturing, Inc. He expressed his desire to continue to work with the
Charlton Pollard Neighborhood to improve and beautify the community, as well as to
continue to employ neighborhood residents.

Mr. Mendoza told Council the College Corridor Neighborhood Association was not in favor
of placing a traffic light at Avenue A and College because of the traffic flowing up the
underpass from the Martin Luther King Parkway.

Manufacturing, Inc. He told Council he was concerned for the safety of the neighborhood

Ms. Harris expressed her concern as to where she would live once the Youth Rescue
Mission closed.

Mrs. Prados told Council that the residents around the Youth Rescue Mission had tried to
get help the past few years to regulate the activities around the Youth Rescue Mission.
She expressed her concern for the plight of the homeless but stated her support to Council
for the decision made to revoke the Mission's permit. Mrs. Prados told Council that as
President of the College Street Corridor Neighborhood Association she was expressing the
Association's position against placing a traffic light at the intersection of Avenue A and
College Street.

Mrs. Williams expressed her agreement with the decision made by Council to revoke the
Youth Rescue Mission's special use permit. She also stated many of the residents of the
surrounding community have asked for help to monitor the activities within the Mission.

Mr. Davis stated his disagreement to Council for the decision made to revoke the permit
of the Youth Rescue Mission. Mr. Davis pointed out that the drug and prostitution activity
once rampart in the surrounding community had decreased since the Mission opened.

Mrs. Davis expressed her disagreement with Council's decision to revoke the Youth
Rescue Mission's special use permit. Mrs. Davis stated she would continue to be the
Director of the Youth Rescue Mission and would continue to help the plight of the City's
homeless. Mrs. Davis stated if the City did not provide a place for the residents of the
Mission she would drop the residents at the homes of Councilmembers.
