The City Council of the City of Beaumont, Texas, met in a regular session on February 5, 2002,
at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider
the following:

Consent Agenda
Mayor Moore called the meeting to order at 1:35 p.m. Councilmember Audwin Samuel gave the
invocation. Mayor Moore led the pledge of allegiance.
Present at the meeting were: Mayor Moore, Mayor Pro Tern Goodson, Councilmembers Smith,
Cokinos,Ames, Samuel, and Patterson. Also present were Stephen J. Bonczek, City Manager;
Lane Nichols, City Attorney; and Terri Hanks, Administrative Assistant.

Consent Agenda
Approval of minutes - January 29, 2002
Confirmation of committee appointments - Appointments: Mel Wright, Chairman and
Leonard Clifton, Vice-Chairman, Convention and Tourism Advisory Committee, for terms
expiring February 4, 2003; and Barbara Gunner, Beaumont Advisory Commission for
Prevention of Child Abuse, for a term expiring February 4, 2004. Reappointment: Lanis
McWilliams, Beaumont Advisory Commission for Prevention of Child Abuse and
Neglect,for a term expiring October 25, 2003. - Resolution No. 02-023
A) Authorize the pledge of securities(covering City deposits at Hibernia National Bank which
have a current market value of$5,046,360) as collateral for City accounts - Resolution
No. 02-024
B) Approve a resolution accepting the Blossom, Mary and Hollywood Street Pavement
Improvement Project, approve Change Order No. 1 (in the amount of $19,308.60) and
authorize final payment (in the amount of $118,329.76 to W. B. Construction, Inc.) -
Resolution No. 02-025

C) Approve a one (1) year contract for the purchase of fittings, pipes and couplings (with
Coburn Supply in the amount of $179,080.25, Golden Triangle Pipe in the amount
$159,969.10, and Hughes Supply in the amount of$2,217.84 foran estimated total annual
expenditure of$341,267) - Resolution No. 02-026
Councilmember Cokinos moved to approve the Consent Agenda. Councilmember
Samuel seconded the motion. MOTION PASSED.

GENERAL BUSINESS
1. Consider a request to abandon portions of the Alabama, Cunningham and Cheek Street
rig ht-of-way
Councilmember Cokinos moved to approve Ordinance No. 02-010 ENTITLED AN
ORDINANCE ABANDONING PORTIONS OF ALABAMA, CUNNINGHAM AND CHEEK STREETS RIGHT-
OF-WAYS IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS; PROVIDING FOR ACCESS
TO A 525-UNIT STUDENT HOUSING COMPLEX ON THE SOUTH SIDE OF ALABAMA SUBJECT TO THE
RETENTION OF UTILITY AND DRAINAGE EASEMENTS AND CONSTRUCTION OF A SIDEWALK.
Councilmember Patterson seconded the motion. MOTION PASSED.
Ayes: Mayor Moore, Mayor Pro Tern Goodson, Councilmembers Smith,
Cokinos, Ames, Samuel, and Patterson

2. Consider approving a three-year contract for concession management services for the
Convention Facilities Division
Mayor Moore stated his concern of receiving only one response of the seven requests for
proposals. Convention Facilities Manager Claudie Hawkins commented Swanson
submitted the only bid eight years ago, has been under contract for 15 years, and
Swanson is contracted with the Port Arthur Civic Center which makes it more conducive
to continue working with the Beaumont Civic Center. She explained competitors are
seeking large venues to combine resources, management teams, and employees, and
lack of response is related to the Civic Center being viewed as a small venue at this time.
Councilmember Cokinos moved to approve Resolution No. 02-027 awarding a three (3)
year contract with an option to renew for two (2) years to the Swanson Corporation for
providing concession management services with fixed percentages to be paid to the City.
Councilmember Ames seconded the motion. MOTION PASSED.
Ayes: Mayor Moore, Mayor Pro Tern Goodson, Councilmembers Smith,
Cokinos, Ames, Samuel, and Patterson

3. Consider approving a contract with the Beaumont Community Housing Development
Organization, Inc. for pre-development activities required for new housing construction
Councilmember Samuel moved to approve Resolution No. 02-028 awarding a contract
with Beaumont Community Housing Development Organization, Inc. in the amount of
$100,000 using funds from 2001 CDBG Program Housing Site Development activity
budget category. Councilmember Ames seconded the motion. MOTION PASSED.

Cokinos, Ames, Samuel, and Patterson
Noes: None
Mayor Moore extended appreciation to Southeast Texas Community Development
Corporation President Antoinette Hardy, stated his pleasure in attending the open house
ceremonies, and noted the excitement of the new home owners.
4. Consider the appointment of an Interim City Clerk
Councilmember Smith moved to approve Resolution No.02-029 appointing Lolita Ramos
as Interim City Clerk. Mayor Pro Tern Goodson seconded the motion. MOTION PASSED.
Ayes: Mayor Moore, Mayor Pro Tern Goodson, Councilmembers Smith,
Cokinos, Ames, Samuel, and Patterson
Noes: None
Mayor Pro Tern Goodson commented to provide continuity, along with Lolita Ramos'
extensive election experience, she could assist staff with election matters while
maintaining her office at Municipal Court, and spoke of a nationwide search, the number
of applicants for the city clerk position, and providing a cut off date for applications.
Mayor Moore recommended further discussion and establishing dates to begin the
interview process at the next meeting.
COMMENTS
Councilmembers comment on various matters
Councilmember Patterson announced tonight's Tyrrell Park Neighborhood Association
meeting, and next Tuesday, at 7:00 p.m. the Pear Orchard Neighborhood Association will
meet at Our Mother of Mercy Church Catholic Hall.
City Manager's Report - 2001 Crime Report; Police Communications System Update;
Swimming Pool Fees; Tyrrell Park Recreation Building
City Manager Bonczek commented on Police Chief Scofield's report on crime results for
2001 which showed a slight increase in overall crime specifically in the theft and burglary

category, a substantial decline in major, property, violent and auto theft crimes, and an
increase in clearing cases in all categories. Mr. Bonczek recognized Police Chief Scofield,
his command staff, and the hard working men and women of the Beaumont Police
Department for a job well done in achieving a safe and secure city for the residents and
visitors.
City Manager Bonczek spoke of completed reports for swimming pool fees and for air
conditioning costs at the Tyrrell Park building, and progress in continuing with the police
communication 800 MHz system.
Public Comment (Persons are limited to three (3) minutes).
Mrs. Beverly Hatcher, 7 Sandlewood Trail, addressed Council on behalf of the Martin
Luther King Parkway Commission, spoke with pride of the diligent work of the commission
in presenting an artist for the M.L. King statue, and distributed pictures articulating the
quality of the artist who is preparing a maquette for a showing in Beaumont to help raise
funds needed for the statue. (Exhibit "A") Mrs. Hatcher suggested dates for Council to
meet with the artist, requested Council permission to move forward, and spoke of the
eagerness and excitement of this project by the citizens. She extended appreciation to
Senior Planner Cheryl Robinson for her work assisting as a yeoman and to Planning
Manager Stephen Richardson for allowing Cheryl to participate.
Councilmember Samuel commended and expressed appreciation to Mrs. Hatcher and the
commission for the many hours of work towards getting to this point in the project.
Mayor Moore also extended appreciation to Mrs. Hatcher and to the commission for
creating an interest and hoped participation would be energized with the visit to the
community by the artist.
