Richardson, Planning Manager MEETING DATE: May 20, 2003 AGENDA MEMO DATE: May 13, 2003 REQUESTED ACTION: Council consider a request for a zone change from A-R(Agricultural- Residential) to RS (Residential Single Family Dwelling) and GC-MD-2 (General Commercial- Multiple Family Dwelling-2)District. RECOMMENDATION The Administration recommends approval of the zone change from A-R to RS and GC-MD-2 Districts. BACKGROUND Don Shaver, Roger Meek and Richard Guseman, the applicants, are requesting a total of 185.77 acres of land for zone changes. The properties extend west and south of Barrington Heights to the proposed Delaware Extension to Major Drive. The proposed zoning requests include 154.3964 acres of RS (Residential Single Family Dwelling) and 31.3755 acres of GC-MD-2 (General Commercial-Multiple Family Dwelling-2) District. 20 acres of the RS zoning is being set aside for a future elementary school. BUDGETARYIMPACT None. PREVIOUS ACTION At a Joint Public Hearing held May 12,2003,the Planning Commission voted 6:1:1 to approve the zone change from A-R to RS and GC-MD-2 Districts. SUBSEQUENT ACTION None. RECOMMENDED BY Planning Commission, City Manager, Public Works Director and the Planning Manager. RECOMMENDED MOTION Approve/Deny a request for a zone change from A-R to RS and GC-MD-2 Districts. ORDINANCE NO. ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT,TEXAS,AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS, AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING THE ZONING OF PROPERTY PRESENTLY ZONED A-R (AGRICULTURAL- RESIDENTIAL) DISTRICT TO RS (RESIDENTIAL SINGLE FAMILY DWELLING) DISTRICT AND GC-MD-2 (GENERAL COMMERCIAL-MULTIPLE FAMILY DWELLING-2)DISTRICT FOR 185.77 ACRES OF LAND WHICH EXTENDS WEST AND SOUTH OF BARRINGTON HEIGHTS TO THE PROPOSED DELAWARE EXTENSION TO MAJOR DRIVE, BEAUMONT, JEFFERSON COUNTY, TEXAS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That Chapter 30 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts, as indicated upon the Zoning Map of the City of Beaumont, referred to in Section 30-513 thereof, is hereby amended by changing the zoning of property presently zoned as A-R (Agricultural-Residential) District to RS (Residential Single Family Dwelling) District and GC-MD-2(General Commercial-Multiple Family Dwelling-2) District for 185.77 acres of land which extends west and south of Barrington Heights to the proposed Delaware Extension to Major Drive, City of Beaumont, Jefferson County, Texas, as described on Exhibits"A" and"B," and the official zoning map of the City of Beaumont is hereby amended to reflect such changes. Section 2. That, in all other respects, the use of the property herein above described shall be subject to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended. Section 3. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end, the various portions and provisions of this ordinance are declared to be severable. Section 4. That all ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only. Section 5. That any person who violates any provision of this ordinance shall, upon conviction, be punished, as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas. RECOMMENDATION The Administration recommends approval of a request for a zone change from RCR to GC-MD District at 2705 Concord. BACKGROUND Mike Aref,the property owner,is requesting this zone change so that he can use the property at 2705 Concord for commercial uses. The subject property is the site of a vacant convenience store. The City water records show that water was cut off in October, 2002. Mr. Aref states that the area is commercial in character. Both sides of Concord Road are zoned RCR from St. Helena to just south of Beatrice. Staff had done a preliminary zoning study of the Concord Road area in anticipation of the improvements being made to Concord Road. This study basically calls for those properties with frontage along Concord to be rezoned to GC-MD. BUDGETARY IMPACT None. PREVIOUS ACTION At a Joint Public Hearing held May 12,2003,the Planning Commission voted 7:0 to approve a zone change from RCR to GC-MD District at 2705 Concord. SUBSEQUENT ACTION None. BACKGROUND George Parsons, the applicant, is requesting a zone change from RM-H to GC-MD for properties located in the 2900 block of San Jacinto. The subject property has been commercial for many years. There are four metal buildings fronting on S. 4th Street from Rockwell to Terrell. There are six metal buildings sited on the east side of the block abutting San Jacinto. This area along S.4th was zoned C-2(Central Commercial)on the original zoning map in 1955. The east half of the block was zoned R-2(now RM-H). The C-2 district allowed distribution,wholesale, fabrication and trucking, among other commercial uses. The C-2 was combined with C-1 (retail) in the 1981 Zoning Ordinance to become GC-MD. In August, 2001, the City Council considered a request to rezone the entire Block 116 to C-M (Commercial-Manufacturing) District. City Council approved the rezoning of the west half of the block to C-M and a specific use permit to allow an abrasive waterjet cutting job shop at 2995 S. 4`h Street. The reason for the current request is the result of trying to get a building permit for 2930 San Jacinto and being denied because records showed that the building had been vacant for a year or more. Since the property is currently zoned RM-H,once the property's legal non-conforming use status is no longer valid, the property's use must revert back to one permitted in the RM-H District. The property has been commercial for years and the property owner has no intent of converting the property to residential. BUDGETARY IMPACT None. PREVIOUS ACTION At a Joint Public Hearing held May 12, 2003, the Planning Commission voted 8:0 to approve a request for a zone change from RM-H to GC-MD District for property in the 2900 block(even) of San Jacinto Street. BACKGROUND Modern, Inc. is requesting a zone change to LI(Light Industrial) and a specific use permit for all of its properties in the Charlton-Pollard neighborhood. In January,2003,Modern,Inc. applied for a zone change to GC-MD for Lots 20-22,Block 1,Minter Addition. The property was to be used for employee parking. At that time, staff recommended denial because the existing and proposed use of those lots would be in support and part of an existing nonconforming industrial use. Staff also stated that the use would not be permitted in GC-MD. For it to be legal,the property needed to be zoned LI(Light Industrial)with a specific use permit or HI (Heavy Industrial). No action was taken due to lack of a quorum of the Planning Commission. Lloyd Koehnen, representing Modern, later met with the Planning Manager to discuss Modern's options. Modern then decided to apply for HI for all the property that it owns in Charlton-Pollard so that it would be a permitted use. This request was denied by City Council on March 25, 2003. Modern, Inc. is now applying for LI and the specific use permit with permission of the Planning Commission. Modern, Inc. has been located on Irving and Tilson for approximately 42 years. The company manufactures tractor powered implements and other metal products. The plant on Irving extends west to Tilson and St. Anthony and from Schwamer to McGovern and contains just over 3 acres of land area. This area of Beaumont was originally zoned C-1 in 1955. The C-1 was converted to GC-MD with adoption of the 1981 zoning ordinance. The RM-H designation of some of Modern's property and also of most of the residentially zoned areas along either side of Irving Street was the result of rezoning studies and changes over the years. The commercial zoning along Irving remained in place. Modern, I nc. i s a in anufacturing c oncern and, as s uch, i s an i ndustrial u se. A s earch o f c ity directories seems to indicate the firm began an operation at 1901 Tilson around 1960 and expanded over the years. Again,Modern,Inc.at the Tilson and Irving Street location is a nonconforming use. Under Section 30-30, "Nonconforming Buildings, Structures and Uses of the Land", regulations explain and discuss various aspects of the nonconforming uses of land. There are several limitations on nonconforming uses and few exemptions. It is questionable whether or not the existing plant operations are a lawful nonconforming use since information leads staff to believe that Modern,Inc. began manufacturing at the site after the area was originally zoned C-1 in 1955. For the use to be conforming, the property where the plant is located should be industrially zoned. Rezoning the property to LI could constitute spot zoning. In considering a"spot zoning"the following issues must be considered: 1. The law demands that the approved zoning plan should be respected and not altered for the special benefit of the landowner when the change will cause substantial detriment to the surrounding land or serve no substantial public purpose. Would the zone change be in compliance with the adopted comprehensive plan? The Comprehensive Plan designates Charlton-Pollard as a Conservation and Revitalization Area. As such, actions are needed to preventj4urther negative influences from incompatible land uses. The Charlton-Pollard Neighborhood Plan designates this area as a medium/high density residential area. The requested zone change would not be in compliance with the neighborhood plan. 2. Will this change adversely impact the surrounding properties?The nature and degree of an adverse impact upon neighboring lands is important. Lots that are zoned in a way that is substantially inconsistent with the zoning of the surrounding area, whether more or less restrictive, are likely to be invalid. Modern, Inc. and residences have co-existed side-by-side in the Charlton-Pollard neighborhood for many years. However,the neighborhood,with the help of the City and others, has been making an effort to revitalize the area for the last 10-15 years. To rezone this property to LI would have a detrimental effect on this neighborhood revitalization effort. Uses permitted in the LI District would be incompatible with the surrounding residential uses and the nearby park. 3. Is the tract of land suitable or unsuitable for use as presently zoned? This is a factor. The size, shape and location of a tract of land or lot may render it unusable or even confiscatory as zoned. The size and shape of the property would allow for medium/high density residential uses. 4. Does the proposed zone change bear a substantial relationship to the public health, safety,morals or general welfare or protect and preserve historical and cultural places and areas? Other uses permitted in the LI District could be detrimental to the public health and safety of the residents in the Charlton-Pollard neighborhood. These issues,as outlined,are to be considered by the Planning Commission and City Council before a determination of spot zoning can be made. The Planning Commission discussed various issues with Modern,Inc. that were of concern with the Charlton-Pollard Neighborhood Association,Inc. While the Planning Commission did not make any of the remedies to those issues a part of their motion, City Council may wish to address those issues in their motion if it is their desire to approve the zone change and specific use permit. (A copy of those areas of discussion is included.) BUDGETARY IMPACT None. With the new loading area most trucks can be sent back on Tilson to McGovern to Irving. 6. Hours of Operation The plant works from 6:00 am until 2:30 pm 5 days a week. Occasionally there is necessary overtime. The work schedule suits the work force as they are available to pick up their children after school. 7. (18) Wheelers idling for extended periods Modern will install no idling signs to get drivers to shut off their engines when waiting. 8. Wasted oil on the ground We had a spill and we hired a state approved environmental firm to dig up the site, treat the site, and dispose of the waste according to state regulations. Certified paperwork is on file with TNRCC. 9. Blocking of Intersection in case of emergency By moving the dumpsters and cargo boxes to the Irving street side we will have room for employee parking and also have room to load on the lots shown on the site plan. 10. Any possibility of Relocating ? If Modern was to relocate, it would be to one of our other facilities outside of Beaumont. This would put approximately 50 families out of work in the Beaumont area. BACKGROUND Thomas J. Sibley, the applicant, is requesting an expansion of the Correctional Systems, Inc. (CSI) facility at 2495 Gulf Street. CSI has acquired the church property(2435 Gulf) located adjacent to its existing facility. The company states that it would like to modify that structure or build a new one for use as new administration offices and a dining hall. It would then convert its present administrative building into office space for case managers,counselors and a conference room. The existing dining hall building will be converted into a series of rooms available to tenants for group therapy, education, church services and bible study. This facility began operation before 1998,when the Zoning Ordinance was amended to require that such facilities receive a specific use permit to operate. In June, 2002, CSI requested a specific use permit to allow expansion onto the church property. The church was to be converted to administration offices and a dining hall. The old administration building was to be converted to dormitory space. City Council denied that request. The current application is for the entire property owned by Correctional Systems, Inc. BUDGETARYIMPACT None. PREVIOUS ACTION At a Joint Public Hearing held May 12, 2003, the Planning Commission voted 6:2 to approve the request for a specific use permit to allow the expansion of an existing transitional treatment center (halfway house)for offenders at 2495 Gulf Street subject to providing 33 parking spaces as required by the Traffic Manager. SUBSEQUENT ACTION None. RECOMMENDED BY Planning Commission, City Manager, Public Works Director and the Planning Manager. BACKGROUND Delta Road Developers,Inc. is requesting this specific use permit for the front 3.71 acres of an 9.86 acre tract of land on the east side of N. Major Drive. This property is located immediately north of Eagle's Landing Apartments. The front half of this property is zoned GC-MD-2. The rear half is zoned RM-H (Residential Multiple Family Dwelling-Highest Density)District. A specific use permit is required for the GC- MD-2 zoning portion. Two 0.624 acre outparcels along Major Drive are left out of this request. 144 market rate units are proposed within 18 two-story apartment buildings. Most units will be 2 bedroom, 2 bath. Overall density will be 17.16 units per acre. 2.1 parking spaces per unit will exceed city requirements. A club house and pool are proposed as amenities. RECOMMENDATION The Administration recommends approval of the revocation of a specific use permit to allow a residential care facility(Youth Rescue Mission)in an RM-H District at 1930 Franklin Street. BACKGROUND In March, 2000, the City Council approved a specific use permit for the Youth Rescue Mission to operate a residential care facility at 1930 Franklin. This specific use permit was approved subject to eight (8) conditions. Sec.30-26(h)ofthe Zoning Ordinance allows the revocation or modification of a specific use permit, after notice and hearing, for either of the following reasons: 1. The specific use permit was obtained or extended by fraud or deception; or 2. That one or more of the conditions imposed by the permit has not been met or has been violated. The City of Beaumont Police Department and Health Department have made numerous calls and inspections at the Youth Rescue Mission. Reports show numerous criminal activities and health code violations occurring on the property. On September 28, 2000, the Planning Manager notified Ms. Davis of an alleged violation of the specific use permit. The Police Department and Crime Stoppers notified the Planning Manager that on September 25, 2000, there were three single men living at the Youth Rescue Mission. Between August, 2002 and February, 2003, the Planning Manager made three inspections of the Youth Rescue Mission. On August 4,2002,the Planning Manager found four single men living there who were not related by blood or marriage to the women and children residing at the facility. On February 17,2003,the Planning Manager again found three single men living at the facility. On April 10, 2003, the Planning Manager, two police officers, the Fire Marshall's office and an Entergy employee made an inspection of the Youth Rescue Mission and found the following violations of City Ordinance 00-26: 1. Eight single men not related by blood or marriage to the women and children residing in the facility have been allowed to reside there during April 8-10,2003. On the night of the inspection, one of those men was arrested for a warrant violation. 2. Facility is not in compliance with all the codes of the City of Beaumont; specifically, the Fire Code, Electrical Code and the Building Code (illegal electrical connection, locked exit door). Enclosed are copies of the reports submitted by City staff listing the violations found during various calls and inspections at 1930 Franklin. On April 16, 2003,Delores Davis, owner of the Youth Rescue Mission,was hand-delivered a letter notifying her of the violations of the specific use permit and of a hearing to consider the revocation of the specific use permit. If City Council approves the revocation of the specific use permit for the Youth Rescue Mission at 1930 Franklin, a residential care facility shall not be permitted to operate at that location. BUDGETARY IMPACT None. PREVIOUS ACTION At a Joint Public Hearing held May 12, 2003, the Planning Commission voted 7:0:1 to approve the revocation of the specific use permit to allow a residential care facility(Youth Rescue Mission)in an RM-H(Residential Multiple Family Dwelling-Highest Density)District at 1930 Franklin Street,with the option of re-application within 12 months provided that all standard requirements are met prior to re-application and with a waiver of the re-application fee. SUBSEQUENT ACTION None. Richardson, Planning Manager SUBJECT: Youth Rescue Mission COMMENTS I met with Delores Davis today to discuss what I had found during my various visits to the Youth Rescue Mission at 1930 Franklin. I told her that I had found the following: 8/22/02 am. A police officer and I went to the Youth Rescue to investigate alleged drug activity. I spoke with a staff person on duty and he assured me that no drug activity was going on at the site. None was observed at the time of the visit. When we drove up I did notice a number of men standing around the property. I asked the staff person if there were any single men living at the facility. He informed me that there were four single men living there at the time. I told him that single men, without children, who lived at the facility were in violation of the ordinance and that they should all leave immediately. 1/28/03 am. I made a surprise inspection at the Youth Rescue Mission to see if single men were living at the facility. Delores Davis was not there. As I was leaving, one of the tenants came up to me and stated that unmarried men continue to live at the facility. 2/17/03 6:00 p.m. A police officer and I went to the Youth Rescue Mission to again investigate alleged violations of the City Ordinance. The officer and I found three unmarried men (one of those living there with his - fiance): There appeared to be no supervisor on duty.—Theofficer did run a check on one male- - resident living there, Robert Eugene Prater, who stated that he was single. It was found he had a police record (criminal mischief, trespassing and disorderly conduct) and a birthdate of 12-18-82. That night, I spoke with Ms. Davis on the phone and told her we needed to get together and talk. Upon discussing my findings with her, she made the following comments: 1. Ms. Davis stated that on the night of 2/17/03, "Roy",the gentleman who called her while we were there, was in fact the supervisor on-duty. 2. Ms. Davis acknowledged that Robert Eugene Prater was 20 years old and single. She stated that the Salvation Army brought him over to the Youth Rescue Mission, 3. Ms. Davis stated that she started out as a rescue mission for young people. The age limits that she set for youth who could reside at the mission are 17-25 years. 4. Ms. Davis stated that it was the City of Beaumont that placed the ,vomen/men with children requirement on her. 5. Ms. Davis stated that there were two older single men living at the mission full-time who did the cooking and cleaning for the facility. 6. Ms. Davis stated that she would continue to accept both young men and women between the ages of 17 and 25. Ms. Davis said that the City should be helping her instead of trying to shut her down. I informed her of the application process for CDBG and introduced her to Janett Blunt. At the conclusion of the meeting,Ms. Davis informed me that she would do all she had to do in order to keep accepting 17-25 year olds. I told Ms. Davis that I had a responsibility to respond to citizen complaints and would be reporting.our conversation and my findings to my supervisors. Richardson, Planning Manager SUBJECT: Youth Rescue Mission COMMENTS I met with Police Officers Burke and Tolley last night,April 10,2003 at 10:00 p.m.to investigate the Youth Rescue Mission. The following was found: 1. Earlier,I had been informed by Entergy that the Youth Rescue Mission's electricity had been cut off on March 26,2003. When we arrived on the scene,the electricity was on. One of the officers called Entergy. An Entergy employee was dispatched and found that the meter had been hot-wired. At about 11:00 p.m.,the electricity was again cut off and a lock was put on the meter. 2. The officers also called the Fire Marshall's office due to a concem over the hot-wiring of the electrical meter. Ranson Jones came out to make an inspection of the property. Delores Davis was issued a ticket for a life safety issue-a locked exit door. 3. Mr. Eric Jones stated that he was the supervisor for the night. Mr. Jones was on the list of clients for the night. I did not ask him if he had received training in supervisory functions. 4. An inspection of the client records for April 8-10,2003 showed that eight(8)single men were living at the shelter. These men did not have a child with them. This is in direct violation of the specific use permit,City Ordinance 00-26. I was informed that several of these men cook, supervise or do general maintenance for the facility. These men appeared to run in ages from their late teens/early twenties to their late fifties/mid sixties. 5. When running checks on some of the clients, the officers found that a Mr. Watson had a warrant out for his arrest for a traffic ticket. While searching this person, the officers noted alcohol on his breath and an apparatus for cleaning crack pipes was found on him. No drugs were found on Mr. Watson and he was not witnessed drinking alcohol beverages. The Youth Rescue Mission House Rules state that no alcohol,drugs, etc. shall be allowed in the Mission at anv time. Citv Ordinance 00-26 does not address this issue. The ordinance also states that no one with convictions for crimes involving violence shall be admitted as residents of the facility. Mr. Watson's current charge was obviously of a non-violent nature. 6. Mr. Roy McDonald,the cook,told me that each client pays Delores Davis $200.00 dollars a month to stay at the Youth Rescue Mission. As stated in a previous memo, during inspections made on 8/22/02, 1/28/03 and 2/17/03, I was informed or investigation found that single men with no children were living at the facility. This violation of the City ordinance has obviously been going on for some time. Persons with convictions for crimes involving violence shall not be admitted as residents of the facility. c. Only women and children and males who are related by blood or marriage to the women and children residing in the shelter may be admitted as residents and allowed to remain overnight in the facility. d. The facility shall provide twenty-four (24) hour adult supervision by persons who have received training in such supervisory functions. e. House rules shall be adopted, reduced to writing and readily available. House rules must include at a minimum of curfew based on a 9:00 pm time limit which may be amended to fit special circumstances of residents. Penalty for curfew violations shall be limited to a fine or other appropriate punishment. In no event shall residents be locked out of the facility for a curfew violation. House rules shall also prohibit residents from soliciting things of value from residents of Beaumont. f. The facility shall never have more than forty-two (42) overnight residents. g. The facility shall be in compliance with all the codes of the City of Beaumont on or after April 22, 2000. h. The facility shall be under the control of the Board of Directors, not more than one of which is a paid employee of the facility. Botb Maddox and Burrell discover people actually living in the facility, Many life safety hazards/violations are present at this time. *September 14, 1995, Captain Brad Penisson attends meeting at Beaumont City Hall at request of Fire Chief C.A. Shelton and Fire Marshal Maddox in reference to 1930 Franklin. Others in attendance are Richard Chappell,Randy Pemberton, Fred Lemell, as well as Mrs. Delores Davis, Mr. Plaia and several others. Mrs. Davis is advised no cooking is to be done at:facility, occupants are to be restricted to first floor, repairs were to be made to correct electrical violations, put up two single station smoke detectors and one five-pound ABC extinguisher. Penisson to correct double cylinder dead bolts so that youth could exit the facility in the event of an emergency. *September 22, 1995, Community.Development Director Richard Chappell, sends a letter to then City Manager Ray Riley advising him of the status of 1930 Franklin_ in letter Chappell advises Rilev staff from Community Development,Building Codes, Fire Department and the Health Department are working with representatives of the Youth Rescue Mission to insure$60,150 in HUD Grant funds are being,used for code compliance renovations at 1930 Franklin. *January 24, 1996, Fire Inspector Ransom.Jones conducts fire inspection of 1930 Franklin, several violations are noted at time of inspection. Mrs. Davis is present for inspection, she is advised of the specific violations and given re-inspection date of February 5, 1996. Mrs. Davis signs and receives a copy of the fire inspection report. Fire Inspector Jones makes several re- inspections at 1930 Franklin,. Fire was caused by a cigarette being discarded inside the wall. *June 13, 2002,Beaumont.Fire/Rescue Engine 12 responds to 1930 Franklin in reference to a femal--having labor pains on second floor of 1930 Franklin. Engine is manned by Captain Earl White, Driver Billy Singletary, and Firefighter Wes Newcomer. After providing medical treatment to female giving birth, Captain White checks the east emergency exit and finds it locked. He advises occupants exit door is not to be locked while building is occupied. *June 1.4, 2002, Captain Brad Penisson and Captain Earl White return to 1930 Franklin and advise Mrs. Davis of a serious Life safety violation of Fire Prevention Code noted by Captain Earl Vs hite on June 13, 2002. Mrs. Davis states she understands and it would not happen again. "April 10, 2003, Captain Earl White is dispatched to 1930 Franklin after BPD Officer Tolley request his assistance at this location. After arriving on scene Captain White is advised the electrical service has been turned on illegally, he also finds the east emergency exit locked. Captain White issues a citation for the violation to black male Eric Brice Jones Captain White verifies with Entergy the electrical service has been turned or.illegally. He has Entergy respond to the scene and cut power to 1930 Franklin. *April 14, 2003, Fire Marshal Jack Maddox and Captain Earl White go to 1930 Franklin and advise residents the facilities fire alarm system is not capable of proper operations due to the power being cut to the facility. Maddox spoke with Delores Davis on the phone and advised her the facility was in violation of the Beaumont Fire Prevention Code. Due to the fact the facility does not have proper operating fire protection equipment, constituting a life safety hazard. He told her she could not operate this facility while these violations existed. At approximately 1OPM on the above date Fire Marshal Maddox and Captain White returned to 1930 Franklin to check the facility. The violations still existed and four occupants were still in the facility. Mrs. Davis was at this location at this time also and was again informed she could not operate the facility while violations existed. *April 15, 2003, at approximately 10PM Fire Marshal Maddox and Captain Earl White checked 1930 Franklin again. The violations still existed. At the time of this inspection, four persons not including Mrs. Davis were occupying the facility. Mrs. Davis informed Chief Maddox and Captain White the people were staying there because"they have no place else to go". Chief Maddox again informed Mrs. Davis she could not operate the facility while the violations existed. ORDINANCE NO. RECOMMENDATION Administration recommends the award of a three(3)year contract to Tomahawk Lawn Service for grounds maintenance services at nine (9) city parks at an estimated annual cost of$60,997.02. BACKGROUND Twelve (12) companies submitted bids on Thursday, May 1, 2003, for performing grounds maintenance services at nine(9)city parks. Grounds maintenance services include mowing, edging litter removal and sweeping once per week between March 1 and November 30, and biweekly from December 1 to February 28. The parks included in this contract are as follow: Charlton Pollard,Jacob's Street,Alice Keith,Babe Zaharias, Cottonwood, Perlstein, Liberia, Pine Street and Rogers Parks. Prices were requested per cutting per park. Based on the mowing schedule there will be 42 cuttings per year. The Parks Manager may reduce or increase the number of cuttings as needed with payments made per cutting cycle. The Parks and Property Services Division is responsible for managing the contract and inspecting the work. The contract term is three (3) years with annual percentage increases based on the consumer price index for all Urban Consumers(CPI-U). A contract termination provision is included should funds not be allocated in future budget years. Because ofthis relationship,the Parks and Property Services Manager will directly supervise this contract. The decision to contract the maintenance of these parks is a result of the reduction in force in August 2002 and January 2003. The Parks and Property Service Division reduced their workforce by eight (8)employees. Currently,there are three(3)additional vacancies in the Parks and Property Services Division that are not scheduled to be filled. Employees currently performing grounds maintenance services at these parks will be assigned to other park maintenance crews, resulting in a higher level of maintenance previously not performed on a scheduled basis. Additional services such as tree trimming and removal,beautification and frequent litter removal will be some of the duties assigned to the reorganized crews. RECOMMENDATION Administration recommends the purchase of twenty-six(26)personal computers for$1,737.95 each and seven(7)personal computers for$1,480.95 each from Gateway Companies,Inc. ofNorth Sioux City, South Dakota. BACKGROUND The State of Texas Cooperative Purchasing Program offers the Catalogue Purchasing Program for the purchase of high technology items. A list of Qualified Information Systems Vendors(QISV)is provided by the State for the procurement of high technology goods such as personal computers, software, and telecommunications systems. Vendors must offer a published catalog or an Internet site describing their products and prices. Local entities may contact a minimum of three(3)vendors for furnishing bids on specified products. In addition to price,the award of the bid may be based on criteria such as technical support,expansion and upgrading,and compatibility with existing systems. Bids were solicited from eight(8)QISV companies for thirty-three(33)personal computers with a minimum 2.53 Gigahertz(GHz)processor, 60 Gigabyte(GB)Hard Drive,and 512 Megabyte(MB) Random Access Memory (RAM). Seven (7) of the personal computers require a standard color monitor and a read-only CD ROM drive while twenty-six(26) of the personal computers require a flat monitor along with a read and write CD ROM drive. The personal computers will be issued to Fleet Management, Municipal Court, Community Development, Clean Community, Police Department, and various other City offices. The upgraded computers are required to replace obsolete terminals that will no longer operate in the City's telecommunications infrastructure. RECOMMENDATION A swimming pool and surrounding concrete are encroaching 6.65 feet into the City's seven and one half(7.5') utility easement for a distance of 37 feet. The easement is located at 7755 Chelsea Place and is described as being out of Lot 14 and west nine feet (9') of Lot 15, Block 1 of the Regency Park Addition. Administration recommends authorization to execute the License to Encroach. BACKGROUND The License to Encroach protects the City from liability and provides a thirty(30)day cancellation clause. RECOMMENDATION Administration recommends awarding a contract to Moncla's Inc., of Beaumont, Texas, for furnishing lunches for the Summer Food Service Program sponsored by the Recreation Division in the amount of$1.97 per lunch served. BACKGROUND The program,which is funded by the U.S.Department of Agriculture and administered by the Texas Department of Human Services,provides free,nutritious, and well balanced meals to any child up to eighteen(18)years of age. This is the twelfth year the Recreation Division has participated in this program. The Recreation Division will provide lunches at Sprott Park, Roberts Park, Alice Keith Park, Magnolia Park,Elmo Willard Library, and the L.L. Melton Y.M.C.A. The program will begin June 2, 2003 and continue through August 8, 2003. Lunches will be served Monday through Friday excluding July 4, 2003. The number of lunches to be served at each location will be determined by the enrollment in summer activities, although participation is not a requirement to receive a lunch. Last year approximately 12,807 meals were served at a cost of $1.95 per lunch for a total of $24,973.65. Bids were solicited from eight (8) food service vendors this year and Moncla's, Inc. submitted the sole bid of$1.97 per lunch. BUDGETARY IMPACT The cost of each lunch served will be reimbursed to the City from the Texas Department of Human Services.
