REQUESTED ACTION: Council consider a request to abandon Hazel Avenue adjacent to
Sabine Tabernacle Church.
RECOMMENDATION
The administration recommends approval of the request to abandon Hazel Avenue adjacent to Sabine
Tabernacle Church, subject to the installation of barricades to comply with regulations of the Traffic
Division of the City of Beaumont.
BACKGROUND
Mr. Richard Worthey, representing Sabine Tabernacle, is making this request to close part of Hazel
for the church. Sabine Tabernacle owns all of the property on either side of Hazel along the 311.5'
east of Forrest and also owns the land on the south side of the street the remaining 208.5' east to
Magnolia Avenue. The church has a master plan for future building expansion that will take in part
of the street.
There are no utilities or public services in the right-of-way requested for abandonment. A letter was
sent out to all interested parties. No objections were received.
BUDGETARY IMPACT
None.
PREVIOUS ACTION
At a Regular Meeting held February 19, 2001, the Planning Commission voted 5-0-1 to approve the
request to abandon Hazel Avenue adjacent to Sabine Tabernacle Church, subject to the installation
of barricades to comply with regulations of the Traffic Division of the City of Beaumont.

None.

Planning Commission, City Manager, Executive Assistant to City Manager/Economic Development
Director and Planning Manager.
RECOMMENDED MOTION

BE IT ORDAINED BY THE CITY OF BEAUMONT:
THAT, Hazel Avenue adjacent to Sabine Tabernacle Church, being a strip of land 37.5 feet
in width out of and part of the existing Hazel Avenue right-of-way between Forrest Street
and Magnolia Avenue in Beaumont. Said 37.5 feet wide strip of land being situated in the
James McFaddin Survey, Abstract 165, Jefferson County, Texas, and being more
particularly described as follows:
BEGINNING at the intersection of the North line of Hazel Avenue (37.5 feet wide)
right-of-way, and the East line of Forrest Street (60 feet wide) right-of-way;
THENCE in an Easterly direction along the with the North tine of said Hazel Avenue
right-of-way a distance of 190 feet to a point;
THENCE in a Southeasterly direction along and with the North line of said Hazel
Avenue right-of-way a distance of 121.5 feet to the Southwest corner of the Charlie
Dean tract of land known as Tract 9, Plat A of said J. McFaddin Survey;
THENCE in a Southerly direction to the South line of said Hazel Avenue right-of-

RECOMMENDATION
The administration recommends approval of the request to abandon the 20'alley in Block 59 of the
Van Wormer Addition.
BACKGROUND
Mr. Eduardo Lugo owns a landscape and irrigation business. He purchased all of Block 59, Van
Wormer Addition from the Oxford family. This is save and except those parts of said block being in
the Kansas City Railroad right-of-way. The alley extends from Avenue B east to the railroad right-of-
way. The block is vacant and is zoned LI (Light Industrial) District.
There were no objections to the request from those interested parties contacted by the Planning staff.
No utility easements need to be retained.
BUDGETARY IMPACT
None.
PREVIOUS ACTION
At a Regular Meeting held February 19, 2001, the Planning Commission voted 6-0 to approve the
request to abandon the 20' alley in Block 59 of the Van Wormer Addition.

WORMER ADDITION, CITY OF BEAUMONT, JEFFERSON
COUNTY, TEXAS.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
THAT a 20'wide alley right-of-way in Block 59 of the Van Wormer Addition, being a 20 foot
wide alley right-of-way extending northeast from the northeasterly right-of-way line of
Avenue °B°, a 60 foot wide street right-of-way, to the south line of the KCS Railroad right-
of-way. Said alley is bound on the north by Lots 5 and 6, Block 59, Van Wormer Addition
and bound on the south by Lots 7, 8 and 9, Block 59, said addition, containing 0.049
acres, more or less, Beaumont, Jefferson County, Texas as shown on Exhibits"A"and"B'
attached hereto, be and it is hereby abandoned.

RECOMMENDATION
The Administration recommends approval of the zone change from GC-MD-2 to GC-MD for a
3.2189 acre tract in the 3000 block of Dowlen Road.
BACKGROUND
In October of 1999,the City Council rezoned a 24.82 acre tract to GC-MD and the remaining 15.72
acres to GC-MD-2. The subject tract is located along the northeast part of the GC-MD-2 zoned tract.
The applicants have secured contracts on 3.2189 acres of land fronting on Dowlen Road. However,
one of the proposed pad sites and building is split between GC-MD and GC-MD-2 zoning. The
retail buyers of the pad sites wish to have all of their property within GC-MD. Dowlen is a major
arterial. The proposal lies across the street from a church and a future office development site.
BUDGETARYIMPACT
None.

At a joint Public Hearing with City Council held February 19,2001,the Planning Commission voted
5-0-1 to approve the zone change from GC-MD-2 to GC-MD for a 3.2189 acre tract in the 3000
block of Dowlen Road.

ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF
ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE
BOUNDARIES OF THE ZONING DISTRICTS, AS INDICATED UPON THE
ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING THE ZONING OF
PROPERTY PRESENTLY ZONED GC-MD-2 (GENERAL COMMERCIAL-
MULTIPLE FAMILY DWELLING-2) DISTRICT TO GC-MD (GENERAL
COMMERCIAL-MULTIPLE FAMILY DWELLING) DISTRICT FOR A 3.2189
ACRE TRACT IN THE 3000 BLOCK OF DOWLEN ROAD, BEAUMONT,
JEFFERSON COUNTY, TEXAS PROVIDING FOR SEVERABILITY;
PROVIDING FOR REPEAL AND PROVIDING A PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
That Chapter 30 of the Code of Ordinances of Beaumont, Texas, and in particular
the boundaries of the zoning districts, as indicated upon the Zoning Map of the City of
Beaumont, referred to in Section 30-56 thereof, is hereby amended by changing the
zoning of property presently zoned as GC-MD-2 (General Commercial-Multiple Family
Dwelling-2)to GC-MD(General Commercial-Multiple Family Dwelling)District for a 3.2189
acre tract in the 3000 block of Dowlen Road,
BEING a 3.2189 acre tract or parcel of land situated in the Hezekiah
Williams Survey, Abstract No. 56, Jefferson County, Texas and being out of
and part of that certain called 680.66 acre tract called "Second Tract* as
conveyed by Treadaway Land Company et al.to Yount-Lee Oil Company as
recorded in Volume 374, Page 113, Deed Records, Jefferson County,Texas
and also being out of and part of that certain called 40.5391 acre tract of
land as conveyed by Amoco Production Company to Dowdel Investments,
Ltd. as recorded in Clerk's File No. 1999047799, Official Public Records of
Real Property, Jefferson County, Texas, said 3.2189 acre tract being more
particularly described as follows:

referenced 40.5391 acre Dowdel Investments, Ltd. tract, said corner also being the
Southeast corner of Barrington Heights, Phase I, a subdivision of the City of
Beaumont, Jefferson County,Texas, according to the map or plat thereof, recorded
in Volume 15, Page 348, Map Records, Jefferson County, Texas and also being in
the West right-of-way line of Dowlen road (based on a width of 100 feet);
THENCE South 01°24' 09" EAST, along and with the West right-of-way line of
Dowlen Road, for a distance of 220.00 feet to the Northeast corner and the POINT
OF BEGINNING of the tract herein described;
THENCE South 01°24' 09"EAST, continuing along and with the West right-of-way
line of Dowlen Road, for a distance of 563.12 feet to a point for corner, said corner
being the Northeast comer of that certain called 24.8240 acre tract zoned GC-MD
as recorded in the City of Beaumont Ordinance No. 99-74;
THENCE South 88° 36' 07" WEST, along and with the North line of the above
referenced 24.8240 acre tract, for a distance of 249.00 feet to a point for comer,
THENCE North 01°24' 09"WEST, parallel to the West right-of-way line of Dowlen
Road, for a distance of 563.10 feet to a 5/8" iron rod set for corner;
THENCE North 880 35' 51" EAST, perpendicular to the West right-of-way line
Dowlen Road, for a distance of 249.00 feet to the POINT OF BEGINNING and

Section 2.
That, in all other respects, the use of the property hereinabove described shall be
subject to all of the applicable regulations contained in Chapter 30 of the Code of
Ordinances of Beaumont, Texas, as amended.
Section 3.
That if any section, subsection, sentence, clause or phrase of this ordinance, or the
application of same to a particular set of persons or circumstances, should for any reason
be held to be invalid, such invalidity shall not affect the remaining portions of this
ordinance, and to such end, the various portions and provisions of this ordinance are
declared to be severable.
Section 4.
That all ordinances or parts of ordinances in conflict herewith are repealed to the
extent of the conflict only.
Section 5.
That any person who violates any provision of this ordinance shall, upon conviction,
be punished, as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.

RECOMMENDATION
The Administration recommends approval of the zone change from GC-MD to RM-H for the
property at 2201 E. Lucas Drive.
BACKGROUND
The applicant, Mr. Harold Garner,wishes to sell his existing home at 2201 E. Lucas Drive and build
a new one. He is negotiating a contract to have the house and garage apartment moved off his
property. The present home was constructed prior to 1981 when the new zoning ordinance
prohibited residences in the commercial zones. The GC-MD is 150' in depth along Lucas but the
applicant's property extends from 212'to 300', more or less, south of Lucas. He owns 1.09 acres and
all but 0.75 acres is already RM-H. There are homes east, west and north of his residence.
BUDGETARY IMPACT
None.
PREVIOUS ACTION
At a joint Public Hearing with City Council held February 19,2001,the Planning Commission voted
6-0 to approve the zone change from GC-MD to RM-H for the property at 2201 E. Lucas Drive.

BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
That Chapter 30 of the Code of Ordinances of Beaumont, Texas, and in particular
the boundaries of the zoning districts, as indicated upon the Zoning Map of the City of
Beaumont, referred to in Section 30-513 thereof, is hereby amended by changing the
zoning of property presently zoned as GC-MD (General Commercial-Multiple Family
Dwelling) District to RM-H (Residential Multiple Family Dwelling-Highest Density) District
for property located at 2201 E. Lucas Drive, being the north 150 feet by 217 feet of Tax
Tracts No. 55 and No. 63, Plat D-18, A. Williams Survey, Ab-385, Beaumont, Jefferson
County, Texas, containing 0.75 acres, more or less, as shown on Exhibit "A" attached
hereto and made a part hereof for all purposes, and the official zoning map of the City of
Beaumont is hereby amended to reflect such changes.

That, in all other respects, the use of the property hereinabove described shall be
subject to all of the applicable regulations contained in Chapter 30 of the Code of
Ordinances of Beaumont, Texas, as amended.
Section 3.
That if any section, subsection, sentence, clause of phrase of this ordinance, or the
application of same to a particular set of persons or circumstances, should for any reason
be held to be invalid, such invalidity shall not affect the remaining portions of this
ordinance, and to such end, the various portions and provisions of this ordinance are
declared to be severable.
Section 4.
That all ordinances or parts of ordinances in conflict herewith are repealed to the
extent of the conflict only.
Section 5.
That any person who violates any provision of this ordinance shall, upon conviction,
be punished, as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.

BACKGROUND
The applicant, Mr. Roger Van Brocklin, owns Eastex Pressure Washers located in Lumberton,
Texas. He has purchased four 25'x 150' lots at 645 Delmar and Fannin in the Sunnyside Addition.
His property lies east of and across the street from the side of Commercial Metals, a large scrap
metal works that faces College. Delmar dead-ends at the edge of the Southern Pacific Railroad yard.
Commercial Metals is zoned HI (Heavy Industrial) and the railroad yard is LI (Light Industrial)
District. The lots abutting Mr. Van Brocklin's 100' x 150' tract are vacant.
The applicant wishes to relocate to Beaumont so that he will be closer to his customers. He sells and
services high pressure washing equipment. Most of his business is servicing the equipment owned
by large industrial establishments and construction equipment leasing companies.
BUDGETARY IMPACT

RECOMMENDATION
The Administration recommends denial of the zone change from RS to NC for the property at 711
W. Lucas Drive. To grant this request would be creating a"spot"zone. All abutting lots are zoned
RS and are occupied as homes.
BACKGROUND
Ms. Darlene W. Howard has converted a house located in the RS District into a clothing alteration
shop at 711 W. Lucas Drive. Her application is in response to a complaint received by Development
Services and a follow-up investigation. The business is in violation of the Zoning Ordinance and the
Development Strategies Plan. The Plan states that stable areas should be protected from blighting
influences such as an incompatible mix of land uses.
BUDGETARY IMPACT
None.
PREVIOUS ACTION
At a joint Public Hearing with City Council held February 19, 2001, the Planning Commission's
motion to approve the zone change from RS to NC for the property at 711 W. Lucas Drive failed
2-3-1 (2 for)-(3 against)-(1 abstention).

NOTE: "The 20% Rule"
Sec. 30-40.D. of the Zoning Ordinance states the following:
Protest: The City Council shall not amend,supplement,change,modify or repeal any
regulation, restriction or boundary or approve a Specific Use Permit where a protest
against such change, signed by the owners of twenty (20) percent or more either of
the area of the lots included in such proposed change or of the lots or land
immediately adjoining the same and extending two hundred (200) feet therefrom,
except by the favorable vote of three-fourths (3/4) of all the members of the City
Council.
This means that in order to approve a zone change or specific use permit when the 20%rule has been
invoked at least six Council members must vote in favor of the Ordinance.
On File 1545-Z, a protest of 44% was received, therefore invoking the Rule on this case.

STREET IN THE CITY OF BEAUMONT, JEFFERSON
COUNTY, TEXAS.
WHEREAS,the City Council for the City of Beaumont desires to issue a specific use
permit to Shannon Denard to allow a church in a LI (Light Industrial) District located at
8370 College Street, being known as Tax Tract 119, Plat SP-7, C. Williams Survey, Ab.
59, Beaumont, Jefferson County, Texas, containing 0.265 acres, more or less, as shown
on Exhibit "A' attached hereto; and,
WHEREAS, the City Council is of the opinion that the issuance of such specific use
permit is in the best interest of the City of Beaumont and its citizens, with a waiver of the
10' wide buffer requirement on the east property line;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
Section 1.
That all conditions necessary for issuance of a specific use permit have been met
and a specific use permit to allow a church in a LI (Light Industrial) District located at 8370
College Street, being known as Tax Tract 119, Plat SP-7, C. Williams Survey, Ab. 59,
Beaumont, Jefferson County, Texas, containing 0.265 acres, more or less, is hereby
granted to Shannon Denard, her legal representatives, successors and assigns for those

purposes. The requirement of a ten (10) foot buffer on the East property line is waived.
Section 2.

and made a part hereof for all purposes.
Section 3.
Notwithstanding the site plan attached hereto, the use of the property hereinabove
described shall be in all other respects subject to all of the applicable regulations
contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended.

REQUESTED ACTION: Council consider a request for a specific use permit to allow a cellular
communications tower in an RS(Residential Single Family Dwelling)District at the northeast corner
of E. Irby and Highland Avenue.
RECOMMENDATION
The Administration recommends denial of the specific use permit request to allow a cellular tower
in an RS (Residential Single Family Dwelling) District at the northeast comer of E. Irby and
Highland Avenue. The Comprehensive Plan designates this area as Conservation and Revitalization
and this is defined as an area where action is needed to prevent or reverse deterioration. N'bile little
residential development has occurred in this area for some years, the proposed placement of the
tower could impede such future development and have a negative effect on existing housing.
BACKGROUND
The application is in compliance with five of the eight conditions necessary for approval according
to staff's understanding of Section 30-26 E. of the Zoning Ordinance. If approved, landscape and
screening regulations of Section 30-31 apply to the north and east property lines.
The applicant for this cell tower is the American Tower Corporation, represented by Mr. Greg
Josefsberg. This is an AT &T fixed wireless service project.
The applicant has proposed two options for siting of the tower on the two lots. The tract measures
150' x 100',but the actual project area for either proposal is enclosed within a 75' x 75' leased area.
The 190' structure is a self-supporting lattice tower with four antennas and a 10' x 12' equipment
shelter.
The site will be unmanned and will be visited once a month for routine maintenance. The site will
comply with all FCC and FAA guidelines and regulations and will be subject to City building codes
and land use regulations. AT&T's project will enable residential and business customers to receive

RECOMMENDATION
The Administration recommends approval of the amendment to Section 30-21.2 (e)(8)a. of the City
of Beaumont Zoning Ordinance.
BACKGROUND
The Zoning Ordinance designates a four(4)year amortization period for nonconforming signs and
parking lots located in a historic district.
Staff inventoried all signs and parking lots in the north side of the Oaks Historic District. At that
time, forty-four(44) signs and three parking lots were found to be out of compliance. All property
owners were notified of their illegality.
Once the number of illegal signs were determined, a number of people began to question whether
the fifteen(15)foot setback was too much. Therefore, a committee consisting of Historic Landmark
Commission members,Old Town Neighborhood Association members and staff considered changes
to the ordinance.
With the ordinance change, twenty-one(21) signs would now be in compliance, two (2)would be
on the right-of-way, three (3) are poles only, one (1) is a monument with no sign, six (6) can be
moved to conform, two (2) could be moved but would need to be shortened and nine (9) should go
to the Zoning Board of Adjustment.
Sec. 30-21.2(e)(8)a
a. Detached Signs. Only one detached sign is permitted on each lot and subject to the
following restrictions:
(I) The structural support of the sign must be located at least fifteen (15) five(5)
feet from any public right-of-way or property line dividing properties of
different ownership. No part of any sign shall overlay any property line. et

(iii) The sign shall not be illuminated; and
(iv) The sign shall not exceed twelve (12) square feet in area.

positions and increasing the Grade I position,this will accurately reflect the current organization of
the Police Department as well as allow the utilization of the police specialist positions.
During the 2000 budget preparation,the Deputy Chief's position was to be rebudgeted as a Grade
I position. As of this time, Chapter 21, Section 21-75 does not reflect this budgeted change.
BUDGETARYIMPACT
The current annual pay for three Grade II Sergeants is$151,020,a Grade IV Captain is$59,004 and
a Deputy Chief is$67,339 making a total of$277,363. The annual pay for four Grade I Patrolmen
is $126,528 which is a positive budget impact of$150,836.

The hotel/motel tax in Beaumont is currently 13%. Of the 13%tax, 7%goes to the State of Texas
and the remaining 6% is received by the City of Beaumont and deposited in the Hotel Occupancy
Tax Fund. The projected revenue in FY 2001 in the Hotel Occupancy Tax Fund is $1,650,000.
If legislation is passed to allow Jefferson County to assess hotel/motel taxes (up to 2%), the
hotel/motel tax in Beaumont would be 15%. The additional 2% would be received by Jefferson
County to promote points of interest in Jefferson County including a proposed visitor's center near
the Southeast Texas Entertainment Complex.

RECOMMENDATION
Administration recommends authorization to purchase one (1) Pierce Lance Custom fire pumper
through the Houston-Galveston Area Council (H-GAC).
BACKGROUND
The requested fire pumper truck is equipped with a six man cab, 750 gallon water tank, a fifty(50)
gallon foam tank and two ladders extending to 24 feet and 14 feet. The truck will also be equipped
with an electronic load management system that automatically shuts down less critical functions such
as the air conditioner,heater,non required emergency lighting, generator and compartment lighting
in case of a power loss.
Martin Apparatus and Equipment of Houston will furnish and warrant the Pierce fire pumper truck.
The truck will be warranted for one(1)year with specific extended warranties provided on the chassis
frame, engine, transmission, water tank and body.
H-GAC is a cooperative purchasing association that provides contracted items to governmental
entities that have been bid in accordance with all State procurement regulations. Fees for the service
range from 1% - 3% of the total purchase.
The total cost of the Pierce Custom Lance Pumper is $335,056 which includes an H-GAC
administrative fee of$4,131.
Purchase of a Fire Pumper

The pumper truck will be assigned to Station No. 2 located at Wilson and Ironton. Engine No. 2,
a 1982 Mack fire pumper,will be placed in reserve status. Maintenance costs for Engine No. 2 have
been in excess of$24,000 during the past twelve(12)months.This vehicle's high maintenance costs
warrant rotating the truck to reserve status. Trucks slated for reserve status are housed at the Fire
Maintenance Shop and are used as a replacement when an active unit is in for repairs. Reserve
Engine No. 6,a 1981 American LaFrance pumper,will be removed from reserve status and disposed
of according to the City's surplus equipment disposal policies.
Delivery of the new pumper truck will be in approximately nine (9) months.

equal to 80% or$981,096 and the City's 20% share $245,275. This grant is in addition to the
annual operating grant the City receives from FTA.
BUDGETARY IMPACT
The budgetary impact information included in the February 6, 2001 agenda item indicated a City
share requirement of$245,275. A budget amendment of$245,000 from the General Fund
unreserved fund balance would provide the necessary funding for the required match.

Section 1.
That Chapter 26, Section 26-23 of the Code of Ordinances of the City of Beaumont
be, and the same is hereby amended to include the following:

RECOMMENDATION
Administration recommends adoption of an ordinance amending the City's General Election
Ordinance to provide for a ballot proposition authorizing the sale of approximately 4.07 acres of
property located at Central Park.
BACKGROUND
The City received written correspondence from representatives of Baptist Hospitals of Southeast
Texas (Baptist)expressing interest in the purchase of a portion of Central Park property, located at
640 Fourth Street. The desired portion is a 200-foot wide strip of land bordering the western
boundary of the park. It is bordered on the north and south ends by Fannin Street and land occupied
by the Texas National Guard,extending approximately 887.03 feet. Total acreage is approximately
4.07.
Baptist intends to use the land for a proposed S53M renovation and addition project to the hospital
campus located adjacent to the park's western boundary. The property is needed for expansion, to
provide a heliport,and additional parking. According to hospital representatives,construction could
begin this summer.
The park currently consists of 13.90 acres of land. Property for the park was acquired by the City
in 1918. Many tenured residents of Beaumont remember with fondness the original 100 plus acre
park. Since its acquisition,many parcels have been sold from the original park site or removed for
other improvements. During 1972, a 32-acre tract was sold to Medical Center Development, Ltd.

for$1,181,393 to construct the Memorial Herman Baptist Hospital campus.
State statutes prohibit the sale of park property by a municipality unless the issue of the sale is
submitted to the qualified voters at an election and is approved by a majority of the votes received.
State statutes also require the property to be conveyed through a competitive bid process. If approval
to convey the property is obtained from the voters, competitive bids will be received from the
general public and the property sold to the highest successful bidder. Baptist has been informed that
the sale is not negotiable, and that a sealed bid process or public auction is required.
The sale of the property was considered by the Parks and Recreation Advisory Committee at their
February 16,2001 meeting. Committee members present voted four(4)votes for and two(2)votes
against recommending that the sale of the park property be placed on the ballot at the next general
election. They also voted to recommend the following: 1)that the City accept no less than$600,000
for the 4-acre tract (an appraisal has been received indicated the value to be $3 per square foot or
$532,000;2)that all proceeds received from the sale be used for park improvements only;and 3)that
a new park is placed within a one mile radius of Central Park,preferably in the area of the Avenues
Neighborhood Association.
BUDGETARY IMPACT
The City received an appraisal of the 4.07 acre tract of park property during the month of February.
The property appraised for$3 per square foot for a total value of$532,000.

SUBSEQUENT ACTION
If approved by the voters, City Council will be required to approve the sale of the property.

Section 1.
THAT Ordinance 01-006 be and the same is hereby amended by amending Section
4 thereof to read as follows:
"Section 4.
Legally qualified voters residing within Wards I, II, 111 and IV in the corporate
limits of the City of Beaumont shall be entitled to a vote at said election for
the respective candidates for each of said Wards and for or against the
proposition for the sale of a portion of Central Park.'
Section 2.
THAT a new Section 15 be and the same is hereby added to Ordinance 01-006 to
amend said ordinance. Said new Section 15 to read as follows:
"Section 15.
That at the election heretofore ordered for the 5th day of May, 2001, there
shall be submitted to the qualified voters of the City the proposition of

Section 3.

ordinance, and to such end the various portions and provisions of this ordinance are
declared to be severable.
Section 4.

Section 5.

RECOMMENDATION
Owner to be issued an order to raze or repair structure within a specified time. Owner must

BACKGROUND .
This structure was inspected and found to be substandard and not meeting City code requirements,
but could be rehabilitated. The structure was presented before City Council on January 16, 2001. At
that time, City Council made the request to review in thirty (30) days because of the possibility of a
new owner acquiring a portion of this building.
BUDGETARY IMPACT
None at this time.
PREVIOUS ACTION
The above structure was issued a notification of being substandard as defined by the City of
Beaumont's Code of Ordinances, Article III, Dangerous Structures, Section 14-50.
SUBSEQUENT ACTION
Staff will enroll owner in a work program and monitor work for allotted time granted by Council.

Section 1.
That the City Council of the City of Beaumont hereby finds and declares the building
located at:
439 Crockett
to be a public nuisance in that said building violates Chapter 14, Section 14-50 of the
Code of Ordinances of the City of Beaumont and is for want of repairs, or by reason of age
or dilapidated condition, likely to cause or promote fires that would endanger persons or
property, and has ordered it to be repaired or demolished.
Section 2.
In accordance with Article XVII, Section 2, of the Charter of the City of Beaumont,
Section 10-2 and 14-52 of the Code of Ordinances of Beaumont,Texas and Section 103.4
of the Standard Building Code, it is hereby ordered that the owner or owners of the
following described building either demolish or repair said structure within
days of the effective date of this ordinance:
439 Crockett
The owner is ordered to enter into a work program concerning the structure
immediately. If the owners fail or refuse to enter into a work program or repair or
demolish the structure within the time limit set herein, the City is authorized to
demolish the structure without further Council action.
Section 3.

Subject: Wading Pools
COMMENTS
In February 2000, City Council was notified that City wading pools were not in conformance with new Texas
Department of Health regulations. New State regulations were adopted to require wading pools to have a
chlorination/filtration system, security fencing and other safety related elements.
City wading pools not in compliance with the State's requirements are located in the following parks: Caldwood,
Chaison,Combest, Cottonwood, Pipkin, Roberts, Rogers, and Sprott. Magnolia and Alice Keith Parks have wading
pools located within their aquatic facilities that conform to the new regulations.
Specifications were developed and bids solicited for the renovation of four(4)pools to meet the State's guidelines. Bids
were received for pool retrofits at Rogers, Roberts and Sprott Parks. Due to its deteriorated condition, demolition and
removal of the entire pool was required at Combest Park. In order to comply with State regulations,the specifications
included a chlorination and filtration system installed in a new equipment building, six-foot iron security fencing,new
concrete decking, the installation of new pool drains and associated piping, and mandatory lifesaving equipment.
Removal of architectural barriers eliminating access to the pools was also planned.
Two bids were received for the pool renovation project. The lowest bid to renovate each pool was$84,000. Removal
and installation of a new pool system at Combest Park was $94,000. At the time bids were received, funds were not
available to be allocated towards completion of the project and the bids were rejected.
During the discussion of the wading pool issue,the Parks and Recreation Advisory Committee recommended that no
new wading pools be constructed within the City. They asserted that water oriented spray devices should be installed
in all new park developments. Their assertions were based primarily on the fact that other cities were closing wading
pools due to high maintenance costs, vandalism, and safety-related liability issues. The city of Dallas closed 42 of its
wading pools in 2000 and Tyler closed all of theirs. Installation of the spray devices seems to be the acceptable norm
for aquatic youth activities at public parks. Spray devices are currently installed at Halbouty,Lefler, Liberia and Pine
Street Parks. Plans for the development of Perlstein Park and the replacement of Carroll Street Park include spray
devices as their aquatic element.

To ensure aquatic activities did not fade from the City's recreational program,the Parks and Recreation Department
offered an expanded swim program during the past summer months. The City contracted with the YMCA and YWCA
to provide swimming lessons and free swimming at Melton YMCA and YWCA pools. Only 35 individuals participated
in the program from June 1S' until mid-July. The program cost the City$2,500.
The Parks and Recreation Department also provided swimming lessons in conjunction with the Red Cross. This
program had more than 350 participants at a total cost of$2,000. And,a.joint swim team effort was offered with the
Police Activity League(PAL)from June 1'until mid-July at no cost to the City. More than 30 participants enjoyed
the program.
Administration is currently working on a financial plan to provide enhanced aquatic elements at two additional
neighborhood parks. Area demographics indicate that Rogers and Sprott Parks are the most favored sites for a
functioning aquatic element. Both locations have wading pools which are no longer operational. Due to Sprott Park's
location within a targeted area, Community Development Block Grant (CDBG) funds could be allocated for
construction of a water-oriented device. Solicitation of corporate support and a contribution from General Fund
reserves would be required to complete the aquatic development at Rogers Park.
A presentation to City Council is planned during the March 20, 2001 work session by the Parks and Recreation
Department. The intent is to provide City Council pertinent information on the use of wading pools and spray devices
as aquatic elements within our park system.

purchasing air, oil and fuel filters at the unit costs stated in the attached staff memorandum with an
estimated total expenditure of$19,144.08. Funds are available for the expenditure in the Fleet
Management Division's operating budget.
C) Authorize the granting of a 40' x 50' Equipment Station Easement to
Southwestern Bell Telephone Company on the City's South End Library
Site
Administration recommends granting an Easement for the Equipment Station. Southwestern Bell
Telephone Company proposes to install equipment in order to improve the capability of offering
high speed data access to its customers in the Sarah Street and Fannett Road areas. The 40' x 50'
easement with a 15' x 20' access easement on the west side will provide the additional space needed
to install the equipment. For granting the easement, Southwestern Bell is offering compensation in
the amount of$5,000. A copy of the staff memorandum is attached for your review.
D) Approve the appointment of David K. Boyer as an Assistant City Attorney
The City Attorney recommends the appointment of David K. Boyer as an Assistant City Attorney

REQUESTED ACTION: Council approval of a resolution authorizing the granting of a 40'
x 50' Equipment Station Easement to Southwestern Bell Telephone
Company on the City's South End Library site.
RECOMMENDATION
Southwestern Bell Telephone Company proposes to install equipment in order to improve the
capability of offering high speed data access to its customers in the Sarah St. and Fannett Rd.
areas. The 40' x 50' easement with a 15' x 20' access easement on the West Side will provide
the additional space needed to install the equipment.
Administration recommends granting an Easement for the Equipment Station.
BACKGROUND
Southwestern Bell Telephone Company is in need of additional space in order to install more
equipment to better serve their customers.
BUDGETARY IMPACT
For granting this easement, Southwestern Bell is offering compensation in the amount of$5,000.

REQUESTED ACTION:
Adopt a resolution approving the appointment of David K Boyer as an Assistant City
Attorney and setting his starting compensation.
RECOMMENDATION:
The City Attorney recommends that the appointment of David K. Boyer as an Assistant City
Attorney for the City of Beaumont be approved at a starting salary of$3192 per month.
BACKGROUND:
Under the Charter, the City Attorney may appoint his assistants with the approval of the
City Council at such compensation as set by the Council. The position vacated byB r a d
Randall has been vacant since November and we have interviewed applicants for the vacant
position. Mr Boyer is very qualified for this position, his resume is attached for your review.
BUDGETARY IMPACT:
The amount necessary to pay the salary and benefits of the position are available in the City
Attorney's budget for fiscal 2001.
