REQUESTED ACTION: Council consider a request for a specific use permit to allow guest
quarters in an RS (Residential Single Family Dwelling)District at 235 Canterbury Drive.
RECOMMENDATION
The Administration recommends approval of a specific use permit to allow guest quarters in an RS
(Residential Single Family Dwelling) District at 235 Canterbury Drive, subject to the guest house
not being used for rental purposes.
BACKGROUND
In June,2002,the Planning Division received a complaint that the accessory structure at the rear of
23 5 Canterbury Drive was being used as a residential structure. In July,the property owner informed
staff that the person that had been living in the structure had moved out in mid-June.
As a result of this complaint, Mr. and Ms. Jeffrey Coulter, the property owners, have made
application to use the structure as guest quarters.
The applicants state that they purchased the house in 1999. The accessory structure was already on
the property. The previous owner told the Coulters that they had converted the garage to living
quarters for an ill parent. The conversion was done without any building permits.
The Coulters state that they have no intention of using the structure for rental purposes,but as a guest
house only.
BUDGETARYIMPACT
None.
PREVIOUS ACTION
At a joint Public Hearing with City Council held November 18, 2002, the Planning Commission
voted 5:0 to approve a specific use permit to allow guest quarters in an RS (Residential Single
Family Dwelling) District at 235 Canterbury Drive, subject to the guest house not being used for
rental purposes.
SUBSEQUENT ACTION
None.
RECOMMENDED BY
Planning Commission, City Manager, Public Works Director and the Planning Manager.

ENTITLED AN ORDINANCE GRANTING A SPECIFIC USE
PERMIT TO ALLOW GUEST QUARTERS IN AN RS
(RESIDENTIAL SINGLE FAMILY DWELLING) DISTRICT
LOCATED AT 235 CANTERBURY DRIVE IN THE CITY OF
BEAUMONT, JEFFERSON COUNTY, TEXAS.
WHEREAS, the City Council for the City of Beaumont desires to issue a specific
use permit to Mr. and Ms. Jeffrey Coulter, to allow guest quarters in an RS (Residential
Single Family Dwelling) District located at 235 Canterbury Drive, being Lot 27, Block 4,
Caldwell Addition, City of Beaumont, Jefferson County, Texas, containing 0.255 acres,
more or less, as shown on Exhibit "A" attached hereto; and,
WHEREAS, the City Council is of the opinion that the issuance of such specific use
permit is in the best interest of the City of Beaumont and its citizens, subject to the
hereinafter described conditions;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
Section 1.
That a specific use permit to allow guest quarters in an RS (Residential Single
Family Dwelling) District located at 235 Canterbury Drive, being Lot 27, Block 4, Caldwell
Addition, City of Beaumont, Jefferson County,Texas, containing 0.255 acres, more or less,
as shown on Exhibit"A" attached hereto, is hereby granted to Mr. and Ms. Jeffrey Coulter,
their legal representatives, successors and assigns, subject to the following condition:
P. The guest house will not be used for rental purposes.
Section 2.
That the specific use permit herein granted is expressly issued for and in
accordance with each particular and detail of the site plan attached hereto as Exhibit"B"
and made a part hereof for all purposes.
Section 3.
Notwithstanding the site plan attached hereto, the use of the property herein above
described shall be in all other respects subject to all of the applicable regulations
contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended.

RECOMMENDATION

(Residential Conservation and Revitalization)District at 2680 McFaddin.
BACKGROUND
Dave Jones,the applicant,wishes to use the structure at 2680 McFaddin as the bookkeeping office
for the eight Novrozsky restaurants in the area. Mr. Jones and two employees will work out of the
building. The building previously had a specific use permit for the operation of a day spa.
Within the 2600 block of McFaddin, there are a number of businesses operating. This use will
complement and not detract from the neighborhood.
BUDGETARYIMPACT
None.
PREVIOUS ACTION
At a joint Public Hearing with City Council held November 18, 2002, the Planning Commission

RECOMMENDATION
The Administration recommends approval of a specific use permit to allow a church in an LI(Light
Industrial)District at 1170 Montrose, subject to the fire gate along Amelia Street remaining closed
except for emergencies.
BACKGROUND
The Family Worship Center is in the process of buying the former night club property located at
1170 Montrose for use as a worship center.
The Family Worship Center activities will include adult worship services, children and youth
services,and nursery/toddler care for families. Sunday worship services will consist of one service
from 10 a.m. to 12 p.m. Wednesday night services will run from 6:30 p.m. to 8:00 p.m. Other
activities may include BBQ dinners, fall festivals and other group fellowships.

None.

RECOMMENDATION
The Administration recommends approval of a specific use permit to allow church related parking
facilities in an RM-H(Residential Multiple Family Dwelling-Highest Density)District at 2590,2608
and 2650-52 Sabine Pass including an 8' tall wooden fence along the interior lot lines and with a
modification to the landscaping requirements along the interior lot lines of each parking lot.
BACKGROUND
Long Architects, Inc., the applicant, is requesting a specific use permit to allow church related
parking at 2590, 2608 and 2650-52 Sabine Pass.
Divine House of Refuge is building a new 12,500 sq. ft. church at the southeast corner of Martin
Luther King Parkway and Sabine Pass. That property is zoned GC-MD. The church currently has
a sanctuary at 2650-52 Sabine Pass. This structure, as well as several other dilapidated structures,
will be torn down and the properties utilized for parking. These lots will serve the church during
Sunday worship services and occasionally during the week for Bible study and other fellowship
activities.
The Zoning Ordinance allows required parking to be located within 400 feet of the primary facility.

WHEREAS, the City Council for the City of Beaumont desires to issue a specific
use permit to Long Architects, Inc., to allow church related parking facilities in an RM-H
(Residential Multiple Family Dwelling-Highest Density) District located at 2590, 2608 and
2650-52 Sabine Pass, being Lot 1, Block 27, and Lots 2, 3, 5 and 6, Arlington Addition,
City of Beaumont, Jefferson County, Texas, containing 0.803 acres, more or less, as
shown on Exhibit "A" attached hereto; and,
WHEREAS, the City Council is of the opinion that the issuance of such specific use
permit is in the best interest of the City of Beaumont and its citizens, subject to the
hereinafter described conditions;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
Section 1.
That a specific use permit to allow church related parking facilities in an RM-H
(Residential Multiple Family Dwelling-Highest Density) District located at 2590, 2608 and
2650-52 Sabine Pass, as shown on Exhibit"A' attached hereto, is hereby granted to Long
Architects, Inc., its legal representatives, successors and assigns, subject to the following
conditions:
► Installation of an eight (8) foot wooden fence along the interior lot lines.
► Installation of a maximum of 10' of landscaping along the interior lot lines of
each parking lot where space permits.
Section 2.
That the specific use permit herein granted is expressly issued for and in
accordance with each particular and detail of the site plan attached hereto as Exhibit "B"
and made a part hereof for all purposes.
Section 3.
Notwithstanding the site plan attached hereto, the use of the property herein above
described shall be in all other respects subject to all of the applicable regulations
contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended.

Doyle King, the property owner, is building a house for his elderly, handicapped parents at 8150
Walker Road. Mr.King states that his situation has recently changed so that he would like to convert
the garage into a separate living quarters for a full-time care giver and driver for his parents.

Thuy Truong has purchased Lot 32,Neches Terrace Addition and would like to build a 1,000 sq.
ft.beauty shop and related parking on the north half of the lot. Ms.Truong has no plans for the south
half of the property at this time. The property is immediately adjacent to a dental office to the east.
The subject property and the dental office are zoned RM-H.

RECOMMENDATION
The Administration recommends approval of the Economic Development Plan Element of the
Comprehensive Plan of the City of Beaumont.
BACKGROUND
The City Charter requires that each of the four elements of the Comprehensive Plan be re-adopted
every two years. As a result,the currently adopted Economic Development Plan was re-evaluated
and minor changes made. Staff is now asking that the Planning Commission and the City Council
adopt the Economic Development Plan as submitted.
The Economic Development Plan element of the Comprehensive Plan provides general policy
guidance on addressing economic growth to the Planning Commission,City staff and City Council.
While the City contracts with the Beaumont Chamber of Commerce for various economic
development activities, the City will continue to leverage the resources available to it to attract
private sector investments which will create or retain jobs and/or increase the tax base.
The Economic Development Plan element recognizes the need for the City to cooperate with the
Chamber of Commerce, the Partnership of Southeast Texas, the Convention and Visitors Bureau,
BUILD,Inc./Beaumont Main Street,Entergy and other groups in marketing Beaumont as a business
location and tourist destination. It also recognizes that quality of life issues are important when
encouraging a climate which facilitates business growth and sustainability.

PREFACE
On April 5, 1986, Beaumont's voters approved a major update of the City Charter. Most of the
Charter revisions were intended to improve the way the City Government carries out its
responsibilities to the community.
One important change was a requirement for a new component to the City's Comprehensive Plan.
The Comprehensive Plan provides, in written and graphic form goals, objectives, policies and
proposals for Beaumont's future physical growth and development. Elements of the Plan address
land use, transportation, and parks, recreation and open space.
In the Charter election, the citizens voted to add an Economic Development element to the
Comprehensive Plan. The new element was proposed by the City staff for two major reasons. First,
most of the physical development policies and proposals contained in the Comprehensive Plan are
closely tied to the related trends of employment and population growth. The physical development
goals of the Plan cannot be achieved without expansion of Beaumont's economy. Second,the state
of the economy is the most important development issue in Beaumont in terms of its direct effects
upon the present and future quality of life of all citizens.
With its adoption, the Economic Development Policy Plan will provide general policy guidance to
the Planning Commission, City staff and City Council.

DEFINITION OF ECONOMIC DEVELOPMENT
Economic development is a widely discussed, but not always understood, concept. Economic
development is often seen as the attraction of new industries. While attraction of new industry is
certainly a worthwhile goal and should be an important part of any comprehensive economic
development program, there should be activities designed to retain and expand existing businesses
and industries and to create entirely new businesses. Research indicates that most industrial
relocations involve moving to a new site within the same metropolitan area and that the number of
organizations in the United States actively soliciting industrial prospects greatly exceeds the number
of new industrial plants built each year. Most economic development practitioners agree that efforts
at industrial retention/expansion and development of new small local businesses and industries often
offer the greatest potential for successful economic development. Economic development also
involves strategic planning: setting goals, determining the competitive strengths and weaknesses of
the area economy and devising a course of action to achieve the desired goals.
For the purpose if this plan, economic development is defined as follows:
ECONOMIC DEVELOPMENT IS THE PROCESS OF USING PUBLIC
AND PRIVATE RESOURCES TO CREATE NEW JOBS. THIS IS DONE
THROUGH INDUSTRIAL ATTRACTION, EXPANSION OF EXISTING
BUSINESSES AND INDUSTRY, AND CREATION OF NEW BUSINESS
ENTERPRISES.

INTRODUCTION
An Economic Development Policy Plan has been prepared to provide City Council with a policy
framework for addressing the strategic issue of economic growth. The City of Beaumont contracts
with the Beaumont Chamber of Commerce for various economic development activities such as
marketing analysis and strategies for business retention.
The Economic Development Policy Plan consists of goals, objectives, policies, and proposals for
guiding Beaumont's future economic growth and development. The strategy was developed
following an inventory and analysis of the characteristics of Beaumont's economy, obstacles to
economic growth,opportunities for new employment,and Beaumont's competitive position in terms
of locational attributes and business climate.
The economic development policies are based on one goal:to increase the total number of permanent
jobs available to citizens of Beaumont and the southeast Texas region. Five objectives have been
identified to address this goal, and policies have been drafted to meet each objective.
One of the most effective economic development functions for a local government is to identify
barriers to economic growth and, where possible, remove or reduce these barriers. Specific
opportunities include:
• continuing to simplify and streamline City regulations and permitting procedures
affecting business expansion.

• providing leadership in developing a community attitude of unity and determination
in strengthening the area economy.
There are several very significant resources Beaumont can build on in strengthening the local
economy:
• Access to a population of 385,000 in the three county, Beaumont/Port Arthur
Metropolitan Statistical Area (MSA). Located less than 90 miles from Houston,
there are 31 million people within one day's driving time. This provides a good
market base for specialized or high-quality retailing, health and other professional
services, and"day-trip" tourism. The population of the"expanded market area" is
also an asset in providing a large labor market for potential new industry and for
providing a sizable market for wholesaling and distribution activities.
• The labor force in the Beaumont area includes a diversified mix of skilled, unskilled,
and trainable workers.
• According to local industrial real estate specialists, there is a more than adequate
supply in Beaumont of industrial and commercial development sites with adequate
utilities and good transportation access.
• A widely diversified transportation system serves the area with freeway, rail,
international port, and aircraft transportation.
• Unlike other regions in the southwest, the Beaumont area has a large reliable supply
of fresh surface water.
• Lamar University provides the nucleus of new research and technology oriented

businesses.
• Lamar Institute of Technology provides the Beaumont-Port Arthur MSA with an
exceptional Workforce Training Program. Lamar has partnered with business and
industry in Southeast Texas to build a better workforce. Customized training
programs are established to assist industry in training it's employees.
• Lamar Institute of Technology is the fastest growing of the 140 established colleges
and universities in the State of Texas. Lamar Institute of Technology offers 27
degree and 22 certified programs.

GOAL: INCREASE THE NUMBER OF PERMANENT JOBS
AVAILABLE TO CITIZENS OF BEAUMONT AND
SOUTHEAST TEXAS
Emphasis should be placed on value added jobs which are most likely to lead to further job creation.
Jobs in"export"industries bring money into the region through production of goods or services that
are exported outside of Beaumont. These jobs, which are generally relatively highly paid, create
spendable household income, generating new jobs in sales and services.
Beaumont also needs jobs which can be filled by workers who were previously employed in shipyards,
refineries, and chemical plants. These skilled workers are among Beaumont's most valuable
economic resources and will leave the area if new job opportunities are not developed.
Because of an especially high unemployment rate among Beaumont's sizable minority population,
entry-level jobs with on-the-job training are needed to bring unskilled workers from low-income
backgrounds into the work force.
WHERE WILL THESE JOBS COME FROM? New jobs come from three sources;
1) expansion of existing businesses
2) creation of new, entrepreneurial enterprises
3) attraction of plants or businesses from outside the community.
Research indicates that expansion of existing businesses and creation of new entrepreneurial
enterprises account for 80%to 90% of all new jobs.
OBJECTIVE NO. 1 MAINTAIN AN EFFECTIVE ROLE FOR THE
CITY OF BEAUMONT IN THE ECONOMIC
DEVELOPMENT PROCESS.
Policy 1.1 Role of the City
The City will continue to serve in a leadership role in the following areas of economic
development:
a) strategic planning—analyzing Beaumont's competitive strengths and weaknesses
in the world economy and then taking aggressive action to capitalize on the strengths
and overcome the weaknesses.

b) legislative advocacy — working closely with Jefferson County, The Port of
Beaumont, Drainage District #6, the Jefferson County Navigation District, BISD,
other municipalities in the region, and other State and Federal elected officials to
secure major funding assistance and to enact or change laws to increase the strategic
competitiveness of the local/regional economy.
c) leveraging and public/private partnerships—using the limited resources available
to the City government, such as grants, development incentives,infrastructure, land,
and staff to attract private sector investments which will create or retain jobs and/or
increase the tax base.
d) develop and communicate a vision of the future—the City's elected officials and
staff must motivate the community to set its sights on the goal of becoming a first-
class medium-sized city with a quality of life capable of attracting new private
investment and population.
The City will serve in a leadership and cooperative role in the following areas, participating actively
and lending whatever support is needed to other members of the economic development network:
a) promotion:assisting the Chamber of Commerce,the Partnership of Southeast Texas,
the Convention and Visitors Bureau, BUILD, Inc/Beaumont Main Street, Entergy,
and other promotional groups in marketing Beaumont as a business location, tourist
destination, etc.
b) business attraction: working cooperatively with the Chamber of Commerce in
competing for new industry.
Policy 1.2 The City's Commitment
The City will commit the assets it has available — star incentives, land, taxing authority,
infrastructure, tax-exempt bonding authority, and access to State and Federal grants—to the
local and regional economic development efforts.
The City will also strive for excellence in conducting its basic responsibilities of providing
public services and infrastructure,recognizing that an efficient,competent and responsive City
government is one of the prerequisites for economic growth of a community.
Allocation of resources for construction of new or the repair or extension of existing city
infrastructure and new or revised city services will be implemented on the basis of need;
however,the impact of such actions on the economic development of the city as a whole will
be considered of overriding importance when deciding where to allocate the city's resources
among areas which are of equal need.

Policy 1.3 Public Return on Investment
The City will examine the potential return on the public's investment when determining where and
how its limited resources will be committed. Return on public investment will be measured in terms
of jobs created,jobs retained, and broadening of the tax base.
OBJECTIVE NO. 2 ENCOURAGE A CLIMATE WHICH
FACILITATES BUSINESS GROWTH AND
SUSTAINABILITY
Policy 2.1 The City of Beaumont recognizes that the degree of cooperation and support of local
government plays a major role in business location and expansion decisions. The City
resolves to improve both its efficiency and effectiveness in providing assistance and
services to business.
Policy 2.2 The City of Beaumont will be committed to improving the quality of life for current
and future residents.
In recognition of the connection between economic development, the quality of life
or livability of a city, and the development of a favorable sense of place among
residents and non-residents alike, the City supports the inclusion of"quality of life"
and "environmental quality" considerations in making planning and development
decisions.
Visual community appearance considerations in the City's planning and development
efforts are to be considered important economic development actions which will
improve Beaumont's ability to attract new businesses and employment opportunities.
In realization of the fact that investing in the overall improvement in the quality of life
or livability of the city is not a goal which can be achieved overnight, the city will
concentrate its resources on the cleanup and rehabilitation of selected neighborhoods
and on the development and implementation of urban design plans for selected open
space, street corridor, and city entrance or gateway areas.

OBJECTIVE NO. 3 ATTRACT NEW BUSINESSES AND
INDUSTRIES TO THE BEAUMONT AREA
Policy 3.1 The City will work with the Chamber of Commerce, the Partnership of Southeast
Texas and other economic development groups in a team effort to bring new
businesses and industries to the Beaumont area.
Policy 3.2 Efforts to attract new business and industry will be targeted on industries whose
locational needs are consistent with the Beaumont area's locational attributes.
Policy 3.3 Continue to promote the Beaumont area's resources and quality of life factors
through the efforts of the Beaumont Convention&Visitors Bureau.
OBJECTIVE NO. 4 RETAIN AND EXPAND EXISTING
BUSINESSES AND INDUSTRIES
Policy 4.1 The City of Beaumont recognizes that existing businesses and industries are the
community's most important economic resources and will support the efforts of
existing businesses to expand and improve operations.
Policy 4.2 An"outreach"program to foster continuing open lines of communication between the
city government and existing businesses and industries will continue.

Policy 5.1 Continue the City's Small Business Revolving Loan Fund which provides financing
assistance for new businesses having difficulty in obtaining conventional financing.

RECOMMENDATION
The Administration recommends approval of a historic preservation loan request in the amount of
$44,400 for property at 1608 Orange Street.
BACKGROUND
David Bienvenu,the property owner wishes to renovate the"Ogden House"at 1608 Orange Street
for his permanent residence. The dollar amount of the request is for $44,400.
Work to be done will initially be used to make renovations to the servants quarters, carriage house
and carport.
In October, 1970, the house went from being a private residence to serving as a halfway house
operated by Land Manor. The house is listed in the 1977 and 1991 SPARE Beaumont Survey and
was placed on the National Register of Historic Places in 1992.
BUDGETARY IMPACT
The loan will come from the Historic Preservation Revolving Loan Fund. This loan fund consists of
CDBG dollars. The rate of repayment will be approximately$462.50 for 96 months.
PREVIOUS ACTION
At a Public Hearing of the Historic Landmark Commission on November 13, 2002,the Commission
voted 8:0 to approve a historic preservation loan in the amount of$44,400.

THE STUART-GRIFFIN HOME

A stately and beautiful old home located in Beaumont at 1608
Orange Street, whose spacious halls have re-echoed through sixty-
seven years with the joyous sounds of many festivities , ceased to
be a private residence in July 1970. In former years it was known
successively as the Ogden, the Smyth, and the Stuart house, the
last named in memory of the Jesse William Stuart family who occupied
it for the greatest length of time. In more recent years it has
been well known as the Stuart-Griffin home, for Mrs . Helen Stuart
Griffin; daughter of the late Mr. & Mrs . Jesse W. Stuart, and her
husband, Mr. Lee Gerald Griffin , a Connecticut yankee who has be-
come a confirmed Beaumonter.
The house is exteriorly constructed of dark red brick and its
walls are of one foot thickness . The most distinguished structural
elements are the four white, plain , and smoothly finished Ionic
columns , which rise from plinth-like pedestals resting on a low
veranda to the ceiling of the second story balcony and support a
simple entablature whose cornice is distinctly motived with a band
of oblong dentils . Surmounting the entablature is a--triangular area
or pediment, both slopes of which are corniced also with dentii or-
nament, and the tympanum of which is elaborated with' a design of
chaplet: and flowing ribbon in basso-rili_evo. The veranda , extending
the width of the front of the h6use and haTF its depth on either side
supports a second story balcony by means of four Ionic solumns pro-
portioned to half the size of the major shafts. The balustrades
which rails the balcony is only little less imposing than the columnar
treatment of the grand facade itself and the two sides of the edifice.
Interiorly, the house contains two large central hallways , a
formal drawing room, a long library' and music room combined , five
master bedrooms , four of which are adorned with massive marble fire-
places ; an old fashioned kitchen ; a ballroom constituting the entire
third story; a large utility room with inward sloping walls from roof
to floor to conform to the shape of an outdoor cistern which , before
city water lines were built in the neighborhood, caught rainwater
for home use. There are also stables and a carriage house still
standing which for the past thirty five years have stored Beaumont
Symphony Society bail decorations , promotion placards no longer
used by the United Appeals canvassers , Magnolia Garden Club equipment,
Zeta Tau Alpha sorority accoutrements , and Neches River Festival
paraphernalia. Other outside buildings include a two story servants
quarters and a miniature house in which girls for successive
r1enerations have played with their dolls . The entire house with
grounds and gardens fronts 1'_00 feet in Orange Street (formerly Bibb
Street) and extends for i0no feet in depth alone what; is now Irma
Street (formally Itat:a Stre(:,t) .

However, the story of an old house is neither more nor less
interesting than the story of its tenants or the people who once
inhabited it. Their pace of life, their joys , their sorrows , and
more particularly their style of living are vividly reflected in
the lingering atmosphere of the place. The house was originally
built in 1903 by Frank Tipton Smith of Beaumont for Lemuel Petman
Ogden, a native of Beaumont ( 1843) and his wife Cynthealia McClure
Of Mississippi . He was the son of Frederick 14. Ogden , a Kentucky
lawyer who came to Beaumont in 1841 and Mary Wilcox Ogden, a New
Yorker. At the time of its completion Mrs . Ogden still preferred
to keep her town house at Number 807 Main Street, and hence she
aptly named her new dilatory dwelling house "Idle Hours . " The
Bibb Street location was then in the hinterlands and accessible
only by horse and buggy over mud roads , or by board sidewalks or
planking. The city had not grown to its outlying neighborhoods and
the Ogdens gave their name to this particular purlieu which soon
became known as the Ogden addition. In the house lived the four
Ogden children, Likens P. , Mittie (for Mississippi ) , Katie Mae,
and Kittie. Also in the house the last named, Kittie Ogden,
married young Mr. Autrey Greer of Memphis , Tennessee, a nephew
of Mr. Hal W. Greer of the firm Greer, Greer (Robert A. ) and Noll ,
well established attorneys who had come to Beaumont in 1884 from
Holly Springs , Mar-shall County, Mississippi , via Corsicana. ( Mr.
Hal W. Greer had actually been a Texan since 1877, at which time
he emigrated from Hernando, Mississippi , the capital city of the
Tennessee border county of De Soto) . The first child of Autrey
and Kittie Ogden Greer, Cynthea 1 , who t•ias to become Mrs . Ross Wilder
of Beaumont. The Greers ' other children were Betty (Mrs . Charles
Ellis) and Autrey Greer, Jr. , and these were the only Ogden grand-
children. Mr. Lemuel Putman Ogden died in 1908. His widow sold
the house October 14, 1911 to Mr. Benjamin Rush Norvell who, on
February 2, 1912 , in turn sold it to Mr. John Blewitt Smyth.
(Deed records of Jefferson County, Texas , Volumes 124 & 126,
pp. 411 and 235) .
J. Blewett Smyth was the son of George Washington Smyth , Jr. ,
who was born in Jasper County, June 19, 1842. Returning in 1865
from service in the War Between the States , he had married Rosealtha
Blewett, also of Jasper county, Texas , and become one of the pioneer
lumbermen of the eastern Texas region by floating logs down the
Neches River to Beaumont. The junior George W. Smyth removed to
Beaumont in 1877. Mr. Smyth carried on the work of his father' s
business , the George W. Smyth Lumber Company, an eastern Texas
operation, and by the year 1901 had absorbed the assets of the
Sabine Tram Company of Deweyville, Texas . .
It was Mr. J. Blewitt Smyth who had completely transformed the
the interior decor of the Ogden house by replacing the entire wood-
work with elegantly carved mahogany, a hardwood as exotic to Eastern
Texas then as when it was first introduced to the 18th century English
woodworkers and cabinet makers and gave the generic name to the age
which signalized their individual productions . The Smyths converted
a downstairs bedroom into a large livingroom and library.

Mr. J . Blewitt Smyth by his first wife, Mrs . 011ie Seale
Smyth of Jasper, had two sons--Blewett Allen Smyth and George
W. Smyth III--and three daughters , Mildred, Rosealtha , and Mary
Frances . After the death of the first Mrs . Smyth , Mr. Smyth
married Miss Mattie Camp of Port Arthur. They were the tenants
of the house until its third transfer of ownership in 1923.
One of the most interesting and brilliant social gatherings
of the pre-World War I era in Beaumont was the wedding of Miss
Mildred Smyth .to Mr-. Lenoir M. Josey of Beaumont. He was the
son of Mr. Jack Evander Josey and his wife Kate Lenoir Josey ,
both of Huntsville, Texas , before coming to Beaumont in the early
part of the century. (Tile first of the Josey family in Texas
was Mr. Jack Evander Josey's father, Evander Theophilus Josey,
an early denizen of Huntsville, who was the father of seven
children, viz. , Jack E. of Beaumont, Julia-Mrs . James L. Shepherd,
Will C. of Beaumont, Robert A. of Tulsa and Houston, J.P. of
Kerrville, E.M. of Huntsville, and Mrs . J. Robert King of Huntsville. )
By this time, Mr. Blewett Smyth, in addition to his duties as head
of the Sabine Tram Company, had become an officer of the Texas Bank
and Trust Company and was one of Beaumont' s first citizens . In 1912
he had been the principal organizer of the Uvalde Rock Asphalt Company
and was spending much of his time in San Antonio, its headquarters .
On the 22nd day of May, 1923, J.B. Smyth and his wife Mattie
Smyth deeded to Mr. J.W. Stuart , a contractor of the Magnolia
Refinery Company since the earliest days of its existence, the
Ogden homestead tract (Deed records of Jefferson County, Texas ,
Volume 229, p. 98) . : Idle Hours once again received a new revitali-
zation. The Stuarts brought into their new home two young children
then on the threshold of the rising post-World War I generation,
A. L. (Pete) and Helen who would prove to be among the most popular
of the new generation of Beaumonters. At this time, too , the ex-
tensive gardens were reworF,(,d, landscaping was planned, and a lower
pitched tile roof was suf)stituted for the original one. It also
seemed as if the majestic oaks planted in the Ogden 's time reached
their full glory and gave to the old house a more antique and ser-
ene appearance. 'The type of aristocratic , ante bellum Southern
dwelling came to full realization.
On October 31 , 1934 , the halls again resounded with hymemean
celebration and gayety when the wedding reception following Miss
Helen Stuart's marriage to Mr. Lee Gerald Griffin was held there.
And since then , in the years following , the same grand halls have
served the Griffin ' s daughters Lea and Gale for their wedding
receptions ; when Miss Lea married Mr. James Perlitz, and when
Miss Gale married Mr. Charles Kelly.
Through the years , the Stuarts and the Griffins have been the
hosts to their many Beaumont and near-by friends at an annual Christ-
mas party, and the sight of the dazzlingly lighted Christmas tree
shining through the recessed leaded glass entrance doors and side
panels has inspired the holiday eve for many passer-by as well as
incoming guest. The hospitality extended was of a kind to justify
the thoroughly ante bellum Southern image conjured up by the appear-
ance of the Greek revival mansion.
Another regular social event has been the reception and luncheon
held following the parade for Beaumont's only annual carnival cele-
bration--its Neches River Festival . During some of these festivities
the Griffins at Idle Hours have been host to Governors Allen Shivers ,
Price Daniel , John Connally, and Preston B. Smith. Most all promin-
ent business and professional men of the Texas Gulf region have at
some time been guests at receptions held for their own coterie. Of
this kind was the social held for more than 200 members of the Garden
Club of America. The union of Idle Hours ' classic granduer with
the Griffins ' affable geniality made the setting appropriately felici-
tious.
In October 1970 Idle Hours changed its character from a private
dwelling house to an eleemosynary institution. The Griffins at that
time, acting in the best spirit of modern social consciousness , really
were at the same gesture carrying on the house's long service of warm
hospitality to the community. The house changed its name also to
Land Manor and became a refuge or temporary residence, a halfway house
for the mentally ill of the region who have needed a time for re-adjust-
ment between hospitalization and the return to independent living.
Therapy, counseling, and vocational guidance are administered to
sufferers from emotional or mental illness who have been needlessly
hospitalized or detained in hospitals longer than necessary. The
residents of Land Manor are referred there by parents , physicians ,
casework agencies , private hospitals , special education departments
of public schools , psychiatrists and psychologists , Beaumont Neuro-
logical Center, Rusk State Hospital , and the Texas Division of
Vocational Rehabilitation. The house is administered by an Executive
Director, house managers , a secretary, a social worker, and a con-
sulting psychiatrist. In these ways , Beaumont has fulfilled its
destiny in a very important and merciful department of social welfare,
of maintaining its capital position in the Texas Gulf region--
through the benevolence of two of its outstanding citizens , Helen
Stuart and Lee Gerald Griffin.
After sixty-seven years Idle Flours , now Land Manor, still stands
a monument to the enduring elements of pioneer American citizenship
and to the ideal of Beaumont character, its enthusiasm for the best
expressions of civic , social , and cultural leadership in its citizens ,
illustrated by the builders , the tenants , the inheritors of Idle Hours--
the Ogdens , the Norvells , the Smyths , the Stuarts , and the Griffins.
How contradictable was the alluringly descriptive name Mrs. L.P .
Ogden of 807 Main Street gave her country retreat amid the oak groves
of post-Spindletop Beaumont!

The facilities described by the attached copy of the article on
the "Stuart-Griffin Home" continues to be used as an eleemosynary
institution in the tradition of the house' s long service of warm
hospitality to the community. The house became "a home away from
home" for mentally restored adults who need a transitional period
between hospitalization and the return to independent living.
The house contains the main offices of Land Manor, Inc. and resi-
dentail facilities for 20 to 25 mentally restored adults . The
servants quarters , now known as Sunrise Cottage, houses seven
mentally restored adults who have been through the transitional
program but still require limited supervised living. The carriage
house was used as recreational facilities for the residents and
a storage area until fire destroyed the structure on March 10, 1977.
Land Manor was entered in the National Register of Historic Places
and was afforded the privilege granted under The Historic Preservation
Act of 1966.
Land Manor, Inc. has developed plans to rebuild the carriage house
maintaining the historical design and material used in the original
structure. The rebuilt carriage house will be used as a recreational
facility for all of the halfway houses operated under the corporate
umbrella Land Manor,. Inc. as well as offer the use of the facility
to other non-profit organizations of Beaumont.

RECOMMENDATION
Administration recommends approval of a contract with Brystar Contracting, Inc., Beaumont, Texas, for
$934,800.50 to relocate sections of the water line on Major Drive (FM 364). The project work includes
relocating approximately 5,090 linear feet of 20-inch bar wrapped cylinder concrete pipe at three locations,
the installation of six 20-inch gate valves, one 8-inch gate valve, one 10-inch gate valve, one 12-inch gate
valve, five 3-inch air release valves, and seven fire hydrants. The MBE goal will be met through
subcontracts with the certified MBE firms of Texas Mechanical and Southeast Texas Precast for a total
amount of$114,500 or 12.25% of the total bid.
BACKGROUND
The existing water lines built in 1974 need to be relocated due to their interference with the expansion of
Major Drive (FM364) proposed by the Texas Department of Transportation. The primary goal of the
project is to relocate the water lines, while maintaining an adequate and high quality water supply to the
customers.
BUDGETARY IMPACT
Ninety-one percent (91%) of the funds for the project will be provided by the Texas Department of
Transportation; 9% is available in the Water Utilities Operating Funds.

RECOMMENDATION
Administration recommends acceptance of the project, approval of Change Order No. 1 in the
amount of($515,957.26) and final payment in the amount of$178,910.33.
BACKGROUND
On June 5, 2001, the City Council awarded Excavators and Constructors, Inc. the contract for the
Concord Road Pavement Widening Phase II Project in the amount of$4,026,428.90.
Due to the decrease in construction item quantities, Change Order No. 1 in the amount of
($515,957.26) is required to adjust the estimated quantities used during performance of the
project, decreasing the contract to $3,510,471.64.
The MBE participation in the performance of the contract totals $256,144.24 representing 7.3%
of the final contract amount. A copy of Schedule C identifying the MBE participation is attached.
The project has been inspected by the Engineering Division and found to be complete in
accordance with the provisions and terms set out in the contract.
BUDGETARY IMPACT
Funds are allocated in the Capital Improvement Program.

RECOMMENDATION
Administration recommends approval of a resolution increasing the fees for Certificates of
Occupancy and fees for Master and Journeyman Electricians.
BACKGROUND
A Certificate of Occupancy is required by ordinance to open any new business in Beaumont. The
one time Certificate of Occupancy fee is currently $15. Depending on the type of business, as
many as four departments may have to inspect the building prior to issuance of the CO. A survey
of CO fees of Texas cities are presented below. The CO fees ranged from $10 to $84.

A Certificate of Occupancy fee of$50 is recommended.
The Code of Ordinances, Section 6-80(a)Registration required, false representation of registration
requires individuals who install, maintain, alter or repair any wiring, fixture or equipment for the
conducting of electricity for which a permit is required to obtain a certificate of registration as
required by the Code. The Code of Ordinances currently includes a registration fee and an annual
renewal fee. It is recommended that the registration and annual fee be combined into one annual
fee. The registration fees for Master and Journeyman Electricians is $50 and $5, respectively.
The annual renewal fee for a Master Electrician is $25 and for a Journeyman Electrician is $5.
A survey of Texas cities revealed renewal fees for Master Electricians range from$25 to$126 and
from $5 to $30 for a Journeyman Electrician.

Journeyman $25
Additionally, there are six electrician classification in Section 6-82(c) of the Code. Two of the
classifications, Master and Limited Master Electrician, are very similar in regard to registration
requirements. As a result it is recommended that the limited master electrician classification be
eliminated.

BUDGETARY IMPACT
During Fiscal Year 2003, it is anticipated that 510 Certificates of Occupancy will be issued to new
businesses. The new fee will generate approximately $17,850. The increase in electrician fees
for Fiscal Year 2003 is estimated to generate $8,000.

ORDINANCE NO.
ENTITLED AN ORDINANCE AMENDING CHAPTER 6 OF
THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT
TO ESTABLISH A CERTIFICATE OF OCCUPANCY FEE AND
FEES FOR MASTER AND JOURNEYMAN ELECTRICIANS
REGISTRATION AND RENEWALS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR REPEAL.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
That Chapter 6, Section 6-21 of the Code of Ordinances is hereby amended to
amend Appendix B by adding a new Section B106 to read as follows:
SECTION B106
CERTIFICATE OF OCCUPANCY
The fee for issuance of a Certificate of Occupancy shall be $50.00.
Section 2.
That Chapter 6, Section 6-82(c), be and the same is hereby amended to read as
follows:
(c) The following fees shall be applicable in this code:
Classification Annual Fee
(1) Master electrician $50.00
(2) Master sign electrician $25.00
(3) Journeyman electrician $25.00
(4) Maintenance electrician $5.00
(5) Journeyman sign erector $5.00
Section 3.
That if any section, subsection, sentence, clause or phrase of this ordinance, or the
application of same to a particular set of persons or circumstances, should for any reason
be held to be invalid, such invalidity shall not affect the remaining portions of this
ordinance, and to such end the various portions and provisions of this ordinance are
declared to be severable.
Section 4.
All ordinances or parts of ordinances in conflict herewith are repealed to the extent
of the conflict only.

RECOMMENDATION
The administration requests approval of a resolution to pledge additional securities covering City
deposits at Hibernia National Bank which have a current market value of$2,016,424.03.
BACKGROUND
The City of Beaumont maintained uncollected ledger balances at Hibernia National Bank in the
amount of$2,957,545.55 on November 20, 2002. After pledging the above security, the market
value of pledged collateral will total $6,070,110.69 and along with FDIC coverage is sufficient
to collateralize current deposits as well as any deposits anticipated in the near future. Deposits
will be higher than normal for the next couple of months due to the fact that property taxes are
due by January 31, 2002.
BUDGETARY IMPACT
None.
PREVIOUS ACTION
Council approved a release of collateral by Hibernia National Bank in the amount of
$1,000,000.00 on April 2, 2002.
SUBSEQUENT ACTION
Subsequent Council action will be requested to pledge or release additional collateral when
appropriate.

Sheriff s Department to apply for grant funds from the Texas Narcotics Control Program.
RECOMMENDATION
Administration recommends approval of a resolution that supports and endorses the application
of the Jefferson County Sheriff s Department to apply for grant funds from the Texas Narcotics
Control Program, as administered by the Criminal Justice Division, Office of the Governor, to
continue funding for the Jefferson County Narcotics Task Force, and to commit to providing the
matching funds not to exceed $63,367.
BACKGROUND
Whereas,the federal funds available under the provisions of the National Anti-Drug Abuse Act
of 1988 are being administered and disbursed pursuant to a statewide strategy developed by the
Criminal Justice Division of the Governor's Office and the application by the Jefferson County
Sheriff s Department would be an appropriate expenditure of said funds in response to the
statewide strategy and needs of the affected communities,to address the illegal drug trafficking
activities therein. The City of Beaumont proposes to continue the cooperative multi jurisdictional
Narcotics Task Force with the police departments in Port Arthur,Nederland, Groves, and Port
Neches,the Sheriff s Department in Jefferson and Hardin County.
BUDGETARYIMPACT
Matching funds of$63,367 taken from Police Department's general fund account.

RECOMMENDATION
Administration recommends approval of Nelkin Lane from existing Nelkin Lane approximately
155 feet north to proposed Jenard Lane. Jenard Lane from proposed Nelkin Lane approximately
143 feet west to three (3) OM-4P end of roadway markers and Jenard Lane from proposed Nelkin
Lane approximately 230 feet east to three (3) OM-4P end of road markers. Also, recommended
for approval are the water and sanitary improvements for Lots 1 and 2 Block 3, Lots 1 - 15, Block
5 and Lots 1 - 15, Block 4.
BACKGROUND
The aforementioned improvements in the subdivision passed final inspection from all entities
involved on November 15, 2002.
