Administration recommends approval of a resolution authorizing the City Manager to submit a
grant application and execute a contract with the State of Texas to receive Vehicle Capital
Replacement funds for the Beaumont Municipal Transit System,
BACKGROUND
The Texas Department of Transportation has prepared a grant application for Section 5309-Vehicle
Capital Replacement funds. The grant will fund up to $531,000 for the purchase of buses. These
funds will be used to offset the cost of purchasing two (2) full size transit buses for the transit
system, estimated to cost $280,000 each for a total of$560,000. The City of Beaumont will be
required to provide the monies necessary to make up the difference estimated to be$29,000. The
City's fleet of buses, presently consists of sixteen(16)buses. Eleven(11) of these buses are 1989
models and the remaining five(5)are 1991 models. The useful life of transit buses, such as these
is determined to be twelve years. The City of Beaumont has submitted a transit project request
for earmarked transportation appropriation funding to replace seven (7) additional buses in the
Fiscal Year 2002. Similar requests are likely to occur in Fiscal Year 2003 and 2004.
BUDGETARY IMPACT
The grant will pay up to a total of$531,000 toward the purchase of two (2) transit buses for the
Beaumont Municipal Transit System. Two buses are estimated to cost approximately $560,000.
The remaining $29,000 will be provided by the City.

RECOMMENDATION
Administration recommends approval of a resolution authorizing the City Manager to execute an
addendum to the contract agreement with Carroll and Blackman Inc., for engineering services
associated with the City's NPDES Storm Water Permit.
BACKGROUND
In 1990, Congress passed the Clean Water Act (CWA) which, with subsequent amendments,
established the National Pollution Discharge Elimination System (NPDES) which requires cities
having populations greater than 100,000 people to obtain a permit to discharge storm water
collected by the city's storm sewer system into "public waters." In compliance with the
provisions of this legislation the City of Beaumont and Jefferson County Drainage District No.
6 (13136), applied for and, effective October 1, 1998, were issued by USEPA, a permit for the
discharge of storm water to the Neches River and Hillebrandt Bayou.
The NPDES Storm Water permit requires the City to monitor the quality of storm water
discharges and to report the findings annually to USEPA Region 6 in Dallas. The permit also
requires the implementation of Best Management Practices (BMP's) designed to reduce to the
maximum extent practicable pollutants borne in storm water collected by the City's storm sewer
system. Accomplishing these goals will require: 1) extensive field collection and laboratory
evaluation of storm water sampling data; 2) creation of various databases to track and evaluate
the effectiveness of the many BMP's required by the permit; 3) training City field personnel to
recognize and properly report various environmental conditions affecting water quality; 4)
qualification and quantification of data in an effort to evaluate the effectiveness of individual and
collective BMP's; 5) the compilation of data required by USEPA, and; 6) the preparation of
annual and interim reports to USEPA and Texas Natural Resource Conservation Commission
(TNRCC).
Public Works/Engineering has limited staff assignable to the accomplishment of the work required
by the NPDES Storm Water Permit and has determined that the services of a professional
engineering group is needed to augment the efforts of City personnel. The Engineering group wil l
assist in: 1) the preparation of BMP guidance documents and training workshop materials; 2)
the preparation of reports; 3) the formulation of local Ordinances which may be required for the
proper implementation of the BMP program and; 4) to lend a national presence to the City's
interface with USEPA.
The NPDES Storm Water Permit requires that all provisions of the permit be fully implemented
by 1 October 2001. In order to complete the successful implementation of all permit requirements
the tasks outlined in the attached Scope of Services will be required. This additional work is
estimated to cost $112,900.
BUDGETARY IMPACT
The addendum to the contract agreement with Carroll and Blackman, Inc., will increase Fiscal
Year 2001 General Fund expenditures by $112,900.

REQUESTED ACTION:
Council amend Chapter 16 of the City of Beaumont Code of Ordinances relating to the
Beaumont Public Library System.
RECOMMENDATION
Administration recommends that Chapter 16 of the City of Beaumont Code of Ordinances relating
to the Beaumont Public Library System be changed as follows:
Section 16-3:
The Library of the city shall be known as the Beaumont Public Library System.
Section 16-10:
Name of the library merely needs to be changed from the Tyrrell Public Library to the Beaumont
Public Library System.
Section 16-14:

Section 16-15:

advance of the use.
BACKGROUND
For many years, the fine for overdue books has been $.05 and we have had a three week loan
period with no renewals. The library staff has discussed this and feels that we can increase the
fine to$.10, have a two week loan period with one renewal of two weeks and have more citizens
pleased with that change. In a survey of eleven area libraries, eight charged overdue fines of$.10
and one charged $.15. The $2 a day fine for overdue videos will remain in place.
The new fee for the meeting rooms will be identical to the rental fee for the Parks and Recreation
meeting facilities.
This was discussed by the Library Commission at their meeting on April 12, 2001 and approved
unanimously.
BUDGETARYIMPACT
The City should see an increase in income from these new fees.

RECOMMENDATION
Administration recommends award ofa proposal to Marsh USA,Inc.for the purchase ofan insurance
policy for fire, flood and extended coverage insurance for City owned property. Marsh USA, Inc.
bidding through Zurich American Insurance Company quoted an annual premium policy in the
amount of$141,549.
BACKGROUND
Eight(8)bids were received on Monday,April 23,2001, for furnishing a one(1)year fire,flood and
extended coverage insurance policy. The policy requested provides full coverage ofall buildings and
contents owned by the City of Beaumont. The one(1)year policy, beginning May 1,2001, is based
on the property values stated below:

Proposals received this year offered plans with increased retention levels, reduced coverage and
increased premiums. The lowest price was submitted by Marsh USA,Inc.through Zurich American
Insurance Company in the amount of$141,549. Zurich American has an A+ rating by A. M. Best.
The policy offered by Zurich American includes deductibles in the amount of$100,000 for all perils
except;flood damage occurring in 500 year zones with a deductible in the amount of$250,000,flood
damage occurring in 100 year zones with a deductible in the amount of$1,000,000 and windstorm
damage with a deductible in the amount of 5%ofthe total value with a minimum of$250,000. Policy
deductibles are applied to claims or losses per occurrence. Should the City experience a loss
involving more than one location, only one deductible amount shall apply against the loss.
The second lowest price received provided a minimum retention of$100,000 or 2%of total building
value. The price for this policy is$237,697. Although,previous policies have included a deductible
in the amount of$100,000, the increase in premium cost does not Justify the lower retention value.
The City has not experienced any building losses in the past fifteen(15) years.
Approximately 100 insurance companies were notified and asked to submit a request for market
assignment. Eleven agents/brokers representing eighteen (18) insurance carriers were assigned
markets.
BUDGETARY IMPACT
Funds in the amount of$135,000 were budgeted in the Building Services Division's FY2001 budget.

BACKGROUND
The Public Works Department, Water Utilities Division, has undertaken a five (5) year capital
improvement program which includes the replacement of deteriorated water lines currently
causing frequent service interruptions in various areas of the city.
The pipe specified in this bid incorporates a patented locking-type joint necessary for the pipe
bursting method of water line replacement now utilized by City personnel. The pipe was
requested in 2-inch, 6-inch and 8-inch diameters, the most prevalent sizes for water lines in the
City system. This quantity will provide the Water Division with a sufficient volume of pipe to
sustain approximately one (1) year of water line replacement.
Bid notices were provided to 33 vendors, with four (4) responding with bids. The bids received

BACKGROUND
The trucks specified in the bid are for use by the Public Works Department, Water Utilities
Division. The trucks will be utilized to transport personnel, tools and pipe bursting equipment
used in water line replacement, as well as for towing 10-ton equipment trailers. The trucks will
be equipped with utility bodies and a hydraulic tool circuit for use with pavement breakers and
hydraulic saws. The units are additions to the City fleet, and are not available through the state
cooperative purchasing program.

RECOMMENDATION
Administration recommends award of a bid for the purchase of two (2) double disc pumps and an
upgrade of one (1)existing pump in the total amount of$46,740 to South Western Environmental
Equipment Technicians of Dallas, Texas.
BACKGROUND
The pumps will be utilized at the Water Reclamation Plant to process the sludge material entering
the facility's second belt filter press, currently under construction. The pumps are necessary to
restore the plant to its design capacity for wastewater treatment. The upgrade of the existing
pump in the belt press unit includes an adjustable drive which will allow the pump to run at
varying speeds most suitable to a given sludge volume at any time, reducing wear on the pump.
Bid notices were provided to 11 vendors, with two (2) responding with bids. The bids received

BACKGROUND
The prison complex is currently being served by a 12-inch sanitary sewer force main that was
constructed in 1990. There are occasional interruptions of service at the complex since the present
demand for water has surpassed the maximum carrying capacity of the 12-inch main. Installation
of the additional force main will provide continuous and adequate service to the complex now and
help accommodate future water needs. In order to install the proposed sanitary sewer force main,
the encroachment agreement is mandatory.

Funds are available for this project from the Water Utilities Division Capital Improvement Fund.
