ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF
ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE
BOUNDARIES OF THE ZONING DISTRICTS, AS INDICATED UPON THE
ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING THE ZONING OF
PROPERTY PRESENTLY ZONED GC-MD-2 (GENERAL COMMERCIAL-
MULTIPLE FAMILY DWELLING-2) DISTRICT TO GC-MD (GENERAL
COMMERCIAL-MULTIPLE FAMILY DWELLING) DISTRICT FOR A 3.2189
ACRE TRACT IN THE 3000 BLOCK OF DOWLEN ROAD, BEAUMONT,
JEFFERSON COUNTY, TEXAS PROVIDING FOR SEVERABILITY;
PROVIDING FOR REPEAL AND PROVIDING A PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
That Chapter 30 of the Code of Ordinances of Beaumont, Texas, and in particular
the boundaries of the zoning districts, as indicated upon the Zoning Map of the City of
Beaumont, referred to in Section 30-56 thereof, is hereby amended by changing the
zoning of property presently zoned as GC-MD-2 (General Commercial-Multiple Family
Dwelling-2)to GC-MD(General Commercial-Multiple Family Dwelling)District fora 3.2189
acre tract in the 3000 block of Dowlen Road,
BEING a 3.2189 acre tract or parcel of land situated in the Hezekiah
Williams Survey, Abstract No. 56, Jefferson County, Texas and being out of
and part of that certain called 680.66 acre tract called "Second Tract" as
conveyed by Treadaway Land Company et al. to Yount-Lee Oil Company as
recorded in Volume 374, Page 113, Deed Records, Jefferson County,Texas
and also being out of and part of that certain called 40.5391 acre tract of
land as conveyed by Amoco Production Company to Dowdel Investments,
Ltd. as recorded in Clerk's File No. 1999047799, Official Public Records of
Real Property, Jefferson County, Texas, said 3.2189 acre tract being more
particularly described as follows:

NOTE. All bearings are based on the North line of that certain called 62.615 acre
tract, identified as Parcel#5, as recorded in Judgement Deed Number D-105,161
as recorded in Volume 2214, Page 318, Deed Records, Jefferson County, Texas.
COMMENCING at a 5/8" iron rod found for the Northeast corner of the above
referenced 40.5391 acre Dowdel Investments, Ltd. tract, said corner also being the
Southeast corner of Barrington Heights, Phase I, a subdivision of the City of
Beaumont, Jefferson County,Texas, according to the map or plat thereof, recorded
in Volume 15, Page 348, Map Records, Jefferson County, Texas and also being in
the West right-of-way line of Dowlen road (based on a width of 100 feet);
THENCE South 01024' 09" EAST, along and with the West right-of-way line of
Dowlen Road, for a distance of 220.00 feet to the Northeast corner and the POINT
OF BEGINNING of the tract herein described;
THENCE South 01°24' 09"EAST, continuing along and with the West right-of-way
line of Dowlen Road, for a distance of 563.12 feet to a point for corner, said corner
being the Northeast corner of that certain called 24.8240 acre tract zoned GC-MD
as recorded in the City of Beaumont Ordinance No. 99-74;
THENCE South 880 36' 07" WEST, along and with the North line of the above
referenced 24.8240 acre tract, for a distance of 249.00 feet to a point for corner;
THENCE North 01°24' 09"WEST, parallel to the West right-of-way line of Dowlen
Road, for a distance of 563.10 feet to a 5/8" iron rod set for corner;
THENCE North 880 35' 51" EAST, perpendicular to the West right-of-way line
Dowlen Road, for a distance of 249.00 feet to the POINT OF BEGINNING and

containing 3.2189 ACRES, more or less, as described on Exhibit UK, and the
official zoning map of the City of Beaumont is hereby amended to reflect such
changes.
Section 2.
That, in all other respects, the use of the property hereinabove described shall be
subject to all of the applicable regulations contained in Chapter 30 of the Code of
Ordinances of Beaumont, Texas, as amended.
Section 3.
That if any section, subsection, sentence, clause or phrase of this ordinance, or the
application of same to a particular set of persons or circumstances, should for any reason
be held to be invalid, such invalidity shall not affect the remaining portions of this
ordinance, and to such end, the various portions and provisions of this ordinance are
declared to be severable.
Section 4.
That all ordinances or parts of ordinances in conflict herewith are repealed to the
extent of the conflict only.
Section 5.
That any person who violates any provision of this ordinance shall, upon conviction,
be punished, as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.
PASSED BY THE CITY COUNCIL of the City of Beaumont on this the 6th day of
March, 2001.
