REQUESTED ACTION: Consider authorizing the execution of a take-over agreement between
the City of Beaumont and Bituminous Casualty Corporation and Old
Republic Surety Company for the completion of the construction of
the 5MG Clearwell Project.
RECOMMENDATION
It is recommended that the Council adopt a resolution authorizing the City Manager to execute a
take-over agreement with Bituminous Casualty Corporation and Old Republic Surety Company for
the completion of construction of the 5MG Clearwell Project.
BACKGROUND
A contract was entered into on June 11,2001,between the City of Beaumont and Blacksher and Son,
Inc. for the construction of the 5MG Clearwell and High Service/Filter Backwash Pump Station in
the amount of$6,575,000. Because of various contract violations,the contract with Blacksher and
Son was terminated December 5, 2002. At that time, the surety companies on the project,
Bituminous Casualty Corp. and Old Republic Surety,were asked to take over the job. A take-over
agreement has been negotiated and the surety companies will complete the project in accordance
with the terms of the original contract. The surety companies will pay to the City the sum of
$61,609.87 for additional expenses incurred from the date that the contract called for substantial
completion to present. Additionally,the take-over agreement provides for the payment to the City
of a maximum of $10,000 per month for additional engineering expenses associated with the
completion of the project.
BUDGETARYIMPACT
There are no new funds implicated by this agreement and there are sufficient funds in this project
account to complete the project.
PREVIOUS ACTION
None associated with this take-over agreement.
SUBSEQUENT ACTION
Acceptance of the project and final payment to the surety companies.

REQUESTED ACTION: Consider an amendment to the existing food manager certification fees
as specified in Chapter 11; Section 11-84 (a) and Section 11-88.
RECOMMENDATION
Administration recommends that the City Council approve the proposed fee increases.
BACKGROUND
Currently, the Health Department charges fees for a number of health related services including a
$60.00 fee for food manager training and certification. Each year, approximately 210 food managers
complete the twelve hour course taught by city staff. At the conclusion of the class, each student
must complete and pass a state test before a food manager's certificate can be issued. In the past,
the state assessed the city a fee of$7.00 per test booklet and the cost for the booklets was absorbed
by the city. However, effective September 1, 2002, test booklet fees were increased to $17.00 per
booklet. As a result, it has become cost prohibitive for the city to continue to absorb these costs.
Staffrecommends increasing the total cost of the course and certification from$60 to$95. Staff also
recommends a proposed re-test fee of$20.00 for students retaking the test. This fee will cover the
actual cost of the test booklets including costs for mailing the completed tests to the state.
BUDGETARY IMPACT:
None. Increase in revenue will be offset by projected increase in costs.

City Manager, Public Health Director, and Health Services Manager.

Sec. 11-84 (a).Issuance of food service manager's certification certificate.
A.food service manager's certificate shall be issued to any person who submits the required
issuance fee and:
(a)Completes the City of Beaumont Food Service Manager's Certilicatimi Course or shows
evidence of completion, within the past three(3)years, of a course of study which is listed
in the Texas Department of Health Food Service Worker's Training Program. Course
Registry, and achieves the required minimum score of seventy-five (75)points out of a
possible one hundred(l.00)points on a written examination administered or approved by the
:regulatory authonty.An applicant who fails to achieve a minimum score of seventy-five(75)
on the written examination may repeat the examination.one(1)time without repetition of the
food sanitation course of study by paying a retesting fee of$,20.00; or

ORDINANCES; PROVIDING FOR SEVERABILITY;
PROVIDING FOR REPEAL; AND PROVIDING A PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
That Chapter 11, Section 11-84(a) of the Code of Ordinances of the City of
Beaumont be and the same is hereby amended to read as follows:
Sec. 11-84(a). Issuance of food service manager's certification certificate.
A food service manager's certificate shall be issued to any person who
submits the required issuance fee and:
(a) Completes the City of Beaumont Food Service Manager's Certification
Course or shows evidence of completion, within the past three (3)
years, of a course of study which is listed in the Texas Department of

Manager's Certification Course under section 11-83(2) herein may attend the food
service sanitation course without payment of the required enrollment fee, so long as
the training is being provided by city staff subject to an availability of space.
(c) The fee for replacement of a valid and current certificate which has been lost, stolen,
or damaged shall be Ten ($10) Dollars. The fee for taking a re-test shall be Twenty
($20) Dollars.
(d) Fees for issuance of certificates will not be refunded in the event that no certificate
is issued.
Section 3.
That if any section, subsection, sentence, clause or phrase of this ordinance, or the
application of same to a particular set of persons or circumstances should for any reason be held
to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such
end the various portions and provisions of this ordinance are declared to be severable.
Section 4.
All ordinances or part of ordinances in conflict herewith are repealed to the extent of the
conflict only.
Section 5.
That any person who violates any provision of this ordinance shall, upon conviction, be
punished as provided in Section 1-8 of the Code of Ordinances of the City of Beaumont, Texas.

REQUESTED ACTION: Council consider a request to enact a resolution to grant certain
insurance and pay benefits for a period of no more than 180 days to
City of Beaumont employees who are members of the National Guard
or military reserves.
RECOMMENDATION
Administration requests that Council grant City of Beaumont employees called to active duty in the
reserves or National Guard compensation in the amount of the difference between their civilian
salary or wage and military pay.
During the 180-day benefit period, employees' dependents shall be allowed to continue their
established medical coverage. Their coverage will be equal to that provided to other members of the
employee's job class. The cost to the employee will be the rate paid by others in the same job class.
BACKGROUND
The President of the United States, George W. Bush, is activating members of the National Guard
and Military Reserves for a possible war with Iraq. The City has identified 21 current employees
eligible for consideration under this resolution.
BUDGETARY IMPACT
None. Employee salaries are budgeted.
PREVIOUS ACTION
During the Persian Gulf War,the City of Beaumont passed two resolutions totaling 225 days which
provided the same benefits as recommended herewith. During the aftermath of September 11,2001,
the City of Beaumont passed resolution 01-232 on October 9, 2001, which provided the same
benefits as recommended herewith for 180 calendar days. On April 24,2002,the City of Beaumont
passed resolution 02-096 extending the initial resolution for an additional 180 calendar days.
SUBSEQUENT ACTION
None.
RECOMMENDED BY
City Manager.
RECOMMENDED MOTION
Approve/Deny a request to grant certain insurance and pay benefits for a period of no more than 180

BACKGROUND
It has been determined that these structures meet the definition of a dangerous structure because
they have deteriorated such that they are no longer considered suitable for repair.
BUDGETARY IMPACT
City may incur the cost of demolition.
PREVIOUS ACTION
These structures have been inspected by the Clean Community Department and found to be
dangerous structures as defined by the City of Beaumont's Code of Ordinances, Article III,
Dangerous Structures, Section 14-50.
SUBSEQUENT ACTION
Clean Community Department will demolish or cause to be demolished said structures.
RECOMMENDED BY
City Manager and Clean Community Department Director.
RECOMMENDED MOTION
Approve/Deny the authorization to condemn and raze the above listed dangerous structures.
REQUESTED ACTION: Council consider after public hearing a raze or repair order
on the following one (1) structure.

but could be rehabilitated.

None at this time.
PREVIOUS ACTION
The above structures were issued notification of being substandard as defined by the City of
Beaumont's Code of Ordinances, Article III, Dangerous Structures, Section 14-50.
SUBSEQUENT ACTION
Staff will enroll owner in a work program and monitor work for allotted time granted by Council.

purchased I told him that he could not do electrical or plumbing and that the electrical work that had
already been done could not pass code because there had not been a permit bought by a licensed electrical
contractor. I also told him no one could live in the structure until total compliance of the structure Staff

REQUESTED ACTION: Consider an amendment to the existing food manager certification fees
as specified in Chapter 11; Section 11-84 (a) and Section 11-88.
RECOMMENDATION
Administration recommends that the City Council approve the proposed fee increases.
BACKGROUND
Currently, the Health Department charges fees for a number of health related services including a
$60.00 fee for food manager training and certification. Each year, approximately 210 food managers
complete the twelve hour course taught by city staff. At the conclusion of the class, each student
must complete and pass a state test before a food manager's certificate can be issued. In the past,
the state assessed the city a fee of$7.00 per test booklet and the cost for the booklets was absorbed
by the city. However, effective September 1, 2002, test booklet fees were increased to $17.00 per
booklet. As a result, it has become cost prohibitive for the city to continue to absorb these costs.
Staffrecommends increasing the total cost of the course and certification from$60 to$95. Staff also
recommends a proposed re-test fee of$20.00 for students retaking the test. This fee will cover the
actual cost of the test booklets including costs for mailing the completed tests to the state.
BUDGETARY IMPACT:
None. Increase in revenue will be offset by projected increase in costs.

BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
That Chapter 11, Section 11-84(a) of the Code of Ordinances of the City of
Beaumont be and the same is hereby amended to read as follows:

REQUESTED ACTION: Council consider a request to enact a resolution to grant certain
insurance and pay benefits for a period of no more than 180 days to
City of Beaumont employees who are members of the National Guard
or military reserves.
RECOMMENDATION
Administration requests that Council grant City of Beaumont employees called to active duty in the
reserves or National Guard compensation in the amount of the difference between their civilian
salary or wage and military pay.
During the 180-day benefit period, employees' dependents shall be allowed to continue their
established medical coverage. Their coverage will be equal to that provided to other members of the
employee's job class. The cost to the employee will be the rate paid by others in the same job class.
BACKGROUND
The President of the United States, George W. Bush, is activating members of the National Guard
and Military Reserves for a possible war with Iraq. The City has identified 21 current employees
eligible for consideration under this resolution.
BUDGETARY IMPACT
None. Employee salaries are budgeted.
PREVIOUS ACTION
During the Persian Gulf War,the City of Beaumont passed two resolutions totaling 225 days which
provided the same benefits as recommended herewith. During the aftermath of September 11,2001,
the City of Beaumont passed resolution 01-232 on October 9, 2001, which provided the same
benefits as recommended herewith for 180 calendar days. On April 24,2002,the City of Beaumont
passed resolution 02-096 extending the initial resolution for an additional 180 calendar days.

RECOMMENDATION
That City Council condemn these twenty-eight (28) structures and order owner to raze within ten
(10) days.
BACKGROUND
It has been determined that these structures meet the definition of a dangerous structure because
they have deteriorated such that they are no longer considered suitable for repair.
BUDGETARY IMPACT
City may incur the cost of demolition.
PREVIOUS ACTION
These structures have been inspected by the Clean Community Department and found to be
dangerous structures as defined by the City of Beaumont's Code of Ordinances, Article III,
Dangerous Structures, Section 14-50.
SUBSEQUENT ACTION
Clean Community Department will demolish or cause to be demolished said structures.
RECOMMENDED BY
City Manager and Clean Community Department Director.
RECOMMENDED MOTION
Approve/Deny the authorization to condemn and raze the above listed dangerous structures.
REQUESTED ACTION: Council consider after public hearing a raze or repair order
on the following one (1) structure.
