RECOMMENDATION
The Administration recommends denial of the request for a zone change from RS (Residential
Single Family Dwelling)to RM-H(Residential Multiple Family Dwelling-Highest Density)District
and a specific use permit for an acupuncture clinic at 4215 Folsom.
BACKGROUND
Helen Zhou,the property owner,is requesting this rezoning and specific use permit for her property
at 4215 Folsom so that she can operate an acupuncture clinic.
Ms. Zhou states that she would continue to live in the house. The acupuncture clinic would occupy
about 50% of the structure. The clinic would operate Monday - Friday, 9 a.m. to 4 p.m. She
estimates that a maximum of 8-10 customers a day would visit the clinic.
The Development Strategies element of the Comprehensive Plan designates this area as "Stable".
These areas are generally characterized by good to excellent structural conditions and neighborhoods
that are free from blighting influences such as incompatible land uses, dilapidated and derelict
buildings and a deteriorated or poor public infrastructure.
This property sits at a very busy corner. To the east of the subject property are commercial uses.
Three residential lots to the north are zoned RM-H. Two of those lots (3755 and 3825 W. Lucas)
front W.Lucas and side and/or front GC-MD zoning. The third lot(4210 Folsom)fronts on Folsom
and is across from GC-MD zoning along W.Lucas. In 1998,a request was denied to rezone that lot
to GC-MD. These three lots could be developed with limited commercial uses with a specific use
permit.
The RM-H zoning remnants along W. Lucas are left over from the original R-2 zoning put in place
in 1955. Since then,various properties along W.Lucas have been rezoned to RS,NSC and GC-MD.
On the west side of W. Lucas, RS zoning extends from the south side of Folsom to just north of
Gladys.
While staff recognizes that the subject property is at a busy intersection and across the street from
commercial uses, staff is concerned over the encroachment of commercial uses into a stable single
family residential area. And while the argument could be made that due to its location,the property
is no longer suitable for residential, the applicant is now living and does intend to continue to live
on the property. This request would not be in conformance with the Comprehensive Plan.
Since the Joint Public Hearing,Mrs.Zhou has told the Planning Manager that she could do without
a sign. In addition, the business could operate with one less parking space than the seven shown.
BUDGETARY IMPACT
None.
PREVIOUS ACTION
At a Joint Public Hearing with City Council held April 21, 2003, the Planning Commission voted
8:0 to deny a request for a zone change from RS (Residential Single Family Dwelling) to RM-H
(Residential Multiple Family Dwelling-Highest Density) District and a specific use permit for an
acupuncture clinic at 4215 Folsom.
SUBSEQUENT ACTION
None.
RECOMMENDED BY
Planning Commission, City Manager,Public Works Director and the Planning Manager.
RECOMMENDED MOTION
Approve/Deny a request for a zone change from RS(Residential Single Family Dwelling)to RM-H
(Residential Multiple Family Dwelling-Highest Density) District and a specific use permit for an
acupuncture clinic at 4215 Folsom.
Note: "THE 20% RULE"
Section 30-40. D. of the Zoning Ordinance states the following:
Protest: The City Council shall not amend, supplement, change, modify or repeal any
regulation,restriction or boundary or approve a Specific Use Permit where a protest against
such change, signed by the owners of twenty(20)percent or more either of the area of the
lots included in such proposed change or of the lots or land immediately adjoining the same
and extending two hundred (200) feet therefrom, except by the favorable vote of three-
fourths (3/4) of all the members of City Council.
This means that in order to approve a zone change or specific use permit when the 20%rule
has been invoked at least six Council members must vote in favor of the Ordinance.
On File 1663-Z/P,a protest of 31.9%was received,therefore invoking the Rule on this case.
ORDINANCE NO.
ENTITLED AN ORDINANCE GRANTING A SPECIFIC USE
PERMIT TO ALLOW AN ACUPUNCTURE CLINIC IN A RM-H
(RESIDENTIAL MULTIPLE FAMILY DWELLING-HIGHEST
DENSITY) DISTRICT, LOCATED AT 4215 FOLSOM IN THE
CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS.
WHEREAS, the City Council for the City of Beaumont desires to issue a specific
use permit to Helen Zhou to allow an acupuncture clinic in a RM-H (Residential Multiple
Family Dwelling-Highest Density) District located at 4215 Folsom, being Lots 1 and 2,
Block 36, Calder Highlands Extension, City of Beaumont, Jefferson County, Texas,
containing 0.41 acres, more or less, as shown on Exhibit "A" attached hereto; and,
WHEREAS, the City Council is of the opinion that the issuance of such specific use
permit is in the best interest of the City of Beaumont and its citizens;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
Section 1.
That a specific use permit to allow an acupuncture clinic in a RM-H (Residential
Multiple Family Dwelling-Highest Density) District located at 4215 Folsom, being Lots 1
and 2, Block 36, Calder Highlands Extension, City of Beaumont, Jefferson County, Texas,
containing 0.41 acres, more or less, as shown on Exhibit "A" attached hereto, is hereby
granted to Helen Zhou, her legal representatives, successors and assigns.
Section 2.
That the specific use permit herein granted is expressly issued for and in
accordance with each particular and detail of the site plan attached hereto as Exhibit "B"
and made a part hereof for all purposes.
Section 3.
Notwithstanding the site plan attached hereto, the use of the property herein above
described shall be in all other respects subject to all of the applicable regulations
contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended.

THE CODE OF ORDINANCES OF BEAUMONT,TEXAS,AND
IN PARTICULAR THE BOUNDARIES OF THE ZONING
DISTRICTS, AS INDICATED UPON THE ZONING MAP OF
BEAUMONT, TEXAS, BY CHANGING THE ZONING OF
PROPERTY PRESENTLY ZONED RS (RESIDENTIAL
SINGLE FAMILY DWELLING) DISTRICT TO RM-H
(RESIDENTIAL MULTIPLE FAMILY DWELLING-HIGHEST
DENSITY) DISTRICT FOR PROPERTY LOCATED AT 4215
FOLSOM, BEAUMONT, JEFFERSON COUNTY, TEXAS;
PROVIDING FOR SEVERABILITY; PROVIDING FOR
REPEAL AND PROVIDING A PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
That Chapter 30 of the Code of Ordinances of Beaumont, Texas, and in particular
the boundaries of the zoning districts, as indicated upon the Zoning Map of the City of
Beaumont, referred to in Section 30-513 thereof, is hereby amended by changing the
zoning of property presently zoned RS (Residential Single Family Dwelling) District to
RM-H (Residential Multiple Family Dwelling-Highest Density) District for property located
at 4215 Folsom, being Lots 1 and 2, Block 36, Calder Highlands Extension, City of
Beaumont, Jefferson County, Texas, containing 0.41 acres, more or less, as described on
Exhibit "A," and the official zoning map of the City of Beaumont is hereby amended to
reflect such changes.
Section 2.
That, in all other respects, the use of the property herein above described shall be
subject to all of the applicable regulations contained in Chapter 30 of the Code of
Ordinances of Beaumont, Texas, as amended.
Section 3.
That if any section, subsection, sentence, clause or phrase of this ordinance, or the
application of same to a particular set of persons or circumstances, should for any reason
be held to be invalid, such invalidity shall not affect the remaining portions of this
ordinance, and to such end, the various portions and provisions of this ordinance are
declared to be severable.
Section 4.
That all ordinances or parts of ordinances in conflict herewith are repealed to the
extent of the conflict only.
Section 5.
That any person who violates any provision of this ordinance shall, upon conviction,
be punished, as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.

Conduct an election of Mayor Pro Tempore
The City Council shall elect one of its members as Mayor Pro Tempore for a one(1) year term.
The Mayor Pro Tempore shall perform the duties of the Mayor in case of the absence or inability
of the Mayor to perform the duties of his/her office, and, if a vacancy occurs, shall become Mayor
for the unexpired term. If the Mayor Pro Tempore is unwilling to assume the duties of Mayor in
the event of a vacancy in that office,then the City Council shall fill the vacancy from their
membership after the vacancy in the City Council is filled as provided in Section 7 of Article III of
the Charter of the City of Beaumont.

REQUESTED ACTION: Council consider a resolution authorizing the award of a contract for
construction of the Twenty-Third Street Pavement Improvement
Project in the amount of$1,824,683.85 to Brystar Contracting,Inc.
RECOMMENDATION
Administration recommends approval and execution of a contract with Brystar Contracting, Inc.
contractor in the amount of $1,824,683.84 for the construction of the Twenty-Third Street
Pavement Improvement Project. The MBE goal will be met through subcontracts with the certified
MBE firm of South East Texas Precast in the amount of$190,000 which represents 10% of the
bid amount.
Administration recommends authorization to award this project.
BACKGROUND
On April 24, 2003, the City of Beaumont received eight (8) bids for the Twenty-Third Street
Pavement Improvement Project. The lowest bid was submitted by Brystar Contracting, Inc. in the
amount of $1,824,683.85. The estimated cost of the project prior to receipt of the bid was
$1,900,000. The list below identifies the total bid received from each contractor:

RECOMMENDATION
Administration recommends approval of increasing the Wastewater Treatment Plant Electrical
Improvements Phase 1 contract amount by$495,495.
BACKGROUND
On July 23,2002,City Council authorized the City Manager to execute a contract with Boyer,Inc.,
in the amount of$ 1,982,981 for electrical improvements at the Wastewater Treatment Plant. The
work to be performed under this contract included the replacement of the existing loop feed electrical
system for the main plant, providing transformers, motor control centers, motor control center
buildings, switches, conductors and all appurtenances for a complete and operable system. Also
included in the contract was a motor control center and conductors for the chlorine control basin,
aeration ponds and the final effluent pump station.
The second phase of electrical improvements at the Wastewater Treatment Plant is the installation
and programing of a process control system. The process control system allows the operator to
monitor and operate the plant from a central location.The engineering estimate to install and program
the process control system and remodel the existing pump station to building to accommodate the
process control system, under a separate contract, is approximately$1,300,000.
It was determined that a significant savings could be realized if the City was to program the process
control system and if a new building was installed rather than remodeling the existing building.
However, the installation of the system and the building would have to be done by others. The
proposed Change Order 1 will authorize Boyer to install a precast control building, ultrasonic
transducers, EMH-7, sludge pumps/VFD's flow meter raceway, Supervisor Control and Data
Acquisition(SCADA)System,concrete steps,remodel the pump station building-including asbestos
abatement and modifying the wiring in motor control center 1. An estimated $700,000 saving will
be realized by installing the system, building and programming in this manner.
BUDGETARY IMPACT
Funds for the Change Order are available in the Water Utilities Capital Improvement Fund.

RECOMMENDATION
Administration recommends authorization to submit a section of Old Dowlen Road to the SETRPC
for inclusion in the CMAQ program.
BACKGROUND
The SETRPC-MPO has made a special call for CMAQ related projects. Projects will be evaluated
and scored by the Jefferson-Orange-Hardin Regional Transportation Study (JOHRTS) Technical
Advisory Committee. These scores and project readiness results will be used to determine projects
eligible for the CMAQ program.
The project under consideration for submittal is Old Dowlen Road, from Dowlen Road to a point
2,200 feet from Dowlen Road. The project will provide wider lanes, a continuous turn lane and
added turning lanes at the intersection of Old Dowlen Road and Dowlen Road.
BUDGETARYIMPACT
Eighty percent(80%)of the anticipated$1,265,000 project cost will be provided by Federal, State
and local sources. The remaining twenty percent 20% ($253,000) will be provided by the local
sponsor (City).

State to maintain traffic signal preemption devices at thirty-one locations.
BACKGROUND
The State of Texas acting by and through the TxDOT has received federal funding through the
Intermodal Surface Transportation and Efficiency Act of 1991 (ISTEA) and the Transportation
Equity Act for the 21' Century (TEA-21) codified under Title 23 U.S.C. Section 101 et seq., to
install signal preemption devices at thirty-one (3 1) locations in the City of Beaumont. All labor,
equipment and material costs associated with the installation of the devices is funded 100%
through this project. In order for the signal preemption devices to be installed, an agreement to
maintain the devices must be executed between the City and State.
BUDGETARY
None. This agreement allows the State of Texas to complete the construction of the devices
including all labor, equipment and material costs. The City then becomes responsible for the
maintenance of these devices.

Administration recommends the purchase of seventeen (17) Code 3 LED X2100 Police vehicle
lightbars from All America Sales Corporation of Houston, Texas for$1,896.23 each.
BACKGROUND
City Council has previously approved the purchase of seventeen(17)new Chevrolet Impalas to be used
as Police patrol vehicles. These cars will require the installation of emergency vehicle lights prior to
being placed into service as patrol vehicles.
The Code 3 brand LED X2100 is a low profile emergency lightbar with clear lenses. The lack of color
and low two(2)inch profile gives the lightbar an inconspicuous appearance on top of a patrol vehicle.
The lightbar remains virtually unnoticed until the red and blue emergency lights are activated. A
mounting kit is included with the lightbar for use by the City's Fleet Management to aid in installation.
Bids were solicited from nine (9) Code 3 brand emergency lighting distributors. Five (5) bids were

BACKGROUND
In 1990, Congress passed the Clean Water Act (CWA) which, with subsequent amendments,
established the National Pollution Discharge Elimination System (NPDES) which requires cities
having populations greater than 100,000 people to obtain a permit to discharge storm water
collected by the City's storm sewer system into "public waters." In compliance with the
provisions of this legislation the City of Beaumont and Jefferson County Drainage District No. 6
(DD#6), applied for and, effective October 1,1998, were issued by USEPA, a permit for the
discharge of storm water to the Neches River and Hillebrandt Bayou.
The current NPDES permit will expire in October 2003 and requires renewal as a TPDES permit.
The permit application requires that the signatory on the application be an official authorized by
Council.

RECOMMENDATION
Administration recommends approval of an application for new funding for the Southeast Texas Auto
Theft Task Force.
BACKGROUND
As result of Title 43, Part III, Chapter 57 of the Texas Administrative Code, local governmental
agencies may apply for one year funding for a State Grant through the Texas Automobile Theft
Prevention Authority. The City ofBeaumont has been the grantee ofthe Southeast Texas Auto Theft
Task Force since 1993. The Task Force is presently operating on $549,452 funded by the Texas
Automobile Prevention Authority and $201,373 of cash matches by the participating agencies.
The Southeast Texas Auto Theft Task Force is a multi jurisdiction agency comprised of five
personnel from the Beaumont Police Department, and one each from Jefferson County Sheriff's
Office, Pt. Arthur Police Department, Orange County District Attorney's Office, and the Hardin
County Sheriffs Office. Since the inception of the Task Force motor vehicle thefts have decreased
by 63% in Jefferson County from 2762 in 1992 to 1034 in 2002. The Task Force currently covers
Jefferson, Orange, Hardin, and Jasper Counties. The Task Force focuses efforts in two areas:
investigations, which target thefts for profit, street gang related thefts, and repeat offenders; and
public awareness, which uses media campaigns, training, and public presentations to promote
prevention techniques and awareness.
The application for FY 2004 is in the amount of$879,961. State funds in the amount of$552,931
are being requested from the Automobile Theft Prevention Authority. It is estimated that the
participating agencies will provide$183,488 of matching funds to assist with the operation of the
Task Force, along with$143,542 considered in-kind match.
BUDGETARY IMPACT
The requested State Funds will pay salary and benefits,estimated at$210,793 for one Lieutenant and
two patrol officers. The City's cash match will pay for the salaries and benefits, estimated at
$144,957, for one Sergeant Investigator and one patrol officer. These are existing positions within
the Police Department, and will not increase the overall City budget. Included in this year's
application are one Sergeant Investigator,and one detective specialist. These are existing auto theft
investigators that are housed in the task force office.They are listed as an in-kind match of$143,542,
and will not have a budgetary impact on the City budget.They are shown on the grant to emphasize
the support of the program by the City.
The operating expenses for the Beaumont officers assigned to the Task Force are estimated at
$66,434. Requested State funds will cover$53,934 of the cost. The estimated cash match by the
City is $12,500, which provides, fuel, oil, and maintenance for all Beaumont Police Department
personnel assigned to the Task Force. The only effect this will have on the City Budget is the
$12,500 estimated for fuel and maintenance on the five task force vehicles.
PREVIOUS ACTION
Resolution No. 02-094 was passed by The City Council on May 3, 2002 authorizing the City
Manager to apply for and execute all necessary documents to authorize acceptance, receive and
disburse grant funds,and to execute inter-local agreements related to the operation of the Southeast
Texas Auto Theft Task Force for fiscal year 2003.
