The City Council of the City of Beaumont, Texas, met in a regular session on October 2, 2001,
at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider
the following:

Mayor Moore called the meeting to order at 1:35 p.m. The Reverend Harland Merriam, Saint
Andrews Presbyterian Church, who also serves as military Chaplin forthe 90`h Regional Support
Command, gave the invocation. Grants Administrator and U. S. Army Sergeant Johnny Beatty
led the pledge of allegiance. Sergeant Beatty was mobilized to active duty and leaves today for
service at Fort McPherson in Georgia.
Present at the meeting were: Mayor Moore, Mayor Pro Tern Goodson, Council members Smith,
Cokinos,Ames, Samuel, and Patterson. Also present were Stephen J. Bonczek, City Manager;
Lane Nichols, City Attorney; and Barbara Liming, City Clerk.
Presentations and Recognitions
Two proclamations were issued: "Breast CancerAwareness Month,"October,2001,and
"Breast Cancer Awareness Day," October 2, 2001.
A presentation by Library and Recreational Director Maurine Gray was deferred to later
in the meeting until the arrival of students enrolled in the City of Beaumont track teams.
City Manager Bonczek announced that the City of Beaumont has received the Certificate
of Excellence from the Government Finance Officer's Association for the Comprehensive
Annual Financial Report and introduced Comptroller Paula Labrie. Mrs. Labrie introduced
her professional team of accountants Peggy Rhame,Janice Ridley,and Robin Butler,and
expressed appreciation to them and her support staff for helping to attain the award for
the fifteenth consecutive year. She also thanked Mayor Moore and Council and the City
Manager for special recognition of their efforts to receive the award.

Reverend Leday, 7498 Boyt Road and 1445 Lindbergh Drive, addressed Council to stand
with the Civil Liberties Union in opposition to passage of Agenda Item 10, said he is
concerned with citizens subjected to court trials without being present, claimed the
ordinance will affect mostly minorities and underprivileged,and requested further research
on how such an ordinance will affect our people.
Ms. Regina Lindsey, representative of the South East Texas Arts Council, addressed
Council to list organizations they assist, and on behalf of SETAC, Ms. Lindsey expressed
gratitude for Council continuing to look at alternative funding solutions and expressed
excitement to their upcoming move to the Julie Rogers Theater building.
Mr. Bill Proctor,4340 Westridge, addressed Council concerning Agenda Item 8 to request
researching bus passes and spoke of revenue losses.
Mr. Rob Clark, 85 Genevieve,addressed Council in support of Consent Item A,expressed
appreciation for funding the Art Museum of Southeast Texas, stated it has been one of the
museum's most active years, and stated their programs exist because of participation by
government and individuals and restated his appreciation.
Attorney Hubert Oxford, 490 Yount, addressed Council in opposition to Agenda Item 10,
stated trial of absentia is something you read about in other countries lacking in our
system of justice, assumed there must be a financial reason to try a person by absentia,
stated terrorist acts affect civil rights, and strongly urged Council to oppose the ordinance.
Mr. Bryan Smith, Executive Director of the Texas Energy Museum, addressed Council in
support of Consent Agenda Item C funding the Texas Energy Museum, expressed
appreciation, mentioned their dinosaur display for Dinosaur Day, and emphasized the
different nationalities and age groups that visit the museum.
Mr. Bill Hataway addressed Council in support and to express appreciation for funding
the Beaumont Heritage Society, commented on Beaumont being a great place to live,
being grateful to John Jay French for establishing a trading post in the early 1800's, gave
visitor statistics for this year and discussed promotion of tourism and the Beaumont
Association of Museums. Mr. Hataway admonished everyone to remember our heritage.
Attorney Trent Bond, 1530 Infinity, addressed Council in opposition to Agenda Item 10,
stated that trial by absentia does not give opportunity for absence reasons to be voiced,
and reported that Attorney Bob Wortham asked that his disapproval of the ordinance be
expressed.

6. Consider a request for a specific use permit to allow private swimming lessons in an RS
(Residential Single Family Dwelling) District at 2608 Hazel
Council discussion included 20% rule voting requirements and restrictions, vehicles
blocking driveways, removal of no-parking signage, appropriateness and wisdom of
reinstallation of signage, and ordinance language.
Councilmember Ames stated neighborhood concerns were not only with parking but
noise, clarified that swim lessons are given three months of the year, four days a week,
commented about the difficulty of a decision because of adamant opposition of neighbors,
and confirmed there were no any additional responses.
Mayor Pro Tern Goodson moved to approve an ordinance ENTITLED AN ORDINANCE
GRANTING A SPECIFIC USE PERMIT TO ALLOW PRIVATE SWIMMING LESSONS IN AN RS
(RESIDENTIAL SINGLE FAMILY DWELLING) DISTRICT LOCATED AT 2608 HAZEL IN THE CITY OF
BEAUMONT,JEFFERSON COUNTY,TEXAS subject to a requirement that vehicles transporting
swim students not block driveways or street pavements in the immediate neighborhood,
remote parking be provided, and reinstallation of no-parking signage. Councilmember
Smith seconded the motion.

Mayor Moore questioned if the letter sent to Council had been shared with neighborhood
residents, and if feedback has been received. He commented that neighborhood
residents seemed to be adamantly opposed to the business in the community, and stated
without that information he would be unable to support the ordinance. He addressed the
20% rule, more than one vote in opposition causing the item to fail, and questioned
Council's willingness to move forward.
Planning Manager Stephen Richardson explained he only reviewed the letter before
today's meeting and staff has not visited with any of the property owners.
Mayor Pro Tern Goodson further discussed two public hearings, proposal to concessions
not lessening those in opposition, and stated he respects both sides because his children
take swimming lessons in a similar residential atmosphere. He stated he looks at the
good opposed to the detriment of the request, said reasonable accommodations have
been made, respects those in opposition, but there are a least five businesses within a
block on Harrison Street. After affirming that deferral of the item would not affect a
deadline, Mayor Pro Tern Goodson expressed willingness to rescind his motion to allow
opportunity for the letter submitted by the applicant to be shared with residents in
opposition to the specific use permit. Councilmember Smith concurred and rescinded her
second. The item was deferred.
7. Consider a request to extend a specific use permit time limit 12 months to October 5, 2002
for the property at 1955 Dowlen Road
Councilmember Smith moved to approve Ordinance No. 01-075 ENTITLED AN ORDINANCE
AMENDING ORDINANCE 99-70 BY GRANTING A TWELVE (12) MONTH TIME EXTENSION FOR A
SPECIFIC USE PERMIT ALLOWING A CREDIT UNION LOCATED AT 1955 DOWLEN ROAD,
BEAUMONT, JEFFERSON COUNTY, TEXAS. Mayor Pro Tern Goodson seconded the motion.
MOTION PASSED.

8. Consider an amendment to Sections 28-5 and 28-6 of the Code of Ordinances increasing
regular and special transit fares effective November 1, 2001
Councilmember Samuel referred to a footnote in the packet that stated "Clients of Social
Service Agencies would not be eligible for monthly pass,"and questioned their ineligibility.
Public Works Director Tom Warner explained that in accordance with federal regulations,
social service agencies whose clients are transported may be charged the fully allocated
cost of each trip minus the regular fare. This would result in a charge to the social service
agency of$13 per trip. The client would pay $2 of the fare. City Attorney Lane Nichols
substantiated that these rates are authorized by federal regulations.

10. Consider approving an ordinance providing for Trial In Defendant's Absence On
Defendant's Violation Of Promise To Appear, to be numbered Chapter 8, Section 8-1.
Consideration of an ordinance ENTITLED AN ORDINANCE AMENDING CHAPTER 8 BY ADDING
SECTION 8-1 TO THE CODE OF ORDINANCES TO PROVIDE FOR TRIAL IN THE ABSENCE OF A
DEFENDANT WHEN THE DEFENDANT HAS VIOLATED HIS PROMISE TO APPEAR; PROVIDING FOR
SEVERABILITY;AND PROVIDING FOR REPEAL was presented.
After introduction of the ordinance by the City Manager, City Attorney Lane Nichols
explained that City Staff was tasked in the budget process to look for amounts of money
due the City and to find ways of collection. Mr. Nichols presented a summary of the
potential amount of outstanding warrant fees for the past three years, stated that an
estimated two out of three people signing the back of a traffic ticket do not appear as
promised, and that in formulation of this ordinance, staff sought to take a pending case
and turn it into a debt or an account receivable for collection. He cited a case in
Mississippi where due process was set out in an ordinance and upheld. Mr. Nichols
explained the procedure beginning with a person signing the back of the citation that
clearly indicates that if one does not appear to answer the ticket within ten days, he
recognizes he can be tried in his absence. He may appear in writing, in person, or by
telephone. If there is no response, after signing and making this promise in the presence
of the ticketing officer, the judge will set a trial date and a notice of the trial date will be
sent to the address given to the officer. If the person does not appear, the judge will
review the evidence and make an appropriate judgement. Then, another notice would be
mailed to the same address giving notification of another 15 days to offer good cause why
they have failed to appear. If they respond, the court may grant their appeal. If they do
not respond, a judgment would be entered and become an account receivable. Mr.
Nichols explained there was no evil intent in recommending the ordinance and considers
this to be an approach in the future to take charge of a massive financial problem in
Municipal Court.

A lengthy Council discussion included constitutional rights of citizens, respecting citizens
comments and concerns,addressing significant financial issues, increased court dockets,
steps taken to assure all measures of due process, procedure for serving warrants, fees
and trial dates, and a request to seek an opinion and/or additional guidance from the
Attorney General's office relative to the impact of such an ordinance before moving
forward.
Council consensus was to defer action on approval of the ordinance.
Library and Recreational Director Maurine Gray reported that 135 children enrolled in the
summer track program. She introduced Coach Roy Washington and Mrs. Edie Smith
Casmore, mother of Harold Smith. The Harold Smith Memorial Award is awarded to the
outstanding 13-14 year old male and female athlete, based on track skill and leadership.
The TAAF Athlete of the Year Award is awarded to a male and female displaying
outstanding skill and sportsmanship, and a TAAF Regional Athlete of the Year is voted on
by Regional members at a summer meeting. This is the first year for a Beaumont athlete
to received the honor. Ivory Williams, a student at Central High School, placed 1St in the
200 meter dash in the TAAF Region State meets and ran on the 4 x 100 relay team. He
also placed 2nd in the Jr. Olympics in Sacramento, California. Ivory was presented with
the TAAF Member City of the Year Outstanding Male Athletic Award by Track Coach Roy
Washington. Ms. Cortenee Boulard from Vincent Middle School won the Regional and
Hershey 200 meter dash and the Hershey State meet, then advanced to the Hershey
National meet in Pennsylvania and finished 5th in the nation. She was presented the
Female Harold Smith Memorial Award to by Mrs. Edie Smith Casmore. Not present to
receive the Male Harold Smith Award was Clyde Robinson who placed 1 st in the long jump
and 4 x 400 relay in the TAAF Regional Meet. He placed 2nd in the 200 meter dash and
4th in the long jump at the State Meet. Moore extended congratulations to the students,
parents, and coaches for representing the City of Beaumont and for making everyone
proud and setting examples for other youth.

City Manager Report - Fire Department Flags Remain At Half-Staff, Sabine Neches
Waterway, CAFR Award,TexShare Program,World Trade Center Disaster Memorial and
Southeast Texas Arts Council
City Manager Bonczek reported the Beaumont Council of Garden Clubs is requesting City
support to construct a memorial for the victims of the September 11 disaster and
permission to solicit funding through water billing. He updated Council on the Sabine
Neches Waterway Study to which the City has committed $300,000 in 2003 and said a
final report from the Army Corps of Engineers is expected in May 2004. Mr. Bonczek
reported the library system will receive funds from the TexShare Program, relocation of
the South East Texas Arts Council offices to the Julie Rogers Theater, and reported
success of the Third Annual Neches River Cleanup with support by the Lamar University

Biology Department, Texas General Land Office, South East Texas Regional Planning
Commission, Beaumont's Clean Community Department, Texas Natural Resource
Conservation Commission, and Mehaffy & Weber Law Firm .
Mayor Moore acknowledged Beaumont Independent School Districtfor an award received
from the State of Texas,thanked members of the community for being active participants
in funding campaigns to assist the victims of the September 11 disaster, and to groups for
showing compassion to their fellowman. Mayor Moore advised the community to be ever
vigilant, pay attention to surroundings, and get to know neighbors.
Public Comment (Persons are limited to three (3) minutes).
Ms. Ouida Broussard, 325 Armstrong Drive, Representative of the Beaumont Civic Ballet,
addressed Council to solicit City support of a proposed event entitled "South East Texas
Arts for America" to demonstrate community support for victims of the tragedy of
September 11, at the Julie Rogers Theater on October 13 at 2:00 p.m. Ms. Broussard
named various art groups to be showcased in a variety show and requested City
sponsorship and with all proceeds going directly to the relief fund.
Mr. Leroy Lewis III, 1201 Euclid, addressed Council extended appreciation to
Councilmember Cokinos for his appointment to the Senior Citizen Advisory Committee
and for efforts made regarding railroad crossings and train noise. Mr. Lewis requested
cleaning windows and concrete at the Beaumont Public Library and asked citizens to
contact Crime Stoppers if they see a crime being committed. He complained about loud
music from cars, thanked citizens for their donations to the victims of New York City, and
requested Council work with the Fire Department to make their jobs easier and that streets
be widened in front of all schools.
Reverend Leday, 7498 Boyt Road, addressed Council in appreciation of elected bodies
that recognize, protect, and defend the Constitution of the United States of America.
Mr. Robert Preston, 1190 Iowa, addressed Council to speak about corruption, Television
Channel 6 not reporting news of Beaumont Police Officers not issuing parking citations
or towing violators near Ayres Campers, stormwater fee proposal rejected by citizens,
requests for evidence of discovery denied, and charges filed on an unsecured building.
Beaumont Police Officer Carmen Apple addressed Council to announce that the week
after the September 11 tragedy in New York City, Patrick Patterson of Lamar University
took a Beaumont Firefighter helmet and a 3' x 5' banner signed with words of
encouragement by Beaumont Police officers and employees with their emblem and the
inscription, "In memory of those fallen September 11, 2001," to Ground Zero's Precinct
No. 1. Mr. Patterson reported back to the Beaumont Police Department that the banner
was the first show of support received from any police or outside agency and said it was
a very emotional moment. The officers were very grateful that someone was thinking of
them, and they showed great interest in our Police Department and the city of Beaumont.
Officer Apple stated her pride in Beaumont and the Police Department.

Mr.William Etheridge,27 Cheska Hollow,addressed Council to question why past warrant
amounts addressed earlier in Item 10 would not be made retroactive for collection with
passage of the ordinance.
