The City Council of the City of Beaumont, Texas, met in a regular session on September 17,
2002, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to
consider the following:

Mayor Evelyn Lord called the meeting to order at 1:30 p.m. Rev. Robert Miller of the North End
Baptist Church, gave the invocation. Councilmember Goodson led the pledge of allegiance.
Present at the meeting were: Mayor Lord, Mayor Pro Tern Smith, Councilmembers Goodson,
Cokinos, Ames, Samuel, and Patterson. Also, present were Kyle Hayes, City Manager; Lane
Nichols, City Attorney; Susan Henderson, City Clerk; and Tina Broussard, Admin. Assistant City
Clerk's Office.

Hispanic Heritage Month - Presented by Councilmember Cokinos, Accepted by Virginia

Councilmember Cokinos moved to approve the Consent Agenda. Councilmember Goodson
seconded the motion. MOTION PASSED.

GENERAL BUSINESS
1. Consider adopting the Tax Roll forthe City of Beaumont Establishing a Tax Rate; providing
for levying, assessing and collecting of Ad Valorem Taxes for the Tax Year 2002; Providing
for severability and providing for repeal.
Mayor ProTem Smith moved to approve Ordinance No. 02-068 FY 2002 Property Tax
Rate and Councilmember Goodson seconded the motion. MOTION PASSED

Ames, Samuel and Patterson

2. Consider adopting the FY 2003 Capital Improvement Program,Article VI, Section 20 states
thatthe Council shall, by resolution, adoptthe Capital Program with orwithout amendment
after the public hearing and on or before the twenty-seventh (27th) day of the last month
of the fiscal year.
Councilmember Cokinos moved to approve Resolution No. 02-212 for FY 2003 Capital
Improvement Program and Councilmember Goodson seconded the motion. MOTION
PASSED

3. Administration recommends Council to adopt the FY 2003 Budget as submitted to Council
on August 13, 2002. Article VI, Section 8 of the City Charter requires that the budget shall
be adopted by the favorable votes of at least a majority of all members of the Council.
Section 9 states that the budget shall be finally adopted not later than the twenty-seventh
(27th) day of the last month of the fiscal year.
Should the Council take no final action on or prior to such day, the budget as submitted by
the City Manager shall be deemed to have been finally adopted by the Council.
Mayor Pro Tern Smith moved to approve Ordinance No. 02-069 the Annual Appropriation
Ordinance Adopting a Budget for the fiscal period beginning October 1, 2002 and ending
September 30, 2003 in accordance with the Charter of the City of Beaumont.
Councilmember Cokinos seconded the motion. MOTION PASSED

4. Consider approving the ordinance amending Chapter 13, Article III, of the Code of
Ordinances of the City of Beaumont to add Section 13-45 to allow immediate remediation
of nuisance water conditions promoting mosquito breeding; providing for severability and
providing for repeal.
Councilmember Cokinos moved to approve the Ordinance No. 02-070. Councilmember
Ames seconded. MOTION PASSED

5. Consider approving the ordinance granting a specific use permit to allow a retail and
service business in an RCR (Residential Conservation and Revitalization) District located
at 2205 Laurel in the City of Beaumont, Jefferson County, Texas.
Councilmember Samuels moved to approve the Ordinance No. 02-072. Councilmember
Ames seconded the motion. MOTION PASSED.

6. Consider approving the ordinance amending Chapter 23 of the Code of Ordinances of the
City of Beaumont to remove the Street User Fee; providing for severability; and providing
for repeal effective October 1, 2002.
Mayor Pro Tern Smith moved to approve Ordinance No. 02-073. Councilmember Ames
seconded the motion. MOTION PASSED.

COMMENTS
Councilmembers comment on various matters
Mayor Pro Tern Smith - None
Councilmember Goodson - Discussed ordinance pertaining to Mr. and Mrs. Carter and
wished them the best in their business venture. Thanked the City Managerforthe detailed
report in the agenda packet regarding the Sales Tax.
Councilmember Cokinos - None
Councilmember Ames - None
Councilmember Samuel-Thanked City Managerforthe quarterly Budgetand information
as to the City stands and particularly with the Sales Tax.
Councilmember Patterson - Thanked the City Manager for the quarterly reports.
Thanked the council for the construction of the 23rd and Virginia St. improvements. Also
stated that the Pear Orchard Neighborhood Association meeting will be held on next
Tuesday, at Our Mother of Mercy Catholic Church at 7:00 p.m.
Mayor Lord -The City has received an Invitation delivered to Council and extended to the
public to attend the 8th Annual Blue Mass at St.Anne's on 11th and Calder. The Rev. Curtis
Guillory will be presiding on Wednesday, September 25, 2002 at 12:10 p.m.
