HomeMy WebLinkAboutORD 01-092 ORDINANCE NO. 01-092 ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES AND ORDERING THEIR DEMOLITION AND/OR REPAIR; PROVIDING FOR SEVERABILITYAND PROVIDING FOR A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That the City Council of the City of Beaumont hereby finds and declares the buildings located at: 1. 3430 Anderson (Multi-Dwelling) 17. 2985 Harriot 2. 5470 Avenue A 18. 4060 Hester 3. 2219 Avenue E 19. 4430 Horn 4. 6375 Bigner Road 20. 1230 Iowa 5. 3135 Brenham 21. 4152 Ogden 6. 2239 Broadway 22. 2782 Pennsylvania 7. 1440 Burt 23. 1195 Powell 8. 1750 Cardinal E. Drive 24. 2919 San Jacinto 9. 2160 Carroll 25. 810 Saxe 10. 1175 Center 26. 845 Stanton 11. 1185 Center 27. 1410 Stewart 12. 2675 Euclid 28. 1047 Willow 13. 3670 Fannett Road (Commercial) 29. 2255-57 North 14. 590 Fletcher 30. 565 Prince 15. 1350 Fulton 31. 3028 Rockwell 16. 2540 Grand 32. 2564 Rusk G:\CG\AGENDA\WEEKLY\lG-30-Ol.wpd to be public nuisances in that said buildings violate Chapter 14, Section 14-50 of the Code of Ordinances of the City of Beaumont and are for want of repairs, or by reason of age or dilapidated condition, likely to cause or promote fires that would endanger persons or property. Section 2. In accordance with Article XVII, Section 2, of the Charter of the City of Beaumont, Section 10-2 and 14-52 of the Code of Ordinances of Beaumont,Texas, and Section 103.4 of the Standard Building Code, it is hereby ordered that the owner or owners of the following described buildings demolish and remove said structures within ten (10) days of the effective date of this ordinance: 1. 3430 Anderson (Multi-Dwelling) 16. 2540 Grand 2. 5470 Avenue A 17. 2985 Harriot 3. 2219 Avenue E 18. 4060 Hester 5. 3135 Brenham 19. 4430 Horn 6. 2239 Broadway 20. 1230 Iowa 7. 1440 Burt 21. 4152 Ogden 8. 1750 Cardinal E. Drive 22. 2782 Pennsylvania 9. 2160 Carroll 23. 1195 Powell 10. 1175 Center 24. 2919 San Jacinto 11. 1185 Center 25. 810 Saxe 12. 2675 Euclid 26. 845 Stanton 13. 3670 Fannett Road (Commercial) 27. 1410 Stewart 14. 590 Fletcher 28. 1047 Willow 15. 1350 Fulton G:\CG\AGENDA\WEEKLY\10-30-Ol.wpd If the property owner(s)fails to comply within ten (10) days, Council orders that the property be demolished without further notification to the property owner(s)or City Council action. Section 3. In accordance with Article XVII, Section 2, of the Charter of the City of Beaumont, Section 10-2 and 14-52 of the Code of Ordinances of Beaumont, Texas and Section 103.4 of the Standard Building Code, it is hereby ordered that the owner or owners of the following described buildings either demolish or repair such structure within ninety (90) days of the effective date of this ordinance. 4. 6375 Bigner Road 31. 3028 Rockwell 29. 2255-57 North 32. 2564 Rusk 30. 565 Prince The owner(s) are ordered to enter into a work program concerning the structures immediately. If the owner(s) fail or refuse to enter into a work program or repair or demolish the structure within the time limit set herein, the City is authorized to demolish the structure without further Council action. Section 4. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 5. That any person who violated any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.
