REQUESTED ACTION: Council consider an ordinance approving the initial rate period and
initial long rates for the $30 million City of Beaumont, Texas, Waterworks and Sewer System
Adjustable Rate Revenue Bonds, Series 2002.
RECOMMENDATION
The administration requests approval of an ordinance authorizing the initial rate period and initial
long rates for the $30 million City of Beaumont, Texas, Waterworks and Sewer System
Adjustable Rate Revenue Bonds, Series 2002.
BACKGROUND
Adjustable rate debt offers flexibility of payout structure, reduced issuance costs and historically
lower interest cost than fixed rate debt. Frank Ildebrando of Dain Rauscher Incorporated, acting
as placement agent, has recommended that the adjustable rate bonds be privately placed with J.P.
Morgan Investment Management of New York. Mr. Ildebrando will report the initial rate period
and initial long rates proposed by J.P. Morgan at the City Council meeting and make a
recommendation on whether the City should accept the rates.
Delivery and receipt of the proceeds by the City is scheduled for August 29, 2002. Proceeds will
be used to finance the expansion, repair, renovation and related improvements to the waterworks
and sewer system.
BUDGETARY IMPACT
All debt and other expenses shall be incurred by the Water Fund which is supported by water and
sewer revenues as generated through user fees.
PREVIOUS ACTION
A resolution was approved on July 23, 2002 to authorize the issuance of $30 million City of
Beaumont, Texas, Waterworks and Sewer System Adjustable Rate Revenue Bonds.
SUBSEQUENT ACTION
None.

ORDINANCE APPROVING THE INITIAL RATE PERIOD AND INITIAL LONG
RATES FOR THE THE CITY OF BEA.UMONT, TEXAS WATERWORKS AND SE'W'ER
SYSTEM ADJUSTABLE RATE REVENGE BONDS, SERIES 2002
BE IT ORDAINED BY THE CITY OF BhALN-MONT, I'EXA.S:
Section 1. Findings and Determinations. It is hereby officially found and
determined that=
(a) Pursuant to Chapter 1502, Texas Goverriment Code, as amended, find
pursuant to an Ordinance passed and approved by The City of Beaumont, Texas (,the
"City") on July 2'), 2002 (the "Series 2002 Bond Ordinance', the City authorized the
issuance of the City of Beaumont; Texas, Waterworks and Sewer System Adjustable Rate
Revenue Bonds, Series 2002 (the "Series 2002 Bonds"), payable from the reve,lues of the
City's water and sewer system for the purpose of constructing repairs, improvements,
additions and extensions to the City's waterworks and sanitary sewer system.
(b) Pursuant to Section 3.3 of the Series 2002 Bond Ordinance, the Series
2002 Bonds are to be intially issued bearing interest at an initial Long Rate or Rates and
with a Rate Period to be specified and approved by the City Council of the City prior to
the initial delivery of the Scries 2002 Bonds.
(c) The City desires to proceed with the closing and initial delivery of the
Series 2002 Bonds, which closing is to take place on August 29, 2002, or the first
possible date thereafter, and in cotmection therewith the City Council desires to specify
the initial Long Rate or Rates and the initial Rate Period of khe Series 2002 Bonds.
Section 2. Approval and Specification of Initial Long Rates aad Rate Period.
The Series 2002 Bonds shall be initially issued and sold to JPMORGAN CHASE BANK in
accordance with the terms of the Series 2002 Bond Ordinance, and the Series 2002 Bonds shall
initially bear interest at the initial Long Rates as set forth in the following schedule:
The initial Rate Period for the Series 2002 Bonds shall be fi-om the date of delivery
until September 1,
All other terms and provisions of the Series 2002 Bonds shall be as set forth, in the
Series 2002 Bond Ordinance.

Section 3. _Further Proceeding. The Mayor of the City, the City Clerk of the City and
other appropriate officials of the City are hereby authorized and directed to do any and all th)ngs
necessary and/or convenient to carry out the terms of this Ordinance.
Section 4. Severability. If any Section, paragraph, clause or provision of :his
Ordinance shall for any reason be held to be invalid or unenforceable, the invalidity or
unenforceability of such Section, paragraph, clause or provision shall not affect any of the
remaining provisions of this Ordinance.
Section 5. Open Meeting. It is hereby found, determined and declared that a suffic)ent
written notice of the date, hour, place and subject of the meeting of the City Council at which this
Ordinance was adopted was posted at a place convenient and readily accessible at all times to the
general public at the City Hall of the City for the time required by law preceding this meeting. as
required by the Open Meetings Act, Chapter 551, Texas Government Code, as arnendf:d, and that
this meeting has been open to the public as required by law at all times during which this Ordinance
and the subject matter thereof has been discussed; considered and forinally acted upon. The City

entertainment and video tape rental(SIC 7841)that rents adult video tapes from the RCR,NC,NSC,
GC-MD, GC-MD-2 and GC-MD-3 Districts.
BACKGROUND
In April,2002,City Council approved amendments to the Zoning Ordinance that addressed distance
requirements and zoning districts that allowed eating places, drinking places and video tape rental
with adult entertainment.
Since that adoption,staff feels that for clarification purposes,Section 30-33(b)2 needs to be amended
to read as follows:
Sec. 30-33(b)
2. Adult Entertainment Uses: The following special conditions and regulations shall apply for
adult entertainment uses without regard to whether the adult entertainment use is a primary
or accessory use. Adult entertainment uses are those which exclude minors by virtue of age
under the Penal Code of the State of Texas unless such minor is accompanied by a
consenting parent, guardian, or spouse and shall include but not be limited to, adult motion
picture theaters, massage parlors, nude modeling studios, nude photography studios, adult
bookstores, or eating and drinking establishments which have sexually oriented
entertainment such as go-go dancers, exotic dancers, strippers or other similar entertainers.
a. An adult entertainment use shall not be established or expanded within fifteen
hundred (1,500) feet of any dwelling.
b. An adult entertainment use shall not be established or expanded within three hundred
(300) feet of any other adult entertainment use, bar,pool hall, or liquor store.
C. An adult entertainment use shall not be established or expanded within fifteen
hundred(1,500)feet of a church,child care facility,school,hospital,public building,
or public park.
d. The method the distance between an adult entertainment use and another adult
entertainment use or any other use shall be from nearest property line to nearest
property line of said uses.
e. Eating places (SIC 5812) and drinking places (SIC 5812) that have adult
entertainment and video tape rental(SIC 7841)that rents adult video tapes shall not
be allowed in the RCR, NC,NSC, GC-MD, GC-MD-2 and GC-MD-3 Districts.

PREVIOUS ACTION
At a joint Public Hearing with City Council held August 19,2002,the Planning Commission voted
9:0 to approve a request to amend the Zoning Ordinance, Section 30-33 (b) 2, Special Conditions,
Adult Entertainment Uses,to delete,as an allowed use by right or with a specific use permit,eating
places(SIC 5812)and drinking places(SIC 5813)that have adult entertainment and video tape rental
(SIC 7841)that rents adult video tapes from the RCR,NC,NSC,GC-MD,GC-MD-2 and GC-MD-3
Districts.

ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE
CODE OF ORDINANCES BY AMENDING SECTION 30-33 (b) (2),
TO THE ZONING ORDINANCE; PROVIDING FOR THE DELETION
AS AN ALLOWED USE BY RIGHT OR WITH A SPECIFIC USE
PERMIT, EATING PLACES (SIC 5812) AND DRINKING PLACES
(SIC 5812) THAT HAVE ADULT ENTERTAINMENT AND VIDEO
TAPE RENTAL (SIC 7841) THAT RENTS ADULT VIDEO TAPES
SHALL NOT BE ALLOWED IN THE RCR, NC, NSC, GC-MD, GC-
MD-2 and GC-MD-3 DISTRICTS; PROVIDING FOR SEVERABILITY;
PROVIDING FOR REPEAL AND PROVIDING A PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
That Section 30-33 (b) (2) of the Code of Ordinances of the City of Beaumont be,
and the same is hereby amended to read as follows:
Sec. 30-33 (b). Special conditions by use

or the application of same to a particular set of persons or circumstances, should
for any reason be held to be invalid, such invalidity shall not affect the remaining

portions of this ordinance, and to such end, the various portions and provisions of
this ordinance are declared to be severable.
Section 3.
That all ordinances or parts of ordinances in conflict herewith are repealed
to the extent of the conflict only.
Section 4.
That any person who violates any provision of this ordinance shall, upon
conviction, be punished, as provided in Section 1-8 of the Code of Ordinances of
Beaumont, Texas.

RECOMMENDATION

H(Residential Multiple Family Dwelling-Highest Density)District at the northeast corner ofPhelan
Boulevard at Mathews Lane,subject to correcting the deficiencies in the disabled parking stall layout.
BACKGROUND
William Nantz, D.D.S. wishes to construct a dental office at the northeast corner of Phelan
Boulevard and Mathews Lane. The one-story building will be approximately 2,900 sq. ft. in area.
This proposed dental office would complement other existing and proposed development along this
stretch of Phelan Boulevard.
BUDGETARY IMPACT
None.
PREVIOUS ACTION
At a joint Public Hearing with City Council held August 19,2002,the Planning Commission voted

PERMIT TO ALLOW A DENTAL OFFICE IN AN RM-H
(RESIDENTIAL MULTIPLE FAMILY DWELLING-HIGHEST
DENSITY) DISTRICT LOCATED AT THE NORTHEAST
CORNER OF PHELAN BOULEVARD AT MATTHEWS LANE
IN THE CITY OF BEAUMONT, JEFFERSON COUNTY,
TEXAS.
WHEREAS, the City Council for the City of Beaumont desires to issue a specific
use permit to William Nantz, D.D.S. to allow a dental office in an RM-H (Residential
Multiple Family Dwelling-Highest Density)District located at the northeast corner of Phelan
Boulevard at Matthews Lane, being Tract 96, Plat SP-6, C. Williams Survey, Abs. 59, City
of Beaumont, Jefferson County, Texas, containing 0.69 acres, more or less, as shown on
Exhibit "A" attached hereto; and,
WHEREAS, the City Council is of the opinion that the issuance of such specific use
permit is in the best interest of the City of Beaumont and its citizens, subject to the
hereinafter described conditions;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
Section 1.
That a specific use permit to allow a dental office in an RM-H (Residential Multiple
Family Dwelling-Highest Density) District located at the northeast corner of Phelan
Boulevard at Matthews Lane, being Tract 96, Plat SP-6, C. Williams Survey, Abs. 59, City
of Beaumont, Jefferson County, Texas, containing 0.69 acres, more or less, as shown on
SAAGENDA\CITY CLERK0&27-02.WPD
Exhibit "A" attached hereto, is hereby granted to William Nantz, D.D.S., his legal
representatives, successors and assigns, subject to the following condition:
► Correct the deficiencies in the disabled parking stall layout.
Section 2.
That the specific use permit herein granted is expressly issued for and in
accordance with each particular and detail of the site plan attached hereto as Exhibit "B"
and made a part hereof for all purposes.
Section 3.
Notwithstanding the site plan attached hereto, the use of the property herein above
described shall be in all other respects subject to all of the applicable regulations
contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended.

RECOMMENDATION
The Administration recommends approval of a specific use permit to allow revisions to building and
parking layout and landscaping of an office building in a GC-MD-2 District at 6380 Folsom.
BACKGROUND
Long Architects, Inc., the applicants for Dunleith Partners, Ltd., is submitting an amended specific
use permit to allow revisions to the building and parking layout and landscaping plan for the new
Script Care offices located at 6380 Folsom.
A specific use permit was granted to Script Care in 2001. That approval waived the fencing
requirement along the north,east and west property lines but did require a 30'wide planted landscape
buffer to a point 30'behind the rear wall of the administration building on the east and west property
lines and a 10' landscape buffer along the north property line.
At the time of the original request, all of the property surrounding the subject tract was zoned A-R
(Agricultural-Residential)District. Since that time,the properties to the north and west have been
zoned RM-H and GC-MD-2, respectively. A redesign of the site plan has the building on the east
half of the property and the parking on the west half. The original site plan had the building centered
in the property with the parking in front.
The applicant is now requesting a waiver of the 30'wide landscape buffers on the east and west sides
of the property. Since the property to the west is zoned GC-MD-2, a landscape buffer is not now
required. The property to the east is the DD#6 retention pond. To the north of the building will be
a vast green area and an abundance of trees between the northernmost portion of the building and
the northern property line.
BUDGETARYIMPACT
None.
PREVIOUS ACTION
At a joint Public Hearing with City Council held August 19, 2002,the Planning Commission voted
9:0 to approve an amended specific use permit to allow an office building in a GC-MD-2 District
at 6380 Folsom with a waiver of the fencing requirement along the north, east and west property
lines but did require a 30' wide planted landscape buffer to a point 30'behind the rear wall of the
administration building on the east and west property lines and a 10'landscape buffer along the north
property line.

BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
THAT Ordinance No. 01-038 passed on May 22, 2001, by the City Council
of the City of Beaumont issuing a special use permit to Jim Brown for Dunleith
Partners, Ltd. to allow a 15,000 square foot office building in a GC-MD-2 (General
Commercial-Multiple Family Dwelling-2) District is hereby amended at the request
of Long Architects, Inc., applicants for Dunleith Partners, Ltd., to waive the 30'wide
landscape buffers on the east and west sides of the property.
Section 2.
That if any section, subsection, sentence, clause or phrase of this ordinance,
or the application of same to a particular set of persons or circumstances should for
any reason be held to be invalid, such invalidity shall not affect the remaining
portions of this ordinance, and to such end the various portions and provisions of
this ordinance are declared to be severable.

All ordinances or part of ordinances in conflict herewith are repealed to the extent
of the conflict only.
Section 4.

BACKGROUND
William Sayre, Jr. with the Stinson Design Group is requesting a specific use permit to allow
construction of 24,116 sq. ft. of commercial/professional office space on a 2.23 acre tract at the
northeast corner of Phelan Boulevard and Shakespeare Drive.
The initial 19,500 sq. ft. of space will include three,one-story brick veneer buildings, connected by
covered walkways. A future building of approximately 4,616 sq. ft. is also shown on the site plan.
The buildings will house the offices for Universal Coin & Bullion, First Fidelity Reserve, 1"
National Reserve and 1 S`American Reserve.
This property was granted a specific use permit for a similar development in 1999. That proposal
included 21,300 sq. ft. of office space in three buildings. That development was never built and the
specific use permit has now expired.
BUDGETARY IMPACT
None.

RECOMMENDATION

gymnastics studio in an RM-H District at 7575 Highway 105, subject to redesigning the proposed
parking lot in order to eliminate one driveway on Tolivar Road, resulting in only two permanent
driveways.
BACKGROUND
Marlon Quibodeaux, owner of Southern Star Gymnastics at 7595 Highway 105, wishes to buy the
property immediately to the east of his property at 7575 Highway 105. He is proposing a three phase
development plan for the property.
In Phase 1,Mr.Quibodeaux wishes to use the home as a residence. In Phase 2,his 2 year goal is to use
the south end of the property for more parking for the gymnastics studio. In Phase 3,his 5 year goal
is to tear down the house and expand the gymnasium onto the subject property.
Mr. Quibodeaux states that his business has grown to the point that he will need to expand in the near
future. The adjacent property has become available for purchase.

RECOMMENDATION
The Administration recommends approval of a specific use permit to allow a church in an RM-H
(Residential Multiple Family Dwelling-Highest Density) District at 1570 Roberts Avenue, subject
to a maximum capacity of 20 persons and a modification to the landscaping/screening requirements
along the north, east and west property lines.
BACKGROUND
El Shaddai Church is currently operating a church at 1570 Roberts Avenue. Staff notified the church
that a specific use permit was required.
The non-denominational church has a membership of approximately 20 people. Meetings are held on
Sundays, Wednesdays and Fridays. Landscaping exists along the east property line in the form of
tallow trees, a 10' yard and a 4' tall chain link fence. The applicant is requesting a waiver of the
landscaping/screening requirements along the north and west property lines. A 20'wide alley separates
the subject property and the property to the north. On the property to the west, a building sits on the
property line.

PREVIOUS ACTION
At a joint Public Hearing with City Council held August 19,2002,the Planning Commission voted
8:0 to approve a specific use permit to allow a church in an RM-H (Residential Multiple Family
Dwelling-Highest Density)District at 1570 Roberts Avenue, subject to a maximum capacity of 20

DISTRICT LOCATED AT 1570 ROBERTS AVENUE IN THE
CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS.
WHEREAS, the City Council for the City of Beaumont desires to issue a specific
use permit to Earnestine Flowers, to allow a church in an RM-H (Residential Multiple
Family Dwelling-Highest Density) District located at 1570 Roberts Avenue, being Lot 8,
Block 62, Cartwright Addition, City of Beaumont, Jefferson County,Texas, containing 0.16
acres, more or less, as shown on Exhibit "A" attached hereto; and,
WHEREAS, the City Council is of the opinion that the issuance of such specific use
permit is in the best interest of the City of Beaumont and its citizens, subject to the
hereinafter described conditions;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
Section 1.
That a specific use permit to allow a church in an RM-H (Residential Multiple
Family Dwelling-Highest Density) District located at 1570 Roberts Avenue, being Lot 8,
Block 62, Cartwright Addition, City of Beaumont, Jefferson County, Texas, containing 0.16
acres, more or less, as shown on Exhibit "A" attached hereto, is hereby granted to

Earnestine Flowers, her legal representatives, successors and assigns, subject to the
following conditions:
Maximum capacity to be 20 persons
Modification to the landscaping/screening requirements along the north,east
and west property lines.
Section 2.

accordance with each particular and detail of the site plan attached hereto as Exhibit "B"
and made a part hereof for all purposes.
Section 3.
Notwithstanding the site plan attached hereto, the use of the property herein above
described shall be in all other respects subject to all of the applicable regulations
contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended.

BACKGROUND
St. Michael Orthodox Church wants to abandon the west 20' x 150' of the alley to prevent traffic
access. The church owns the parking lot to the south of the sanctuary. They would like to install a
new entrance on the south side of the church to provide safer access to the parking lot.
The request was sent to all interested parties. Southwestern Bell,Time Warner Cable,Entergy and
City of Beaumont Water Utilities have utilities in the alley. They did not object subject to the
retention of a utility easement or moving the existing utilities at the church's expense.
BUDGETARY IMPACT
None.

On March 5, 2002,the City Council approved the abandonment of that portion of Milam Street west
of IH-10 and Hillebrandt Bayou. This abandonment was done at the request of Iron Horse Enterprises.
The City retained a 60'wide utility easement. It is now the desire of Iron Horse Enterprises to abandon
the middle 25' of this utility easement.

RECOMMENDATION
The Administration recommends approval of the re-adoption of the Parks, Recreation and Open
Space Plan Element of the Comprehensive Plan.
BACKGROUND
The re-adoption of the Parks,Recreation,&Open Space Plan Element was last approved on August
29,2000. Its re-adoption is being requested in order to maintain the two year re-adoption schedule
required by the plan and City Charter.
The text has been modified only to update the document to reflect changes that have occurred over
the past two years. For example, information on changes to the facility descriptions and the
implementation sections where the listing of projects,the costs of the projects, and their time-lines
for short-term improvements had to be changed. No changes were made to the goals, objectives,
policies, or proposal sections.
The staff has made only these minimum type changes because a completely new plan is being
prepared for review and re-adoption in early Fall of 2003. That new plan will have Census 2000
data, much of which comes out this Fall. Once adopted, the 2003 Plan will be submitted to the
National Park Service for approval so that Beaumont can remain eligible for Federal UPARR grants.
The document will also be submitted to the Texas Parks and Wildlife Department for their review
and approval. The new document is being prepared consistent with the grant program requirements
of the state and the National Park Service. One document,the 2003 Plan,is being prepared to take
the place of two current documents; the Parks, Recreation, & Open Space Plan and our UPARR
Recreation Program Recovery Action Plan (RAP).

At a joint Public Hearing with City Council held August 19,2002,the Planning Commission voted
9:0 to approve the re-adoption of the Parks, Recreation and Open Space Plan Element of the
Comprehensive Plan.

REQUESTED ACTION: Council consideration of an annual contract for container and solid
waste collections.
RECOMMENDATION
Administration recommends awarding an annual contract to Waste Management of Beaumont,
Texas for container and solid waste collection services in the estimated monthly amount of
$3,697.72.
BACKGROUND
Refuse container and collection services are required at twenty-nine(29)sites throughout the City.
The size of refuse containers required at each location range in size from two (2) to ten (10) cubic
yards and the collection frequency rates range from one (1) to four (4) times per week.
Bid specifications stated the size of containers currently used and the frequency of collections
currently required by the City. The specifications allow the City to add or delete containers and
change locations or container sizes as needed. The award of the bid is based on the number of
containers and locations currently being serviced. The following bids were received:

REQUESTED ACTION: Council approval of a mutual aid agreements between the

to provide mutual aid assistance.
RECOMMENDATION:
Council consideration to authorize the Mayor to sign an agreement for providing mutual aid as may
be requested by The Cities of Pt. Neches, Bevil Oaks, China and Nome for emergency conditions
as defined by the Texas Disaster Act of 1975.
BACKGROUND:
Congress, in November 2000,updated and replaced many sections of the Stafford Act(Emergency
Management Act) with the Disaster Mitigation and Recovery Act. One of the requirements was to
have in place, signed mutual aid agreements between political subdivisions. This is to insure that if
mutual aid assistance is provided to another jurisdiction, and there is a Public Assistance
Declaration, both entities (assisting jurisdiction, and the affected jurisdiction) are eligible for full
reimbursement for services performed. Failure to have these agreements executed prior to the event
will negate any reimbursement for the affected or responding jurisdiction. The guidance offered is
that the respective county should have signed agreements with all of the incorporated cities within
the county,and each incorporated city within the respective county should likewise have agreements
executed. These mutual aid agreements will be forwarded to the respective Cities for approval by
their City Governments.

MUTUAL AID AGREEMENT
The contracting cities and counties solemnly agree:
SECTION 1. PURPOSE
The purpose of this agreement is to provide mutual aid among the cities and
counties in meeting any emergency or disaster from enemy attack or other cause, natural
or otherwise. This agreement is made pursuant to the Interlocal Cooperation Act,
Vernon's Texas Civil Statutes, Chapter 7-91 Government Code; and Vernon's Texas Codes
Annotated, Government Code Chapter 418, commonly referred to as the Texas Disaster
Act of 1975. This agreement recognizes that the prompt,full and effective utilization of the
resources of the respective cities and counties is essential to the safety, care and welfare of
the people thereof in the event of a major emergency or disaster. The Directors or
Coordinators of Emergency Management of all party cities and counties shall constitute a
committee to formulate plans to take all necessary steps for the implementation of this
agreement. Such planning shall incorporate the use of resources, including personnel,
equipment, and supplies necessary to provide mutual aid.
SECTION 2. RESPONSIBILITIES
It shall be the duty of each party city or county to formulate emergency
management plans and programs for application within such city or county. There shall
be frequent consultation between the representatives of the cities and counties with the
State of Texas and the free exchange of information and services. In carrying out such
emergency management plans and programs, the party cities and counties shall, so far as
possible, provide and follow uniform standards,practices and rules and regulations
including:
(a) Warnings and signals for exercises or disasters and the mechanical devices to
be used in connection therewith;
(b) Shutting off water mains, gas mains, electric power connections and the
suspension of all other utility services;
(c) Selection of all materials or equipment used or to be used for emergency
management purposes to assure that such materials and equipment will be
easily and freely interchangeable when used in or by any other party City or
County;
(d) The conduct of civilians and the movement and cessation of movement of
pedestrians and vehicular traffic, prior, during, and subsequent to exercises
or disaster;
(e) The safety of public meetings or gatherings;
Any party city or county requested to render mutual aid shall take such action as is
necessary to provide and make available the resources covered by this agreement in
accordance with the terms hereof; provided that it is understood that the city or county
rendering aid may withhold resources to the extent necessary to provide reasonable
protection for such city or county. Each party city or county while operating within its city
or county limits under the terms and conditions of this agreement,the same powers (except
that of arrest unless specifically authorized by the receiving city or county), duties, rights,
privileges and immunities as if they were performing their duties in the city or county in
which normally employed or rendering services. Emergency management forces will
continue under the command and control of their regular leaders, but the organizational
units will come under the operational control of the emergency management authorities of
the city or county receiving assistance.
All requests for mutual aid under this agreement shall be made through the State
Disaster District organization and that organization will serve as a channel through which
outside aid will be dispatched.
SECTION 3. LIABILITY
No party city or county or its officers or employees rendering aid in another city or
county pursuant to this agreement shall be liable on account of any act or omission in good
faith on the part of such forces while so engaged, or on account of the maintenance or use
of any equipment or supplies in connection therewith.
SECTION 4. SUPPLEMENTARY AGREEMENTS
Inasmuch as it is probable that the pattern and detail of the arrangements for
mutual aid among two (2) or more cities or counties may differ from that appropriate
among other cities or counties party hereto,this instrument contains elements of a broad
base common to all cities and counties, and nothing herein contained shall preclude any
city or county from entering into supplementary agreements with another city or county or
cities or counties. Such supplementary agreements may comprehend, but shall not be
limited to, provisions for evacuation and reception of injured and other persons, and the
exchange of medical care,fire, police, public utility, reconnaissance,welfare,
transportation and communications personnel, equipment and supplies.
SECTION 5. COMPENSATION
Each party city or county shall provide for the payment of compensation and death
benefits to injured members of the emergency management forces of that city Qr county
and the representatives of deceased members of such forces in case such members sustain
injuries or are killed while rendering aid pursuant to this agreement, in the same manner
and on the same terms as if the injury or death were sustained within such city or county.
SECTION 6. FINANCE
Any party city or county rendering aid in another city or county pursuant to this
agreement shall be reimbursed by the party city or county receiving such aid for any loss
or damage to,or expenses incurred in the operation of any equipment answering a request
for aid, and for the cost incurred in the operation of any equipment answering a request
for aid, and for the cost incurred in connection with such requests; provided that any
aiding party city or county may assume in whole or in part such loss damage expense, or
other cost, and provided further that any two (2) or more party cities or counties may enter
into supplementary agreements establishing a different allocation of costs as among those
cities or counties.
SECTION 7. SEVERABILITY
This agreement shall continue in force and remain binding on each party city and
county until the City Council or Commissioners' Court of such party city or county takes
action to withdraw therefrom. Such action shall not be effective until 90 days after notice
thereof has been sent by the Emergency Management Director of the party city or county
desiring to withdraw to the Emergency Management Director of all other party cities or
counties.
This agreement shall be construed to effectuate the purpose stated in Section 1,
hereof. If any provision of this agreement is declared unconstitutional,or the applicability
thereof to any persons or circumstances is held invalid, the constitutionality of the
remainder of the agreement and the applicability thereof to other persons and
circumstances shall not be affected thereby.
SECTION 8. APPLICABILITY
This agreement shall become operative immediately upon its approval by any city
or county as between it and any other city or county or cities or counties so ratifying. Duly
authenticated copies of this agreement and of such supplementary agreements as may be
entered into shall, at the time of their approval, be deposited with each of the party cities
and counties and with the division of Emergency Management and other appropriate
agencies of the State of Texas.
This agreement shall become binding and obligatory when it shall have been signed
by the Mayor and/or County Judge of the respective cities and counties enumerated in this
agreement; when it shall have been approved by the City Council and/or Commissioners'
Court of each city or county.
