WHEREAS, The staff of the Public Utility Commission has filed a "Request for Expedited
Consideration and Request to Delay Capacity Auction" relating to Entergy Gulf States, Inc.
(EGSI); and,
WHEREAS, such filing has been made in a new docket(Docket 24469)which is a docket
in which intervention by the City of Beaumont has not yet been authorized; and,
WHEREAS,although the previous authorization to intervene in the EGSI"unbundling"and
fuel cases should be adequate, EGSI has earlier challenged the authority of the City to intervene
in cases where specific authority has not been obtained; and,
WHEREAS, it is essential that the City of Beaumont participate in the case to delay
competition for EGSI because there is not a competitive market for all customer classes in the
EGSI service area in Texas and to allow competition to continue at this time might result in an
unregulated monopoly which would not be in the best interest of consumers of electric energy
in Beaumont;
NOW THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
That the City Attorney be and he is hereby authorized to authorize Barbara Day,the attorney who
represents the group of cities in the various EGSI cases, to intervene in Docket 24469 and any
other docket which might arise in connection with Deregulation of the Electric industry in Texas.
The steering committee of Cities associated with these cases shall authorize the actions of Miss
Day in the handling of these cases.
