REQUESTED ACTION: Council consider a request for a zone change from RS (Residential

RECOMMENDATION
The Administration recommends denial of the zone change from RS (Residential Single Family
Dwelling) to RM-M (Residential Multiple Family Dwelling-Medium Density) District at 1155
Glendale Street.
BACKGROUND
Mr.Jack Naymik, the property owner,would like to rezone this 1.12 acres of land at 1155 Glendale
Avenue to RM-M in order to build 8 townhouse units. Mr. Naymik bought the property from the
City. On the property sits a former fire station.
The surrounding property is zoned RS. To the north and west are single family residential uses. To
the south is a church. To the east of the subject property is farm land.
This zone change could be considered spot zoning and the following issues should be considered
when determining the validity of spot zoning:
— The law demands that the approved zoning plan should be respected and not altered
for the special benefit of the landowner when the change will cause substantial
detriment to the surrounding land or serve no substantial public purpose. Would the
zone change be in compliance with the adopted comprehensive plan?
Developing the property with 8 townhouses would increase the density and traffic in
an area currently developed with low density housing. The Comprehensive Plan
designates this area as a"stable area". In a stable area, incompatible land uses are
discouraged. Are 8 townhouses incompatible with an area of mostly single family
homes?
Lots that are rezoned in a way that is substantially inconsistent with the zoning of
the surrounding area, whether more or less restrictive, are likely to be invalid.
All of the property surrounding the subject property is zoned RS.
— Is the tract of land suitable or unsuitable for use as presently zoned?
While the property is currently developed with an old fire station, with demolition,
the two lots could be used for single family use.
BUDGETARYIMPACT
None.
PREVIOUS ACTION
At a joint Public Hearing with City Council held June 17, 2002, the Planning Commission voted
7-0 to deny a zone change from RS to RM-M District for property at 1155 Glendale Street.
SUBSEQUENT ACTION
None.

Planning Commission,City Manager,Executive Assistant to City Manager/Economic Development
Director and the Planning Manager.
RECOMMENDED MOTION
Approve/Deny a request for a zone change from RS to RM-M District for property at 1155 Glendale
Street.
Note: THE "20% RULE"
Sec. 30-40.D. of the Zoning Ordinance states the following:
Protest: The City Council shall not amend, supplement, change, modify or repeal
any regulation, restriction or boundary or approve a specific use permit where a
protest against such change, signed by the owners of twenty (20) percent or more
either of the area of the lots included in such proposed change or of the lots or land
immediately adjoining the same and extending two hundred (200) feet therefrom,
except by the favorable vote of three-fourths (3/4) of all the members of the City
Council.
This means that in order to approve a zone change or specific use permit when the
20% rule has been invoked at least six Council members must vote in favor of the
Ordinance.
On File 1619-Z,a protest of 66.3%was received,therefore invoking the Rule on this
case.

PROPERTY PRESENTLY ZONED RS (RESIDENTIAL
SINGLE FAMILY DWELLING) TO RM-M (RESIDENTIAL
MULTIPLE FAMILY DWELLING - MEDIUM DENSITY)
DISTRICT FOR PROPERTY LOCATED AT 1155 GLENDALE
STREET, BEAUMONT, JEFFERSON COUNTY, TEXAS;
PROVIDING FOR SEVERABILITY; PROVIDING FOR

BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
That Chapter 30 of the Code of Ordinances of Beaumont, Texas, and in particular
the boundaries of the zoning districts, as indicated upon the Zoning Map of the City of
Beaumont, referred to in Section 30-513 thereof, is hereby amended by changing the
zoning of property presently zoned as RS (Residential Single Family Dwelling) to RM-M
(Residential Multiple Family Dwelling - Medium Density) District for property located at
1155 Glendale, being Lots 14 and 15, Block D, Mayfair Addition, City of Beaumont,
Jefferson County,Texas,containing 1.125 acres, more or less,as described on Exhibit"A",
and the official zoning map of the City of Beaumont is hereby amended to reflect such
changes.

That, in all other respects, the use of the property herein above described shall be
subject to all of the applicable regulations contained in Chapter 30 of the Code of

application of same to a particular set of persons or circumstances, should for any reason
be held to be invalid, such invalidity shall not affect the remaining portions of this
ordinance, and to such end, the various portions and provisions of this ordinance are
declared to be severable.
Section 4.
That all ordinances or parts of ordinances in conflict herewith are repealed to the
extent of the conflict only.
Section 5.
That any person who violates any provision of this ordinance shall, upon conviction,
be punished, as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.

RECOMMENDATION
The Administration recommends approval of a zone change from RS to GC-MD-2 District at 2682
Hazel and a specific use permit to allow parking facilities subject to the following conditions:
1. The parking facility will not be used for any truck deliveries.
2. Modification to the screening/landscaping requirements on the north and east sides
of the subject property.
BACKGROUND
Jeff McManus and Judy McManus Manuel,owners of the McManus Company,wish to rezone this
property in order to build a driveway to a proposed parking lot and small warehouse that they intend
to build behind the existing business.
The applicants state that their business has grown tremendously over the last five years and are in
need of expansion. In order to expand their present location,they need the subject property to build
the aforementioned driveway.
Where they need to position the new warehouse,there is an existing building that they now use for
storage that is in a dilapidated state. They plan to tear it down and construct the new warehouse
positioned behind two of the buildings they presently own. These properties are currently zoned
GC-MD.
The applicants state that parking is also a serious problem. Presently, they have eight parking
spaces, forcing customers and employees to park on Hazel. As part of this new construction, a 4
space parking lot and new dumpster location will be built on the property zoned GC-MD.
While the Planning Division has typically recommended denial ofcommercial encroachment from 11''
Street into the Oaks Historic District,staff feels that this change to GC-MD-2 would be appropriate
for the following reasons:
1. The subject property is already a vacant lot. No residential structures will be
demolished.
2. The zone change is needed to build a driveway that will accommodate four parking
spaces in a GC-MD district.
3. The parking lot would get parked cars off Hazel.
4. By approving GC-MD-2 zoning and a specific use permit for parking facilities only,
the Planning Commission and City Council could require additional requirements that
would lessen the impact that this development might have on adjacent properties.
The applicants submitted a certificate of appropriateness to the Historic Landmark Commission for
construction of the warehouse and parking lot on two of the lots zoned GC-MD. This item was
considered at the June 10 Historic Landmark Commission meeting and was approved.
BUDGETARY IMPACT
None.

(GENERAL COMMERCIAL-MULTIPLE FAMILY DWELLING-
2) DISTRICT LOCATED AT 2682 HAZEL IN THE CITY OF
BEAUMONT, JEFFERSON COUNTY, TEXAS.
WHEREAS, the City Council for the City of Beaumont desires to issue a specific
use permit to Jeff McManus and Judy McManus Manuel to allow parking facilities in a GC-
MD (General Commercial-Multiple Family Dwelling) District located at 2682 Hazel, being
Lot 19, Block 54, Averill Addition, City of Beaumont, Jefferson County, Texas, containing
0.172 acres, more or less, as shown on Exhibit "A" attached hereto; and,
WHEREAS, the City Council is of the opinion that the issuance of such specific use
permit is in the best interest of the City of Beaumont and its citizens, subject to the
hereinafter described conditions;
NOW, THEREFORE, BE IT ORDAINED BY THE

Section 1.

BACKGROUND
Ronald Walker and Joe Arena are buying the subject property and wish to develop an additional 74
self storage units. Access to these additional units would be through an existing self storage facility
that fronts on College Street. That property is zoned GC-MD. The property owners received a
specific use permit in 1999 to build that facility.
The proposed storage facility will consist of pre-engineered buildings. The applicant states that the
current facility generates approximately 8-10 persons per day visiting the facility.
There is a 40 foot wide DD No. 6 drainage easement south of the subject property. The properties
to the east and west are wooded. The applicant is requesting a modification to the
landscaping/screening requirements along the south, east and west sides of the property.
BUDGETARY IMPACT
None.

PROPERTY LOCATED AT 9405 COLLEGE STREET,
BEAUMONT, JEFFERSON COUNTY, TEXAS; PROVIDING
FOR SEVERABILITY; PROVIDING FOR REPEAL AND
PROVIDING A PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
That Chapter 30 of the Code of Ordinances of Beaumont, Texas, and in particular
the boundaries of the zoning districts, as indicated upon the Zoning Map of the City of
Beaumont, referred to in Section 30-513 thereof, are hereby amended by changing the
zoning of property presently zoned as RM-H(Residential Multiple Family Dwelling-Highest
Density))District to GC-MD-2(General Commercial-Multiple Family Dwelling-2)District for
property located 9405 College Street, Beaumont, Jefferson County, Texas, and described
as follows:
Being that certain 2.047 acre tract out of Lot 6 and Lot 14, Block 3 of
Wescalder Fig Acres, a plat recorded in Volume 4, Pages 149 and 150 of the
Deed Record of Jefferson County, Texas, and being comprised of that tract
conveyed to James C. Smith and wife,Anita K. Smith as recorded in Volume
1951, Page 126 of the Deed Records of Jefferson County,Texas,that called
0.170 acre tract conveyed to Louis P. Lichenstein as recorded in Clerks File
No.20001016939 of the Official Public Records of Real Property of Jefferson
County, Texas, and that tract conveyed to Louis P. Lichenstein as recorded
in Volume 1933, Page 81 of the Deed Records of Jefferson County, Texas,

COMMENCING at a 3/4" iron pipe found in the east right-of-way line of
Reynolds Road for the northwest corner of the said Smith tract from which
a 1" iron rod found for the southwest corner of a 40-foot wide drainage ditch
conveyed to Jefferson County Drainage District No. 6 as recorded in Clerks
File No. 20001015968 of the Official Public Records of Real Property of
Jefferson County, Texas bears South 00 005'44" West 123.15 feet (called
South);
THENCE North 81033'34" East continuing along the north line of the said
Smith tract a distance of 559.87 fee (called North 81 030'48" East) to a 1/2"
capped iron rod set for the northwest corner of the said 2.047 acre tract and
POINT OF BEGINNING;
THENCE North 81033'34" East continuing along the said north line of the
Smith tract a distance of 15.17 feet (called North 81°30'48" East) to a 3/4"
iron rod found for the southwest corner of a called tract conveyed to Walker-
Arena, Inc. as recorded in Clerks File No. 199820673 of the Official Public
Records of Real Property of Jefferson county, Texas;
THENCE North 81 031'48" East continuing along the said north line of the
Smith tract and north line of the said Lichenstein tracts a distance of 438.57
feet (called North 81 030'48" East) to a 1/2" capped iron rod set for the
northeast corner of the said 2.047 acre tract;
THENCE South 00 008'53" West along the east line of the said Lichenstein
tract a distance of 232.15 feet (called South) to a capped iron rod marked
DD6 found in the north line of a 40-foot wide drainage ditch conveyed to
Jefferson County Drainage District No. 6 as recorded in Clerks File No.
2001007248 of the Official Public Records of Real Property of Jefferson
County, Texas for the southeast corner of the said 2.047 acre tract;
THENCE West along the south line of the said Lichenstein tracts and Smith

Section 2.
That, in all other respects, the use of the property herein above described shall be

Section 3.
That if any section, subsection, sentence, clause of phrase of this ordinance, or the
application of same to a particular set of persons or circumstances, should for any reason
be held to be invalid, such invalidity shall not affect the remaining portions of this
ordinance, and to such end, the various portions and provisions of this ordinance are
declared to be severable.
Section 4.
That all ordinances or parts of ordinances in conflict herewith are repealed to the
extent of the conflict only.
Section 5.
That any person who violates any provision of this ordinance shall, upon conviction,
be punished, as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.

accordance with each particular and detail of the site plan attached hereto as Exhibit "B"
and made a part hereof for all purposes.
Section 3.
Notwithstanding the site plan attached hereto, the use of the property herein above
described shall be in all other respects subject to all of the applicable regulations contained
in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended.

BACKGROUND
Mr. Michael Gammill,the contracted purchaser, is buying 3 acres of land between Eastex Freeway
and Old Voth Road. The property sits in the 9800 block of Old Voth Road. Of the 3 acres, Mr.
Gammill wishes to rezone 1.7 acres to RS. On this 1.7 acres, he wishes to build his personal
residence. On the remaining 1.3 acres that front on Eastex Freeway and are zoned GC-MD,he wants
to build his office/shop.

At a joint Public Hearing with City Council held June 17, 2002, the Planning Commission voted

The Administration recommends approval of a specific use permit to allow the expansion of a
transitional treatment center(halfway house) in a GC-MD (General Commercial-Multiple Family
Dwelling) District at 2435 Gulf Street.
BACKGROUND
Fittz and Shipman, the applicants, are requesting on behalf of Correctional System, Inc. (CSI), a
specific use permit to allow the expansion of its transitional treatment center. CSI has acquired a
vacant church at 2435 Gulf Street. They would like to modify the structure into administrative
offices and a dining area. CSI would then convert its present office into a dormitory. The expansion
into the existing office will require an additional specific use permit.
CSI built its current location before the Zoning Ordinance required a specific use permit for such
facilities in a GC-MD District.
This facility currently takes State of Texas parolees. The residents are required to work off-premise
and only sleep at the facility. The facility is transitional in that it eases the residents back into
society. The residents are strictly monitored and any infraction of the rules will constitute the
issuance of a warrant for their arrest.

BACKGROUND
Beaumont Family Practice Associates proposes to build a 15,000 sq. ft.single story family clinic and
medical office building on 2.29 acres of land on the north side of Folsom, between Major Drive and
Dowlen Road. This property was rezoned to GC-MD-2 in July, 2001.
The proposed facility will have diagnostic imaging services and physician clinic space. There will be
no emergency room or surgical services. This property is immediately west of a 15,000 sq. ft.office
building that is currently under construction.
BUDGETARY IMPACT
None.
PREVIOUS ACTION
At a joint Public Hearing with City Council held June 17,2002,the Planning Commission voted 7-0
to approve a specific use permit to allow an outpatient based family clinic and medical office building
in a GC-MD-2 District in the 6300 block of Folsom Extension, east of Major Drive.

The Administration recommends approval of a specific use permit to allow a halfway house for
federal offenders in a GC-MD(General Commercial-Multiple Family Dwelling)District at 1255-59
Broadway.
BACKGROUND
Bannum, Inc. is requesting this specific use permit in order to relocate its current facility at 1310
Pennsylvania Avenue to 1255-1259 Broadway. Bannum has submitted a proposal to the Federal
Bureau of Prisons to relocate to the subject property. The existing building was formerly the offices
of Manpower. The building will require renovations to meet Federal Bureau of Prisons safety
requirements.
The term for the proposed contract is five years. The estimated requirement specifies 25 beds for
males and 5 beds for females. Federal placements at the facility will come from three sources:
individuals who are transferred from an institution to the facility for pre-release programming,
individuals who are committed directly to the facility by the Federal Courts, and individuals under
the supervision of the U.S. Probation Office for whom residence at the facility is a condition of
supervision. Nationwide, the average placement is three to four months in length, although longer
placements are sometimes made.
This facility will provide housing and related services to those persons from Beaumont and the
immediately surrounding area who are returning to their homes, family and friends. The residents
will go to work daily and return to the facility after work to sleep.
Each resident's movement in the community will be monitored. However, there are no bars, locks
or other physical restraints. Bannum will employ a professional staff to include social workers to
monitor and guide the residents through this period of transition. Violations of the rules will call for
reporting the resident to the appropriate Federal authorities.
BUDGETARY IMPACT
None.
PREVIOUS ACTION

1255-59 Broadway.

RECOMMENDED BY
City Manager and the Planning Manager.
Although this project is eligible for consideration for a specific use permit from a planning
perspective, the Administration is concerned with the impact on the immediate neighborhood. The
Administration recommended to the applicant that a more suitable location be considered. (April
8, 2002 letter attached) The Administration also recommended that the applicant have a
neighborhood compatibility meeting to address resident concerns prior to the Planning Commission
meeting.
RECOMMENDED MOTION
Approve/Deny a request for a specific use permit to allow a halfway house for federal offenders in
a GC-MD District at 1255-59 Broadway.
Note: THE "20% RULE"
Sec. 30-40.D. of the Zoning Ordinance states the following:
Protest: The City Council shall not amend,supplement,change,modify or repeal any
regulation, restriction or boundary or approve a specific use permit where a protest
against such change, signed by the owners of twenty (20) percent or more either of
the area of the lots included in such proposed change or of the lots or land
immediately adjoining the same and extending two hundred (200) feet therefrom,
except by the favorable vote of three-fourths (3/4) of all the members of the City
Council.
This means that in order to approve a zone change or specific use permit when the
20% rule has been invoked at least six Council members must vote in favor of the
Ordinance.
On File 1623-P,a protest of24.1%was received,therefore invoking the Rule on this
case.

Bannum's proposed use is compatible with and not injurious to the use and enjoyment of
other property. nor does it significantly diminish or impair property values within the
immediate vicinity.
Bannum's proposed use will not impede the normal and orderly development and
improvement of surrounding vacant property.
Adequate utilities. access roads, drainage and other necessary supporting facilities
currently exist.
The design. location and arrangement of all driveways and parking spaces provides for
the safe and convenient movement of vehicular and pedestrian traffic without adversely
affecting the general public or adjacent development.
There will be no offensive odor. fumes. dust. noise or vibration.
Directional lighting will not be required as the proposed use will not disturb or adversely
affect neighboring properties.
There exists sufficient landscaping and screening to insure harmony and compatibility
with adjacent property.
The proposed use would not negatively affect or hinder, in any way, the comprehensive
plan.
Again. we believe that our record of operations in Beaumont over the past four and one
half years speaks for itself and our current operation has not negatively impacted the
community with respect to any of the items discussed above.

The City of Beaumont received a letter from Bannum, Inc. on April 2,2002 related to a proposed
location for a"halfway house"for federal offenders releasing to the Beaumont area. Bannum,
Inc. currently operates a facility at 1310 Pennsylvania Avenue. Their contract will expire on
October 31, 2002 and they are rebidding for another five-year period in response to a request for
proposals issued by the U.S. Department of Justice, Federal Bureau of Prisons.
The proposal by Bannum, Inc. includes relocating their Beaumont facility to 1255-1257-1259
Broadway. The proposed property is zoned commercial and will require a specific use permit
from the City of Beaumont to house and operate the program for federal offenders. The City
Administration has determined that this location is not in the best interest of the community,
specifically the surrounding churches and businesses. Within one and half blocks from the above
address is Temple Emanuel and within three blocks is First Baptist Church of Beaumont. The
proposed location is also within four blocks of downtown Beaumont which currently has more
than$20 million of construction projects underway in an effort to revitalize the Central Business
District.
The City of Beaumont would like to work with Bannum, Inc. in an effort to find a more suitable
location to house the program and offenders and to keep the facility in Beaumont.

preliminary site inspection of our proposed location at 1255 Broadway on Thursday, May

As you may be aware,Bannum has been operating a Federal Community Correction Center
(CCC) or"halAvay house" program for federal offenders releasing to the Beaumont TX area at
1;10 Pennsylvania Avenue, since 1997(over four years). Our current contract is to expire on
October 31, 2002, and therefore,we are re-bidding that contract for another five-year period in
response to a request for proposal, RFP 200-0722-SC, issued by the U.S. Department of Justice,
Federal Bureau of Prisons. The BOP encourages full and open competition in the procurement of
these services; consequently,other offerors may also be responding to this RFP.
As pan of the CCC contracting process,the BOP requires that all offerors notify and seek input
from the local law enforcement authority and two levels of locally elected government officials.
This lever will serve as documentation of partial satisfaction of this requirement.
Bannum has submitted a proposal to the Federal Bureau of Prisons to relocate this Federal
program to 1255-1257-1259 Broadway, Beaumont,TX.The proposed property is zoned
commercial and was the former business location for Manpower. The building will require
renovations to meet Federal Bureau of Prisons safety requirements by the contract performance
date of November 1. 2002.
The total term of the proposed contract is five years. The estimated requirement specifies 25
beds for males and 5 beds for females. These numbers reflect the BOP's best estimates of bed
space needs at this time. The BOP may exceed its original estimates if there is an unanticipated
need for additional bed space in this area. Performance is to begin on November 1, 2002 with
contract award made by July 1, 2002.
The BOP has a long history of transferring individuals ubo are within a few months of release to
a contractor-operated CCC for transitional programming These individuals have often been
removed from the community for an extended period of time. Sound correctional practice
suavests that CCCs enhance public safety by offering these individuals the opportunity to find
ernpioyment,establish residence, and re-enter the community from which they came through a
structured, supportive environment.
The BOP takes its responsibility for contract oversight very seriously. Contract language
establishes requirements for individual accountability,programming, life safety, staffing,
discipline, urine and alcohol surveillance, and a variety of other areas. These requirements are
closely monitored by BOP staff, who provide training and conduct both scheduled and
unannounced on-site inspections.
Federal placements at the CCC will come from three sources: individuals who are transferred
from a institution to the CCC for pre-release programming, individuals who are committed
directly to the CCC by the Federal Courts, and individuals under the supervision of the U.S.
Probation Office for whom residence at the CCC is a condition of supervision. Nationwide, the
a-%,eraee CCC placement is three to four months in length,although longer placements are
sometimes made.
Bannurn will provide housing and related services to those persons from Beaumont and the
immediate surrounding area that are returning to their homes, family, and friends. Our residents
will go to work daily and return to the facility after work to sleep. Then; as long as they are
honoring=their agreement to qualiA, for the program,they can go visit their family and friends if
the. "'ish. They would then return to the facility on -weekday evenings at their individual curf6v
time. Many residents would be allowed to check out on Friday and would not return again until
their Sunday night curfew.
Bannum will monitor each residents movement in the community by periodic on-site and
telephone verification of their employment, educational pursuits, family visits, or other
,hereabouts. Bannum will assist the resident to find employment if they are not employed by
rnaking referrals to local employment agencies and local employers which have expressed
interest in employing these residents.
Since this is a period of transition for these persons, Bannum simply assists them in re-
establishing employment and family ties, locating suitable housing and preparing to function
normally within the community to which they are returning. Bannum also makes referrals to
local community agencies as appropriate.
Bannum's personnel monitor the program on a 24-hour basis, but there are no lochs, bars, or
other physical restraints. Bannum will employ a professional staff to include social workers to
monitor and guide the residents through this period of transition.
If a resident violates his agreement to remain in the program by missing curfemr,, by unexcused
absence from work, etc., or if the resident fails to return to the facility or decides to leave the
facility without our permission, we cannot and will not stop them. In these cases we simple
report the resident to the appropriate Federal authorities.Penalties include a return to
incarceration.
Bannum's staff are not peace officers,are not permitted to carry weapons of any hind_ and are
not authorized to physically restrain any person. Bannum's staff do no wear uniforms or possess
any other form of identification or powers than any other citizen of Beaumont.

WHEREAS,the City Council for the City of Beaumont desires to issue a specific use
permit to Carl Moss to allow the temporary placement of a travel trailer for a period of two
(2) months in an RS (Residential Single Family DWelling) District located at 990 Church
Street, being Lot 12, Block 24, Jeff Chaison Addition, City of Beaumont, Jefferson County,
Texas, containing 0.16 acres, more or less as shown on Exhibit"A" attached hereto; and,
WHEREAS, the City Council is of the opinion that the issuance of such specific use

Beaumont Masonic Lodge No. 286 wishes to construct a 1,980 sq. ft.building for meeting purposes
at the northwest corner of Phelan Boulevard and Berry Road. Meetings will be held at least once
a month to conduct regular fraternal business and as deemed necessary for conducting open
meetings, presentations and programs for the fraternity and public interest.
The property will be screened with an eight foot tall screening fence and 10 foot wide landscape strip
on the north side of the property. The parking lot will be landscaped to meet Zoning Ordinance
requirements.

ENTITLED AN ORDINANCE GRANTING A SPECIFIC USE
PERMIT TO ALLOW A MASONIC LODGE IN AN NC
(NEIGHBORHOOD COMMERCIAL) DISTRICT LOCATED AT
THE NORTHWEST CORNER OF PHELAN BOULEVARD
AND BERRY ROAD IN THE CITY OF BEAUMONT,
JEFFERSON COUNTY, TEXAS.
WHEREAS, the City Council for the City of Beaumont desires to issue a specific
use permit to Beaumont Masonic Lodge No. 286 to allow a masonic lodge in an NC
(Neighborhood Commercial) District located at the northwest corner of Phelan Boulevard
and Berry Road, being Tract 75A, Plat SP6, C. Williams Survey, City of Beaumont,
Jefferson County, Texas, containing 0.577 acres, more or less, as shown on Exhibit "A"
attached hereto and made a part hereof for all purposes; and,
WHEREAS, the City Council is of the opinion that the issuance of such specific use
permit is in the best interest of the City of Beaumont and its citizens, subject to the
hereinafter described conditions;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
Section 1.
That all conditions necessary for issuance of a specific use permit have been met
and a specific use permit to allow a masonic lodge in an NC (Neighborhood Commercial)
District, located at the northwest corner of Phelan Boulevard and Berry Road, being Tract
75A, Plat SP6, C.Williams Survey, City of Beaumont, Jefferson County, Texas, containing
0.577 acres, more or less, is hereby granted to Beaumont Masonic Lodge No.286, its legal

representatives, successors and assigns for that certain tract shown on Exhibit "A"
attached hereto and made a part hereof for all purposes, subject to the redesign of the
parking lot to comply with City design requirements and no freestanding sign.
Section 2.

accordance with each particular and detail of the site plan attached hereto as Exhibit "B"
and made a part hereof for all purposes.
Section 3.
Notwithstanding the site plan attached hereto, the use of the property herein above
described shall be in all other respects subject to all of the applicable regulations contained
in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended.

RECOMMENDATION
The Administration recommends approval of the specific use permit to allow a taxi service in a GC-
MD(General Commercial-Multiple Family Dwelling)District at the southwest corner of Center and
Liberty Street.
BACKGROUND
Paul and Liz Leger, owners of American Quality Cabs,must vacate their current place of business
in the Goodhue Building by June 30. All tenants have been ordered to vacate that building.
Therefore, the Legers are now in need of a new location to operate their taxi service business.
In 1999,City Council approved a specific use permit to allow the Legers to operate their taxi service
on property at M.L.K. Parkway and Laurel. After the granting of the specific use permit, the
property owner changed his mind and the Legers were not able to use that property. Since then,they
have operated out of the Goodhue Building on Crockett.
The Legers would now like to utilize two vacant lots at the southwest corner of Liberty and Center.
A 10'x 44'modular office will be used as a"taxi terminal". This will involve an office and dispatch
center. A 30' x 40' metal building will be used for minor maintenance to autos. Contact with the
drivers will be via a 2-way radio. The drivers work 12 hour shifts and the shifts will be staggered
so that there will only be one or two drivers at the office at shift change. All major work on the
vehicles is contracted and will be done off-site.
BUDGETARY IMPACT
None.

At a joint Public Hearing with City Council held June 17, 2002, the Planning Commission voted
7-0 to approve a specific use permit to allow a taxi service in a GC-MD (General Commercial-
Multiple Family Dwelling) District at the southwest corner of Center and Liberty Street.

RECOMMENDATION
The Administration recommends approval of an HC-L(Historic Cultural-Landmark Preservation)
Designation for the site only at 1021 Bonham.
BACKGROUND
Willie G. Carriere,the property owner,has requested an HC-L Designation for the property located
at 1021 Bonham. On the property sits a vacant building identified as"Mae's Place".
According to Mr. Carriere, 1021 Bonham was one of the first Black owned and operated businesses
in the City of Beaumont. Mr. Carriere states that the City Directory, dating back to 1935, shows a
James Miner as the owner of a barbecue restaurant for black customers only at this location. Since
that date, eight black owned restaurants have been located at this location.
Mr. Carriere says that a building has been at 1021 Bonham since 1889. This location has been in
the City Directory since 1928. This property is located in what was called the"Red Light District".
Other buildings that were part of this district and still remain include the Stedman Building,the train
depot and the warehouse on Crockett.
According to Mr. Carriere, there has been a restaurant and tavern located at 1021 Bonham for the
last 75 years. Mr. Carriere states that this site reminds many of the history of how the Black
community began in Beaumont.
Mr.Carriere states that Herbert Oxford and his wife,Sadie,owned a local lumber yard and a number
of properties. These enterprises provided many opportunities for the African-American community.
This property was owned by Mrs. Oxford and she leased it to various Blacks who used the property
for restaurants.
In 1961, Willie and Verdie Mae Carrierre began renovation of the property. In 1981,the Carriere's
purchased the property from Mrs. Oxford. The restaurant served the Black community and the
downtown area.
On June 10, 2002, the Historic Landmark Commission voted to recommend approval of an HC-L
Designation for the site only.

THE CODE OF ORDINANCES OF BEAUMONT,TEXAS,AND
IN PARTICULAR THE BOUNDARIES OF THE ZONING
DISTRICTS, AS INDICATED UPON THE ZONING MAP OF
BEAUMONT, TEXAS, BY ESTABLISHING AN HC-L
(HISTORICAL-CULTURAL LANDMARK PRESERVATION
DESIGNATION) FOR THE SITE ONLY AT 1021 BONHAM,
BEAUMONT, JEFFERSON COUNTY, TEXAS; PROVIDING

BE IT ORDAINED BY THE CITY OF BEAUMONT:

That Chapter 30 of the Code of Ordinances of Beaumont, Texas, and in particular
the boundaries of the zoning districts, as indicated upon the Zoning Map of the City of
Beaumont, referred to in Section 30-513 thereof, is hereby amended by establishing an HC-
L (Historical-Cultural Landmark Preservation Designation) for the site only at 1021
Bonham, being Lot 2, Block 23, Van Wormer Addition, City of Beaumont, Jefferson
County, Texas, containing 0.16 acres, more or less, as shown on Exhibit "A" attached
hereto and made a part hereof for all purposes, and the official zoning map of the City of
Beaumont is hereby amended to reflect such changes.
Section 2.

BACKGROUND
Rose Sprott Swain,the applicant,is requesting that the house at 2398 Roberts be designated as a City
of Beaumont historic site.
The property was purchased in 1913 by Mr. Ed Sprott, Sr. Ms. Swain states that he was the first
African American postal worker in Beaumont and also one of the first African American landowners
in Beaumont. He and his first wife Myrtle raised nine children in the two bedroom home located
at 2398 Roberts. Three of the children born in the house became physicians and founded the Sprott
Hospital at 2390 Cartwright. That property was declared a historic landmark by the City in 1999.
The family homestead was also the birthplace of some of the early leaders of the black community
in Beaumont. Four of the children became teachers,one a postal worker and one received his Ph.D.
The house was built in the mid-1800's and is typical of the farmhouse vernacular of the period. The
house is currently under restoration.
This item was approved by the Historic Landmark Commission on May 13, 2002.

BACKGROUND
Gene Van Meter, the applicant, is requesting this abandonment of the dead-end portion of Florida
Avenue. It is not being maintained currently by the City of Beaumont. This remnant was left over
when Cardinal Drive was developed. Mr.Van Meter states that the subject right-of-way is now used
for the dumping of garbage. The only property that uses the subject right-of-way for access is Mr.
Van Meter's.
The Traffic Manager,in his review of the proposed request,said that the City needs this right-of-way
for future intersection improvements or re-alignment associated with roadway widening (Florida
Avenue)or safety enhancements. Presently,the widening of this portion of Florida is not on the CIP
(Capital Improvements Plan).

(Memorandums of Understanding) with Jefferson County and Port Arthur necessary to the
development of a public health system to respond to bioterrorism.
RECOMMENDATION
The administration recommends that Council approve the resolution presented.
BACKGROUND
The CDC ( Centers for Disease Control and Prevention) has made $60,000,000 available to the
State to build and enhance the public health infrastructure to address bioterrorism. Statewide
$27,000,000 will be distributed to local health departments. $393,000 is available to address the
needs within Jefferson county. The CDC expects the state plan to demonstrate coordination,
cooperation, and local involvement. Funding, which may be continued for four years, must be
used according to the general guidelines established for select focus areas.
Coordination of activities is expected within each health region and because Jefferson county is
one of only four served by more than one health department, additional expectations are
mandated. The State will require that cooperative agreements be established between Port Arthur
Health Department,Jefferson County Health and Welfare, and Beaumont Public Health
Department. Beaumont Public Health Department, the largest health department in the county,
will collaborate to create a comprehensive public health emergency preparedness response plan
for emergencies caused by bioterrorism and other public health threats and emergencies.
Further because Beaumont Public Health Department has responsibilities that cross jurisdictional
lines, its management will need to coordinate with both the City's and County's Emergency
Management Coordinators on how to deal with public health emergencies. The need for planning

is evident. Local health departments have recently been placed on notice by TDH that in the
event of a disaster declaration, the traditional public health communications system must change
to comply with the strict lines of communication mandated by the authority of the Governor.
Additionally,the grants provided to Hardin and Orange Counties will include approximately
$58,000 to allow them to contract with Beaumont Public Health Department for epidemiologic
services. Beaumont's programs will be designed to enable this inter jurisdictional cooperation.

This Agreement is made and enterec into this day of , 2002,by and
between the City of Beaumont,Texas("Bcaumtmf),the City of Port Arthur, Texas("Port
Arthur')(the"Cities"),and Jefferson County,Texas("County"), governmental entities
authorized by the Interlocal Cooperation Act, §791.001 et seq.,TExAs GovEi?-N-NtEN'r Com,to
enter into intergovernmental agreements to carry out their respective purposes.
WHEREAS, the geographic area of Jefferson County,including Beaumont,Port Arthur,other
incorporated cities and the unincorporated area of the County,is eligible for grant funding from
the Texas Department of Health for Bioterrorism Planning,Preparedness,Surveillance,
Investigation,Response and Public Information; and,
WHEREAS,the Cities and County desire to work cooperativcly to apply for said grant funds and
implement a program of Bioterrorism Planning,Preparedness, Surveillance,Investigation,
Response and Public Information.
NOW,THEREFORE,for the mutual consideration set out below,the parties hereto agree as
follows:
1.SERVICES
A. The Cities and the County will collaborate in an assessment of the capacity of public
health systerus in J ffcrsotx County to determine their readiness to respond to
bioterrorism and other public health threats and emergencies.
S. The Cities and the County will collaborate to create a comprehensive public health
emergency preparedness response plan for emergencies caused by bioternxism and
other public health threats and emergencies.
C. The Cities agree to provide surveillance and investigation(epidemiology)services to
the entire County,including the cities of Bevil Oaks, China, Groves,Nederland,
Nome, Port Neches and the unincorporated County,to ensure sufficient staffing and
coordination with area healthcare providers,with Beaumont providing services to that
area encompassing county commissioner precincts one and four,and Port Arthur
providing services to that area encompassing county commissioner precincts two and
three.
D. The Cities further agree to provide appropriate education and training to key public
health professionals,infectious disease specialists, emergency depar-ment personnel
and other healthcare providers in preparedness for and respons:to biotcsrorism.

Resurfacing in the amount of$263,200 to Trans Texas Tennis, Inc.
RECOMMENDATION
Administration recommends approval and execution of a contract with Trans Texas Tennis, Inc.
in the amount of $263,200 for the Athletic Complex, Post-tension Concrete Tennis Court
Resurfacing Project. The MBE will be met by sub-contracting 10% of the total construction cost
to a qualified Minority Business Enterprise.
Administration recommends authorization to award this contract.
BACKGROUND
On June 13, 2002, the City of Beaumont received four (4) bids for the Athletic Complex Post-
tension Concrete Tennis Court Resurfacing. The lowest bid was submitted by Trans Texas
Tennis, Inc. in the amount of$245,600. The lowest bid includes the combination of the base bid
in the amount of $224,900 plus alternate one (1) in the amount of $20,700. The Engineer
estimated the cost of the project prior to receipt of the bid at$300,000. The list below identifies

The Administration recommends approval of the purchase of one Trane RTAA 100 HVAC chiller
from Sunbelt Controls, Inc. of Beaumont in the amount of$46,723. The new chiller will replace
the Carrier unit currently in service at the Activity Center,which was installed in 1995 and has
subsequently been repaired on a number of occasions. The unit is currently unable to effectively
cool the building. Funds are available for this expenditure in the Capital Improvements Fund. A
copy of the staff memorandum is attached for your review.
B) Authorize the settlement of a lawsuit
The lawsuit of Christian Jayme v. City of Beaumont, Texas would be settled in the amount of
$13,000. Council discussed the settlement of this lawsuit in executive session on June 4, 2002. A

of Beaumont for the purchase and installation of one (1) Trane RTAA 100 HVAC chiller at the
Sterling Pruitt Activity Center.
BACKGROUND
The new chiller will replace the Carrier unit currently in service at the Center, which was installed
in 1995 and has subsequently been repaired on a number of occasions. The unit is currently
unable to effectively cool the center, and requires replacement of the coils and compressors. The
warranty period has expired, and initial price estimates for repair are in excess of$40,000.
Bid specifications require the vendor to furnish the new chiller, remove and dispose of the existing
chiller, and install the new unit. Installation will be completed within 75 days of award. The bid
amount includes a one (1) year full warranty and a five (5) year warranty on the unit's four (4)
compressors.
Bid notices were provided to eighteen(18) vendors, with four(4) responding with bids. The bids
received are reflected in the attached bid tabulation.
BUDGETARY IMPACT
Funds are available for this expenditure in the Capital Improvements Fund.
