ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF
THE CODE OF ORDINANCES OF BEAUMONT,TEXAS,AND
IN PARTICULAR THE BOUNDARIES OF THE ZONING
DISTRICTS, AS INDICATED UPON THE ZONING MAP OF
BEAUMONT, TEXAS, BY CHANGING THE ZONING OF
PROPERTY PRESENTLY ZONED GC-MD (GENERAL
COMMERCIAL-MULTIPLE DWELLING)TO RS(RESIDENTIAL
SINGLE FAMILY DWELLING) DISTRICT FOR PROPERTY
LOCATED IN THE 9800 BLOCK OF OLD VOTH ROAD,
BEAUMONT, JEFFERSON COUNTY, TEXAS; PROVIDING
FOR SEVERABILITY; PROVIDING FOR REPEAL AND
PROVIDING A PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
That Chapter 30 ofthe Code of Ordinances of Beaumont,Texas,and in particularthe
boundaries of the zoning districts,as indicated upon the Zoning Map of the City of Beaumont,
referred to in Section 30-513 thereof, is hereby amended by changing the zoning of property
presently zoned as GC-MD(General Commercial-Multiple Dwelling)to RS(Residential Single
Family Dwelling) District for property located in the 9800 Block of Old Voth Road, City of
Beaumont, Jefferson County, Texas, and described as follows:
BEING a 1.7914 acre tract or parcel of land situated in the W. B. Dyches
Survey,Abstract No. 17,Jefferson County,Texas and being out of and part of
that certain called 20.315 acre tract of land as described in a"Special Warranty
Deed" from Phil V. Hall to Mrs. Walter S. Parker, Walter S. Parker, III and
James E. Parker as recorded in Volume 2192, Page 380, Deed Records,
Jefferson County, Texas, said 1.7914 acre tract being more particularly
described as follows:
NOTE: All bearings are based on the West right-of-way line of U.S. Hwy. 69,
96 and 287 as SOUTH 10'46'45"EAST as recorded in the above referenced
Volume 2192, Page 380.
COMMENCING at the Southeast corner of the Parker Brothers Subdivision
Unit One, a subdivision of the City of Beaumont, Jefferson County, Texas,
according to the map or plat thereof recorded in Volume 16, Page 18, Map
Records,Jefferson County,Texas,said corner also being in the West right-of-
way line of U.S. Highway 69,96 and 287 and in the East line of the said 20.315
acre Parkertract and said comeralso being the Northeast corner of that certain
called 2.00 acre tract of land as described in a"Warranty Deed with Vendor's
Lien"from James E. Parker and Walter S. Parker, 111 to Joseph Garrett Guillory
and Jacqueline F.Guillory as recorded in Clerk's File No. 1999043734,Official
Public Records of Real Property, Jefferson County, Texas;
THENCE SOUTH 100 46'45" EAST, along and with the East line of the said
20.315 acre Parker tract, the West line of U. S. Highway 69, 96 and 287, the
East line of the said 2.00 acre Guillory tract and the East line of that certain
called 2.00 acre tract of land as described in a"Warranty Deed with Vendor's
Lien"from James E. Parker and Walter S. Parker, I II to Travis W. Hefley and
Michelle Hefley as recorded in Clerk's File No. 1999031662, Official Public
Records of Real Property, Jefferson County,Texas, for a distance of 325.31
feet to a point for corner, said corner being the Southeast corner of the said
2.00 acre Hefley tract;
THENCE NORTH 08° 14'30"WEST,along and with the South line of the said
2.00 acre Hefley tract, for a distance of 220.00 feet to the POINT OF
BEGINNING of the tract herein described;
THENCE SOUTH 08' 14' 30" EAST, parallel to the East right-of-way line of
Voth Road, for a distance of 236.56 feet to a point for corner;
THENCE NORTH 89° 12'25"WEST, parallel to the South line of the said 2.00
acre Hefleytract,fora distance of 334.01 feet to a point forcorner,said corner
being in the East right-of-way line of Voth Road and in the West line of the said
20.315 acre Parker tract;
THENCE NORTH 08° 14'30"WEST,along and with the East right-of-way line
of Voth Road and the West line of the said 20.315 acre Parker tract, for a
distance of 236.56 feet to a point for corner, said comer being the Southwest
corner of the said 2.00 acre Hefley tract;
THENCE SOUTH 89' 12'25" EAST, along and with the South line of the said
2.00 acre Hefley tract, for a distance of 334.01 feet to the POINT OF
BEGINNING and containing 1.7914 ACRES, more or less,
as described on Exhibit "A" and the official zoning map of the City of Beaumont is hereby
amended to reflect such changes.
Section 2.
That, in all other respects, the use of the property herein above described shall be
subject to all ofthe applicable regulations contained in Chapter 30 of the Code of Ordinances
of Beaumont, Texas, as amended.
Section 3.
That if any section, subsection, sentence, clause or phrase of this ordinance, or the
application of same to a particularsetof persons or circumstances,should forany reason be
held to be invalid,such invalidity shall not affectthe remaining portions of this ordinance,and
to such end, the various portions and provisions of this ordinance are declared to be
severable.
Section 4.
That all ordinances or parts of ordinances in conflict herewith are repealed to the extent
of the conflict only.
Section 5.
That any person who violates any provision of this ordinance shall,upon conviction,be
punished, as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.
