REQUESTED ACTION: Council consider a request to abandon the southwesterly 3' of the 10'

RECOMMENDATION
The administration recommends approval of the request to abandon the southwesterly 3' of the 10'
x 101.24'utility easement lying along the north side of Lot 38,Block 1, Glen Oaks Addition at 4665
Glen Oaks Circle, subject to the property owner entering into a contract with Southwestern Bell
Telephone Company to relocate the existing phone cable and granting a new easement at his
expense. (See Subsequent Action.)
BACKGROUND
The Glen Oaks Subdivision extends to the southeast off Comstock Road in north Beaumont. The
applicant,Mr. Thibodeaux, lives at 6180 Comstock on a 0.64 acre tract. His residential tract abuts
and wraps around the north and west side of the subject Lot 38 which is the last numbered lot in the
subdivision. He plans to build a single family structure on the lot but needs more width for the one-
story house. He is asking for the abandonment of the 10' wide easement. That done, he would
provide the normal 5' wide building setback on the north side of the lot.
A memorandum explaining the request was sent out to interested departments and utility companies.
Southwestern Bell Telephone Company has a cable line in the easement. The engineering division
of the phone company says that the cable can be relocated at the expense of the applicant. Mr.
Thibodeaux owns the land abutting the easement and has verbally agreed to grant a new easement
for the phone company on his residential tract.
BUDGETARY IMPACT
None.
PREVIOUS ACTION
At a Regular Meeting held December 4, 2000, the Planning Commission voted 5-0 to approve the
request to abandon the 10' x 101.24' utility easement situated along the northerly side of Lot 38,
Block 1, Glen Oaks Addition at 4665 Glen Oaks Circle, subject to the property owner entering into
a contract with Southwestern Bell Telephone Company to relocate the existing phone cable and
granting a new easement at his expense.
SUBSEQUENT ACTION
Mr. Thibodeaux has met with Mr. Wayne E. Thomas who is in the Engineering Design Division of
Southwestern Bell Telephone Company. The phone cable lies underground in the center of the north
seven(T) feet of the ten(10')wide utility easement. Mr. Thomas explained to Mr. Thibodeaux and
also to Murray Duren of the Planning Division staff that the phone company could maintain the
cable line if seven (T) feet of the easement remains. Mr. Thibodeaux stated that he would be
satisfied to have only the remaining southeasterly three (3') feet x 101.24 feet of the ten (10') foot
wide utility easement abandoned. Therefore, no relocation of the phone company cable is required.

LOT 38, BLOCK 1, GLEN OAKS ADDITION AT 4665 GLEN
OAKS CIRCLE IN THE CITY OF BEAUMONT, JEFFERSON
COUNTY, TEXAS; PROVIDING FOR THE RELOCATION
OF THE EXISTING PHONE CABLE AND
GRANTING A NEW EASEMENT.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
THAT the southwesterly 3'of the 10'x 101.24'utility easement situated along the northerly
side of Lot 38, Block 1, Glen Oaks Addition at 4665 Glen Oaks Circle, in the City of
Beaumont, Jefferson County, Texas, being the southeasterly three (3') foot of a ten foot
(10')wide dedicated utility easement lying along the northwesterly side of Lot 38, Block 1,
Glen Oaks Addition to the City of Beaumont, Jefferson County, Texas, as shown on said
subdivision plat filed for record in the Map Records of Jefferson County on August 9, 1978
in Volume 12, Page 90, said portion of the utility easement to be abandoned being more
particularly described as follows:
For a locative point start in the most northwesterly corner of Lot 38, Block 1, Glen
Oaks Addition, same being in the southwest right-of-way line of Glen Oaks Circle,
a 50'wide public street right-of-way;Thence southeast along the southwest right-of-
way line of Glen Oaks Circle a distance of seven(7')feet to the Place of Beginning;

Thence S. 50° 27' W. along a line which is 7 ft. southeast of and parallel to the
northwest line of Lot 38, Block 1, Glen Oaks Addition, a distance of 101.24 feet to
a point for corner;

distance of 3 feet to the Place of Beginning, containing 0.0069 acres, more or less,
shown on Exhibit "A" attached hereto, be and the same is hereby vacated and
abandoned.
Abandonment is conditional upon the property owner entering into a contract with
Southwestern Bell telephone Company to relocate the existing phone cable and granting
a new easement at owner's expense.

ordering their repair or removal by the owners and authorizing the removal of certain other

RECOMMENDATION
Administration recommends a raze order because owners failed to comply with previous orders
to correct code violations or demolish the structure.
BACKGROUND
Each of these structures have appeared before City Council in the past and a raze or repair order
was issued. The owners failed to comply with correcting code violations or demolishing the
structures.
BUDGETARYIMPACT
City may incur the cost of demolition.
PREVIOUS ACTION
Previous orders by City Council to raze or repair were not complied with.
SUBSEQUENT ACTION
Clean Community Department will demolish or cause to be demolished, said structures.
RECOMMENDED BY
City Manager and Clean Community Department Director.

Approve/Deny the authorization to demolish the above listed structures in non-compliance with City
codes.

BACKGROUND
It has been determined that these structures meet the definition of a dangerous structure because they
have deteriorated such that they are no longer considered suitable for repair.
BUDGETARY IMPACT
City may incur the cost of demolition.
PREVIOUS ACTION
These structures have been inspected by the Clean Community Department and found to be
dangerous structures as defined by the City of Beaumont's Code of Ordinances, Article III,
Dangerous Structures, Section 14-50.

BACKGROUND
These structures were inspected and found to be substandard and not meeting City code
requirements, but could be rehabilitated.
BUDGETARY IMPACT
None at this time.
PREVIOUS ACTION
The above structures were issued notification of being substandard as defined by the City of
Beaumont's Code of Ordinances, Article III, Dangerous Structures, Section 14-50.
SUBSEQUENT ACTION
Staff will enroll owner in a work program and monitor work for allotted time granted by Council.

application of same to a particular set of persons or circumstances should for any reason

ordinance and, to such end, the various portions and provisions of this ordinance are
declared to be severable.

A) Approve the purchase of 340 feet of fiberglass pipe and one manhole assembly
for use by the Water Utilities Division
Administration recommends approval of the purchase from Industrial Utility Sales Co., Inc. of
Houston in the amount of$75,400. The pipe is to be used to replace a portion of the sanitary
sewer interceptor on 11th Street at Washington Boulevard. The existing concrete line is more
than 40 years old and badly deteriorated,resulting in frequent service interruptions in the area.
Funds are available for this expenditure in the Water Utilities Fund. A copy of the staff
memorandum is attached for your review.
B) Approve the purchase of one diesel powered winch for use by the Water Utilities
Division
Administration recommends approval of the purchase from TT Technologies, Inc. of Aurora,
Illinois in the amount of$74,500. The winch is being added to the City fleet to work in
conjunction with new pipe-bursting equipment. This unit will aid in the alignment of the
bursting equipment,minimizing wear, and will be used in slipline replacement of existing water
and sewer lines. A copy of the staff memorandum is attached for your review.
C) Approve a three-year contract for grounds maintenance of Tyrrell Park
Administration recommends approval of a three-year contract with Alamo Lawn Service of
Beaumont. Areas to be maintained include the right-of-way on Tyrrell Park Road, the lawn area
in the Tyrrell Park Garden Center,the area enclosed by Babe Zaharias Drive, and the area
surrounding the Tyrrell Park stables. Alamo submitted a bid in the amount of$6,400 per month
during the growing season and $2,500 during the non-growing season or$65,100 per year. A
copy of the staff memorandum is attached for your review.
D) Approve an annual contract for medical laboratory services
Administration recommends approval of an annual contract to Christus St. Elizabeth Hospital
Lab for medical laboratory services at the unit costs stated in the attached staff memorandum
with an estimated annual expenditure of$31,370. Medical laboratory services are required for
the analysis of employee drug and alcohol tests, for testing and management of air and blood
borne exposures to public safety employees, and for the testing of patients seen in the Health
Clinic.
E) Accept maintenance of the street, storm sewer,water and sanitary sewer
improvements in Ashton, Phase I and Ashton, Phase 2, Block 3
Administration recommends approval of accepting the improvements which passed final
inspection from all entities involved on January 11, 2001. Copies of the staff memorandums are
attached for your review.
F) Approve a resolution urging the U.S. Environmental Protection Agency to
finalize approval of the clean air plan submitted in 1999 by the Texas Natural
Resource Conservation Commission (TNRCC)
Administration recommends approval of the resolution. The Southeast Texas region of Hardin,
Jefferson and Orange counties does not meet the National Ambient Air Quality Standard for
ozone and is currently classified as a moderate nonattainment area for ozone by the EPA. The
proposed plan maintains the moderate ozone nonattainment status for the three counties and
provides an attainment date of 2007 to coincide with the Houston/Galveston area's attainment

RECOMMENDATION
Administration recommends award of a bid for the purchase of 340 feet of 60-inch diameter
fiberglass pipe and one(1)manhole assembly in the amount of$75,400 to Industrial Utility Sales
Co., Inc. of Houston, Texas.
BACKGROUND
The pipe is to be used to replace a portion of the sanitary sewer interceptor on 11`h Street at
Washington Boulevard in central Beaumont. The existing concrete line is more than 40 years old
and badly deteriorated, resulting in frequent service interruptions in the area. The fiberglass pipe
will be more resistant to degradation.
Bid notices were provided to 11 vendors, with one (1) responding with a bid. The bid received
was from Industrial Utility Sales Co., Inc. at the unit cost of $195 per foot for the pipe, and
$9,100 for the manhole assembly, for a total bid of$75,400.
Delivery time for the pipe and manhole assembly is approximately 30 days from the date of order.
Installation will be performed by Water Utilities personnel upon receipt of the material.
BUDGETARY IMPACT
Funds are available for this expenditure in the Water Utilities Fund.

Administration recommends award of a bid for the purchase of one (1) diesel powered winch in
the amount of$74,500 to TT Technologies, Inc. of Aurora, Illinois.
BACKGROUND
The winch is being added to the City fleet to work in conjunction with new pipe-bursting
equipment. This unit will aid in the alignment of the bursting equipment, minimizing wear, and
will be used in slipline replacement of existing water and sewer lines. The unit will also be used
in general pipe handling on jobsites. The winch is mounted on a self-contained trailer for
transport.
Bid notices were provided to five (5) vendors, with one (1) responding with a bid. The bid
received was from TT Technologies, Inc. in the amount of$74,500.
The winch carries a one (1) year, or 1,200 hour, full parts and labor warranty, with a delivery
time of 30 days.

Funds are available for this expenditure in the Water Utilities Fund.

RECOMMENDATION
Administration recommends that the award of a three year contract for grounds maintenance of
Tyrrell Park to Alamo Lawn Service, located in Beaumont, Texas.
BACKGROUND
Seven(7)bids were received for a three(3)year contract for grounds maintenance at Tyrrell Park.
Areas to be maintained include the right-of-way on Tyrrell Park Road,the lawn area in the Tyrrell
Park Garden Center,the area enclosed by Babe Zaharias Drive,and the area surrounding the Tyrrell
Park stables. This contract does not include the Henry Homberg Golf Course or horticulture
maintenance at the Tyrrell Park Garden Club.
Grounds maintenance of the 125 acre park includes weekly mowing, sweeping, and edging during
the growing season(March 1 through November 30). The non-growing season(December I through
February 28) requires bi-monthly mowing, edging, and sweeping of the grounds. Daily litter
removal is required everyday throughout the year.
Alamo Lawn Service submitted a bid in the amount of$6,400 per month during the growing season
and $2,500 during the non-growing season. Bids ranged from$65,100 to $118,500 annually.
This contract shall be in effect for a period of three(3)years beginning within thirty(30)days after
the date of award by City Council. On the annual anniversary dates of this agreement,the City will
increase the monthly payments by an amount not to exceed the percentage increase in the Consumer
Price Index(CPI).
Last year,contract pricing was$7,000 per month during the growing season and$2,700 per month

past two (2)years.

RECOMMENDATION
Administration recommends the award of an annual contract to Christus St. Elizabeth Hospital
Lab for medical laboratory services at the unit costs stated on the attached tabulation with an
estimated annual expenditure of$31,370.
BACKGROUND
Medical laboratory services are required for the analysis of employee drug and alcohol tests, for
testing and management of air and blood borne exposures to public safety employees, and for the
testing of patients seen in the Health Clinic.
Invitations to bid were sent to thirteen (13) medical laboratory service companies with one
responding. Specifications required the testing laboratory to be directed by a board-certified
pathologist and a clinical scientist to provide support in medical and technical areas.
Specifications also required the testing laboratory to be certified by the Clinical Laboratory
Improvement Amendments of 1988 and the National Institute on Drug Abuse for the performance
of urine drug analysis. The responding vendor met these specifications.
Testing supplies will be provided by the laboratory at no cost to the City. Specimens will be
collected from the Health Department twice daily. STAT specimens will be picked up as needed
by Christus St. Elizabeth Hospital Lab. In addition, written test results will be supplied to the
Beaumont Public Health Department. Repeat testing will be performed without charge when
requested by the department's physician.

WHEREAS,the Southeast Texas region of Hardin,Jefferson and Orange counties

WHEREAS,the South East Regional Planning Commission Air Quality Advisory
Committee(SETRPC AQAC)in conjunction with local,state and federal elected officials and
area plant managers,have worked diligently to demonstrate to the EPA that ozone causing
pollutants are transported into Southeast Texas from a significant upwind source,the
Houston/Galveston(HGA)area,and;
WHEREAS,the Southeast Texas region cannot be held accountable for pollutants
transported from other areas which cannot be locally controlled,and;
WHEREAS,pollutants transported into Southeast Texas from HGA prohibit the
Hardin,Jefferson and Orange county region from reaching attainment until the HGA area
does so,and;
WHEREAS,the TNRCC has provided agency staff and resources to prepare the air
dispersion modeling and other technical data needed to complete the proposed dean air
plan and submitted it to the EPA for their consideration in accordance with all EPA's
applicable guidelines and criteria,and;
WHEREAS,local,state and federal elected officials and area plant managers have
worked diligently to facilitate the review and timely approval of the proposed State
Implementation Plan(SIP)by the EPA,and;
WHEREAS,the EPA announced on December 19,2000,a proposal to approve a
dean air plan for the Beaumont/Port Arthur(BPA)area. The plan,formally known as the
ozone attainment demonstration SIP,details how the BPA area will ensure it meets the
national health-based air quality standard for ozone by 2007,and;
WHEREAS,the BPA dean air plan is the first in Texas where EPA recognized the
impact of ozone traveling from the HGA area to other areas in the state. As a result of the
impact of ozone from Houston,the EPA has given the BPA area the same dean air
attainment date as the HGA area,2007.
NOW,THEREFORE,BE IT HEREBY RESOLVED:
The South East Texas Regional Planning Commission and the(governmental entity)
