Bonczek, City Manager Lolita Ramos, Interim City Clerk The City Council of the City of Beaumont,Texas, met in a regular session on July 2,2002,atthe City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Presentations and Recognition Public Comment: Persons may speak on scheduled agenda items Consent Agenda Mayor Evelyn Lord called the meeting to order at 1:34 p.m. The Reverend Kevin LaRouffe, Pastor of Central City Baptist Church, gave the invocation. Councilmember Guy Goodson led the pledge of allegiance. Present at the meeting were: Mayor Lord,Mayor Pro Tern Smith,Councilmembers Goodson,Cokinos, Ames, Samuel and Patterson. (Councilmember Samuel arrived at 1:36 p.m.) Also, present were Stephen J. Bonczek, City Manager; Lane Nichols, City Attorney; and Terri Hanks, City Clerk Administrative Assistant. Presentations and Recognitions Chairman of the Martin Luther King,Jr. Parkway Commission, Mrs. Beverly Hatcher,7 Sandlewood Trail, unveiled a miniature maquette of Dr. Martin Luther King, Jr. Mrs. Hatcher spoke of a progressing new phase ofthe M.L.King,Jr.Commission,diligent fund-raising efforts,the internationally known artist,costs associated with the sculpture,and distributed photographs and literature as shown in Exhibit "A." Councilmember Samuel expressed excitement concerning the current progress of the Commission, a Beaumont street appropriately honoring Dr. Martin Luther King coming into fruition, and moving forward with further beautification. He applauded the Commission's efforts and requested citizens to continue their support in honoring Dr. Martin Luther King. Ms.Annie B.Scott Moy6, 1861 Prairie Avenue,as a memberof the West Tabernacle Baptist Church, announced raising $4,242 toward the statue honoring Dr. Martin Luther King, Jr. Mayor Lord commended the Martin Luther King, Jr. Commission for their efforts. Public Comment: Persons may speak on scheduled agenda items. No one wished to address the scheduled agenda items. Consent Agenda Approval of minutes - June 25, 2002 Confirmation of committee appointments - Appointments: Chris Coco, Civil Service Commission, for a term expiring July 1, 2004. Resolution No. 02-141 A) Approve an annual contract(with Bourque's Oilfield Services in the amount of$65,000) for ground maintenance at Cattail Marsh - Resolution No. 02-142 B) Approve an annual contract(with Shepherd's Uniform and Linen Supply Company, Inc.foran estimated $34,656) for employee work uniforms - Resolution No. 02-143 C) Approve an annual contract(with JMPKL, Inc.d.b.a.The Lube Shop in the amount of$61,317) for automotive preventive maintenance - Resolution No. 02-144 D) Approve a change in signatories(adding Lisa Foster and deleting Paulo Garcia and Jocelyn Harden of Ward Strategic Claims Solutions)fora Workers Compensation Account at Hibernia National Bank - Resolution No. 02-145 E) Authorize a change order(Change Order No. 1 in the amount of$22,120.17, increasing the contract amount to$5,560,689.42)between the City of Beaumont and Allco, Inc., related to the Concord Road pavement Widening Project, Phase III - Resolution No. 02-146 F) Authorize a reimbursement (in the amount of $38,515.11 of which $30,812.09 will be reimbursed by the Texas Department of Transportation)to Alon Petroleum Pipe Line Company for the adjustment of their facilities on FM 364/Major Drive - Resolution No. 02-147 G) Approve an annual contract(with Trinity Aggregate Distribution for an estimated$85,000)for the purchase of limestone base material for use in the Public Works Department-Resolution No. 02-148 Council member Cokinos moved to approve the Consent Agenda. Considera resolution that would allow the City ofBeaumont/Clean Community Department to remove all heavy equipment, vehicles, litter and debris from property located at 11175 Carpenter Road and across from 11175 Carpenter Road. Councilmember Cokinos moved to approve Resolution No. 02-149. Mayor Pro Tern Smith seconded the motion. MOTION PASSED. Consider approval of a mutual aid agreement between the City of Beaumont and Jefferson County. Mayor Pro Tern Smith moved to approve Resolution No. 02-150. Councilmember Ames seconded the motion. MOTION PASSED. Ayes: Mayor Lord,Mayor Pro Tern Smith,Councilmembers Goodson,Cokinos, Ames, Samuel, and Patterson Nays: None 3. Consider approval of a mutual aid agreement between the City of Beaumont and the City of Nederland. CouncilmemberCokinos moved to approve Resolution No.02-151. Council member Ames seconded the motion. MOTION PASSED. Ayes: Mayor Lord, Mayor Pro Tern Smith,Councilmembers Goodson,Cokinos, Ames, Samuel, and Patterson Nays: None Concerning rendering disaster assistance, Mayor Lord clarified the mutual aid agreements must be in effect before extending aid to neighboring communities and to be eligible for Federal reimbursement. 4. Consider approving the purchase of eight paratransit vehicles for the Beaumont Municipal Transit System Mayor Pro Tern Smith moved to approve Resolution No. 02-152 awarding a contract to National Bus Sales and Leasing, Inc. in the amount of$794,332. Councilmember Goodson seconded the motion. MOTION PASSED. Ayes: Mayor Lord,Mayor Pro Tern Smith,Councilmembers Goodson,Cokinos, Ames, Samuel, and Patterson Nays: None WORK SESSION FY 2003 Budget City Manager Bonczek reported meeting tomorrowwith department directors to introduce proposed budget cuts and ideas for raising revenues. Mr. Bonczek spoke of meeting with consultants to review water losses and will discuss matters further at the next Council meeting. Minutes -July 2,2002 Page 3 COMMENTS Councilmembers comment on various matters Councilmember Samuel requested staff investigate property on Helbig Road forweed abatement and address dilapidation of the structure,and contact Mr.Granger concerning a waterservice interruption at 3760 Robinson Street. Councilmember Ames requested clarification of dates for neighborhood budget meetings and confirmed the September 10, 2002 budget public hearing date. City Manager Bonczek responded the neighborhood associations will be contacted on the budget discussion dates and notification will be made once the dates are confirmed. For the record, Councilmember Goodson commented Council will meet with each of the four wards sometime in the latter part of August and notifications will be made to the neighborhood associations. He discussed a number of meetings and events held last week and extended appreciation to Council and civic and business leaders for meeting with members of the Texas Municipal League(TML)Board. Councilmember Goodson stated the TML Board had a wonderful time and was impressed with the facilities at both Gladys City and Downtown Crockett Street. Mayor Pro Tern Smith extended appreciation to Clean Community Director John Labrie for efforts in clearing the property on Carpenter Road and spoke of difficulties since 1989. Mayor Lord thanked Councilmember Goodson for providing hospitality to the Texas Municipal League and complimented him for being a fine host. She spoke of attending Literacy Program and South East Texas Regional Planning Commission meetings. Mayor Lord proudly extended invitations to attend the July 4th celebration at Riverfront Park. She described events such as fire works,concerts,and a fly over by a United States Air Force bomberwhich has recently finished a tour of duty in Afghanistan and piloted by an Orange, Texas native. City Manager's Report-YMCA Downtown Facility;Fletcher Mini-Park Renovations; Enforcing of Litter Laws; Weapons of Mass Destruction Class; Neighborhood Update; Arbitrage Compliance Services; Texas Safety Association Awards City Manager Bonczek discussed touring the YMCA Downtown facility. Based upon the structure's current condition,he did not recommend accepting the YMCA proposal. Mr.Bonczek reported working with residents and professionals concerning Fletcher Mini Park and discussed renovations estimated at$50,000. The City Manager confirmed near completion of the first phase of the 32 park analyses. City Manager Bonczek explained arbitrage which is a price differential from investing proceeds from a lower interest tax exempt issue into an investment vehicle having tax liability and the differential netting revenues. He suggested engaging professional expertise to perform required rebate reporting. Through the efforts of Emergency Coordinatorand Fire Chief Micky Bertrand,Mr.Bonczek mentioned receiving grant funds concerning the training and planning for the impact of weapons of mass destruction and encouraged Council to attend training classes on August 8 through 9 at the Texas Air National Guard. Public Comment ( Persons are limited to three (3) minutes ) Minutes -July 2,2002 Page 4 Mr.Allen Lee,5095 Maddox,addressed Council to extend appreciation forthe completion of the new Theodore Johns Library. Mr. Lee suggested a new City-owned recreational facility, retaining the namesake honoring the community works of Dr. L. L. Melton, and commented children and senior citizens are unable to afford YMCA memberships. He spoke in opposition to contributing public funds to a private organization. Mr. Lee requested Council consideration in appointing Deputy City Clerk Rebecca Hoge to the vacant City Clerk position. Ms.Marie Easley,(no address given),addressed Council to announce being a committed and working member of the Dr. Martin Luther King, Jr. Parkway Commission. Mr. Leroy Lewis III, 1855 North Street, addressed Council to report standing water on Calder and Fourth and Seventh Streets,and requested enclosed bus shelters. He extended appreciation to the City Manager, Councilmembers Patterson and Cokinos, Police Department, and the citizens for community efforts. Mr.Lewis expressed sincere thanks forthe Theodore Johns Library and suggested changing restrictions at the Art Museum. There being no further business, the meeting adjourned at 2:10 p.m. Evelyn M. L rd, Mayor Lolita Ramos, Interim bity Clerk Minutes -July 2,2002 Page 5 Cttyfu �t IMMEDIATE RE EASE For information contact: Beverly Hatcher, Chairman, MLK Parkway Commission, (409)781-4956 Today July 2, 2002, the MLK Parkway Commission will unveil a prototype "Head/Bust" statue that will memorialize the life of Civil Rights leader Dr. Martin Luther King, Jr. Internationally acclaimed artist, Ed Dwight of Denver, Colorado, completed the Bronze prototype of Dr. King to present to the citizens of Beaumont for the public to view. THE UNVEILING WILL TAKE PLACE TODAY A 1:30 P.M.AT THE BEGINNING OF CITY COUNCIL IN THE CITY COUNCIL CHAMBERS,THEN THE BRONZE PROTOTYPE WILL BE PLACE AT THE BEAUMONT CIVIC CENTER FOR THE PUBLIC TO VIEW DURING THE CITY OF BEAUMONT 4 JULY DAY LONG CELEBRATION. Six jurors from the MLK Parkway Commission selected Dwight from a field of 13 artists who responded to the Commission's request for proposal. Selection was based on the artists'demonstration of: • Facial Characteristics, General Likeness of Dr. King • Non-verbal Poise and Clothing/Attire of Dr. King • Feasibility • Composition/Visual Arrangement Upon completion, the 16' Bronze statue of Dr. King and four(4) children will be placed on the comer of Wall Street and M.L. King Jr. Parkway in Beaumont. Artist's Background A celebrated artist, Dwight is also a graduated engineer. He is a former United States Air Force Test Pilot and America's first Black astronaut trainee. He received his Master of Fine Arts degree (MFA) in sculpture from the University of Denver in 1978. In 1975, Dwight was commissioned by the Colorado Centennial Commission to create a series of bronzes depicting the contribution of Blacks to the American Frontier West. The series of 30 bronzes was on exhibit for several years throughout the United States, and gained widespread acceptance and critical acclaim. In 1979,while the series was on exhibit at the Jefferson National Expansion Memorial of the National Park Service, Dwight was encouraged to create a bronze series portraying the history and historical roots of Jazz. The series, entitled "JAZZ: An American Art Form," now consists of over 70 bronzes characterizing the creation and evolution of Jazz from its African and European roots to the fusions of contemporary music. Dwight's first large-scale commissioned work was the abolitionist Frederick Douglass in 1978. This life-sized monument was commissioned by the National Park Service, and is on display in Anacostia, Maryland. Since 1978, Dwight has completed of 65 large-scale installations throughout the United States and has also created of 7,500 other sculptures. He is represented in some twenty galleries throughout the United States. Recently, Dwight was commissioned to create the largest memorial to African Americans in history. The 90-foot Black Patriots Memorial will be installed in Washington DC between the Lincoln Memorial and the Washington Monument. EXHIBIT "A" P. 0 .
