Patterson September 3, 2002 Audwin Samuel Lane Nichols, City Attorney Kyle Hayes, City Manager Susan Henderson, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session on September 3,2002, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Presentations and Recognition Public Comment: Persons may speak on scheduled agenda items Consent Agenda Mayor Evelyn Lord called the meeting to order at 1:30 p.m. The Reverend Will Hood, Pastor of St. Stephens Episcopal Church,gave the invocation. Council member Tom Warner led the pledge of allegiance. Present at the meeting were: Mayor Lord, Mayor Pro Tern Smith, Councilmembers Goodson, Cokinos, Ames, Samuel, and Patterson. Also, present were Kyle Hayes, City Manager; Lane Nichols, City Attorney; Susan Henderson, City Clerk; and Tina Broussard, Admin. Assistant City Clerk;s Office. Presentations and Recognitions - There were no presentations and recognitions made. Public Comment: Persons may speak on scheduled agenda items Consent Agenda Approval of Minutes - Minutes of August 27, 2002 Approve Three Party Utility Agreement for the Millennium Pipleline Company, L.P., on the FM 364 Major Drive Improvement Project - Resolution No. 02-207 Approve the authorization of the City Managerto execute necessary documents to autorize acceptance of the funding and to receive and disburse funds related to the operation of the Southeast Texas Auto Theft Task Force - Resolution No. 02-208 Councilmember Cokinos moved to to approve the Consent Agenda. Councilmember Goodson seconded the motion. MOTION PASSED. Ayes: Mayor Lord, Mayor Pro Tern Smith, Councilmembers Goodson, Cokinos, Ames, Smauel, and Patterson Nays: None GENERAL BUSINESS 1. Public Hearing: FY 2003 Proposed Budget The FY 2003 Proposed Budget was submitted to Council on August 13, 2002. Public meetings were held in Wards I, III and IV using a PowerPoint slide presentation and included discussion of significant issues impacting the FY 2003 budget process and the challenge to produce a balanced budget. It is recommended that Council hold a public hearing as scheduled on the Proposed FY 2002 Budget to Council on August 3, 2002. The FY 2003 Budget must be adopted no later than September 27, 2002. The FY 2003 Budget is proposed for adoption on September 17, 2002. Public Hearing FY 2003 Budget Comment Period Jim Rich, President Beaumont Chamber of Commerce located at 1110 Park St. Beaumont. Mr. Rich discussed that a year ago a resolution was presented to council that they prefered a small tax increase after seeing the types of efforts to cut expenses, he also wanted to commend the City Manager for his efforts that went in to the Budget Proposal. There were no other citizens to speak regarding the Proposed Budget, Maylor Lord stated that the Public Hearing on the Proposed Budget was closed. 2. Public Hearing: FY 2003 Capital Improvement Program The FY 2003 Capital Improvement Program was submitted to Council on May 14, 2002. Public meetings were held in Wards 1, III and IV using a PowerPoint slide presentation and included discussion of the FY 2003 CIP as well as the FY 2003 Proposed Budget. It is recommended that Council hold a public hearing as scheduled on the FY 2003 Capital Improvement Program originally submitted to Council on May 14, 2002. The FY 2003 CIP must be adopted no later than September 27, 2002. The FY 2003 CIP is proposed for adoption on September 17, 2002 Minutes -September 3,2002 Page 2 Public Hearing FY 2003 Capital Improvement Program Comment Period There were no comments from citizens regarding the Capital Improvement Program. Mayor Lord closed the Public Hearing on the Capital Improvement Program 3. Public Hearing: FY 2003 Proposed Tax Rate A notice of a Public Hearing of Tax Rate Increase was published August 26, 2002 regarding the proposal to increase total tax revenue from properties on the tax roll by 4.99%. The percent change to the homeowner is dependent on their taxable unit. It is recommended that Council hold a public hearing as scheduled on the Proposed Tax Rate of$0.67 and set and announce the date of the meeting at which the City Council will vote on the tax rate. On August 13, 2002 City Council took a record vote to place the proposal to adopt a tax rate pf$0.67 on the agenda of a future meeting. The motion passed and a public hearing was scheduled for September 3, 2002. Public Hearing FY 2003 Proposed Tax Rate Comment Period There were no comments from citizens regarding the Proposed Tax Rate. Mayor Lord closed the Public Hearing on the Proposed Tax Rate. Executive Session Consider matters related to contemplated litigation in accordance with Section 551.071 of the Texas Government Code: Beaumont Professional Firefighters Local 399 Columbus Broussard v. City of Beaumont, et al COMMENTS Councilmembers comment on various matters Councilmember Patterson announced the Terrell Park Neighborhood Association would be having there monthly next Tuesday September 10, 2002 at the Old Terrell Park Elementary School, which is the sight of the Community Players. Councilmember Patterson - also made comments which are a part of the Audio and Video tapes. Councilmember Samuels- also made comments which are a part of the Audio and Video tapes. Councilmember Ames - also made comments which are a part of the Audio and Video tapes. Councilmember Goodson -also made comments which are a part of the Audio and Video tapes. Councilmember Smith - also made comments which are a part of the Audio and Video tapes. Minutes -September 3,2002 Page 3 Mayor Lord asked for a motion to set the date of September 17, 2002 to adopt the Propose Tax Rate Councilmember Cokinos moved and Councilmember Goodson seconded the motion. MOTION PASSED. Ayes: Mayor Lord, Mayor Pro Tern Smith, Councilmembers Goodson, Cokinos, Ames, Samuels, and Patterson Nays: None Public Comment ( Persons are limited to three (3) minutes ) Speakers making comments included: Mr. Leroy Lewis III, 1855 North Mr. Jude Perez, Audio and video tapes are available upon request in the City Clerk's Office.
